Starbucks Coffee Bag Purchasers File Class Action Lawsuit Against Starbucks Over Alleged Undisclosed Service Fee.
A class action lawsuit has been filed against Starbucks Corporation (“Starbucks” or “Defendant”) in the U.S. District Court for the Western District of Washington (styled Bonnie Kurnick v. Starbucks Corporation, Class Action Case No. 2:11-cv-01985-MJP), alleging, among other things, that Starbucks was charging a $1.50 service fee to customers who purchased less than a full pound of coffee and allegedly were not given notice of such fee prior to purchasing such bags of coffee, nor given notice after their purchase on their receipt, according to the Starbucks Coffee $1.50 Service Fee class action lawsuit complaint.
The Starbucks Coffee $1.50 Service Fee class action lawsuit complaint is reportedly brought on behalf of a putative class consisting of the following persons, unless otherwise excluded:
(1) California Class: The class that Plaintiff seeks to represent (“the California Class”) consists of all persons who are citizens or residents of California who purchased Starbucks coffee weighing less than one pound, within the four years prior to the filing of the initial complaint. Excluded from the class are Defendant, any parent, subsidiary, affiliate, or controlled person of Defendant, as well as the officers and directors of Defendant, and the immediate family member of any such person. Also excluded is any judge who may preside over this case, and such judge’s immediate family and courtroom staff.
(2) Nationwide Class: The class that Plaintiff seeks to represent (“the Nationwide Class”) is defined to include all persons in the United States who purchased who purchased Starbucks coffee weighing less than one pound, within the four years prior to the filing of the initial complaint. Excluded from the class are Defendant, any parent, subsidiary, affiliate, or controlled person of Defendant, as well as the officers and directors of Defendant, and the immediate family member of any such person. Also excluded is any judge who may preside over this case, and such judge’s immediate family and courtroom staff.
