Sears Roebuck Technician Files Class Action Lawsuit Complaint Against Sears Roebuck Over Alleged Failure to Pay Minimum Wages, Overtime Pay, & Premium Wages.

A class action lawsuit has been filed against Sears Roebuck & Co. (“Sears Roebuck” or “Sears” or “Defendant”) in the Superior Court of the State of California for the County of Riverside (styled Nikola Lovig v. Sears Roebuck & Co.), alleging among other things that Sears Roebuck failed to pay certain hourly and non-exempt employees (including certain Sears Roebuck technicians) minimum wages, overtime pay, and premium wages, purportedly in violation of California law, according to the Sears Roebuck overtime pay and wage and hour class action lawsuit complaint.

The Sears Roebuck overtime pay and wage and hour class action lawsuit is reportedly brought on behalf of the following putative classes of persons:

Technician Class: All persons employed by Defendants in California who, during the time period from four years before the filing of the action to the date that final judgment is entered, have held the position of “Technician” and/or other hourly or non-exempt positions with similar job descriptions and/or duties.

Premium Wage Rate Class: All persons employed by Defendants in California in hourly or non-exempt positions who, during the time period from four years before the filing of the action to the date that final judgment is entered, received both (a) premium wages in lieu of meal and/or rest periods; and (b) commissions and/or bonuses.

Personal Days Class: All persons employed by Defendants in California during the time period from four years before the filing of the action to the date that final judgment is entered in who: (a) forefeited one or more personal days; and/or (b) were eligible for personal days when they voluntarily or involuntarily seperated from Defendants’ employment.

Waiting Time Penalties Class: All persons who voluntarily or involuntarily seperated from Defendants’ employment during the time period from three years before the filing of the action to the date that final judgment is entered who are members of the Technician Class, Premium Wage Rate Class, and/or Personal Days Class.

Waiting Statement Penalties Class: All persons employed by Defendants during the time period from one year before the filing of the action to the date that final judgment is entered who are members of the Technician Class, Premium Wage Rate Class, and/or Personal Days Class.

    whom do i contact obout my check i have not recived from the class action suite received letter that check was to be made for $1000.00 had not followed up spoke with others who have received payment txs ralph

    Same here I was in eemployee new of the law suites I left sears in 2010 after 20 plus years. So I don’t know if my new place are address I moved from Colorado to Washington please let me know we’re are how to git my payment from the law suite
