OpenFeint Mobile Application Users File Class Action Lawsuit Complaint Against Openfeint and Gree International Over Alleged Privacy Violations.
A class action lawsuit has been filed against mobile social gaming network Openfeint, Inc. (“Openfeint”) and Gree International, Inc. (“Gree International”) (collectively “Defendants”) in the United States District Court for the Northern District of California (styled Matthew Hines, Jennifer Aquirre, Alexander Hernandez v. Openfeint, Inc. and Gree International, Inc., Class Action Case No. 11-CV-3084) alleging, among other things, that Openfeint and Gree International individually and in concert with third parties gained unauthorized access to, and unauthorized use of, putative class members’ mobile devices used for communication over a cellular network which include internet and multimedia capabilities in order to access, collect, monitor and remotely store, allegedly without consent, their mobile device’s Unique Device Identifiers (“UDIDs”), Personally Identifiable Information, OpenFeint user account, GPS “Fine” coordinates (latitude and longetude) and Facebook and Twitter profiles, allegedly linking aggregated data with their UDIDs for financial gain, according to the Openfeint & Gree International privacy class action lawsuit complaint.
The Openfeint & Gree International privacy class action lawsuit complaint is reportedly brought on behalf of the following putative class of persons, unless otherwise excluded:
All persons residing in the United States that downloaded and enabled a mobile application affiliated with OpenFeint, from February 17, 2009 to the date of the filing of the complaint (“U.S. Resident Class”); and
All persons after the date of the filing of the complaint, residing in the United States that downloaded and enabled a mobile application affiliated with OpenFeint after the date of the filing of the complaint (“Injuntive Class”).
The Openfeint & Gree International privacy class action lawsuit complaint reportedly asserts alleged violations of the Computer Fraud and Abuse Act (18 U.S.C 1030), Electronic Communications Privacy Act (18 U.S.C. 2510), California’s Computer Crime Law (Penal Code 502), California’s Invasion of Privacy Act (Penal Code 630), Consumer Legal Remedies Act (CLRA), Unfair Competition law, breach of contract, breach of implied covenant of good faith and fair dealing, conversion, negligence and trespass to personal property and chattels.
