Nordstrom Wage & Hour Class Action Lawsuit Complaint Filed By Nordstrom Commissioned Salespersons Over Stocking Time

Nordstrom Commissioned Sales Employee Files Wage & Hour Class Action Lawsuit Complaint Against Nordstrom In California Over Alleged Failure to Provide Minimum Wages & Pay For Stocking Time or Stocking Duties.

A class action lawsuit has been filed against Nordstrom, Inc. (“Nordstrom” or “Defendant”) in the Superior Court for the State of California for the County of San Diego (styled Gino Maraventano v. Nordstrom, Inc., Civil Action Case No. 37-2010-00060965-CU-OE-NC) alleging, among other things, that Nordtrom failed to pay commissioned salespersons state mandated minimum wage for all hours worked, failed to pay wages in a timely manner upon resignation or termination and failed to properly record hours worked and rates of pay, purportedly in violation of state labor laws, according to the Nordstrom wage & hour class action lawsuit complaint.

The Nordstrom wage & hour class action lawsuit complaint reportedly alleges, among other things, that Nordstom employees were not paid for hours spent on “stocking time” or “stocking duties” (i.e., time spent off the sales floor and performed prior to the store opening, during certain shifts and/or after a sales shift) unless the Nordstrom commissioned sales employees met their minimum commission draw.

The Nordstrom minimum wage class action lawsuit complaint is reportedly brought on behalf of a putative class consisting of the following, unless otherwise excluded:

All current and former employees that worked for Defendant as commissioned salespeople or in a substantially similiar position under a different title, within the state of California, who were not paid the state mandated minimum wage for all hours worked within the four-year period prior to the filing of the complaint through the final disposition of the action.

    What’s interesting about wage and hour lawsuits in department stores is whether or not retail salespersons that are paid on a commissioned basis can be charged back for commissions earned as a result of a customer returning merchandise.

    My friend was hired by Nordstrom to work holiday. In the group meeting at the origianl hire he and several others were under the assumption they would get min wages the total hours worked per day. After the first pay check my friend questioned not being paid for the 8 hr day + commission and was explained in such a convoluted manner that he would have had to have an attorney there to explain to him what they meant. Also, he was required to bring stock to be shipped to the shipping dept., handle transferring goods from their stores to other stores, fold clothes to be put back on shelves in the stockroom (for the pacesetters) and had to clean areas, fold clothes, straighten shelves during his shift….All this meant that he could not be on the floor selling. After the store was closed he was required to stay anywhere from 1 to 2 hours to fix things in the stock room., restock items in the dept and “straighten up”….He was not paid for that time either. There was no team work and many times fellow workers would literally steal
    a commission by taking a customer he had been working with to the register to ring up the goods and if he said anything he was called to
    the office

    Everything mentioned in the charges regarding unpaid stock time is all true, been working for them for over 10 years and that is exactly what they do, NOT pay you for stock time.

    Nordstrom will tell you the hourly vs commission switch automatically happens and to not worry. During the last year working at Nordstrom employees were required to stay until 11:30 pm many times but didn’t get paid for it. We are reviewed on our sales per hour but they lie on time keeping which decreases the rate. The management staff are 19 yrs old to mid 20’s (majority) and have no respect for ethics. They show favoritism regularly and if you say something then they write you up for inappropriate things. They gossip with the employees they supervise and place Nordstrom in a very vulnerable situation. If your over 40 well they are so worried due to a trend of the employee 40 and over being fired.

      This happens at the Nordstrom I work at but if I dare discuss this with the higher level of management my employment will be ended unfavorably. I use to believe Nordstrom was a true family business!! Well I found out it isn’t at all a caring company. They now hire the girls under 26 do the insurance coverage isn’t needed. Now that Obama changed insurance coverage under family insurance until 26 Nordstrom is able to save millions at least. They are targeting the 40 and up employee due to high risk medical and dental expensive needs. It’s so disappointing to know how Nordstrom fooled the customer via the 40 and up employee being fooled, Business world actually believes in one of the top 100 companies to work for and many more. The morale at Nordstrom is now very low and customers see through it all. Especially now when they go to Nordstrom and no longer see the sales associates that aren’t a bit more mature then the 20ish kids working there now.

      Perfect example of a good company going downhill you burn one too many employees – then you have no way of fixing the bad reputation without cleaning the upper management team including the store managers!!!! I’ve seen 3 great store managers either leave or be transferred to a new store. How sad!!!! Nordstrom places inexperienced managers as store managers and destroy all the good work downhill. It’ll come out but it takes as couple years to see the damage and believe me – lots of damage.
