Owners and/or Lessees of Ford, Lincoln and Mercury vehicles equipped with a MyFord Touch, MyLincoln Touch & MyMercury Touch system file a class action lawsuit complaint against Ford.
Ford Motor Company (“Ford” or “Defendant”) has reportedly been named as a defendant in a class action lawsuit in the United States District Court for the Central District of California (styled The Center For Defensive Driving v. Ford Motor Company, Case No. CV 13-5068) alleging, among other things, that the MyFord Touch, MyLincoln Touch & MyMercury Touch system installed on certain Ford, Lincoln and Mercury vehicles often fails to perform as advertised, according to the MyFord Touch, MyLincoln Touch & MyMercury Touch class action lawsuit complaint.
The proposed MyFord Touch, MyLincoln Touch & MyMercury Touch class action lawsuit is reportedly brought on behalf of the following nationwide putative class members:
All persons or entities in the United States who are current or former owners and/or lessees of a Class Vehicle (i.e., Ford, Lincoln and Mercury vehicles equipped with a MyFord Touch, MyLincoln Touch or MyMercury Touch system).
In addition the Ford class action complaint is reportedly brought on behalf of a putative California class consisting of those persons and entities who purchased or leased a class vehicle in the State of California.
The MyFord Touch, MyLincoln Touch & MyMercury Touch class action lawsuit complaint reportedly asserts legal claims for alleged violations of the Magnuson-Moss Warranty Act, breach of express warranty, breach of implied warranty of fitness for a particular purpose, breach of implied warranty of merchantibility, violation of California unfair competition law, and violation of California’s consumer legal remedies act.
The plaintiff and the putative class in the MyFord Touch class action law suit reportedly seek, among other things, actual damages, punitive damages, pre and post judgment interest, attorneys fees and costs of suit and injunctive relief requiring a recall or free replacement program.
