A class action lawsuit has been filed against Mercedes-Benz USA, LLC (“Mercedes-Benz” or “Defendant”) in the United States District Court for the District of New Jersey (styled Greg Suddreth and Paul Dunton v. Mercedes-Benz USA, LLC) alleging, among other things, that Mercedes-Benz M272 engines are equipped with defective gears in their balance shafts and Mercedes-Benz M273 engines are equipped with defective idle gears which wear out prematurely, excessively and without warning, purportedly causing the vehicles to malfunction, the check engine light to illuminate and the vehicle to misfire and/or stop driving, according to the Mercedes Benz M272 and M273 balance shaft gear and idle gear class action lawsuit complaint.
The Mercedes Benz M272 and M273 balance shaft gear and idle gear class action lawsuit complaint is reportedly brought on behalf of a putative class of all owners and lessees within the United States of Mercedes vehicles equipped with M272 engines (bearing serial numbers up to 2729..30 468993) or M273 engines (bearing serial numbers up to 2739..30 088611), unless otherwise excluded. The Mercedes Benz class action lawsuit also is reportedly brought on behalf of Illinois and Massachusetts subclasses.

I am on the west coast of newfoundland about 900 kms from the dealer. Well over a month now I have been trying to get an answer from MB . Had to take to St.Johns 900kms one way to have it checked on their star tester 1200 and 1208 codes the same as generic P0016 and P0017. Even though the light was on when they sold it they wanted all my invoices for work done, especially oil type. Now all that is done will have to wait to hear if they will pick up the tab. Will let you know as soon as I know.

I have the same problem in New York, I have still been driving the car, seems to run ok still…but was diagnosed with a faulty “balance shaft” i would love to join the lawsuite !
I have a 2005 350 slk, just diagnosed with the engine balance shaft problem, $5628.00 just for the labor !! Can I get in on this suit ?
My 2006 c230 @ 97,000 miles just got diagnosed with exactly the SAME problem! Balance shaft. MB in NJ says the job is $7,550 BUT MB will absorb 50%… Still a lot of money for something that is their problem! ALSO.. Both door handles broke off! Another faulty item in this model. I would like to know the status of this class action suit against MB and of course would like to join it! Any assistance would be greatly appreciated! Thanks!

I own a 2006 mercedes R350 and the check engine light is on. I took it to a dealer who casually said it is the balance shaft gear and they want $5,000-6,000 to repair it. I then took it to an independent servicer who stated that it is either the balance shaft gear or the car needs a software update. I will have the software updated and see if that gets rid of the light. I suspect that it will not, but it will give mercedes an excuse to charge me for software that should be made publicly available to all owners of their product.
Have you had the software update and if so did it work , did the light go out and stay out ? My dealer wanted all the service records sent to them which I did and they will sent them to head office for a decision as to if they will help with the price tag. Am waiting a reply from them. Stopped driving the thing afraid of loosing the engine.

We bought a 2006 R350 in april 2010 from the dealer in Springfield IL. This car has been in the shop at least 2 time a month so far. The repairs range from replacing both front drive axles, a front drive grease boot, to having loose screws on one of the front brakes and currently they just replace an alternator. All of which has been cover by warranty. My question how long does the lemon law last? and is this law only for new cars? what can I do?
I have a 2006 R350 with the cam gear problem. This is my first and last Mercedes I will ever buy. If there is a litigation that I can be a part of or help to please contact me. This is the worst vehicle I have ever owned. I bought it for safety and dependability. Not what I have gotten. Check engine lights and messages of tail light problems never ending. I can’t afford a $6,000 repair right now, nor should I have to. Never have I had a need for a huge engine repair in any other vehicle under 100,000 miles.

No one can afford $6000 for a repair on a vehicle that is supposed to last forever, right? Have you filed a complaint with the NHTSA? You should! The more complaints filed there, the more likely this part will be recalled. Also, if you are on Facebook, there is a group there for this problem where we converse about the problem. First, go to the NHTSA and file a complaint for engine/engine cooling:engine. In the comments, state this is a balance shaft issue. Good luck!

I also own a 2006 MB R-350. Purchased in June 2010 with 62000 miles. In April 2011 (mileage at 69000) after having complete checkout of the vehicle before our vacation, the CEL comes on. Service dept says a loose gas cap. NOT. Drive over 1500 miles back to Chicago area with the CEL on. After bringing into dealer, the balance shaft gear was the codes the computer gave. They wanted $5000 for the repairs. Now I am trying to deal with MB USA to get some assitance. None offered yet. Keep me in the loop if you have any resolution.

I have the same problem 2006 r350 4matic….if your car starts shifing threw gears funny and the check engine light comes on trust me trade it in asap befor you have to pay 5-6000 in repairs..please trust me you dont want to be in the situation i was put into..balance shaft we need to get this to bea recall..these cars are way to pricey to have any issues mercedes are suppose to be bullet proof..ever since 2002 up benz is goin downhill.

We are fighting about the same issue now with Mercedes about the gear shifter getting stuck. After reading this blog we believe they tried to fix the problem without us knowing when we brought the vehicle in so we wouldn’t join this complaill of a sudden the problem went away during an inspection. The lite was on at 90000 kms .How much before that I am trying to find out . I got the thing with 93000kms on it I now have 10200 kms on it. The question I would like to ask is , do anyone know of one with this unfixed problem having 150000kms on it and still driving it.

Yeah Dave, MY wife has a 2006 ML350 with 150,000+ mi, however , I haven’t seen anything on the web that suggests her vehicle could be included in the class action suit. She’s still driving it, and the light has been on for a while. I have a 2006 c350, haven’t had any major problems. I don’t know why her car isn’t on this list like mine, since it is the same engine. We own a 2007 c280 with approximately 50,000 miles. It has been at the Mercedes dealership twice within a year for shifting type problems but has not stored any codes in the computer so the service department can not fix the problem. They have been very courteous and are still in the process of diagnosing the problem for proper repairs. I would like some information as what are the symptoms of the shifter problems.
March 2010 my engine light went on, it was one of the worst days of my life, $5,300.00 for a Balance Shaft. They said they had to take the entire engine out of my Mercedes C230 that only had 74,000 miles on it.
The service manager John and his boss said that this is very rare to have happened but I went straight to the internet and found out differently.
Now, the work that Laguna Niguel Mercedes-Benz Dealership did, 8 months later and only 4200 miles since that repair, I need a new intake manifold and #2 exhaust Valve that is not seating. Another $2825.18 to fix this now!
The Dealership said they never toughed any of those things while working on the engine however the invoice they gave me says differently!
Add me to the Class Action Law Suit…please!!!

Unbelievable! ML 350 (not included in the Illinois and other class action lawsuits) balance shaft inoperable. Cost to repair $5,553 at the Riverside Walter’s Mercedes-Benze Dealership with vehicle registering less than 90,000 miles. Also, 1500 miles later I need a new intale manifold, a $1500 cost. It seems that MB’s 2006 or later models (all) have been substandardly manufactured/produced. Did I mention, earlier I repaired the “body valve” at a cost of roughly over $1800. Look at the cost over a period of a litttle over wo years and less than 90,000 miles. Yes, I did contact MB. Next move complaint (working on correspondence) to NHTSA. Add me to the the Class Action Law Suit, please!!!!
William, my wife and I just left Walters MB 30 minutes ago , $1800.00 for cruise control system and other electrical nonsense on her 2006 ML350. Prior to leaving they were kind enough to tell us that the ( check engine light ) will remain on because we need to get the balance shaft repaired ( $5000.00). I had no idea there was such a problem with these things until I started researching it a few minutes ago. I have the 2006 c350 160,000mi, haven’t had any problems with it yet, but its included on other class actions. Ml350 should also be on the list since it is the same engine as mine. Any response from NHTSA yet ?
My 2005 was just diagnosed with both the engine balance shaft, and the transmission valve body moduel, I am in Wisconsin and I do not have 7500.00 for repairs………I have 92,000 miles on it.
I have also just recently experienced trouble with my wife’s ’06 R350 with only 37,000 miles! On the first occasion that the CEL appeared we called the dealer and they indicated that it was probably just the gas cap. We tightened the cap and the light went off–easy fix? Weeks went by and the light returned at wich point we brought it to the dealer for service. We were then told that it was due to an issue with the exhaust manifolds which in turn damaged selonoids costing $285. plus labor. I informed the dealer that we had an extended warranty but do not believe that they wanted to do the leg work! I picked up the vehicle and brought it to my independent mechanic who looked at it and diagnosed it as the balance shaft and informed me that there was a Service Bullitin out on this issue from Mercedes for well over two years! He suggested that I take it back to the dealer to see what can be done. I also have a repair bill in the amount of $4500 less a “Good will” credit of $1,000. which I told them is unacceptable. I had to take a personal day from work today to deal with this. I will keep you posted on my progress.

Sorry to hear your story. You’d think if a vehicle is still under warranty that there would be now problem getting fixed. I was thinking that we weren’t hearing about the problem as frequently as it is happening because MB is fixing it under the warranty and therefore not showing up as problem. We really need to get this problem out in the public eye and get this part recalled. Then they will have no choice but to fix it. Did you see Richard Reed’s post below? Have you filed a complaint with NHTSA? I filed last week and got an email yesterday that stated it was a “notification of escalation” I don’t know what that means, but hope it means they are getting more complaints about the same problem. The same story with my 06 CLK350 convertible. On my way to work the CEL came on and I had the car towed to the dealership on Monday 11/22/10 and I was told that it was the balance shaft and quoted a repair bill of $5,300 with labor being $4,200. They explained that the engine must come out and taken apart and that is why the labor cost is so “outrageous”, I was informed that it would take 30 hours of labor. I am now trying to find an independent mechanic to fix the issue. No extended warranty and just purchased the car six months ago. Purchased the car with 76,000 miles, the current mileage is 85,000.
Same issue. Light came on for Low Coolant Fluid, noticied an oil leak in the garage, smelled burning oil, drove it for an extra day since and took it to an independent mechanic for my Service B checkup (needed within the next 1,400 miles). Currently at 49,850, the mechanic told me to take it to the dealer asap, as he thought the warranty was 5yrs/50K miles. I did! Warranty as I was told is 4yrs/50K miles (my luck). Now in an Enterprise rental (Toyota Corolla – my next car will be a Lexus or Acura) car. Repair rep will not return my call – as I had to fax him all my service records yesterday. Just spoke to the service manager and now waiting for them to call me to tell me it will cost $5K. More to follow…

I just surpassed 50,000 miles yesterday and believe this is a bunch of crap for a car with such low miles.
Yes, there is a California contingent. I have experienced this “balance shaft” issue along with the “valve body” issue, with cost nearing $10,000 on a vehicle with less than 90,000 miles. Draft correspondence. Send to NHTSA. Join Class Action Lawsuit. Hope for reimbursement. Get vehicle repaired at an authorized MB dealership.

Could you provide the contact information for the class action lawsuit. I have not only had the “balance shaft” issue, but have also had to replace the transmission and it is now in the shop to replace the intake manifold. This has happened all in a 3 month period. My vehicle only has 85,000 miles on it.
I will be going back to BMW. I drove my last BMW 230,000 miles and never had an engine problem. Mercedes USA seems to be clueless and disinterested in helping their customers.
The 06′ 350 CLK is not on the list. It should be. I am verifying if my VIN falls within the M272/M273 engine specs.
Double check the list, VIN and engine specifcations. My 2006 ML 350 is not on the list and have experienced these unacceptable standards.
I agree. The 2006 ML 350 should be in this list. At 80K miles my regularly service ML350 had the check engine light illuminate. Upon having it checked by an independent MB mechanic, he informed me that my timing chain sprocket was worn. He made me aware that he had heard of this same issue and to get with the dealership. this was approximately 2.5-3 years ago. After getting the regional mercedes service rep involved, the dealership somewhat caved and paid half of the $4500 bill. Still cost me over $2300. I would certainly like to recoup that bit of change.
I live in the Toronto area, same issue. CEL came on and off intermittently at 65,000km. Warranty is 4 years 80,000km. Truck is outside the 4 year mark, well under the 80k mark. SUV sitting at a dealer for a week, dealer called, offering parts only coverage. Want me to foot a bill f $4,200.00. Call in to MB Canada, at a few different levels. Waiting for word.

My wife has a 2006 E350, the CEL went on a few weeks after warranty at 59,000 miles. The dealership (MB Long Beach CA) wanted $8,000 to replace the balancer shaft and offered 50% as courtesy. Totally unacceptable, and MBUSA doesn’t seem to care. We’re furious at the MB brand. Class action lawsuit, Sign us in.
I am the unhappy owner of a 2006 Mercedes R350. In October 2010 I discovered an unusual noise coming from the engine upon startup. I immediately took the car to my mechanic to have it diagnosed. He diagnosed it with a faulty balance shaft, a typical problem with my engine type. The estimate for the repair was $5500. I researched the web for help. I visited several sites that are the voice of Mercedes owners that are dealing with the same problems. I was told to contact Mercedes-USA and to not accept less than 50% of the cost of repair. I did exactly what was told and Mercedes accepted to pay half of the cost of the repair. I jumped to the offer knowing that I desperately needed a car for work. Mercedes of Pembroke pines began the work and called me two days later to tell me that I had sludge in my engine. I didn’t believe them and was suspicious. Knowing that all my oil changes were on time i ask questions to friends who work for Mercedes. I was told that it was part of their play-book to not warranty their work. Mercedes did the work and i drove my car home that Saturday. Sunday morning, during startup, i heard that same familiar noise. I returned to Pines Mercedes on Monday to report the problem. I was directed to the service manager Greg. He told me that the noise was because of the sludge and it will go away after several oil changes. He insisted that it would go away. Weeks went by and i began to become angered at the fact that i was conned by this service manager. I noticed the service light and instead of taking it to Pembroke pines Mercedes i took it to Miami Mercedes. Miami Mercedes diagnosed it as the cam shaft adjuster and also recognized that there was work recently done to the car. Not knowing who did the work they told me to take it back. I returned to Pembroke pines Mercedes and all i heard were excuses in which they even told me that the technician at Miami Mercedes didn’t know the history of the car and probably mis diagnose the problem. I would like to join this class action law suit. I own a 2006 Mercedes E350. My wife noticed an oil leak on our garage floor. I took the car to an independent Mercedes mechanic who informed me of the balance shaft problem. I then had the car towed to the dealership where I purchased the car. They immediately confirmed the diagnosis and said Mercedes would absorb half the cost to repair said issue. This car has only 39000 miles on it and I am 2-3 WEEKS OVER THE WARRANTY EXPERATION DATE. 2-3 WEEKS!!!! 2 weeks over warranty and they want me to pay half? I have owned 6 Mercedes but I guess that doesn’t count for much in their eyes. I will soon be a Lexus owner.
I have 2007 c230 which I just took to the shop this morning. The check engine light came on while driving. I took it my dealership and was told it was probably the thermostat. A few hours after I dropped my car off my servive guy called to tell me it that it’s the balance shaft. My question is is replacing the balance shaft a temporary fix? I do have a really good warranty but could this issuse cause other problems with my engine??
Michelle did they tell you the cost? The engine got to come out and be striped down . If the mechanic is not careful he will bend the valves and that is major trouble.
I still haven’t heard back on mine .it is still sitting in the driveway .Should hear this week if MB will foot the bill.

I bought my 06 R350 from a Porsche dealer in sept 2010 with 66k on it Cel was on so i took it to my local stealer they said the magnets were bad ( P0016 P0017 ) so i took it back to the Porsche dealer they replaced the magnets and cel stayed off for a month now it is on and off more on …. add me to the class action…

We are having the exact same issues with our ’06 R350. Same CEL reappeared after camshaft selonoids were replaced last week. The dealer has the car and has informed us the engine may need major work to the tune of $5K+. I do not feel safe allowing my family to be in the car! How do we get in on the lawsuit?

I purchased the 2006 MB R350 14 months ago. We were given a 1 year warranty. The CEL came on 3 months ago and the dealer told us that it was no problem, probably some bad gas. Now I bring the vehivle into the dealer, they tell me $5K to fix the balance shaft and gear. I too am outraged that I was sold a “Certified Used Vehicle” that within 7000 miles of purchase I am expected to pay $5k for a repair!!! This is my first…and last MB. My Acura handles better, gets better milage, and there is not a SCAM by the service dept or manufacturer. To think that the service tech told me he had never heard of the balance shaft problem before mine is just an outright lie. I will never trust this Westmont Illinois MB dealer again!!!

I purchased my 2000 C280 on 12/31/2010, from European Auto Sales in Westchester, IL, I drove the car back to Milwaukee, and noticed when stopping at the tolls that the car wouls stall, Drove it on 1/5/2011 to get my plates and the car stalled and shut off while turning a corner then the abs/esp/! lights came on. The car then shutoff at a red light and would not accelerate. The dealership acts if they had no idea of the problem. Add me to the class action lawsuit!!
I have a 2006 C230 with 75,000 miles. A few months ago the check engine light turned on. Finally I took it to the MB dealership in Kansas City for a diagnostic. They gave me a loaner while they checked out my car. The next day they called and said it was a camshaft or balance shaft and the gears were wearing down. I was like, uhhhhh ok… He said it was going to cost about $7,00o but it wasn’t going to cost me a dime. They took apart my whole engine, replaced a bunch of stuff in the engine, transmission and whatnot then put it all back together. It was 100% free! It sucks my car needed such a substantial repair but at least it’s fixed now and it didn’t cost me a dime. It seems like most people on here are having the same problem. Go to Mercedes Benz of Kansas City. They are awesome and fixed my whole car free of charge!
David from Kansas how many miles on your car? Is it still covered under warranty ? There does’nt seem to be a problem if covered,it is when the car is barely out of warranty that the problem with MB happens . I am trying for over two months now to fine out if mine is safe to drive.

Was told today that there will be no help from MB . Suck it up. The reason given was that I never bought it from a MB dealer. OK here is what happened the car was a leased car light came on keep running the milage up until 90,000 now it is out of waranty auction it off , only dealers can buy it and they sell it then that person cannot get “good will ” because he never got it from a dealer. Can I prove it yes with a piece of 2×4. It is whats called shoddy business pratice.

I am the original owner of a 2006 Mercedes E 350 which has been serviced on time by Mercedes dealers exclusively.
December 2010 at 80,000 miles the transmission failed and the repair was $6,550.00.
No explanation was given for the failure and to add insult to injury when I asked for the failed parts the answer was that these were available at an additional $1,000.00 charge only.
Phone calls to MBUSA headquarters remain unanswered. A call made to MB Stuttgart Germany resulted in “there is nothing we can do” Emails to Mr. Veig the service manager at MBUSA remain unanswered.
Conclusion: Mercedes is no longer the quality that it used to be. Save yourself money and aggravation. Buy BMW instead.
The dealer who sold the car in the first place informed me that the car was out of waranty so no help. The good will offer was denied because I never bought it from a MB dealer. Under the good will where they offer half the labour and all the parts carries with it a “sell your soul clause” where you agree that you will never say anything bad about Mercedes. Gag Order same thing. This is why very few are complaining . Me I am getting my fixed very soon ,paying the whole shot . What options I will follow after remain to be determined.
I have a 2006 E350 which I purchased used with 45,000 miles. At 65,000 the check engine light came on and after trying several mechanics to fix the problem, it will not go away. Mercedes dealer has been unwilling to help. I live in Georgia and would also like to join the lawsuit.
I have the same code problem with my mercedes benz R350,fault code 1200 and 1208 , with only 48500 miles on,but the most real problem here is that the factory warranty has expired , the check engine light is on and the car fuel economy is very low, i have not warranty on that and what i think or read about is that the job done to repair this is big…….

We bought a C23o for our daughter when she graduated from college. Knowing that she was going to be driving the length of California between her new job and home, we wanted her in a safe reliable vehicle. This Christmas on the way home the CEL came one. We thought no big deal because she was going to take the car in for an oil change anyway. Well, it was and still is A BIG DEAL! The balance shaft is broken. The gears were actually in the bottom of the oil pan. We can not afford to fix the vehicle right now, but still have a $300 month payment. Fortunately, we had an old/reliable Tahoe not being used. I was so surprised to see how big of an issue this is. MBUSA was contacted over a week ago. I haven’t heard from them since. I have had a call to them since last Friday and they haven’t called. PLEASE: YOU NEED TO FILE A COMPLAINT WITH THE NHTSA! See Richard Reeds post above for the link. There are several choices: but I think the best is Engine/Engine Cooling: Engine. Then make sure you state at the beginning of the process that this is a BALANCE SHAFT issue. Our best recourse right now is a RECALL! The more complaints filed with NHTSA the closer we get to this happening. Then, I think we should all start calling National Investigative Reporters!

I have my car back fixed at a cost of #7500.00 No help from MB. They will only warrant the replacement shaft for 2 years any milage. The avg. milage for most of us is 20,000kms(12,000mi.)

I have a 2010 E350 only 6000 miles on it and the engine light has just came on 2nd time. Was in shop for same thing 1.5 weeks ago. Told it was a software update Hmmm. 10 days later and now the engine light is on ..what will I be told this time? How many times before it is a lemon

Purchased a 2006 E350 wagon on an impulse from a non-MB franchise dealer (anyone want to guess the Japanese franchise name) with clause to clear the Check Engine Light. They tried and couldn’t and wanted to brush me off. Returned last Friday to have them take care of the issue and when I returned to pick up car, light still on. I was mad and pressed them on the “we owe”. They scheduled an appointment at MB dealer on Sat. The service guy came out after about 1 hour and informed me of the problem. Wanted out of the deal, but dealer, who is in IL said that state law does not allow return of automobiles so I would be out sales tax but would work with me to solve problem. I have a we owe and I will not go away until problem is fixed, but it is a hassle. If I am not made whole, I want to join the lawsuit too. BTW, one-owner, local trade (friend of the non MB dealer sales manager) with about 80,000 miles.
I have 2006 E350 with 44K lies on it. The check engine light on, took to dealer and have “a faulty balance shaft gear” , estimate of $4200, with credit of money we have to pay for the diagnostic. How can I join the class action now

I emailed my issue on the website Richard Reed posted. The second day I got a call from MB. A few days later, the dealership called us and said we can have the car fixed for free. BTW, I called MB first and the lady on the phone did not offer much help, told me that I am out of the warranty and talk to the general manager at the dealership.
Now I am relieved that I don’t have to pay for the repair, but also worries how long the fix will last. Does anyone have any updates after the reapir?

I had mine replaced . The waranty is 2 years unlimited mileage. Most owners drive about 12,000 miles a year . The orginal waranty was 4 years or 50,000 miles. A known bad part was covered for twice the time and milage as the replacement part. That is what I e-mailed head office in Toronto Canada.
Got my R350 back today ( 3/4/2010 ) everything seems to be running great paid $100

I have a 2006 R350 that went in the shop a week ago for the same exact problems. I got the car from Fletcher Jones MB in Newport Beach, CA. They are obviously aware of the issue and “are working with us” (but initially non-committal). They offered us a 75% “goodwill’ discount on repairs that amounted to almost 12K!!! I am still paying about 3K out of pocket, but it’s better than paying for the whole amount. It helps to have knowledge of the problem, as we used this info to our advantage. (Our car was diagnosed by an independent shop before we took in to the dealership). I also spoke with MBUSA direct and they did acknowledge the issue, and are currently offering “assistance”. I hope this info helps.
Oh and by the way, our R350 only had 62K miles on it, out of warranty and has started showing signs of “slowing down” at about 48K miles.
I have a 2006 R350 with the balance shaft issue. I have 48,400 miles on the car but it is about 6 months out of warranty. Mercedes refuses to pay labor, parts only they said. W. I. Simonson wants 35 hours at $170 per hour for a total of $6,000!
When I called to escalate I got the following from… the case manager:
1) You did not buy the car new,
2) You did not service it at the dealer,
3) As far as MBUSA is concerned I am not a customer! I jus happened to own a Mercedes, but I have not been a source of income for the company….
What do I do next? Any suggestions? How do I become part of the class action law suit?
I am in Florida and had same problem…was fortunate enough to have a SUPER service group that searched out this problem. Anyone else out there in Florida? It was a 4100.00 dollar REPAIR!!!!!
Wow! I am surprised although relieved to hear that I am not the only one going through this check engine/balance shaft issue. We live in California and own a 2006 E350. We were quoted between $4000-$7000 to fix the balance shaft. We were also told NOT to drive the car until the problem was fixed. Another victim of MB…..today I took my 2007 R350 (54K miles) to the dealership with “check engine” light on and the service guy called about this same problem “worn engine balance shaft” – replace balance shaft with a quote for $5300+tax. Vehicle is out of warranty and so they said they can’t help out with this repair charges. I am glad that somebody has already taken up this fight with MB. Please add me to the class action lawsuit as well. I have filed the complaint with NHTSA.
I am a car dealer and have seen this balance shaft issue over and over.
We are scared to buy any Mercedes out of warranty.We have also seen the manifold linkage breaking due to carbon build up in the intake manifold.
The linkage and manifold are made of some sort of resin/plastic /epoxy?
The carbon hangs up the secondary runner and snaps the linkage .You can not purchase only linkage. I think these are A MAJOR ISSUE FOR MERCEDES AND THEY SHOULD ADDRESS ALL OF THEM .
My wife has a ’06 CLK 350 with 18k miles. When I spoke with a former Benz Tech he advised her engine was one subject to the balance shaft problems. I wrote MBUSA regarding the issue on the balance shaft and idle gears stating the large number of cases I found on line with the same issue. I received and email dated 3/9/11 from Honora Duffy Ex Case Mgr-NE/SE Regions. It did not address the issue at all. Duffy stated “if the vehicle is out of warranty go see a Benz dealer for repairs with the cost of repairs being the owners responsibility!” In looking at Class Action I did not see a ’06 CLK 350 listed. Last year, I have already paid Mercedes of Pembroke Pines $5500 for repairing the cam shaft on my wife’s R-350. I will file a complaint on the NHTSA and the MB Production website. How long does this law suit normally take?

2006 ml350,I replaces the transmission at 55miles then at 60,00miles the balance shaft went,the problem is its a us car and I live in toronto no one wants to help me out I have had it with mb canada,10k in repairs in less the 5000 miles. Now the truck has been sitting for 3 months while i try and figure out a solutin that wont cost me 5k…anybody with any suggestions?

Now on top of that the freaking engine seized and MDUSA is telling me there’s nothing they can do. How can I get some help with this. The reason it seized is because the sealer put on parts of the engine was not done properly thus blocking oil passages. Trust me on this I have been working on these cars for a very long time. Demand that Mercedes takes it to a quality control shop and diagnose your issue
My wifes ML350 was just diagnosed with idler gear problems and other related issues. The vehicle has 78000 miles and out of warranty. Until I found out about the lawsuit, my Benz dealer quoted me almost $8000.00 for repairs. The service writer did not offer any type of information regarding this issue, although I am positive they know due to it being widespread. I’m sure they reduce their commission drastically if it is a warranty job which is why I suspect they did not inform me of the defective parts in the SUV. Once I insisted they notify Mercedes about the problem and request a warranty repair due to defective parts and notification to my attorney, they approved the repair. ***YOU HAVE TO INSIST ON THE NOTIFICATION TO MERCEDES***
I just took my ML350 to the dealer and they told me they have to replace the balance shaft $5300 I do not have warranty. please advise what I can do.
Received a check engine light notice. Took C-230 (2006) to dealer and was told that the code indicated a worn timing gear problem and would require major engine repair. The cost estimate was $4000 to $5000 to take the engine apart and determine if the gear was worn and needed replacement. Performed a internet search and found that this is a common problem with these engines. Car has 85,000 miles and was purchased in 2008 with 40,000. Have not had the repair performed yet.
This is a worldwide fault that MB knew about in 2007. We are based in Madrid, Spain and have the same problem on a 2006 S500. According to MB service data sheets, the number of hours for this repair is 20 max. (we pay the equivalent of 107 USDollars/hour,) and the kit of parts/oil etc. is 755USdollars. The number of repair hours should be the same same throughout the world.
Our total repair quote is 2772USDollars and MB are saying they won’t pay for the work.
Does anyone know if there are similar lawsuits in Europe?

Understand one thing, with doing a job like this it takes alot longer than 20 hours to do the job so it is bad on our end (mechanics) as well as the customer. I have worked on these cars for a while and I am one of the few among the shop that does internal engine work. And trust me it’s not like working on a Honda civic. These are precision machines that take more knowledge than some jiffy Lube tech.
I drive a 07 c230 with 70k on the odometer. About a month ago my check engine light comes on so i took it to the dealership about 2 weeks ago to find out whats the problem. Welp just like you guys/gals its my balance shaft as well. The service director proceeds to tell me that this is a $4500 job and i almost fainted. After reading this forum i decided to call mbusa to explain my situation. The rep gets back with me after a week and happily declined any assistance due to the fact the purchased on aution by a private dealership. When i bought the car it only had 14k miles on it and all of my service has been done at my local mb dealership so i dont see why that would even matter and to add insult to injury i got the actual break down of the price via fax yesterday and its a grand total of 5044.37($3300 in labor). They wont even gimme a freaking military discount!!!
One thing I notice is that tons of People who drive Mercedes seem to not have a dime to fix them. There a high end car not a side lot special. Be prepared to spend money but drive with luxury unmatched by any other manufacture
Umm, just because you have money doesn’t mean that MB doesn’t have to take responsibility for a known design flaw.

The reason you pay more money is you expect to get better quality and a more reliable vehicle and service. You “DO NOT” expect to have to pay additional “out-of-pocket” money because of poor engineering design. You may want to also factor in the current economic situation as to why someone may not have the money to repair their vehicle.
I have paid “out-of-pocket” $9,000US to repair the Balance Shaft, replace the Transmission and replace the Intake Manifold. This is within the last 3 months on a vehicle with 85,000 miles.
You want to refer to this as a “high end car” . . . in reality, it’s a piece of crap that Mercedes doesn’t want to assume the responsibility for poor design and engineering quality.
By the way, on “luxury unmatched”, I previously had a BMW in which I sold it after I drove it 230,000 miles. I never had “ANY” engine issues with that vehicle. You may want to rethink your “unmatched quality” based on the responses given on this website.

Yes, I had to replace my manifold and now my car needs a new transmission. This happen without warning and the car just stop after feeling the car go through some jerking motion while driving. They should be responsible for replacing all parts that are related to this malfunction.

I have a different issue with the same problem and that is the “check engine” light has come on, notwithstanding that my 2006 E-350 otherwise works fine. However, I’m from Massachusetts and need to have the car re-inspected for the State sticker by June 30, 2011. I’ve been told that any time the “check engine” light comes on, the Massachusetts inspection system automatically fails the unit which then forces a person to have to fix the problem … to fix this problem, MB USA (through a dealer in Tiverton, RI) is seeking about $7,500. In as much as my E-350 already has 140,000 miles, it wouldn’t likely make economic sense to spend that kind of money (50% of value) on this sort of isse; meanwhile, I can’t sell it because nobody is likely to buy a “check engine” light problem and as such I may now have a total loss of about $15,000 (the normal Kelly book value of this vehicle without the “check engine” light on.) What an embarrassing “black eye” for a brand that sells itself for superior quality of workmanship!!!!
I just got the same problem on my 2006 R350. They say this is a $K job as they have to pull out the engine and has been a defect in the 2006 models. What can I do to have Mercedes fix this defect as this should not happen in a Mercedes less than 5 years old that has always been properly maintained by Mercedes?
I had purchased a 2006 Certified used MB E350 in Feb of 2008 with only 18K miles. I kept the maintenance like clock work. On 26th Dec 2010, I got a reduced braking power light on my car. It was a sunday after Christmas and I had the car towed to the dealership. On 27th and 28th they “worked on the car”. they ‘fixed’ the brake pump and also found an oil leak which they claim to have fixed. And they also replaced brake pads and rotors. within 5 miles after I pick up the car from the dealer, it catches on Fire!! the freaking Honora Duffy is total B%^*(#. at the corporate dealership. The don’t replace the car, they don’t take the ownership of the problem and throw me under the bus, just like hundreds of other people. The car is totaled…

2006 E350 lemon in California. Cracked valve shaft and intake flapper already fixed just out of warranty and now error code 1208 with the check engine light. Sufffering the same issue as everyone else (Balance Shaft). You think you pay for quality but end up with lies and deception. Please add me to the class action lawsuit.

2007 C230, Quoted close to $7,000.00 to replace the cam sprockets only! The car only has 56,000 mile on it and is 6 months out of warranty. Dealer says about 2-3 weeks in the shop. Called Mercedes USA and dealer with no help to fix their defective parts.

I also own a 2006 ML350, my check engine light came on and we towed the car to the dealership. We were told the fuel pump was faulty and replaced. We arrived to pick up our car only to be told it wasn’t ready. The following day was told it was misdiagnosed that we needed a new balance shaft or a new engine. Pricing starting at $11,000 and our warranty had expired, so Mercedes would not be able to help with the cost. We have since had a new engine installed by a independent repair service, due to the cost, and now discover the thousands that have filed class action lawsuit for the exact same repair work! There’s no discussing this problem with Mercedes!

A independent mechanic is quoting approximately $10,000 to fix this problem, and suggesting I get rid of the car!! This is my first ever Mercedes!! I’ve dreamed and waited so long to own one of these cars, and now I can’t wait to get rid of it! Poor form MB!! I want to join the class action. Please add my email to any correspondence re: this Lawsuit. I purchased a 2008 R350 in March and it has gone back for 1. replacement of a battery within 48 hours. 2. Replacement of components of the air suspension after it was found to be leaning heavily to one side 2 months later. Now I have noticed a grinding noise coming from the steering column when I turn the car on and also when I am driving for no reason. It has also had a significant drop in power when accelerating and not only has trouble shifting, but also shifts unexpectedly. The other thing I noticed is I am unable to coast down hills- it’s like the transmission is holding the car back and slowing it down. I commute 95 miles round trip at least 3 times a week and am afraid of what I am driving at this point. I reside in, and bought it in Pennsylvania. Does this sound familiar to others with balance shaft problems? I am wondering if I have any other recourse regarding the entire vehicle and the problems I have had. It is a CPO and with the other repairs, I was only charged for a rental vehicle they gave me- but I do not believe I should have to pay even the rental and the distance to the delaership’s shop is at least 120 minutes round-trip from where I work or 4 hours roundtrip from where I live and every time the vehicle goes back, it is taking miles away from my CPO miles on the warranty. Any suggestions or help is much appreciated.
Have a 2006 CLK 350 Cab with 66,000 miles on the odometer and “Check Engine Light” illuminated at approximately 53,000 miles just after the MB B engine service was completed. Local Columbia, SC MB dealer checked and ditto with balance shaft issues. MB dealer quoted $4,675 to repair and 2 to 3 weeks to complete repairs. Contacted MB USA with offer to split the cost 50/50.
No go… MB USA took a rigorous position that vehicle was out of warranty and repair costs would be responsibility of owner. During conversation MB USA would not acknowledge that balance shaft problems exist and relied on warranty covenants.
Expected a quality product from MB but from this experience MB did not deliver ….

hello, i have the same exact problem with my 2006 E350, it has 53,000 miles and it just suddenly will not accelerate. it is very dangerous because we almost got wiped out by a truck coming from behind. fault codes are p0715/p0717 and p0718. i called mb na but they said that this is just another problem that i have to fix myself. i would like to be a party to this class action lawsuit versus mb na.
Please add me to the lawsuit. ML350, 2006 Model Year purchased June 2006, now (July 2011) has approximately 92,400 miles. All scheduled maintenance / services were completed on time at the dealership. Check Engine Light (CEL) first came on in July 2009, now again in June 2011. Each time, I called the dealership and was told to check the gas cap, so I did. After 2-3 days, the CEL went off. In July, 2011 the CEL came on again and stayed on. I took the ML350 to the dealership to get this checked out and they told the balance shaft needs replaced and that the repairs will cost $6,500!!
I haven’t experienced any problems with my car yet, but my 06 only has 13K miles on it. I went to try and sell it though and a buyer bolted on me when he found out that there was this engine issue.

2006 E350 same problem…….went for the repair in Febuary 2011. Grand total 5547.23. NOT GOOD.
I have a 2006 ml350 with 56,000 and experiencing the same issue regarding the balance shaft. My car has been in the shop for over a week and going on the 2nd week. Awaiting to hear from Mercedes to see if they are going to assist with the repairs. Outside Warranty company will only pay half of the 5700. Warranty company’s argument is why should they replace parts that are still working….such as oil pan etc…. I am getting so fustrated.
I have a 2005 C230 Kompressor that has just jumped the timing because the CAM gears are worn away. I baby the car with synthetic oil and frequent oil changes which is why I got 109,000 miles out of it, but the gears should go 250,000 miles if properly hardened. This is a Mercedes defect that they should make good on, this is of recall proportion at this point
I bought a used R-350 11 monthes ago. After several trips to the dealship where I bought the car (for multiple concerns) including an engine light that never goes out I went to an independent foreign car specialist who diagnosed codes 1208 & 1200. He then explained the balance gear shaft issue. The dealship claims they knew nothing about it but I am suspicious. How do I join this lawsuit? I have already spent a mint in lost work days and frustration on this vehicle and will not be able to get an inspection sticker next month when needed if the problem persists.
Also have the same problem with the engine light comes on.
Do a MB S350 -07, bought it new.
In service work load so they claim that there is a worn engine balance shaft

I have the same problem on my 2006 E350, 48000 miles. The check engine light came up, took it to dealer, they said it is the balance shaft, will cost $5800, MB will pay part, I need to pay $2500.
I went to NHTSA and tried to file the complain, but I can’t find the right place. If somone can provide the link or instruction, I will love to do so.

I have a 2002 c230 compressor with only 60k miles on it. I have had it sitting in my garage waiting for a recall as it required a new transmission at such low mileage and everyone who owns one had the same failed transmission. Please include our year in the suit!
I have a 2006, R350 that we bought new. The engine light came on shortly after the warrenty was expired. In May, while driving home from school with my kids, the car just stopped without warning. An independant foreign car specialist told us about the balance shaft problem, and class action suit taking place. We contacted Mercedes, who basically said that it was out of warrenty, and that because we did not service it with them, they would not help us.
We have our car back after(8 weeks) a repair of 9, 700.00 and a new engine.

I have a 2007 MB R350 recently had the car serviced due to check engine light not turning off. After several diagnositic tests, loss of work time and repair bills beyond belief I am told that code 1200 &1208 are stored for camshaft correlation.
I would like to be part of the suit. Please reply with any additional information pertaining to the suit or this issue.
