Low-Income Beneficiaries of Indiana Medicaid Program File Class Action Lawsuit Complaint Against IBM, ACS Human Services, Phoenix Data and Arbor E&T Over Medicaid Benefits.
A class action lawsuit has been filed against International Business Machines Corp. (“IBM”), ACS Human Services, LLC, (“ACS”), Phoenix Data Corporation (“Phoenix Data”) and Arbor E&T, LLC (“Arbor”) (collectively “Defendants”) in the Marion Superior Court in the State of Indiana (styled James Bowman as next friend for Jameel Bowman and Melissa Gibson as next friend for Courtney Anderson v. International Business Machines Corp., ACS Human Services, LLC, Phoenix Data Corporation and Arbor E&T, LLC, Civil Action Case No. 11 04 PL 013108), alleging, among other things, that IBM, ACS, Phoenix Data and Arbor illegally cut off benefits for certain low-income beneficiaries of the Indiana Medicaid program who are dependent on Medicaid coverage for access to health care services,according to the International Business Machines IBM Indiana Medicaid class action lawsuit complaint.
The IBM, ACS, Phoenix Data and Arbor Indiana Medicaid class action lawsuit complaint is reportedly brought on behalf of two putative classes of persons, as follows, unless otherwise excluded:
Beneficiaries who appealed or attempted to appeal terminations or reductions of their benefits within the timely notice period and whose benefits were interrupted, reduced or terminated as a result of Defendants’ actions or inactions.
Beneficiaries whose Medicaid was terminated when Defendants’ re-determined the facts of class members’ eligibility in one category without making a determination of the beneficiaries’ eligibility in another category, according to the requirements of 42 U.S.C. § 1396a(a)(8), 42 C.F.R. §435.930(b), and the procedure established in Clevidence v. Sullivan, IP 94-836-C-M/S, Judgment and Order dated December 19, 1995.
The IBM, ACS, Phoenix Data and Arbor Indiana Medicaid class action lawsuit complaint reportedly seeks an award of compensatory damages to all putative class members who were allegedly deprived of the benefit of Medicaid coverage allegedly as a result of Defendants’ action, attorneys’ fees to Plaintiffs’ counsel and costs.
