Hyundai Sonata Owners & Lessees In New York File Class Action Lawsuit Against Hyundai Over Allegedly Defective Brakes.
A class action lawsuit has reportedly been filed against Hyundai Motor America (“Hyundai” or “Defendant”) in the Supreme Court of the State of New York County of Westchester (captioned Karen Marshall, Paul Flannery and Darrell R. White v. Hyundai Motor America, Case No. 53222/2012) alleging, among other things, that model year 2006 through 2010 Hyundai Sonatas are equipped with defective brakes and that the Hyundai Sonatas manifest squealing and premature deterioration of the brake rotors and pads and sticking of calipers when the brake pedal is applied, which allegedly can lead to complete failure of the braking system, according to the Hyundai Sonata Brake Pad, Rotor & Caliper class action lawsuit complaint.
The Hyundai Sonata Brake Pad, Rotor & Caliper class action lawsuit is reportedly brought on behalf of a proposed class consisting of the following persons:
All persons who are or were at the time of purchase or lease, a citizen of the State of New York, who purchased and/or leased a 2006 to 2010 Sonata automobile.
The Hyundai Sonata Brake Pad, Rotor & Caliper class action lawsuit complaint reportedly asserts claims for, among other things, alleged breach of contract, unjust enrichment, deceptive trade practices, breach of express warranty and breach of implied warranty of merchantability and declaratory relief.
The Hyundai Sonata Brake Pad, Rotor & Caliper class action lawsuit complaint reportedly seeks, among other things, a declaration that the remedial work necessary to correct the allegedly defective brakes is covered by the Basic Warranty, compensatory damages, restitution, treble damages, pre-judgment interest, post-judgment interest and attorneys’ fees and costs.

I have a Sonata from this period and I can confirm this is a BIG problem.
I have driven less than 35k miles and it has been serviced twice already.
Hyundai needs to recall the vehicles to fix this problem.
I’m a citizen of PA but I can sure relate to this…..
I actually just took my 2007 Hyundai Sonata Limited to the mechanic this morning for the squealing and screeching sounds I was hearing while driving. They just called me and told me I needed brake pads AND rotors cause they were “metal on metal”. Hope this isn’t the beginning of future problems with the braking system.
I own a 2012 sonata, with less than 6k miles and my brakes are already shot. I’m not sure if they actually fixed the problem.
Hmm … I have a 2012 SE 2.0t – and I haven’t been shy about using the accelerator either – and am approaching 24k miles and MY brakes still have 40-50% left.
In fairness, I’m not convinced that Hyundai’s OEM braking hardware is top-shelf anyway …
But I see someone complaining about shot brakes at 6k miles and all I can think of is “left foot braking” – MORE than they realise they’re doing it! Besides the terrible danger to those following, left-foot brakers are destroying their cars – killing the gas mileage AND pulverising their brake pads / rotors.
I have the same model Sonata, only “real” compliant so far that they were not up front about paying for a map update every yr it’s available. This might seem trival for some but it’s not for myself. I’m a rep for a large corporation and I have to drive all over the top half of the state. The newer model map’s are much faster/gives the speed limit usually and the roads are a lot more accurate with names, less mistake etc..just my two cents…I know this doesn’t apply to many but they lied to me when I asked how they updated and they told me there was no charge…when I have time i’m going to find a attorney. They admit they don’t have it in writing and I didn’t sign for it. I will start a class action lawsuit. It’s nothing compared to what some of you are going through with “real” issues like braking etc..but 200.00 a yr to update your nav? When I got the most expensive Sonata with all the bells and whistles that cost me OTD 29,600????? Please.
Had the issue happen to me on my newer 2009 with less than 10K and the issue was the passenger rear wheel caliper was defective; it happened on the highway in middle of now where,(sound was horrendous I thought it was a wheel-baring or worse). Nursed it to a tire shop and they confirmed the issue however couldn’t fix it for any amount as none of the local parts places even stocked the parts yet, as the car was so new at the time; however the manf did! Had to take it to the dealer praying they didn’t start a fire etc who stated it was my fault for not cleaning the breaks every 5k miles. I never had this issue with any other vehicle in my life! And no I don’t ride my breaks and I do anticipate stops with my accelerator. No choice and hope Hyundai starts putting this requirement in their ads soon so people are aware and can either start factoring their time or funding for this issue before deciding on purchasing a Sonata! Sun visor broke too which appears everyone else has issues with too!
I am an owner of a 2010 Sonata and I just had my first major problem with my brakes. I just got off the phone with the dealership and they are going to look into this for me. Not a happy owner right now.
2007 Sonata. First set of rear brakes (” rust, dust, calipers hung up, sorry not under warranty”) at 17,000. Just came back today from dealer. Same problem, another set of rear brakes, same excuses, don’t drive enough, dust, blah blah, blah. Only 33, 000 on it. Never buy a Hyundai again! Hope this suit goes some where.
I am an owner of a 2010 Sonata and I am having the same problem with my car. I’ve had my car for 4 months and im about to take it to the dealership because im hearing sqeeking noise in the rear. I have 52,000 miles on it. Upset right about now.
I have exactly the same issue.
I just spent $350 for repairs at 38000 miles.
They were repaired at 18000 miles. How can
I join this lawsuit? It is a design issue
since the design is not as good as front
brakes.
I own a 2007 sonata, bought new. Having yhe rear brake problem.
Dealer said I needed to have it repaired to pass state inspection at my expense, which I did. Where can I join in the class action suit for this problem ?
I have the same problem with my 2007 Hyundai Sonata. I have been complaining of a burning smell coming from my right rear brakes since 15,758 miles and now my left rear brake is doing the same thing. They keep telling me I dont do enough long distance driving. How do I go about joining the class action suit for this problem?
We bought our 2007 Hyundai Sonata with about 24k on it in 5/2008. My wife had to get the rear brakes and pads replaced in 5/2011 with only about 38k on it which cost us over $318. They too were metal to metal. Now, we just got news after taking the car in for the required oil change at our Hyundai dealer, that the cailper is frozen with only 43k miles on it. Now we were told that the caliper had to be replaced..$150 . This is crazy!! I have never had to change calipers on any car that I have owned let alone a car with less than 50k miles on it. How do i get included in this lawsuit. I would love to be compensated for the large cost repairs and have this problem fixed permanently by Hyundai if possible. This is craziness that they won’t admit and fix the design flaws or least cover all repairs for this problem for free. Please let me know how I can be included in this suit.
My daughter has a 2007 Sonata and wife a 2009 Sonata. Both cars have the same problem, starting with right rear brakes. I’m dealing with the 2009 car right now, which is at a dealer in Savannah, Georgia. Problems surfaced while on vacation at Hilton Head. As we live in Pittsburgh area, you can appreciate what I’m up against! I would join a class-action lawsuit against Hyundai if possible.
I heard high pitched noise from rear while driving 2007 Sonata GLS. I found that the rear wheels were extremely hot. I was afraid the tires will catch fire due to the heat. I took it to the dealer in Southfield Michigan. The manager said that it would cost me $300 to replace rear pads and they were not covered under warranty. Rear brake pads essentially were 95% worn out. Front brake pads were minimally worn during this time period and were OK. I got them replaced at “NAPA complete car care center” for $176 in Oct 19, 2009 when it had 17,513 miles on it. At 40,042 miles while driving from Detroit to Milwaukee, I heard dreadful grinding noise. At “car-x auto service” in Milwaukee they found the same problem with rear pads while front pads were OK. One rear pad was almost bare and others were more than 95% gone. I spent another $350 and this time the rotors also have to be replaced. There is definitely a design flaw and it is a safety issue due to heat which can cause tire fire. It seems the rear pads stop moving freely after certain pad wear. It could be too much hydraulic oil pressure in the rear brake lines or there is some defects due to ABS system. Hyundai must own this problem and fix this issue for good. Environment al (salt, water etc) effect is the same for both front and rear brakes. Front brakes do not need any adjustment or lubrication and they are OK. Why would only rear brakes need cleaning and lubrication at every 5000 miles as suggested by the Dealer? In my driving for 40 years I have never seen this issue in any of the other vehicles I drove. On checking internet discussion boards I found that this issue is common and Hyundai is not doing anything. This is not fair at all while consumers are holding the bag with perpetual expensive repairs and fear of being stranded and tire catching fire.
did you get any help? The more I’m reading the more I’m getting aggrevated.
I own a 2006 Sonata GLS. I was just telling my co- worker that I have never had to replace brakes on a car so often. It seems I have to get new pads and/or rotors every year and no one can give me an explination why? ugh!!! Can I Get in on this lawsuit?
I just read about the class action lawsuit against Hyundai, concerning the rear brakes, I find it so interesting we are having the same issue with our 2010 sonata. Upon calling Hyundai we were told this would be covered under the warrenty, and when we took it to the dealership to be fixed we were told it was not covered because it was normal wear and tear. Like many others our brakes were inspected 3,000 miles ago and now we have to replace just the rear drivers side brakes and rotor. We live in New Hampshire could anyone tell us how to get in on you class action lawsuit or start one of our own? I thank you for any and all help..
I’m hoping someone can help me as well. I too have been through breaks already AND my caliper on the rear passenger side locked up last year and now again this year (8/9/2012 as a matter of fact) I was wondering if anyone else has had the same problem and I am seeing that there are several complaints. Is there anything being done w/this? Does anyone know how I can start something to at least get some of my money back because of course it’s not covered under factory warranty. Please use the e mail jpfritchey1014@aol.com
Thank you
We also own a 2009 sonata and started have the smell of burning & smoke coming from my rear brakes at 15,000. Took it to the dealership & they charged me to
We also own a 2009 sonata and started have the smell of burning & smoke coming from my rear brakes at 15,000. Took it to the dealership & they charged me to clean them telling me that the caliper was sticking. Well that sure didn’t fix the problem because at around 23000-24000 miles my pads & the right caliper were gone. The caliper was flaking apart & the dealership wanted me to bring it to them, how no caliper. On top of replacing the pads on the left side also my tires all needed replacing with only 23000-24000 miles on the originals (they install cheap materials). 5,000 miles later go to the dealership for oil change & noise coming from the back left. They tell me I need new pads, rotors & emg. Brake. Told them don’t touch it. No mention that the caliper was sticking. I call Hyundai customer service & made a complaint. 1 week later those left back brake smelling, had to replace the caliper. Couldn’t get it to a dealership as we were leaving the next morning for vacation. Hyundai’s customer service told me to fax/email my receipts and let them know both were emergency repairs. How’s that working for me, yeah they are not standing behind there vehicle. I would like to be part of this class action suit, we live in NY .
I also have a 2009 Sonata like my co-worker above. Both of us have had the same problems. My back brakes actually got so hot, it burned my finger when I touched one of the lugnuts because I had noticed it had changed colors. It has been 3 months since I have changed the rotors, calipers, and the pads, only to ahve it start all over again! I would be more than happy to join in a lawsuit! Shame on Hyundai for covering up something as important as your brakes!
I live in Ontario Canada, and have a 2009 Hyundai Sonata. My rear pads wore out just as quick as my front pads at 11000km. Now that I have taken notice my right rear rim gets very hot, probably due to a sticking Caliper. The danger of a wheel blowing from this heat is serious, and the rear braking system should be addressed by Hyundai.
2010 Hyundai Sonata GLS – trouble from day 1. Bought the car used with 31+k miles on it. Front brakes shook and vibrated like crazy until I replaced them a few months later(rotors were probably warped). The rear brake calipers stuck and continue to do so. I have the parts to replace the pads and rotors, just have to get them installed(probably should do the calipers, too). I can actually feel them release when coasting down a hill – the car just seems to roll more freely. This is my first experience with a “foreign” car. Never again, and especially a Hyundai.
Purchased a 2002 Sonata had to replace the brakes several times within a few years I had the car. I purchased a brand new 2009 Sonata and yesterday (9/29/2012) the garage told me that I needed rear pads, rotors, and brakes. Needed 4 new tires because they were so bald. A new battery which should last 4-5 years and its less than 4 years. I only have 18,168 miles on the car. My bill was over 1400 dollars. Not a happy customer.
I own a 2009 Sonata and in June of 2012 I had the rear brakes replaced and both rotors cut at the cost of $418.00 with the inspection. Then 2 weeks later the right rear caliper froze up. hyundai told me oh that will be $150.00 for the caliper. I had a 1989 Dodge Dakota 2 W/D with 210,000 miles on it and it had original calipers on it. say what you want about Dodge, but I will NEVER buy another Hyundai.
Oops! They also replaced the master cylinder. That was another $200.00
Recently took my 2009 Sonata for a routine rear brake job. The Hyundai service dept. said I had a cracked caliper. After 35 years of getting break jobs, I never experienced a cracked drum or caliper. Being skeptical, I asked to see the part. Sure enough, there was a crack for well over half the circumference of the caliper. It was a large enough crack that you could see light. The service mgr. said rust was the possible culprit. I think Hyundai uses inferior materials, as well as having product engineering issues. The other caliper was also warped. There needs to be a nationwide recall.
I own a 2009 Sonata, purchased in 2009. Car needed rear brakes and rotors at 20k miles in late 2010, which I thought was unusual. At 40k miles , June 2012 a rear passenger tire vibration started during driving and braking, car was brought in for servicing, Hyundai dealer wrote off complaint as non-verifiable(problem only manifested itself when wheel was hot). Two weeks after service vibration was worse when braking, called for service and was advised by dealer to lubricate pins. Since then burned the 20k pads to smoke, replaced pads and caliper and ground down tabs on new pads so they would not bind.Hyundai refuses to reimburse $82 for parts since I did the labor.
I am having the same problems with my Sonata 2006 regarding the rear brakes. All the issues mentioned in the comments are present in my car.
I am in Canada (Ontario) and I hope that something is going to be done to help to bring a solution to this matter.
I have had 5 break jobs within the first 55k miles. Way fed up, but the dealer says I need to take it easy on the breaking as I do alot of city driving. I have a father in law mechanic that looked at the breaking system and he confirms the calipers appeared defective as they are so tight the break pads do not release after breaking that they rub constantly. Very embarassing when driving real estate clients around with this terrible screeching before i get them fixed again. Let me know how to get involved and make this a recall and how I can receive my money back for the 5 brak jobs I’ve already had, thanks.
I have a 2006 Sonata, had one brake job a couple years ago and now get a strange sound when coming down a steep hill… will have to have it looked at. I guy just died here in Binghamton today when the Sonata he was driving had a brake failure (apparently). That accident happened on Friday. There seems to be no info on how to join this, but perhaps any settlement will include all of us who own these cars..
Having same problem with my 2006 Sonata. Have had rear brakes replaced twice now (pads and rotors) in 5 years. While driving yesterday my rear driver’s side brake stuck. Couldn’t get home fast enough. Any word on class action suit in Illinois? We need to fight this! They shouldn’t wait until someone dies before they agree to fix it.
I have to same problem. Rear driver side brakes are sticking and this will be the second set i have had put on. I love the car but not worth all the repairs. Never again will I but a Hyundai. Plus, Hyundai dealers are not the best people to work with.
I have a 2009 Sonata, and do plenty of both city and highway driving and at 68k have had to have brakes and rotars replaced twice in just the last year, as well as having to have the calipers released when they locked. When the mechanic looked at it he said he’d only ever seen the calipers lock and this type of damage from kids doing “power slides”. I asked him what that was and apparently its when the pull the parking break while driving quickly to slide the car? I had never heard of such a thing before but I doubt millions of hyundai owners would be doing that. I would like join in on this lawsuit, because at $250 each repair, I can’t afford an extra $500 or more a year for this car. They need to recall already and fix the problem permanently, as well as repay us for the repairs.
I have a 2010 Hyundai Elantra. It has 23,000 miles on it and I was told that the rear rotors are pitted so bad that they need replaced. The pads are also shot from the pitting. They said that the front rotors could be turned. Hyundai has a 5 year 60,000 mile warranty on the rotors but their warranty isn’t worth the paper it is written on. They determine what is considered “normal” wear and tear. You could end up paying to have the rotors replaced a week after you purchase the vehicle if it sat on the lot for a long time. This will be my last purchase from Hyundai!!! Burn me once and I am done with you.
I UNFORTUNATELY OWN TWO 2009 SONATA GLS CARS. THE REAR CALIPERS ARE SHOT ON BOTH, WORSE THE REPLACEMENT THEY HAVE MADE HAS NO BRAKE SHOES ON THE MARKET THAT WORK WITH IT, AND TO GET A PART FROM THE DEALER IS 235.00 EACH. ITS HIGHWAY ROBBERY AND THEY WILL NOT HONOR ANY WARRENTY.
I bought 2009 Hyundai Sonata brand new. When car had only 18000KM, the rear left brake pads were down to the bare metal. The change of pads and brake discs cost me $ 300. A few months later when car had 35000 KM, the rear brake jammed and I could not drive the car, luckly I had just exit of the highway. I got the car towed to the
Sonata dealership. The service manager told me there is nothing wron with the brakes and the fault is with my driving. When I told him the brake problems quite common, and shown him the email print out
from the drivers in the states. He said these problems only happens in the US and not in Canada. He had no answer when I told him that my Sonata was also manufatured in the US as well, he could not answer this question and told me to throw the print out in the garbage.
The second brake job cost me over $ 1300.
Now at 78000 KM the problems started again and my brakes are sticking again. I do not know what should I do. Hyundai Canada is no help. I wish some one help me in Canada. One thing is for sure I will not buy another Hyundai Product.
I was not warned or been told about recalls. I dont live in new york but indiana, purchase car in illionis in 2011. I have a 2010 gls sonata and my brakes, pads, rotor, calipers are out. I never had this problem with my Toyota and I owned that 12 years ( purchased brakes once) . I will never buy Hyundai again.
Wow! Thought my brake woes were just a string of bad luck but now I see that this is clearly a defect in the brake design. Too many of the same problem for the same models is clearly a call for action and recall on the part of Hyundai. Terrible! Same story as everyone else, right rear brake caliper shot, fixed it at almost $400 for new pads, rotors, caliper. Not 5 days later, left caliper needs replacing. Simply terrible that this issue is not being addressed. Thinking of calling the dealer, but realizing that I’ll just get the runaround and they’ll replace it with same sub-par parts. This should be addressed immediately by Hyundai. I was a fan before all this, but I’ll never buy Hyundai AGAIN!
same exact problem I have with my 2009 sonata..Grinding noise on left rear wheel…Dealer replace pads and cut rotor..Same problem occurred
4 weeks later on the same wheel…Front brakes fine….going back to dealer and talk to service manager first….They must know of this problem along with Hyundai management….How does one get a class action suit started?….All of the complaints indicated no proper corrective action from the dealer service department or Hyundai management..
I purchased a ’09 Sonata back in November 2010. It had only about 14,000 miles on it. I recently had to purchase a set of new tires, and have been good at regularly taking it in to have tires rotated. About 4 months ago I took my car in to have tires rotated, and mechanic told me my rear brakes were pretty worn, but could probably go another 3000-4000 miles until my next tire rotation. I took my car in two days ago (2/14/13) for tire rotation and brake check, and I had no brakes on my rear wheels. It was metal to metal. I only have 48,000 miles on my car. I had new pads and rotors put on that cost me $300. I was told that the left rear caliper was defective, and should be replaced asap. The mechanic said it appeared to be a defective caliper, and it had been put constant pressure on my brake pads. My husbands a mechanic and he has never heard of rear brakes going out before front brakes, and at such low miles. After reading all the other complaints, I’m worried that Hyundai won’t see this as a defect and that the customer will be stuck paying the bill every year to have new pads and rotors replaced. If I had known about this issue, I would have never bought this car! How could Hyundai not have fixed the problem with the defective caliper by now! According to the above comments this has been going on for 5 years now. How can they be so dishonorable to their customers and put their lives at risk!!!
We bought two 2009 Hyundai Sonata’s both have just over 60,000miles, and both have failed calipers and sticking breaks that had to be repaired to the tune of over 800. dollars. We have taken the cars to the dealer for multiple problems including the engine light going on, and the dealer can’t figure out why. They keep doing “things” and charging for the repair, only to have the light go on a week later with a new problem.
I’m an owner of a 2009 Hyuandai Sonata. I’ve had ongoing brake problems. I just had my rear brake pads and rotors replaced last month. The one side also needed a caliper and bracket. When I went to the dealership a few weeks after they told me Im going to need the pads replaced again soon if I dont get my pistons cleaned. 2 weeks ago I had my front brakes done. My brakes are grinding again horribly like never before. I’m assuming its the back. WTF had I know about this issue I would have never purchased any hyundai vehicle!
I have a 2006 Sonata with 20,ooo original miles. I store it in the winter. I too have a brake problem (Need new pads & Rotors). How can this be??? I hardly drive the damn thing!! Took it to the dealer and because I inherrited the car from my cousin, no warrenty! Thanks Hyundi… I’ll sell it and get a more reliable car!
My 2008 Hyundai sonata back brake calipers locked up at 30,000 and the other one at 31000 miles, it happened to be under warranty, will they go out again now that is is not under warranty? This needs a lifetime warranty…I am from Illinois
I can’t remember how many brake jobs, Pads and Rotors, I’ve had on my 2007 Sonata. I do know that just today I had the front calipers (First time ever on any of my cars), rotors and pads replaced for $821.00!!!!!!!
In my opinion an easy fix to the pads. Dont understand why not just fix it and be done with it. I end up having extra work every time i change pads. Otherwise i do like the car a lot.
I have a 209 sonata and am on my third set of brakes. The dealership says there is no recall and therefore NO PROBLEM!!!
I purchased my2008 sonata new and with less than 18000 miles I had to replace rear rotors and pads my mechanic told me that the adjusters had froze up.at 38000 miles I gave the car to my son. Shortly after that he had to replace the rear rotors and pads.now at 60000 miles his wife took the car in for a NYS inspection and the mechanic told her the rear brakes are completely ruined and advised her to replace rotors and pads again.she didn’t have enough money with her to do the repair so she had to drive the car home completely scared to death! Ru $&;? Me we need action against Hyundai now!
Unfortunately this problem is not new and is quite widespread. I bought a new 2002 Elantra GT and brakes were a huge problem (airbags also, but that’s another story). Parking brake cable broke at 24K miles (luckily dealer replaced under warranty) and then at 27K miles I had to replace rotors, calipers, shoes & pads (not-so-lucky this was considered “normal wear” and not covered under warranty, $800 out of pocket). I had no luck getting any attorneys to pursue this (no one got injured or killed thus not worth their time) so good luck to the newer Sonata owners — I hope you get the compensation we older Hyundai owners didn’t get the chance for.
I purchased a 2009 Sonata new. In 3 years and 14,000 miles rear brakes were completely gone including rotors. Dealer says they only warrantied for 2 years or 12,000 miles. Called Hyundai and they said “too bad”. Cost me $300 to repair. I have owned more than 15 autos in my lifetime and none ever had to have brakes replaced in less than 30,000 miles. Very disappointed w/Hyundai. Need to recall and repair these defects or will not buy another. How do I apply for class action suit?
I was surprised when I had to replace the rear brakes 1st @ 42k, did the front brakes 10+k later. Now the car is pulling left on braking, and will try to take it in this week. I guess I’m luckier than many.
I have a 2012 Sonata with 21000 miles on it. I brought it to the dealer for my first 3000 mile oil change and mentioned a subtle rubbing noise coming from the front wheel(s?). They returned it to me assuring me there was nothing wrong with it so I thought, that’s odd but apparently that is how a brand new Sonata is supposed to sound, ah, O.K.? Last week the subtle rubbing sound turned suddenly into a metal on metal grinding noise. I carefully, so as not to burn myself, looked at the outside and felt the inside of the rotors and felt deep grooves on the inside of the right front. I brought it to the dealer and they told me it sounded like something that would be covered. About an hour later, they called to tell me that the warranty only covered 1 year or 12000 miles and the car needed new pads on both front sides and resurfaced rotors which they would be happy to take care of for $206 and some change. I questioned them about the condition of the pads and they told me that both sides on the front were (in a nutshell)very worn on the inboard and more than half good on the outboard. They were obviously in need of repair, this was said, of course, as though this was normal. Furthermore they inspected the calipers and again determined everything was functioning “normal” and that again since the car was past the 1 year/12000 mile warranty period, this was not covered. He did take advantage of the opportunity to mention that Hyundai has a new “recommended brake service plan every 15000 miles for $94 and some change”. I sarcastically said “that sounds great”, “well what can I do, I need to stop, fix the brakes”. Having pondered this for the remainder of the day, I called the service dept back and asked for the pads that were removed and again asked for a description of the wear (much the same as before) and questioned how they could consider this type of wear normal. I also mentioned that I admittedly am harder than average on brakes, but I did not paint the Sonata yellow and but checkers on the side, and start using it to pick up fares in Manhattan, half of those miles indeed, were highway miles. I also mentioned that if I buy lifetime warranty pads from the auto parts store and bring them back with that kind of a difference in wear, the auto parts place would not warranty the pads because of the grossly uneven wear. They would tell me that I have a bad caliper causing the uneven wear. After hearing all of this, the guy at the service counter said he would discuss this with his service manager and the district rep from Hyundai (odd?)and get back to me. He called back shortly later and said that although again everything was “normal” that they would cover the cost of the repairs that were performed on the brakes. I told him that I still had some concerns that if this was considered normal that I would be going through this every 15000 miles (if I only want to replace the pads before they damage the rotors) and the whole reason I bought a brand new car was so I didn’t have to put a bunch of money into repairing a piece of junk all the time(subtle, I know). I guess we both agreed to cross that bridge when we got there. I drove the car home and for the first time there was not a strange rubbing noise and now that I feel how it should feel when it is normal, I realized that the brakes were rubbing/dragging, at least part of the time, because it now rolls a lot more freely when coasting to a stop and the brakes also worked well. I was not aware of the issues with back brakes on the previous years Sonatas, they told me all of the wear in the back was, well, the pads were all good! Again they said this like it was normal. Let’s recap the front were, worn to the metal on the right and nearly to the metal on the left on the inboard pads with roughly 40% wear (60% good for those that are bad at math)on the outboard pads (still on the front), and roughly 40%wear (60% good)on all of the rears(inboard and outboard). Normal? I think not. It’s a shame that there are all of these issues from before that apparently have not been remedied because I really like driving the car (it a turbo hee hee) FUN! I just had my boss asking me about the Sonata and the question was, “would you buy it again”? I mentioned the recent brake problems and that with the low-pro tires, it was bad in the snow, but probably would because it was fun to drive, and quick! After hearing of the recurring brake issues I will be changing my answer. Like I told the guy at the dealer, the “best warranty in the business” doesn’t do any good if they consider things like this normal, and therefore “not covered”.
P.S. NO! I am not a left foot brake rider! I drive with one foot (the right) like I should.
I’ve been having a similar probelm. I did not notice it right away because when I went to go replace the rear pads they were not making any noise. They didn’t make noise because there was no PAD at all and the pistons were full extended. Ever since then i’ve been through a couple sets of pads/rotors and replaced the calipers with no success! This is soo annoying.
I have a 2006 and a 2007 Sonata, in Wisconsin. Both bought new. Have been through 3 rear brake jobs on each car and now every 15000 miles a dealer “brake maintenance” where they take brakes apart and clean & lube them (for $90). My daughter had a rear brake lockup in traffic and almost had accident because of it. Why isn’t the NHTSA doing something about this before people start getting killed. This is defective brakes, not a defective radio or something. Why do we have these government safety agencies if they won’t hold a foreign carmaker accountable for a safety defect???
I have a 2009 sonata gls and I too am having terrible break problems specifically the back left caliper which is shot so I’m told. I only have 45,000 miles on it. I replaced the pads about 20,000 miles ago and thought that was crap, then my back left caliper started to freeze up and I could tell it was just eating up my pads, not to mention my rotors. So I thought hey maybe I just brake a lot. I took it in, had all rotors and pads replaced. 750 bucks later i think my car is fixed. The very next day my brakes are smoking and squeeling again. I just sceduled an appointment with hyundai to have them replace the clearly faulty caliper system. I’m assuming it will be covered, but looking at the comments it looks like they are going to give me some excuse why it wont be covered. I’m going to brush up on the warranty details, and bring in this suit and see what happens, I will gladly support this class action suit. Faulty breaks for sure. Overall I have been happy with the vehicle, but I expect Hyundai to stand behind their warranty. I understand that they cant always see these problems ahead of time, but at least accept their is a problem and fix it as per the warranty. They are going to lose a lot of customers if they do not, including myself.
I have a 2009 sonada I went to buy new tires and they told me I needed all new brakes on the rear. now I need new rotors and pads on the front because just the front brakes are working they said my calibers are froze on the back and ruined my rotors and pads this is going to cost over 600.00 to fix and I only have 30,000 miles on my car this really makes me mad.The more I research this and find out hyundia is aware of this problem and is doing nothing.
Hi everyone,
I am back to update my experience about having my rear caliper replaced by warranty. I told everyone that I had an appointment this past Friday and to get it looked at. After reading all your posts, I expected they would not repair it an make me pay for it. I went in and had an amazing experience with the Fucilllo Hyundai dealership in Syracuse, they not only replaced my caliper, and the break pads, but they cleaned all my other calipers as well. Now the vehicle runs great! no more burning. To further my experience they even shuttled me to a nearby mall to shop around for a couple hours and picked me up. I paid for nothing. I was very impressed. I am sorry to hear about everyone’s experience, and I believe they should repair your breaks as well. Another thing to add is they even repaired the brakes even when I had previously changed the pads myself and had another shop put on new rotors. So nothing but smiles from me.
I just replaced the back breaks and rotors last year. They have to be replaced again this week. Calaburs are sticking, causing grinding, i’m told. No other problem with my 2007. Great car, sucky break system.
2009 sonata gls with 60k miles. replaced rear brakes twice now and right rear rotor recently. same ongoing problem with cailper hanging up grinding and sticking! i am so sick of this i am ready to trade the car which i really like except for this. its dangerous because i cant even accelerate normally when this happens. wake up hyundai!!!
Please.
Count me in. 2009 Sonata, except I went to a Mr. Tire shop and they informed me that one of my back calipers was sticking. I was upset because it was grinding down my break pad, which forced me to purchase new pads and have the calipers shaved. So far since the shaving they seem to be holding up but I definitely agree that there should be a recall for this issue. Since it is a volatile item it doesn’t surprise me that Hyundai is looking the other way on purpose. Where do you join the suit?
I have a 2002 Sonata I’ve replaced pads , rotors, seems like its a never ending problem.cause looks like its ready to be replaced again.and it hasn’t been more than six months ago.Need to get Hyundai to fix the problem…..
When we first got the water pump went out.Do you know what you got to go thru to replace it.Well it wasn’t a piece of cake. You literally have to pull the motor out.
I also have an 07 sonata and i paid to have my rear brakes also replaced the odd thing is that only 1 shoe was worn to the metal and they told me it wasn’t covered under the warranty so what i did to solve this problem was replaced the rotors and the pads with high performance rotors and ceramic pads and i didn’t have any more problems with the brakes its just a shame that a regular joe can figure out the problem when licensed mechanics can’t. i would also like to be involved in the lawsuit how can i?
I own 2 2009 sonatas the Calipers simply lock up
I’ve had to replace my rotors, brakes, calipers three (3!!!!!!!!) in 6 years. How do you get involved in this suite? I’m a Ky girl.
I would like to join the law suit
I have 2007 and 2010 sonata. In 2012 & 2013 I had to replace rear brake pads to abnormal quick uneven wear. I guess brake caliper is sticks and in one case dust cover had slip off and is difficult to push it back. This is a safety issue.
My girlfriends 2010 sonata developed driver side brake problems at 20,000 miles. I checked the internet to find that others had brake issues and that n0t many dealers were standing behind the problems. I changed the pads all around the car and just figured I would eat the cost of the pads. I did the work myself so that the stealers yes stealers woudn’t make money for something that should be taken care of free of charge. Now at 31000 the drivers side rear is down to bare metal again. Where do I sign up for the class action suit?
I have a hyundai sonata 2009 for 3 year I put 2 rotor and 4 set of brake shoe on in the last year. my problem is the right rear. my wheel kelp on go hot and wearing the pad down. my next step is to put a new caliper on this is taking a lot out of me. it just one wheel. this my second hyundai sonata i had a 2003 that was good no problem. something got to be done hyundai got step up to the plate. Mike Washington July 7; 2013. 555pm. I going to sign up for the class action suit.
Michael Washington July 7 2013
I have a 2009 hyundai 3 year The last year I put 2 rotor 4 set of brake shoe on it . The problem is The wheel get hot then it wear out the pads. It is the right Rear have the problem. My next then is to put the rotor on I had enought this is a disapointment something got to be done. I do not have it like. I try to the my self I do not the money to pay.. I going to sign up for the class action suit.
I’d like to join the party too considering that my 2009 Sonata needed new brakes, new rotors, and 4 new tires that were apparently dry rotted out. My car has 14, 000 miles on it. I had the work done at Midas on June 27th and now all of a sudden the right drivers side caliper is now stuck. Actually, I think Midas broke the caliper considering they had the part in stock and the dealership had to order the part. I went to the dealership to see if it was covered under warranty , of course my coverage expired 40 days ago. It just boggles the mind to have invested so much money in a car that has 14,000 miles on it. Something is seriously wrong here. Oh yes, by the way, I get a lovely 14 miles to the gallon on this vehicle.
how can I get involved in the lawsuit or start my own or find others?
How do I get involved in the lawsuit? I have a 2007 Sonata with 18,000 miles and I just replaced my back brakes. I have had no other mechanical problems with the car.
I have a sonata 2009 about a month ago i replace the pads on the car and now the disks and calipers are damage… no wonder I am having problems with this car
We need to connect with Hyundai and get these problems fixed, recalled or whatever. After 1800 dollars spend in the last two years on brakes, rotors and calipers. The driver side rear wheel gets hot, is burning and was told that this is not a problem. I love my dealership, but they need to get busy with their Hyundai Corporate Office. I am scared as I drive my grandchildren almost daily..
Same problem happened with my 2010 Sonata at 53K miles. Back left caliper seized up and wore down my brake pad, and had to replace calipers. I’d like to join this lawsuit or start one in wisconsin.
I have a 2008 with 80k on it, I had the dealer do rear breaks at 50k front breaks shortly after and now need rear again. This time it’s everything and the calipers are shot as well. The break switch has gone out twice and I also have to change lights constantly. Hyundia wants over $800 for the break job and the last time it was $400. I would like to get in on this law suit also. How can I? I’m in MN
I have the same problem. I am replacing pads and rotors every 4-6 months. I live in the State of Illinois.
Same thing..now the burning smell with the rear, drive side wheels are hot to touch, and just had the rotors, brake and calipers replaced again. Am I heading into an accident in PA?
I purchased a 2010 Sonata with 24K miles on it. I am on my second rear brake job. My parents had a 2006 Sonata with constant rear brake issues. I purchased my car in NH and am now living in MD. The left rear caliper is sticking and I can’t find anyone willing to replace only the defective caliper, one rotor, and the brake pads. I don’t have hundreds of dollars to keep spending on brakes. I would welcome the opportunity to join the class action lawsuit.
It is now 6 months later and since my last post, I had to have my front rotors and pads replaced even though I had already done this 7 months prior. Now, I have a rear caliper sticking again and am headed back to the service department. What a hunk of junk this car is! NOT including this latest issue, I have spent $1500+ on brakes for my car in less than a year. Considering I’ve owned a few different cars before this one over the last 20 years and never had brake issues, I’d say this is definitely a Hyundai problem – not my driving.
I spent thousands of dollars for both front and rear brake issues directly related to this. I WANT to sign up for this class action law suit. Where do I do this????
I’d like to sign up for the class action law suit also. I live in New Jersey and had similar problems with my 2009 Sonata GLS.
People, let’s get this straightened out with the 2009 Hyundai Sonata, four door. 54,000 miles. brakes, calipers and rotors replaced three times. The last service last week, was told it would not be okay, well the burning smell is back and my rear left metal on the tire, burning hot. Need to be able to join the Class Action Suit..
I’m not a citizen of New York, but own a 2009 Sonata and have had to replace my caliber and rotors. All states should be included in this suit and not just the state of New York
Help same problems Brakes, caliphers and rotors replaced to the total tune of $1800.00. Just had rotors replaced last week and the left rear wheel is burning and smoking and was told, this is okay by the dealership. PA gal …how can we get Hyundai to fess up?
I have a 2007 Sonata and went through two sets of pads and rotors before 20000 miles…I spoke with the Hyundai dealership and they said that they aren’t covered under the warranty and that if I had them serviced at the dealership it wouldn’t have happened…at a cost of $350…now after the fourth set of rotors and pads and I ma at 35000 miles…I am really tired of this…it looks like the calipers have frozen and I am not getting any braking function at all out of the rear brakes.
2009 Hyundai Sonata bought at 58k miles and brakes worked fine for about 9 months when I began to hear grinding/squeaking coming from my right rear tire WHILE driving. Resulting in the right rear locking up and thankfully breaking free on it’s own while driving (about 30mph).
I replaced front pads, rear pads and rear calipers because my mechanic who is a friend immediately noticed what the problem was. I assumed there was just a problem w/ my car and didn’t think it was a design flaw. Until 1 year after replacement and now at 79k miles, it’s happening again. I agree, that I cannot afford to replace calipers every year and shouldn’t have to. I can’t remember replacing even the pads on other vehicles as often as I do on this one.
Third set of Pads and Rotors for my 2006 Sonata.
Calipers are now Pulsing and Squeaking.
Emergency brakes are completely gone.
Not happy.
my 2009 Hyundai Sonata is grinding in rear driver side in which costing $600 to replace 2 calipers 1 rotor pads rear only bleeding and replace ing fluid car has 65,000 miles. I live in florida so rust should be limited.
I have a 2007 Hyundia Sonata and have the same problem as others regarding my brakes, calipers and rotors. I have had the car for 3 1/2 years and have had the front and back brakes changed twice already, have had back passenger side caliper replaced, both rotors on the back of car replaced and I have also had to change the front driver side caliper twice. I reside in Michigan.
I have a 2010 Hyundai Sonata GLS. Already had the left rear caliper replaced at around 58,000 miles and now the right rear caliper is bad at 70,000 miles.
I changed my front brakes early but it was done in Canada. Now I’m doing my back brakes and I’m only having problems with them, but I ewas getting them done in the states, this is the second time I’m putting the brake system done. I’m getting the second set done in Canada. I hope I have just as good luck with the back brakes as I had with my front brakes.
I am hearing the same squeky sound on my breaks since last year when I had replaced both back breaks/rotors. The breaks don’t rub the rotos evenly as they do in the front. This is a huge safety and mechanical issue that hyundai needs to address.
I have had the brakes on my Sonata 2007 replaced once already and I an in need of another replacement with just approximately 59,000 miles. I do not think I have ever replaced brakes that frequently on any model car I may have owned. First time it was over $600.00. Now hearing the squealing when applying brake pedal and a clicking noise when window is open and I am just barely moving. When brake pedal applied it sounds like something is dragging in the wheels. I know I cannot wait to do this repair as I am sure it is bad. Just came onto this possible Class action suit. Any way to be included in this? Please let me know.
My girlfriends 2010 has gone through 3 sets of rear brakes and rotors…the car only has 65K on it. Simply crazy!!!! Sue the shit out of them!!!!!! Korean car will ever fail.
Iv just got home stopped to get my mail and heard a clicking sound in back rear on drivers side smelled something burning. Pulled into drive and checked and it is hot, hot, hot. I just had the brakes done last July it is a 2007 Sonata and had the brake with pads oh did I mentioned that was the second time the brakes were repaired also had them done 2011, same problem. So I immediately came in the house and went on my computer and see this about the Sonata brakes problem. I need help I only have 65,000 miles on my car this isa problem that needs to be addressed and I need for Hyundai to take care of this it is obviously a wide spread problem and it is their responsibility to make it right.! Please someone I can’t keep repairing cost to much and I am on a retirement small plan. Please help me.!
I have a 2009 Sonata ive had the brakes rotors pads calabers replaced twice now and again they need replacement seems im not the only one with this problem so why isnt it a recall
2010 Sonata Limited
I just had to replace rear brake pads, rotors, calipers & hoses; less than 6 months after I initially replaced the brake pads. Passenger side caliper was shot and wore out the brake pads completely. In addition to that I was told that the Emergency Brake is stuck on passenger side which doesn’t make any sense at all to me. How does it get stuck on when it isn’t even engaged?!?! This should absolutely be a recall!!! Please include me in Class Action Suit if possible.
I have a 2008 Hyundia Sonata and am experiencing all of these issues. I have already replaced my rotors as they have warped for some reason and just had to get a complete brake job as the brake pads stuck to the calipers and and ruined them. I paid $300 dollars for a multi-point inspection in June and less than 3k miles later this happened, which resulted in an additional $500 bill. Not to mention the constant squeeling of the brakes. I am extremely dissappointed in the Hyundai brand. Please include me in the class action lawsuit if possible
I had a 2006 Hyundai Elantra. (The reason I am posting here is I do not believe there were very many Elantras in 2006 with ABS and 4 wheel disc brakes.) I had a 2006 Hyundai Elantra with 4 wheel disk brakes and ABS. It was the only one on the lot at the time but I wanted ABS. MISTAKE 1, MISTAKE 2 I bought it. At around 11,000 I had complete right rear brake failure and was almost involved in a crash. I had been to the dealer several times and was told the noise I was hearing was normal. I guess it was not normal. I went back to the dealer but was told brakes and parts were not covered by warranty. I had it repaired, complete disk, rotor and other parts. Not at Hyundai but I guess they would say it is not their fault. By 21,000 the same thing happened. I got rid of it. I am on Social Security and do not have a car now. When I brought it I was told the vehicle was care free. They even would not sell me the car without some type of warranty plan which I refused. They deducted something so they could sell me the plan but it did not cover brakes. The whole thing should be criminal. HYUNDAI SUCKS!
Last year I bought a 2010 Hyunday Sonata used with 35000
miles from a dealer. I have so far had the car in the
shop for the brakes and calipers twice costing alltogether
$1,300. I would appreciate any information regarding
the Class Action lawsuit. The brakes are definitely
defective!
’07 Sonata, 30,000 miles. Left rear pads worn down to metal on metal, right rear still at 70%
Calipers barely open wide enough to fit over new pads….had to force them on.
Please include us in this class action suit.
I have a 2009 hyundia sonata bought brand new in 2008 from Hyundia dealer in Newark, Delaware. Since 2013 when I got new break pads because of that awful grinding and screeching noise, it’s now only a year later and I have the same issue again. I feel unsafe in driving my own car that was supposed to be a great car. Where are the answers for this issue? I’ve already put enough money into this car since I’ve bought it. Why am I forced to put so much money into this car for a manufacturers mess up? I want answers to this issue.
I had to replace my rotors and pads and after only 4500k on them I found out the reason why I had to replace the rear rotors and pads my calipers are what have been the problem they are locked up and my new parts in the rear are ruined I didn’t realize that the problem was the calipers now I feel Hyundai should compensate me because of their faulty brakes on my 2008 Sonata this really sucks because I’m on disability and I don’t have a lot of money oh well
I have a 2009 Hyundai sonata with stuck rear brake calipers. Just had rear brakes done in Sept 2014, replace almost all parts. Now November and left caliper stuck and needs to be replaced along with brale line.

My calipers on my 2008 Sonata damaged my new rotors and pads I didn’t even have 2500 miles on the new parts I have to put new calipers rotors and pads on this week and I only have 67000 miles on my car anyway there must be a problems looks like a lot of others are having similar problems also…..Best Wishes
I have a 2010 Sonata. I have 60,000 miles on the car and just had to get pads, rotors, and calipers on the back. I had already purchased back brakes 15 months ago. I do not ride the brakes or stop quickly. They should not have worn out or have calipers seize.
I have a 2009 Hyundai Sonata with 38000 miles and my brakes locked up!!! Smelled smoke and my car would not accelerate at all, I am so mad and regret that I purchased this darn car. Please help me somebody!
