Guam Taxpayers File Class Action Lawsuit Complaint Against The Government of Guam Over Guam Territorial Income Tax Refunds.
A class action lawsuit complaint has been filed against the Government of Guam (“Guam” or “Defendant”) in the District Court of Guam for the Territory of Guam (styled Rea Mializa O. Paeste, Jeffrey F. Paeste, Sharon M. Zapanta v. Government of Guam, Class Action Case No. 11-cv-00008), alleging, among other things, that the Government of Guam owes taxpayers an estimated $269 million in Guam Territorial Income Tax refunds, according to the Guam Territorial Income Tax Refund class action lawsuit complaint.
The Guam Territorial Income Tax Refund class action lawsuit complaint reportedly is brought on behalf of the following putative class of persons, unless otherwise excluded:
All persons and entities who: (a) have filed a timely claim for refund of an overpayment of the Guam Territoria Income Tax for any tax year from at least 2006 to the present, (b) have not been given by the Government of Guam, via certified or registerer mail, a timely notice of disallowance of such claims, and (c) have not been paid such refunds by the government of Guam.
