GMAC Mortgage Borrowers Who Allegedly Timely Paid Off Their Mortgage Obligation And Were Assessed A Late Fee File Class Action Lawsuit Against GMAC Mortgage.
A class action lawsuit has reportedly been filed against GMAC Mortgage, LLC (“GMAC Mortgage” or “Defendant”) in the United States District Court for the District of Massachusetts (styled Audrey Kessler v. GMAC Mortgage) alleging, among other things, that GMAC Mortgage routinely adds a late payment charge to the schedule of amounts due when GMAC mortgagors request a payoff letter to repay their note early (the “Late Fee”) that are allegedly improper and unlawful because the mortgage payments tendered were allegedly timely, according to the GMAC Mortgage Late Fee class action lawsuit complaint.
The GMAC Mortgage Late Fee class action lawsuit is reportedly brought on behalf of the following proposed class pursuant to Federal Rules of Civil Procedure 23(a) and (b)(3):
All individuals who entered into a Fannie Mae/Freddie Mac Uniform Instrument and who timely paid off their mortgage obligation to GMAC from December 30, 2005 through and including the present but who were improperly assessed a Late Fee.
The GMAC Mortgage Late Fee class action lawsuit complaint reportedly asserts claims for alleged breach of contract and unjust enrichment.

GMAC reported false info. on my Credit Reports and then used illegal practices to start a foreclosure This cost me over 80,000 dollars because I had to use a hard money lender to but out mortage GMAC then reported for over 7 yrs that my mortage was still 120 days past due and did not even have a loan with them It was paid off GMAC has always stated that they were not reporting any of this to the credit report people because it was not on their books I had the loan with them for nine yrs and they purposely reported false info and purposely used illegal tactics to cost me over 80,000 The loan payoff was less then 150000 and but the time I had to use the Hard money lender the loan was 230000 Gmac now holds the new loan since 2004!!!
