A class action lawsuit has been filed against Ford Motor Company (“Ford” or “Defendant”) in the United States District Court for the Southern District of California (styled Karla and Virgil Iler v. Ford Motor Company, Class Action Case No. 10CV2648 DMS JMA) alleging, among other things, that the rear tailgate of 2002 through 2005 models of the Ford Explorer, Mercury Mountainer and Lincoln Aviator suffer from a defect that causes the rear tailgate to crack which allegedly results in a safety risk and diminution of value of the vehicles, according to the Ford Explorer, Mercury Mountainer & Lincoln Aviator cracked rear tailgate class action lawsuit complaint.
The Ford Explorer, Mercury Mountainer & Lincoln Aviator Cracked Rear Tailgate class action lawsuit complaint is reportedly brought on behalf of the following putative classes of persons, unless otherwise excluded:

All original owners or lessees of a 2002 through 2005 Ford Explorer, Mercury Mountainer & Lincoln Aviator residing in the United States, that have not yet repaired or paid another individual or entity to repair a damaged rear tailgate of a 2002 through 2005 Ford Explorer, Mercury Mountainer & Lincoln Aviator (the “original owners not repaired subclass”)
All subsequent owners or lessees of a 2002 through 2005 Ford Explorer, Mercury Mountainer & Lincoln Aviator residing in the United States, that repaired or paid another individual or entity to repair a damaged rear tailgate of a 2002 through 2005 Ford Explorer, Mercury Mountainer & Lincoln Aviator (the “subsequent owners repaired subclass”)
All subsequent owners or lessees of a 2002 through 2005 Ford Explorer, Mercury Mountainer & Lincoln Aviator residing in the United States, that did not repair or pay another individual or entity to repair a damaged rear tailgate of a 2002 through 2005 Ford Explorer, Mercury Mountainer & Lincoln Aviator (the “subsequent owners not repaired subclass”)
The Ford Explorer, Mercury Mountainer & Lincoln Aviator rear tailgate class action lawsuit complaint reportedly asserts claims for violation of the Magnuson-Moss Warranty Act, breach of express warranty, breach of implied warranty of merchantability, breach of implied warranty of fitness for a particular purpose, negligence, fraudulent concealment and misrepresentation, negligent misrepresentation, and unfair competition under the California Business & Professions Code 17200.

Same problem here with the crack and also the faulty transmission ( OD off) blinking light.

My Nationwide insurance would not pay for having the crack fixed. I would like, very much, to get my money back as I paid for having same repaired.
I have a 2005 Ford Explorer Limited, and I am the 1 and only omwer of this car. My rear tailgate just cracked right next to the FORD decal ( kinda ironic). I think every 2002 Ford Explorer and up until the the new model style has the same crack. It’s sad that the great american car company won’t stand by their most popular product and fix the problem! Shame!!!
I have a 2003 Aviator with only 42000 miles. The outside did not crack, but the lock mechanism for the glass is loose. So I can’t close the glass easily. I’m thinking this is what’s causing the cracks to occur when the lock is not aligned and you slam the glass shut.
Any help how to fix it would be appreciated.

I have a 2002 Ford Explorer. I have 2 cracks. 1 on each side of the FORD logo. How would I be able to join in on the law suit?
Ours cracked around the emblem too. Want in on the class action lawsuit. Costs over $500.
Same problem with the crack. Told them about it the first cold season for the car, 2005/2006. Although I heard and saw several other complaints for the same issue FORD has done nothing. Now the gate won’t close, the window won’t close. Even better my glass company ordered replacement 07/31/2014 and I still have not seen it. I spoke with Jonathan at Ford Customer Relations who was of NO help.
Also, any actions against FORD for the transmission shifter lock problems?
I have a 2013 cmax sel hybrid , so far I have had 5 recalls on the car ,plus I have had it in the dealer this will be 6 times on the cd player , when playing the cd all of a sudden it jumps to a rap station or hard rock station ,I was so startled that I hit the breakes almost getting rear ended , now on Monday I have to take it to the FORD DEALER TO HAVE THE FRONT SEAT FRAMES REPLACED , I CAN NOT BELEIVE THIS CAR WOULD HAVE ALL THESE PROBLEMS , I HAVE A LOT OF DOCTORS TO SEE BECAUSE OF AHEART TRANSPLANT FOR TEST AND I THINK THIS CMAX HYBRID SEL IS A BIG BIG BIG LEMON , IT REALLY IS A JOKE ,FORD SAYS ITS FOR MY SAFETY THEY ARE RECALLING IT , I TOLD THEM I DO NOT THINK SO,SO DISAPOINTED IN FORD ,CHUCK
