A class action lawsuit has been filed against Foot Locker, Inc. and Foot Locker Retail, Inc. (collectively “Foot Locker” or “Defendants”) in the United States District Court for the Western District of North Carolina (styled Damita Kennedy v. Foot Locker, Inc. and Foot Locker Retail, Inc., Class Action Case No. 10-cv-00570), alleging among other things that hourly-paid employees who are or were exployed by Foot Locker in non-managerial positions, such as Sales Associates, Cashiers, and/or Stock Persons were not compensated for all hours worked in excess of forty in a work week, including overtime pay, according to the Foot Locker overtime pay class action lawsuit complaint.

All persons within the State of North Carolina who (i) are/were employed as Retail Employees with the Company as any time during the period of three (3) years from the filing of the Complaint through the date the Court rules on Plaintiff’s motion for class certification; and (ii) are/were not paid for all hours worked in a given workweek, including the payment of premium overtime compensation for hours worked beyond the forty (40) hour work week (the “Class”).
