Nevada Residents File Class Action Lawsuit Complaint Against Farmers Insurance Over Underinsured Uninsured Motorist (UM/UIM) “Stacking” Benefits & Anti-Stacking Discounts.

A class action lawsuit has reportedly been filed against Farmers Insurance Exchange d/b/a Farmers (“Farmers Insurance” or “Farmers” or “Defendant”) in Clark County Nevada District Court (styled Nayanananda Ratnayake v. Farmers Insurance Exchange d/b/a Farmers, Class Action Case No. A-11-648013-C) alleging, among other things, that Farmers has a practice of not providing its insureds with an anti-stacking discount in violation of Nevada law and allegedly denies its insureds’ claims for stackable  Underinsured Uninsured Motorist (UM/UIM) benefits, according to the Farmers Insurance Underinsured Uninsured Motorist (UM/UIM) Coverage “Stacking” class action lawsuit complaint.

The Farmers Insurance Underinsured Uninsured Motorist (UM/UIM) Coverage “Stacking” class action lawsuit complaint reportedly is brought on behalf of a putative class consisting of the following persons, unless otherwise excluded:

All Nevada residents who (1) were occupants of a motor vehicle insured by Defendant Farmers Insurance Exchange d/b/a Farmers (“Farmers” or “Defendant”) under a personal auto insurance policy; (2) who were injured in a motor vehicle accident due to no fault of their own; and (3) who were, between September 8, 2005 to the present, denied stackable UM/UIM benefits under an alleged invalid anti-stacking provision in a Farmers auto policy. (Subclass A);

All Nevada residents who (1) were occupants of a motor vehicle insured by Farmers under a personal auto insurance policy; (2) who were injured in a motor vehicle accident due to no fault of their own; and (3) who were, between September 8, 2005 to the present, denied stackable UM/UIM benefits based on Farmers’ alleged misrepresentation that an anti-stacking discount was provided to them in a Farmers auto policy.  (Subclass B);

All Nevada residents (1) who were, between September 8, 2005 to the present, insued by Farmers under a personal auto insurance policy; (2) whose Farmers auto insurance policy included an anti-stacking provision; (3) who were, under Nevada law, entitled to an anti-stacking discount due to the presence of an anti-stacking provision in the auto policy; and (4) who were not provided with an anti-stacking discount by Farmers allegedly in violation of Nevada law.  (Subclass C)

    I was sent forms for class action lawsuits involving both farmers ins. & washington mutual.
    I filled them out made copies & sent them back both by certified mail delivery confirmation.I did receive a delivery confirmation receipt for the farmers issue but have never heard another word from them & many months have now passed.I never did receive a confirmation receipt re:washington mutual but I did track the delivery info.from my receipt which showed that it was delivered & signed for also.That one was over a month ago & like the other no one has ever contacted me to let me know anything?
    Is there someway I can find out information regarding the status of my claims?
