eBay Members Subject To eBay User Agreement Who Placed Good Til Cancelled GTC Listings on eBay.com, eBay Stores or eBay Motors File Class Action Lawsuit Against eBay Over Alleged Fees For Good Til Cancelled GTC Listings.
A class action lawsuit has been filed against eBay, Inc., eBay Europe S.A.R.L. and eBay International AG (collectively “eBay” or “Defendants”) in the United States District Court for the Northern District of California in San Jose (styled Richard Noll v. eBay, Inc., eBay Europe S.A.R.L. and eBay International AG, Class Action Case No. CV-11-04585), alleging, among other things, that eBay charges fees for Good Til Cancelled GTC listings in a manner different than set forth in the applicable Fee Schedules and allegedly overcharges sellers by charging Listing Fees every 30 days for Good Til Cancelled GTC listings on eBay.com, eBay Stores, and eBay Motors during the No Recurring Charge Period and charged fees in addition to Insertion Fees (the fee eBay charges for placing a listing) every 30 days for Good Til Cancelled GTC listings during the Insertion Fee Only Period, according to the eBay Good Til Cancelled GTC Listing Fee class action lawsuit complaint.
The Plaintiff reportedly brings the eBay Good Til Cancelled GTC Listing Fee class action pursuant to Rule 23 of the Federal Rules of Civil Procedure on behalf of the following putative class, unless otherwise excluded:
All eBay members subject to the eBay User Agreement who, on and after September 16, 2008, placed GTC Listings on eBay.com, eBay Stores, or eBay Motors and were charged at any time after the initial listing: (i) Listing Fees during the No Recurring Charge Period; and/or (ii) any other Fees (excluding Final Value Fees) in excess of Insertion Fees during the applicable Insertion Fee Only Period.
