Consumers Who Registered With BidRack.com And Were Charged For A Bid Pack File Class Action Lawsuit Complaint Against BidRack.

A class action lawsuit has been filed against BidRack Inc. (“BidRack” or “Defendant”) in the United States District Court for the Northern District of California (styled Verna Parino v. BidRack Inc., Class Action Case No. 11-CV-3149) alleging, among other things, that BidRack owns and operates a “penny auction” website www.bidrack.com and that BidRack allegedly deceptively marketed and billed consumers for unauthorized Bid Pack charges, according to the BidRack Bid Pack penny auction site class action lawsuit complaint.

The BidRack Bid Pack penny auction site class action lawsuit complaint is reportedly brought on behalf of the following classes of persons:

All United States residents who were charged for a bid pack during the BidRack.com registration process by Defendant BidRack, Inc. (“BidRack Class”)

All California residents who were charged for a bid pack during the BidRack.com registration process by Defendant BidRack, Inc. (“BidRack California SubClass”)

All United States residents who were directed to a BidRack.com landing page by John Doe Defendants and were charged for a bid pack during the BidRack.com registration process by Defendant BidRack, Inc. (“John Doe Defendant SubClass”)

    I run an online community of penny auction players.

    When we first heard of the BidRack complaints from the BBB, we checked out their site. On their landing page, directly opposite from where you input your credit card information, was the explanation of what you were buying AND the option to buy a cheaper bid pack, or one of several more expensive bid packs.

    This is simply a case of people throwing their credit card numbers around without reading what they were doing. Self imposed ignorance is a lousy cause for a lawsuit, and I hope and expect that these type of lawsuits go no where, fast.

    @Nicholas Whatever you may have seen on their website is only part of the story as you well know. Most folks did not have “self-imposed ignorance” as you quaintly put it. Instead, they were duped by a host of intertwined measures which the court documents make plain and clear. Among these are farticle websites posing as news, massive countdown banners and the promise of easy cheap products. The availability of these products at the alluded to price is a major part of the con and is wholly against US & UK law which states unfair promises of prices or goods is very very naughty and you can get locked up for it.

    I too have checked the auction website and it’s all clean and green, now. Well it would be, wouldn’t it? However, that wasn’t the case when the folks were conned and the plethora of spam pointing BidRack’s way to my own email address showed the various methods they used to suck folks in.

    BTW, links on your website to helpful topics like “Are Penny Auctions Scams?” etc aren’t working. All I get is a 404 Not Found
    followed by nginx.

    I want to be part of this lawsuit! I have so many complaints there is not enough room to list them all! Won a bid on June 2 and still don’t have item and they won’t give me a refund. The whole company is one big SCAM! Won a CHEAP camera shipped from China with no scan disc with it! P.S. I have kept all my emails from Bidrack.

    I was scammed for $100 and now see where many others have been also, as well as auction scams, no product delivery, etc. I am hopeful that a Class Action Lawsuit will be initiated, as I would like to be included!

    TO ALL THOSE WHO SAY “too bad” TO THOSE WHO GOT SCAMMED…
    Yes, obviously you need to always read the fine print, BUT that $99 fee (or whatever it is) was not always charged. I started w/ Bidrack when they first begun. Things were great until their distributor fell thru and a ton of people DID NOT RECEIVE what they won. Instead we got credits and they KEPT OUR MONEY FOR SHIPPING! I thought I’d give them the benefit of the doubt and continued playing. Won some great stuff too!! Then they started changing their rules BY THE DAY!!! You couldn’t keep up. Then it happened again. They began sending messages saying that there was some sort of problem w/ my transactions and they WOULDN’T BE SHIPPING OUT ANY OF MY WINS ~~ AGAIN! But this time they were willing to refund my money. HOWEVER, I had several wins that they were unable to process the refunds for since they were still “pending.” Once they items came out of pending status, I called them back, as instructed, and the RUN AROUND insued!! Tons of calls and emails- no WAY would they ever let you speak to a supervisor- EVER!! No resolution to that problem ever! THEN THE WORST OFFENCE…
    I had several wins that I had not pd for and did not plan on doing so, since I was not receiving any of my merchandise- just a lot of BS answers! The SOB’s had the audacity to charge my card anyway!! When I found out about it I removed the card and they still charged items without my consent!! My credit card co. was super about refunding the charges, but unfortunately I used my MC debt card at some pt and my bank wouldn’t help me out. I am out around $100. due to their fraudulent practices!! Unfortunately, I have not had the time to push this farther, until I saw this blog. Now I am thinking maybe I should push forward… It is the principal of the whole thing!! GEEZ anyone who understands how these sites work knows the owners are making money hand over fist! There is absolutely no reason to screw over you customers when you are bringing in that kind of money!! BIDRACK AND NOMORERACK ARE DEFINATELY ON MY S#!T LIST!!

    so, know all the facts before you talk down to others, unless of course that is how you get your jollies!!
