A class action lawsuit has reportedly been filed against Barnes & Noble, Inc. (“Barnes & Noble” or “Defendant”) in the Superior Court of the State of California in and for the county of Orange (styled Kevin Khoa Nguyen v. Barnes & Noble, Inc. Class Action Case No. 30-2012-00562713-CU-CXC) alleging, among other things, that Barnes & Noble sold a HP 16 GB TouchPad Tablet at an advertised discounted price of about $101.95, but then later canceled Barnes & Noble customers’ purchases, according to the Barnes & Noble HP TouchPad Tablet class action lawsuit complaint.
The proposed Barnes & Noble HP TouchPad Tablet class consists of all persons who ordered one or more HP TouchPad Tablets from Barnes and Noble through Barnes & Noble’s internet site barnesandnoble.com beginning in August 2011 for an advertised discount rate and later received a cancellation of their order.
The Barnes & Noble HP TouchPad Tablet class action lawsuit complaint reportedly asserts claims for, among other things, alleged false advertising and unfair and deceptive business practices under California Business and Professions Code 17200 and 17500, breach of contract under New York Uniform Commercial Code, false advertising under New York General Business Law 350 and Deceptive Business Practices under New York General Business Law 349.
