Apple 3G Enabled iPad User Files Class Action Lawsuit Against Apple, Inc., AT&T Inc. and AT&T Mobility, LLC Over Alleged Discontinuance of AT&T’s Unlimited Data Plan.
A class action lawsuit complaint was filed against Apple, Inc., AT&T Inc. and AT&T Mobility, LLC (collectively “Defendants”) in the U.S. District Court for the Northern District of California (captioned Adam Weisblatt v. Apple, Inc., AT&T Inc. and AT&T Mobility, LLC, Case No. 5:10-cv-02553-PVT) alleging that Apple and AT&T sold the 3G-enabled iPads with promises that “unlimited data” service plans would always be available at the customers’ option, but that as of June 7, 2010, Apple and AT&T discontinued providing the “unlimited data” plan, according to class action lawsuit news reports.
The Apple 3G Enabled iPad and AT&T Unlimited Data Plan class action lawsuit complaint reportedly alleges that Apple and AT&T had promised consumers flexibility with their data plans, allowing them the ability to freely switch back and forth between the limited data plan, the unlimited plan, and no 3G data plan, based on their data needs, but have now allegedly been stripped of their ability to do so.
The Apple 3G Enabled iPad and AT&T Unlimited Data Plan class action lawsuit complaint is reportedly brought on behalf of a putative class of all persons in United States who purchased an Apple iPad with 3G capability between April 30, 2010 and June 6, 2010, and who are not otherwise excluded.

I bought one of the 3G IPADS for the exact same reasons alleged in this complaint and feel this argument is completely justified. I bought the IPAD 3G thinking I that it made sense to replace my Sprint 3G datacard for my laptop which I was paying $60.00 a month for unlimited data with the IPAD which would max out at $30.00 a month for unlimited data. So on May 1, 2010, I signed up for the AT&T 3G service on my IPAD. I initially choose the $14.95 a month plan not knowing how much data transfer I would go through in a month with IPAD. I used the IPAD as an attorney not as a gamer or big video watcher on IPAD. In May I had no problems. In June I was over my data limit in 3 weeks. I discovered that AT&T had cancelled my data plan on June 20, 2010 along with whatever data I had left for the month. My plan was supposed to go through June 29,2010. Now I get messages saying my only options are to renew on the 29th with their new plans of either $14.95 or $25.00. I am no longer allowed to get the existing plan I was initially sold on May 1, 2010. All during this time my data plan was paid up and not cancelled by myself. This appears to be a classic bait and switch when AT&T realized how much money they were giving away given the amount of data service IPAD 3G users were going through. I could not beleive they had the nerve to not grandfather the first buyers in to at least let you toggle between the original two plans. This is now probably going to cost me more because
undoubtly the $25.00 limited data plan is not enough to cover the
data usage as the new Apple operating system comes onboard in IPAD allowing multiple windows and tasks. I wonder how many thousands of IPAD 3G s and data plans were sold between April 30th and June 7, 2010?
