HTC EVO 3D and/or HTC EVO 4G Smartphone Purchasers File Class Action Lawsuit Against HTC and Accuweather.
A class action lawsuit has been filed against HTC America, Inc. (“HTC”) and Accuweather.com, Inc. “Accuweather.com” or “Accuweather”) (collectively “Defendants”) in the United States District Court for the Western District of Washington in Seattle (styled Chad Goodman and Jon J. Olson v. HTC America, Inc. and Accuweather.com, Inc., Class Action Case No. 2:11-cv-01793), alleging, among other things, that Defendants integrated an AccuWeather application into Plaintiffs’ HTC smartphones to make weather information conveniently available to Plaintiffs but have allegedly used and continue to use the application to track Plaintiffs’ exact geographic location for Defendants’ own purposes unrelated to weather information, according to the Accuweather.com & HTC EVO 3D & HTC EVO 4G Smartphone class action lawsuit complaint.
Plaintiffs reportedly bring the Accuweather.com & HTC EVO 3D & HTC EVO 4G Smartphone class action pursuant to Rules 23(a) and (b)(2) and 23(b)(3) of the Federal Rules of Civil Procedure on behalf of themselves and the following classes of persons, unless otherwise excluded:
a. National Class: All persons residing in the United States who purchased the HTC EVO 3D and/or the HTC EVO 4G smartphone and whose claims are not barred by statutes of limitations.
b. Minnesota Subclass: All persons residing in the state of Minnesota who purchased the HTC EVO 3D and/or the HTC EVO 4G smartphone and whose claims are not barred by the statutes of limitations.
c. California Subclass: All persons residing in the state of California who purchased the HTC EVO 3D and/or the HTC EVO 4G smartphone and whose claims are not barred by the statutes of limitations.
