Abercrombie & Fitch Gift Card Holders File Class Action Lawsuit Against Abercrombie & Fitch Over Gift Card Expiration Date.
A class action lawsuit has reportedly been filed against Abercrombie & Fitch Stores, Inc. (“Abercrombie & Fitch” or “Abercrombie” or “Defendant”) in the Court of Common Please Cuyahoga County Ohio (styled Beth Seaver v. Abercrombie & Fitch Stores, Inc., Class Action Case No. 11 CV 771466) alleging, among other things, that Abercrombie & Fitch conducted a promotion in 2009 in which consumers buying at least $100 worth of merchandise at Abercrombie & Fitch Stores across Ohio were promised a $25 gift card for use at Abercrombie & Fitch Stores with “No expiration date” but allegedly voided the gift cards on or around January 30, 2010, according to the Abercrombie & Fitch Stores Gift Card expiration date class action lawsuit complaint.
Plaintiff brought the action as a class action on behalf of the following persons:
All Ohio citizens who purchased merchandise from Abercrombie or one of its wholly owned subsidiaries from an Ohio store where Abercrombie or one of its wholly owned subsidiaries offered a gift card with a minimum purchase and the gift card indicated that it had no expiration date and where Abercrombie and/or one of its wholly owned subsidiaries electronically put an expiration date on the Gift Card which was not used in full on or before the Gift Card’s expiration date, from the period two years prior to the filing of the complaint to the present.
