A class action lawsuit has reportedly been filed against 24 Hour Fitness USA, Inc. (“24 Hour Fitness” or “24 Hour” or “Defendant”) in the United States District Court for the Northern District of California (styled Albert Alatorre v. 24 Hour Fitness USA, Inc., Class Action Case No. 11-CV-4318 JCS) alleging, among other things, that 24 Hour Fitness charged club members who cancelled or terminated their membership an extra month of dues charges associated with an Unlimited Guest Services Special Privilege Agreement, according to the 24 Hour Fitness Unlimited Guest Services Special Privilege Agreement Membership Cancellation & Dues Charges class action lawsuit complaint.
The 24 Hour Fitness Unlimited Guest Services Special Privilege Agreement Membership Cancellation & Dues Charges class action lawsuit complaint reportedly is brought on behalf of a putative class consisting of the following persons, unless otherwise excluded:
All persons from whose bank account or credit/debit/charge card an EFT was made by LaSalle Bank National Association or Paymenttech Merchant Services, Inc., or any other payment processor, on behalf of 24 Hour Fitness USA, Inc. for Dues Charges associated with an Unlimited Guest Services SPA submitted by 24 Hour to a payment processor on or after 24 Hour placed into its membership database file a Request for Cancellation or Termination of the Class Member’s or Club Membership Holder’s Unlimited Guest Services SPA since the four years prior to the filing of the action. (“Federal Class”); and
All persons in the United States who signed a 24 Hour Fitness Unlimited Guest Services SPA contract since the four years prior to the filing of the action to the present in the United States and who were required to pay dues upon or after notification of cancellation, whether by prepaid last month dues and/or Electronic Funds Transfer. (“State Law Class”)

I had a membership to 24 hr fitness and i paid regularly for 19 months. I also prepaid for a personal trainer which i never used due to an injury and they would not give me a refund. When i lost my job i asked them to apply the 500.00 toward my bill and they refused. My credit was messed up and i feel they are responsible and should be made to held liable. A lawsuit is in order most definitlely for all of us.
Time and time again I signed on a guest to my 24 Hour Fitness membership and was autocharged incorrectly once the membership was cancelled.
This corporation has some horrible business practices. I’m glad that this lawsuit was brought against them.
