A class action lawsuit has been filed against fitness club chain 24 Hour Fitness USA, Inc. (“24 Hour Fitness” or “Defendant”) in the Superior Court of the State of California, Alameda County (styled Raoul Fulcher, Jr., Kenneth King, Jr., Richard Lopez, Rebecca Mason, Leslie Thornhill and Thomas Weeks v. 24 Hour Fitness USA, Inc., Case No. 10524911) alleging that 24 Hour Fitness discriminates against minority and female club employees on the basis of race, color, national origin and gender with respect to promotions to managerial positions, according to a class action lawsuit news report.
The 24 Hour Fitness race and sex discrimination class action lawsuit complaint reportedly alleges that 24 Hour Fitness hires many minority and female employees into entry-level positions but denies them equal opportunity for promotion. The 24 Hour Fitness class action complaint also reportedly alleges that 24 Hour Fitness engages in discriminatory policies and practices in filling managerial club positions by using unjustified subjective decision-making that is arbitrary and permits discriminatory bias to influence decisions, by failing to notify all employees of job openings, by failing to consider applications before filling jobs, by failing to establish and inform employees of criteria for promotion, by using promotion criteria unrelated to job performance, and by using promotion criteria that are not reliably or consistently applied.
