Wal-Mart Stores Sex Discrimination Class Action Lawsuit Class Certification Decision Upheld On Appeal By the Ninth Circuit Court of Appeals

Ninth Circuit Court of Appeals Upholds Trial Court’s Class Certification Decision in Dukes v. Wal-Mart Stores Gender Discrimination Class Action Lawsuit.

The United States Court of Appeal For the Ninth Circuit issued an opinion affirming the district court’s class certification decision in a class action lawsuit filed against Wal-Mart Stores in the United States District Court for the Northern District of California (styled Dukes et al. v. Walmart Stores, Inc., Case No. CV-01-02252-MJJ) alleging that Wal-Mart, Inc., discriminates against women in violation of Title VII of the Civil Rights Act of 1964.

The Wal-Mart Stores class action complaint reportedly alleges, among other things, that women employed in Wal-Mart stores: (1) are paid less than men in comparable positions, despite having higher performance ratings and greater seniority; and (2) receive fewer—and wait longer for—promotions to in-store management positions than men.

    I filed a discrimination suit against walmart 18 months ago with EEOC and the ruling was in my favor but too expensive for me to file a lawsuit on my own. Who do I need to contact in support of this lawsuit? I filed based on age, race, I am white, and sex. Please advise! Thankyou!

    I, too, am one of those women who are afraid of losing my job due to age. I have 10yrs. with Walmart and currently, in my store, they are “cleaning house”. I, along with many other older associates, feel they are phasing out the older ones who cost the company money in insurances and retirement benefits. They put more work on the older associates in hopes they will not be able to handle the pressure and quit. I have a retired gentleman in his upper 60″s who has been in a dept. since he has been there now forced to work in grocery on o/n’s and he is quickley thinking about quitting. He has gone to mgt. and they don’t care. Another female associate has applied for a dept. mgr. position for almost 2yrs. and recently acquired the position only to find herself everywhere except at that position. I have, recently, found those male associates who have just been hired are making close to what it has taken me 10yrs. to make. I say, good luck to all involved and hope the family of Sam Walton realizes the mistakes they are making and take necessary steps to compensate and return to the old fashion values that Mr. Sam founded his company on. Money is not everything! walmart cheer states, “who is number one” (the customer) “who’s store is it” (my store”). Neither is true anymore! Good luck and may God and the lawyers know to do the right thing by Sam Walton!
