Subaru Class Action Settlement In Subaru Odometer Class Action Lawsuit

If you purchased or leased in the continental United States of America and Hawaii a 2002-2007 Model Year Subaru vehicle, may be entitled to an extension of your vehicle’s warranties, an extension of your lease contract or a cash refund as part of a class action settlement.

A class action settlement has been reached in a class action lawsuit pending against Subaru of America, Inc., Subaru Auto Leasing, Ltd., Subaru of Indiana Automotive, Inc. and Fuji Heavy Industries Ltd. (collectively “Subaru” or “Defendants”) in the United States District Court for the Southern District of New York (styled Peter A. Vasilas, Scott Diamond, Robert Kasindorf, and Paul Thomas, Jr. v. Subaru of America, Inc., Subaru Auto Leasing, Ltd., Subaru of Indiana Automotive, Inc. and Fuji Heavy Industries Ltd., Civil Action Case No. 2007-CV- 2374 (GBD)), alleging, among other things, that that the odometers in their Subaru vehicles overstated the mileage of the vehicle and that Subaru of America had breached the warranty and violated the Federal Odometer Act, according to the Subaru class action settlement notice.

The Subaru odometer class action lawsuit was brought on behalf of the following, unless otherwise excluded:

All persons and entities who either bought or leased in the continental
United States of America and Hawaii a Subaru vehicle, Model Years
2002-2007 (the “Class Vehicles”).

If the Court approves the proposed Subaru odometer settlement, Subaru of America, Inc. will extend by 5% the mileage-based coverage periods of certain warranties, extend annual mileage allowed by vehicles leased from Subaru Auto Leasing, Ltd. by 5%, and reimburse certain repairs and excess mileage charges.

The Court is scheduled to hold a settlement hearing before the United States District Court for the Southern District of New York, 500 Pearl Street, New York, New York 10007 on November 8, 2010, at 9:30 a.m to decide whether the proposed Subaru settlement is fair, reasonable, and adequate and should be approved

    This is a horrible settlement for most owners of these Subaru vehicles, as it does nothing to address the underlying problem for vehicles that are not under warranty, or the impact of the extra mileage on resale value. Given these are model years 2002 through 2007, most are already out of the time based warranty, and the 5% extension of the mileage based warranty won’t help. I urge Subaru owners to either object to this settlement or, if you do not benefit directly from it, exclude yourself. I noticed a few years after purchasing my Subaru that the speedometer overstates my speed by a few miles per hour. I only noticed it because I purchased a GPS, which exactly matches the speed of the other cars I use it in. I am guessing that is at the root of the odometer problem.

    I was very annoyed by this lawsuit . . . not due to the claim itself but due to the fact that I was “opted in” automatically. For me, notification of the class action suit should be made to the owners who can then act to “opt in” if they so choose. Spending my time and effort to write to the lawyers offices (both sides) to opt out just ribbed me the wrong way. Including peoples names in law suits without their consent just should not happen. The secondary reason for opting out is that I find no fault in my odometer readings. GPS or mile markers all read close enough for my satisfaction. A happy 07 WRX wagon owner/driver am I!

    the settlement should have included or reflected compensation for all of the time spent at the dealership/repair/service centers.

    Subaru is a negligent company. I have had nothing but problems with my 2005 WRX. Subaru needs to be held accountable for wrongdoing.
