LeadClick Media & B2Mobile Text Message Advertisement TCPA Class Action Lawsuit Settlement

If You Received an Unsolicited Text Message Advertisement, You Could Get Up to $100 from a Class Action Settlement.

A class action settlement has been reached in a class action lawsuit against LeadClick Media (“LeadClick Media”) and B2Mobile (“LeadClick Media) (collectively “Defendants”) pending in the United States District Court for the Northern District of California (styled Kramer v. B2Mobile, LLC, Class Action Case No. 10-cv-02722) alleging, among other things, that unsolicited text message advertisements were sent to consumers from the abbreviated phone number 77893 or that contained one of the website links listed below by or on behalf of the Defendants and that Defendants purportedly violated the Telephone Consumer Protection Act TCPA because consumers did not consent to receive these text message advertisements, according to the LeadClick Media & B2Mobile Text Message Advertisement TCPA class action settlement notice.

The Court reportedly decided that everyone who fits this description is a member of the LeadClick Auto Class:

Anyone in the United States and its territories who, from January 1, 2008 until July 29, 2011, received an automobile-related text message from Short Code 77893 or an automobile-related text message containing one of the website links that was transmitted by or on behalf of B2Mobile and was sent without the recipient’s prior express consent.

The Court also reportedly decided that everyone who fits this description is a member of the B2Mobile Class:

Anyone in the United States and its territories who, from January 1, 2008 until July 29, 2011, received a text message from Short Code 77893 or a text message containing one of the website links that was transmitted by or on behalf of B2Mobile and was sent without the recipient’s prior express consent.

Defendants have reportedly created two Settlement Funds totaling $12.2 million, made up of a $10 million LeadClick Settlement Fund and a $2.2 million B2Mobile Settlement Fund.

If you are member of the LeadClick Auto Class or the B2Mobile Class, and the Court gives final approval to the Settlement, you may be entitled to receive up to $100 (payment will reportedly depend on the total number of valid claims that are filed and the Class is reportedly estimated to include approximately 47 million Class Members).

If the amount required to pay all claims made by the LeadClick Auto Class or B2Mobile Class exceeds the amount available (after paying fees and expenses in each respective Settlement Fund), then each Class Member who filed a valid claim reportedly will receive a reduced share of that Settlement Fund and if the reduced share is calculated to be less than $5 for a member of either Class, then all money remaining in that Settlement Fund will be paid to one or more charitable or non-profit organizations.

The Court will reportedly hold a Fairness Hearing at 2:00 p.m. on January 26, 2012 in Courtroom 2 of the Ronald V. Dellums Federal Building, 1301 Clay Street, 4th Floor, Oakland, California 94612 to consider whether the LeadClick Media & B2Mobile Text Message Advertisement TCPA class action class action settlement is fair, reasonable, and adequate.

    I think they sent me the text trying to get more buisness knowing that I not able to receive as much money as they say. Then also tryiing to scam people out of their money. Getting peoples hope up for something they can’t give them. They might even be trying to get other people information to use for other reasons.

    I received an email from this website just today. I can’t understand what they are still in the process of trying to “scam” people. They should be completely shut down and not allowed to solicit from anyone. This just doesn’t make any sense to me. I know absolutely nothing about them and never tried to contact them.

    I think that, if more of these types of actions were taken, maybe a lot of these” scammers” would go away.They need to go to jail, that’s what really needs to happen. Some stern and definite action needs to be taken to , send a message that, this type of activity will not be tolerated. I receive phone calls from strange numbers, numbers that you can not call back, threats, and god only knows what else. I’m so tired of this. The internet is not our friend, and in some ways, I feel that the internet as caused a lot of crime that we did not have to be subjected to before. Phony email addresses and the list goes on.
