T-Mobile Customer Files Class Action Lawsuit Complaint Against T-Mobile Over Alleged Data Caps or Limits On T-Mobile’s Unlimited Web & Email Data Plans.

A class action lawsuit has been filed against T-Mobile (“T-Mobile” or “Defendant”) in the Superior Court of the State Of California for the County of Yolo (styled Trent Alvarez v. T-Mobile), alleging, among other things, that T-Mobile markets its Unlimited Web & Email plan as providing an “unlimited” amount of data and allegedly offers T-Mobile customers discounts on new phones if the customer signs a contract, but then caps data use once T-Mobile users are locked into a cell phone contract, according to a class action lawsuit news report.

    tmobile has the worst support I’ve come accross in 62 yearas. They’re also theives and liars. My wifes “free” upgrade phone cost us a $18 upgrade fee. they never told us that just put it on the bill. been with them 6 years and have never been charged that before but now they just tell mee tough and pretend that thats the way it always been, I hate liars and hope they go out of business

    T Mobile has charged me about $400 in web access on my daughter’s line in which i have never authorized. I’ve been a customer with them since “2001”and this is how the treat their customers. I already pay $180 a month on 3 lines as if that isnt enough. Not to mention they have been charging me an exra $3 for a tetris game that i was not aware of for the last 6 months when i realized it i called them and they were suppose to remove the game, however i just found out im still being charged til this day. Every $ add up. Their customer service reps are rude and not very helpful at all. Are there othere customer like myself whom is getting cheated by TMobile. Please advise.

    I have been w/Tmobile 4 over 12 years and added my 19 yr old son 3/18/2009:I ordered unlimited internet for my line aprx. JULY 2009, and told the agent that I NEEDed the best internet and phone because I was discontinuing my home service and solely using my cell for everything. I was told I was getting the best 3G web service available, and it was UNLIMITED!I am toward the end of my billing cycle and my browser was so slow that it is ridiculous, I thought my phone was broken so I tried to use my Google Maps GPS to find the cellphone repair store and the browser took over 30 minutes to load. I cant do my banking online. I was on hold 1hr the 1st time I called 611, I spoke with a rude rep, possibly named Kathyrn, who refused to let me speak with a manger, she placed me on hold to get a supervisor whom she advised me could not rectify the sittuation, while holding again, she just hung up on me and never returned my call. I could not go to the website. So I called again, held 37 mins. That time only to again be refused any reasonable solution, and would not allow me to speak with management, EIN 1244455 Roxanne and Bret EIN 1244276. Told Me that its unlimited So long as its not completely turned off. I received a text from tmobile “Free T-Mobile Message: Due to the amount of data you have used this billing cycle, your data speed will be slowed for the remainder of the cycle.” UNACCEPTABLE, COMPLETE DISREGUARD FOR ME AS A HUMAN BEING , let alone a loyal on time paying refferal giving client that I am. I started at Ten O’clock A.M. and its 8 PM and I still am not done. UNLIMITED STILL MEANS WITHOUT LIMITATIONS. That is what I pay for and that was how it was presented to me. This is the first I’ve heard that if I use 5 GB of data they make my browser so slow that I haven’t been able use it. UNLIMITED means it should work just as well now as it did at the start of my billing cycle. I am loosing money daily not being able to communicate, I’m loosing my sanity as well. Money is hard to come by these days, if they can advertise 4G speed, yet they refuse to fix my service, it is just flat out abuse. I am so frustrated, I just paid 60 dolllars for Match.com and I can’t even browse the site. I feel violated, disrespected, strong armed into a contract renewal just 4 adding the web, and I am so unhappy, dissatisfied, and insecure because my only means of communication, income, and family, banking, and even my spiritual I.D.M.R. class is via UStream and it doesn’t load either. I can not even listen to Pandora Satelite radio at the gym because it takes over an hour to respond after turning it on. The customer service reps said ” their definition of unlimited means it still works, not like it did at the start of the cycle, but eventually a page may load, but it could take hours. They refuse to give me quality service because I have reached a 5GB DATA LIMIT ON MY UNLIMITED SERVICE PLAN. I DO NOT WANT TO GIVE MY LOYAL BUSINESS TO T-Mobile any longer. The service is unacceptable, I want to be reimbursed for every penny I paid to t-mobile for the limited “unlimited internet service” I want out of the contract, I was fraudulantly forced into agreeing to in order to add the web. I am apauled that these companies get away with this. It is so wrong, I would like a trial by Jury, I will be obtaining council if I can find a probono attorney. The Public needs to be aware and warned of these misleading scams. I am so upset that this literally took my entire day. The Old dial up connection was faster. I Was never told that I would be punished for using my internet over 5gb, never was informed that they would make my service so slow that I wouldn’t be able to use it, but within some grey area because its not shut off completely, therefore they feel that their service still falls under the term UNLIMITED.       I read your comment about T-mobile. They are TOTAL scumbags! They have virtually no customer service anymore. When you call up anytime of the day or night you are put on hold for an hour or more. They cap internet speeds on our Blackberry to the point where the internet is completely unusable. You know they were just bought by ATand T for 39 billion dollars…don’t you? You need to file a complaint with your Attorney General of your state and the FCC. That’s what I’m doing! The more complaints they get the harder it will be for this merger to go through. It has not been approved by the FCC yet.

    I would need to speak with someonewho is handling the class action. I have filed a complaint with the BBB. I want to be reimbursed for every last penny that i paid for a fradulant service. I want to be compensated for not only the many hours I’ve lost waiting for pages to load, and reasonably compensated for the mental frustration, disrespect from T Mobiles reps. I feel like I’m imprisoned by a cell phone company. How is it that they advertise 4G speed, yet they can’t provide decent service to a 12 yr, loyal client! If they want to make it right they can give me 4G service, REALLY UNLIMITED at no charge, and an apology. I don’t know if i should consider the class action o r get a private attorney, because I’m sick of thirst cell companies strong arming you into a new contract , they wouldn’t have to do that if they provide quality service, and morals.       Any word on who to contact? I dont necessarily want tons of money, but at least let me out of the friggn contract without a fee. I did the math and at 21mpbs (slow end of 4g speeds, high end is 82mbps) you can achieve 5GB in less than 5minutes. of course you have to be downloading some serious data. Regardless why offer “unlimited” if it isnt. They kept trying to tell me it was unlimited internet “up to 5gb”. I tried to even negotiate bumping me down to 2g speeds, which they said they couldnt change the speed, of course i responded, “really? you had no problem dropping me down to 60kbps”. This is BS and they need to just drop the word unlimited. if 21mbps is a firehose, .06mpbs is slower than chinese water torture. let me know if you find a way to join the lawsuit, i want to help pay to get tmo to stop this… even though they are jumping the US ship.

        I need to know who to contact as well I am already going to file a complaint with the bbb and the fcc and who ever else I have too! I just got off the phone with a customer service rep who is trying to convince me that there is absolutely nothing that t-mobile can do or WILL do to provide better service or simply let me out of my contract with no fee. I have been a loyal customer for 6 damn years and I have hardly no service what soever where i live!!!! be it that its not tmobiles fault that I HAD TO MOVE. But at least they can try to help me fix the problem with their cell service!!!! My calls get dropped and then i have periods of no service at all!!! i am a stay at home mom with no car and 99% of the time no cell service!!! all i am asking is for t-mobile to let me out of a contract with no fees because i am paying well over 100 a month for a service that does not work for me!!! I have tried the hotspot! I have tried the wi fi! I have tried the land line that I still have and cant use because it decides on its own that it does not want to work I have purchased expensive equitpment because their customer loyalty department said it would work and I spent over 200 on these items for it not to work!!! I want some reimbursements here and I want them NOW!!!!! so please if you know who I can talk to to get some thing done let me know!!! I am looking up how to file a class action law suit against tmoblie for their horrible service!!!!! there is no way they are going to get away with charging me every month when they dont provide me with any darn services that I am paying for!!!!!

    I was told that I have reached my limit of 5G for the month by T-Mobile representative as the result I could not surf the web at a usual speed. Now I also was told that I need to monitor my usage in order for me not to exceed the limit next month on my unlimited plan. Tmobile is ridiculous and a scam artist company,

    i would also like in with this lawsuit. Why am i paying an extra 19.95 a month to tether my internet to my computer, only to have a 5GB cap so that after 4 days my computer is useless?? its rediculous.

    I would like to know what I could do to join in on this, advertising unlimited data then throttling it is B.S. That is one of the reasons I got this phone was to have internet on my computer also. I am NOT renewing my contract with T-Mo .

    P.S. a tip I found on another site if your data is throttled swich your data to 2g its a bit faster

    I was not happy with T Mobile the FIRST time they got me with this scam. I was counting the days until my contract was up when I got a call from T Mobile two weeks ago asking me to renew. When I had a very detailed conversation with the woman on the line about how I was not happy about the 5GB cap SHE ASSURED ME IF I SIGNED A NEW 2 YEAR CONTRACT IT WOULD BE TRULY UNLIMITED WITH NO CAP. I CHECKED AND RECHECKED AND MADE HER SWEAR UP AND DOWN IT WAS TRULY UNLIMITED. They got me twice!!!!! UGH ARE YOU KIDDING MEEEEEEE?????? Just got off the phone with them telling me too bad so sad for you, give us $200 and you don’t have to be our customer anymore. THIEVES AND LIARS! Unbelievable that they get away with it.

    I thought I was alone! I filed a complaint with BBB, spoke with Angela Beckett from the office of the president, been complaining ever since February 2011. It started with two $200 rebates that I was supposed to receive within 30 days and didn’t get for about four months, then I found out the hard way that my $30 per month internet isn’t truly unlimited. Ms. Beckett stated that if I used as much data as I wanted it wouldn’t be fair to other users cause it would slow them down. So my reply was, why are you selling a service that your network obviously can’t handle?
    I asked if due to this reason I may be released from my contract so that I may go with a provider that is truly unlimited in data access and she said she could not do that. Now it’s football season,i pay extra to have a mobile feature to watch the games when I’m out, but because of this cap I can’t even get on the espn website. Tomorrow I will file a complaint with the FTC. Please let me know how I could join this lawsuit! Thank you,

    I am outraged! T-Mobile scammed me into this “UNLIMITED” data plan. The 2nd day after my billing cycle began, I had a msg stating that I already used 2g! Really?!!! In two days?!! I called a rep, and she told me that I used 2g but she claimed that I need 5 GB and it will cost an additional $20.00. As of now I really and truly despise t-mobile!

    Here’s a good one for all of you. T-Mobile added 5g service to my Samsung 4g. My family took advantage of their unlimited data text 2gig offer for 2 phones at 49.99. Last month they added 5 extra gigs of memory. When I called them they told me we added this online at our My T-Mobile page…lie…. I told them we don’t even use 1 tenth of the 2 gigs. They went on and on reading a script that we did this. I told them we received no text notification on an account change and it’s not even in our History of account events. So what did the cs Rep do… they went over and repeated their script.
    Can we get a class action lawsuit but this time make an example out of their executive staff that write these scripts and snake like business practices.

    RIDICULOUS!!!

    Tmobile flat out lied to me about their broadband service from day one and I have fought with them and been lied to and taken through the ringer for almost the entire two years. I live in Washington DC and if there is a class action law suit I can join, please let me know. I have tons of emails and communications showing the exact nature of my entire deceitful, disruptive and dishonest experience with them.

    I have been a customer of TMobile for about 6 years now and lately since i agreed to purschase unlimited 4g service my bill has increased from 110.00 a month to $220.00, the customer service rep said it was because of the 4g . which is bull… I was told that my area only had 2g and so it was changed. I would just like to get out of my contract free. I promise you will all that is holy I will never re-sign another damn contract with them.. I would love to get in the law suit if there is one or will be one

    It doesn’t stop u from surfing the web but it does slow ur speed down To what is similar to the old dial-up internet. (Ex T mobile employee). The rep is suppose to inform u of this when the data plan or web connect is offered or added onto ur account.

    I have T-mobile as my phone carrier – I’m under contract until 2014 — if I quit before then they charge $200 for each line — so since January every month – my account information has been compromised – someone is ordering replacement phones in my name and they are not returning the damaged phones so my account gets charged – right now these extra charges equal $600 – basically being defrauded – Asurion is the T-mobile Insurance and that is how these phones are being ordered….They actually cancelled my account with Asurion & this is still happening – I want to get away from T-mobile w/o getting charged due to their lack of security & negligence – PLUS god only knows what other information they have obtained on me and my family….also how many others are they doing this too? do u know someone I can talk too?
