Volkswagen VW & Audi Sunroof Drain and/or Fresh Air Plenum Water Ingress Class Action Lawsuit Settlement

If You Purchased or Leased, New or Used, Certain Volkswagen VW or Audi Vehicles, Or If You Now Own Or Lease Certain Volkwagen or Audi Automobiles, Your Rights May Be Affected By The Volkswagen Class Action Settlement.

A class action settlement has been reached in a class action lawsuit pending against Volkswagen AG, Beteiligungs Gesellschaft MBH, Volkswagen Group of America (f/k/a Volkswagen of America, Inc.), Audi AG, Volkswagen Group of America, Inc. d/b/a Audi of America, Inc., Audi of America, LLC and Volkswagen DE Mexico, S.A. DE C.V. (collectively “Defendants”) in the United States District Court District of New Jersey (styled John Dewey, Jacqueline Delguercio, et al v. Volkswagen of America, Inc. et al. Case Nos. 07-CV-2249-FSH-PS and 07-CV-2361-FSH-PS (consolidated)) alleging that certain Volkswagen VW and Audi vehicles were susceptible to water ingress into the passenger compartment through sunroof drains and/or the fresh air plenum,  that such vehicles were damaged or were at risk of sustaining damages and that defendant failed to provide appropriate maintenance instructions to prevent or mitigate the effects of the alleged defects and pay for damages sustained, according to the Volkswagen VW & Audi Water Ingress Class Action Settlement Notice.

The Volkswagen VW & Audi sunroof drain and/or fresh air plenum water ingress class action settlement reportedly provides, among other things, that if the settlement is finally approved by the court, the Defendants will provide certain members of the Settlement Class with payment for specified repairs and water related damage from a reimbursement fund of $8,000,000.

Volkswagen settlement class members who currently own or lease a settlement class vehicle will receive Revised Maintenance Schedules recommending inspection (and cleaning if necessary) of the plenum drain systems, and sunroof drain systems (where applicable) every 40,000 miles or every 2 years, whichever comes first and additional reminders that these areas should be periodically checked for and kept clear of accumulations of foreign matter and debris.

Some members of the Volkswagen class action settlement class will be eligible to have their sunroof drain systems modified and inspected through an instituted Service Action that addresses water ingress issues.

Your rights may be affected by the proposed Volkswagen class action settlement if:

(1) you ever purchased or leased, new or used:

• 2001- 2007 Volkswagen New Beetle equipped with sunroof (VIN below 3VW—1C-7M514779)
• 2001-2007 Volkswagen Jetta Sedan or Wagon equipped with sunroof
• 2001-2007 Volkswagen Golf, Volkswagen GTI equipped with sunroof
• 1999-2005 Volkswagen Passat.
• 1997-2006 Audi A4 B5 & B6 Platforms (including Cabrio, S and RS versions).
• 1998-2005 Audi A6 C5 Platform (including Allroad, S and RS versions); or

(2) you now own or lease:

• 1998-2000 and 2007-2009 Volkswagen New Beetle equipped with sunroof (VIN 3VW—1C-7M514779 or higher)
• 1997-2000, and 2008-2009 Volkswagen Jetta Sedan or Wagon equipped with sunroof
• 1997-2000 Volkswagen Golf/GTI & 2008 – 2009 Volkswagen Golf/GTI equipped with sunroof
• 1997 & 2006-2009 Volkswagen Passat equipped with sunroof
• 1998 Volkswagen Passat
• 2004-2009 Volkswagen Touareg
• 2005-2008 Audi A4 B7 equipped with sunroof (including S and RS versions)
• 1997 & 2005-2009 Audi A6 C6 platform equipped with sunroof (including S & RS versions)
• 1997-2009 Audi A8 (including S versions)

A final fairness hearing is scheduled to be held before Judge Patty Shwartz on July 26, 2010 at 10:00 a.m., to determine, inter alia, whether the proposed settlement should be finally approved.  The class action settlement hearing is scheduled to take place at the Frank R. Lautenberg United States Post Office and Courthouse, 2 Federal Square, Newark, NJ 07102, Courtroom 10.

February 2014 Update:  On February 12, 2014 the Third Circuit Court of Appeals issued a decision affirming the district’s courts’ approval of the parties modified settlement agreement which placed all class members on equal footing and which awarded class counsel a little more than $9 million in attorneys fees.

    I am an owner of a 2002 GLX VR6 Volkswagen that has been having problems since i first got it; with the shorting out of batteries, two altenators and a wire harness. And now im stuck with a car will all of the lights on, on my dashboard like a christmas tree.
    I beleive this is all caused by a water leakage from the sunroof on the driverws side that went into the main wires to the car that controled a lot of the electrical components.

      this sounds familiar…. on my 2002 GLX VR6 + Timing chain broke…. so its a beautiful SHELL of a vehicle….

      Did you find any satisfaction? VW Corporate was contacted after we found water in my wiring harness leading to the battery in the backseat. We too had severe electrical problems and batteries replaced like crazy.

      Got a $900 dealership bill in Fargo ND (200 miles from where I live one way) and pulled out of the lot and noticed my gas guage and temp sensor light was out. Turned back and they were closed for the day; so upon my return to Bismarck, I wrote VW Corporate a nastygram….. took back the car to Fargo and they found the waterleak source. By the waterpump it emptied into the wiring harness and had coolant in the harness….. WTF???

      German engineering is MISSING in this worse than YUGO or FIAT

      Then a few tanks of gas later the timing chain fails. Sheesh….
      I want to get these VW bastard’s. I have owned Porsche/Audi’s and several Jetta’s and this one has more $’s spent on repairs than all of the others combined in 30 years.

      Please let me know if you have any ideas.

    I took my 2006 Passat in today and they are trying to charge me $45.00 to remove some debris. WTH!?!?! $45.00!? Should we really be paying this?

    WATER DAMAGE CAUSED TRANSMISION MODULATOR TO MALFUNCTION RESULTING IN $5800.00 REPAIR BILL PAID BY sTATE fARM BUT COST ME $500.00 DEDUCTIBLE WHICH i WOULD LIKE TO RECOVER

      In 2008, my vw took in water via the sunroof tube, soaked the TCM and wiring harness? Initially the local auto shop replaced the TCM, for $2,000. However, the flooring stayed wet and there were problems shifting. The vw dealershiip said to contact insurance and ultimately the transmission had to be replaced. I am submitting claims for deductibles, rental car, etc. I spent a lot of time and $$ getting it fixed. I hope to recup.

        I owned a 1999 VW Beetle for 20+:years and I spent too much money trying to stop water from entering the driver side of my car around the dashboard and floor, it made me sick both physically and mentally.

    The legal fees in the proposed settlement are $30Million. The proposed settlement is only worth $8M. Why should the lawyers be paid so much? I urge all members of the class to send a letter of objection to the judge. Lawyers are getting rich off of the backs of car owners, and this will raise prices for all of us.

    I am finding that I am in the same boat as so many. I started having problems with my 03 Passat within 1 week after purchase. I’ve had battery, brake, light, engine leaks, valve cover leaks, MAJOR water leak and several other things go wrong with this car. Right now alone I need over $3000 in repairs and not to mention that due to the water damage I have been told my car is considered a total loss. And I still have another 2 years on my loan! I contacted VW of America and they continue to tell me that there is nothing they are willing to do because I am out of warranty. I think the lawsuit is definatelty justified as VW clearly takes no responsibilty (google a little more and you will find quite a few other unfortunate VW owners). However I would like to know if I join this suit now can I still later turn around and sue for all the issues that have taken place and the fact that VW misrepresented information to me during the time of sale. Or would that be considered like a double jepordy type thing? I am worried that if I join I may get nothing from the settlement as I could not actually afford to have the water damages repaired (have to be able to provide receipts right?). And then I might actually be setting myself up to not be able to take further action later should I find an attorney. Any suggestions anyone?

    All class members should read the notices they received carefully. If you do not opt out of the class, you will waive any and all future water damage claims you may have. Not understanding this now will not help you later even if you could prove to a magistrate that you ARE TOO STUPID TO UNDERSTAND HOW A CAPS LOCK KEY WORKS. This class action is representative of the breed – the class members get diddly, the lawyers for the class get rich and the manufacturer endures some pain to get rid of the problem forever. The proposed settlement is, in my view, a joke. First, reimbursement is offered only for repairs of the TCM – which sits on the passenger side floor. CCM’s which sit on the driver’s side floor, get wet due to this problem and then die. The CCM is very expensive. Can you get reimbursed for the CCM ? Apparently not. Note as well that VW is offering no remedy for underlying problem – i.e. modifying the drains or cleaning them at their expense – all they are doing is giving you a little addendum to your owners manual saying YOU should pay to have the drains cleaned/checked more often. My view is that class members should object or opt-out.

    I OWN A 1999 PASSAT, IT HAS NO SUNROOF, BUT THE FLOOR IN THE RIGHT SIDE OF THE BACK PASSENGER, GET FLOODED IN THE WINTER. IT GETS OVER A GALLON OF WATER. COULD THIS BE RELATED TO THE SAME PROBLEM?

    I have a 1998-1999 Jetta Wolfsburg 4cyl 2.0L 5 speed which I love with all my heart it is paid off and the last gift my dad ever gave me before he died however in the 6 years that I have owned it, he bought it used in 2003 and it had two prior leasors anyway I have put 3 times the $4,995 he paid for it in repairs it had 64,000 miles on it now it has 148,000 at 85,000 tranny went out due to 3 broken motor mounts due to volkswagens excessive vibration which apparently cause the catalytic converter to fail and the heat shields to rattle like you are parked on top of a helicopter and the exhaust to shake free of its clips etc… Not to mention the windows falling down every few miles and the bad regulators etc… what about that kind of water damage and the fact they will not recall the regulators on them and those crudy clips in the window kits. My jetta after the tranny went out started leaking water at the headliner and the visors would drip on me also my floor mats would always be wet as would I when at carwash or rain I did not ever think to associate this with the wiring problems I have had recently my catalytic converter wasreplaced and then it caused the CEL to illuminate and now no matter what I repair it is gutless gas hog money pit and I have just had a new distributor and timing belt all belts water pump, air filter oil change plugs and wires and rotor and blah blah blah after the distributor was replaced actually only need the camshaft position sensor but got talked into a distributor and then 2 days later barely passed smog before the check engine light was on again and the trouble codes read Mass Air Flow sensor it idles erratically and has no power and I cant believe they get away with charging so much for parts on what they have sold so many bad ones VW’s I mean they refuse to own theyre crap and we are made to suffer and the lawyers arent oing any one but themselves a favor us little folks always get the short end of the stick I also have radio volume knob issues and bad suspension issues and have had lots of large dollar problems even with low miles originally on it I now have no air conditioner due to my compressor going out and last summer after I got an A/C recharge the car stalled at 65 mph on a busy Fresno FWY with my baby in the car and the warm A/C blowing all the lights came on and I was stalled I turned the key it started and I turned off A/C and it was fine until the next time I turned A/C on again it did the same thing. After the new water pump it worked for a day and then warm air again. another recharge and nothing but warm air all this money and it solves nothing it goes around and around and one thing leads to another she gets to point A and B but it is very stressful with 107 degrees in fresno no windows staying up and never sure if you will be stranded and then broke after repairs this last go round I was without my car for 8 weeks 3 shops later my CEL is still glowing and I now dread the compressor will cost around $345.00 then who knows what is next have to do windows if fix A/C and then brakes and rotors and maybe some body stuff as I have old body stlye. I used to think INKY my black Jetta was at least sporty looking and cute but now with sticks holding the windows up and no rubber on the doors any more and the 4 rusty rotors and oxidising paint that she sounds looks and drives like a nazi beater car. I will drive it till its end though and never ever own another Jetta even as a gift. wow I wish that made me feel better. Thanks for listening.

    I have a 1999 beetle and have had water draining in the passenger side. I have tried to clean the drains but I’m having difficulty. Today I pulled the glove box off because the ac won’t run on #4, my resistor has shorted out and corroded, the resistor had water just sitting in it.

      Hi everyone– hope thisthread is still active. I am having soooo many crazy problems with electrical, andbattery shorting, , locks and windows, and mechanical, lights coming on, and not going off. major water on my floor, moldy midewy smell. I know Imust obviously have this Water leak problem but have just ealized in the past months that is what is going on, and seems the law suit- or eligibility has past. I ko hae mao epairs. My car is currently completely dead affter thepast year of continued stallingout and battery shorting out and water ++++++ ETC ETT ETC!!! Completely dead. I haven’t brought it in yet- I need to tow it, but not sure how to handle. Or if I am able to get repairs covered. My repairs ould go WAAAAYYY BEYOND what I have read the settlement is offering– to clean the filters and maybe carpeting replace! SERIOUSLY!! Great– but that is just the tip of the iceburg. What about all the other damage!!!??? And – again- not even sure if I am too late for the deadline to et even the tiny bit offered in the settlement covered! OMG! Volkswagon is underhanded and SINFUL! Anyone w/ any info– Please please let me know, or if we can join together? It is now April, 2011. Worried I am stuck up the creek without a paddle- and they won’t do anything for me and the rest with ajor cost repairs, not to mention- having to rent cars and now, no car!!

      dada…The website is down when I tried to check the lawyer’s website. The “for real, for real” final fairness hearing to disperse funds is scheduled for November 9th, 2012….but I think that it was scheduled to be held in the District Court of New Jersey (ugghhh)…Sandy might delay the final outcome here….due to water damages (imagine that). Let’s hope we all start getting paid before Thanksgiving!!

    Can someone please advise? I have an Audi A4 ’03 which just got flooded…the “plenum” area (never heard of that before) and resulted in a $840 repair bill (from Audi). According to notice, I am a month too late to file for a claim. Damage happened 8/23/10. Claim cut off date was 7/23/10. I Express Mailed papers and forms to “Ingress Administrator” yesterday (at a cost of $18.30!).
    Ques: Will they honor my claim late?
    Will I get full reimbursement on my repair bill?
    Where can I go to for help? Thank you. P.

      The courts extended the claims deadline to November 28th, 2012, I think, but the final fairness hearing to disperse funds under the new modified settlement will be November 9th, 2012, unless Sandy Supa Storm slows this process down. Look for more legal mumbo jumbo, and pray you get paid before the end of the year. I have been waiting since 2010 to get paid…(the lawyers have gotten most of their fees already)

    I HAVE A VOLKWAGEN JETTA THAT HAS HAD THE SAME PROBLEMS…WATER DAMAGE ON THE PASSENGER SIDE. SEEMS TO HAVE SHORTED OUT MY ELECTRICAL. MY BILL SO FAR IS $1200.00….MAY BE MORE BEFORE I FINISH. HAS LESS THAN 30,000 MILES ON IT AND STILL AT THE REPAIR SHOP. IS THERE ANY RECOURSE I CAN TAKE??

    I have a 2001 New Beetle. The mystery of the pond in my passenger compartment was finally solved by finding it online. I have removed all the trim in my car, made sure all the hoses and tubes from the sunroof drains are clear and attached and my car still floods with water every time it rains. My car now closes it’s own windows, locks it’s own doors and turns on it’s own alarm. Very inconvenient since my ONE door lock will only lock with the key but not unlock. I really enjoyed having to climb in through the trunk at 3 a.m. when my car suddenly decided to freak out on me.
    Also, I’m curious why the registered owners of VW’s ( at least in my case) don’t get notified of class action lawsuits and recalls? I could have had my now disconnected heater core replaced and have heat now if I had been. How do you get notified????

      I have a 2002 New Beetle with windows and locks that have minds of their own……
      From what I have found, the dealership ( Pignataro in my case ) will do ONLY the bare minimum as repairs go.
      If you, like myself and Mary have the same issue’s we need to all get together and add continued affects clauses to this lawsuit, or begin another.
      I have called the VW 1-800 # and recieved all sorts of answers none being the same.
      My drivers side window goes up and down on its own, the sun roof will go up into the tilt position, the water runs down the back side windows in the rain….Etc Etc, But “This can not be from the front drain leak” is the answer i get.
      I also have mold growing all over the car and have been told that it is impossible for this to be caused by this drain leak issue.
      Really? come on people!!! Water in a car will cause mold through out!!!!
      I finally had to make the service manager look like an idiot to get them to do the repairs, but they still do not think they have to clean the mold.
      There are also issues around the timing belt, the breaking system, the CAT Converter, break lights, head lights, and the electrical system in general.
      I was not notified of the lawsuit either….FYI.

My MAJOR problems, and my awareness of the cause is now TOO LATE for the settlement it seems. I have a 2002 Passat with sunrof. MAJOR leak. My car is absolutey dead, and the floors are soaked, and looks like black mold on the carpeting, and SMELLS like disgusting mildew! Here is the original message I posted:

    I have a 2002 volkswagen passat GLX . My car have water in the rear passenger floor every time it rain and it makes all the lights go off in the car. Also, the check engine will not go of along with the brake light.

    I have a 2001 Audi Allroad equiped with sunroof. After the last storm that came through, the floor board on the left side, front and back, was saturated with water. After close inspection, I found the water penetrated the auto body through the sunroof. The proper design of a sunroof does not rely on the moveable sunroof cover to seal out water, but rather the water which comes through the edge of the glass drops down into a tray built into the roof around the sunroof window. The water collected in this tray is then diverted through tubes routed to the exterior of the car. The tubes are mounted in the tray at each front corner. The tray in my car is cracked along the front edge, on the left side, extending about half way across. This crack is visible to anyone who opens the sunroof and looks carefully along the edge. I may also look “normal”, like a seam, but it is not! Water penetrates through the crack, and then runs down into the interior of the car, reaching its destination on the floor. The water may pass through sensitive electrical components as it passes down, and this can cause further damage. Inspection for the crack is critical, and not caused by debris collecting in it. The crack can be seen better when someone lifts up on the sunroof frame from the inside of the car, moving it up and down. Then any crack gap can be seen from its opening and closing with this hand motion. The use of plastic for this tray is the Audi design defect in question, as the use of metal (e.g. aluminum) would have prevented this cracking. Plastic was a cheap choice of material to design this water barrier, and an especially poor choice when considering the expansive forces in freezing temperatures. It is theoretically possible to use a silicone sealant to seal up the crack, but the movement of the sunroof frame due to vibrations typical for aggressive road conditions would force the glue to crack from the up-down motion. A long-term solution with a sealant is therefore questionable. I surely wish quality in design trumped cost by car manufacturers, especially those high-end cars!

    HA, I HAVE A 2002 VW BEETLE THAT HAS BEEN GETTING MAJOR WATER IN THE BACK PASSENGER SIDE FLOOR FOR OVER A YEAR, LOT WORSE LATELY IT POOLS UP AND RUNS UP UNDER THE FRONT SEAT ON MY FEET. I HAVE BEEN GETTING MOLD ON THE LEATHER SEATS. I CALLED THE VW DEALERSHIP IN KINGSPORT TN AFTER A FRIEND TOLD ME SHE HAD READ OF A RECALL. THEY INFORMED ME THERE WAS NO RECALL. AFTER JUST FINDING THIS ON THE COMPUTER I AM MAD. WHAT SHOULD MY NEXT STEP BE?

    I have a 2001 Audi A6 C5 4.2, and had same problem 3 days ago, I didn’t know anything about it until I starting browsing around, I am curious to find out if this could be covered by the Audi Dealer so I can take it and get it fixed. I was drying out the car today, my next step is to remove the carper and dry it as much as I can. Does anyone know if we are supposed to register for this lawsuit? what are we supposed to do in the mean time? should we contact Audi Dealerships to find out if there is a recall on this issue? o does anyone have information on that??

    1999 Audi A6 Quartro Avant, front pass floor always wet after a rain storm. Transmission is now stuck in third gear and Im being told its due to water damage to the computer which is located in this area. Thanks Audi for making such an expensive piece of Sh……..

    I just found this website an I think I’m part of this settlement. I have a 2000 Jetta and it hasn’t leaked from the sunroof however it has leaked from the firewall or some where close to it on the passager side every time it rains. The leather seats etc. are now moldy and the car stinks of mold when the car sits for awhile. I haven’t had this repaired as I fear it will cost a lot to repair. Any thoughts on this?

    If there are any disgruntled Canadian VW owners out there, we’re trying to gauge the potential of a class action against VW Canada. Gross leakage from our roof window has resulted in defects for diagnostics of several hundred dollars and one VW dealer estimated over $1100 more with no guarantees they couldn’t cure the problem. They suggested the ingress was via the windshield. This is a known problem that VW Canada or shying away from. The diagnosticians they had look at our car are either incompetent or, more likely, trying to divert attention away from the real cause, the roof window. It took a local body shop only an hour or so with a hose to get to discover the source of the leak.

    The black box in our 2005 Passat wagon seems to be shot as a result of water ingress – airbag warning light on constantly, engine defect warning light comes on and off intermittently and the gear shift stops working on tiptronic or auto.

      l have every intention of taking audi to court over their design fault and subsequent water damage to computers. l also intend to use the social meadia further, eg facebook, twitter, produce a damning video with humour so that it goes viral big time and then see if the audi social media rep responds

    Leaky sunroof… should be a major recall on VW sunroofs… this is a manufacturing defect… not the owner’s fault!!
    The other major issue is the lack of communication received about the leaky sunroof class action & the resulting settlement should be for any VW/Audi vehicle sunroof leak — no matter when the work was performed~~! The ONLY notification I received regarding the issue was a letter and manual page from VW regarding the 40K mile service change to inspect/clean the sunroof drain in May 2010.
    Immediately took my 2005 Jetta sedan into the dealership, which they now say they didn’t perform any work on. But somehow, where had no leak problem before, I now have had water leaking from the sunroof since the dealership visit. The headliner has even started to come down due the water leak. Called the dealer, says they’re not sure what they are responsible for since they didn’t perform any work & there was no recall notice.
    Called the settlement administrator number to ask about what to do & why had I never received notification about the class action. She said that they have record that I should have received notification sometime around May 2010 in order to file a claim. But the catch is that a refund would only have been eligible if the work was performed prior to that time period. Stated there was nothing she could do for me!
    I will never own a VW again!

    The sunroof is NOT the only water leak problem with VW’s!!! How about the inner door panel seal which is faulty? I believe that has been my problem ALL along. (never realized water on the door sills is not normal) I have had this problem from day one, and recently cost me $4000, and the problem is not even fixed yet. More thought should have gone into this class action suit, and I believe another should be started.

    I have a 2010 Jetta Volkswagon Wagon with a sunroof that is leaking bad (South Florida weather) because of drainage issue. Because of the water flooding into the spare tire section and inside the car, the electrical computer is damaged and the dashboard warning signs are always lite up. Took the car to the dealer and after a $550 charge the dashboard continues to lite up. More so, the mold smell inside the car is unbearable. The dealer wants to charge me another $400 to take care of the smell. Has anyone experienced the same issues? Are we still on time to join the class action suit? Do we have any recourse?
