Tavenner v. The Talon Group | First American Title Insurance Escrow Wire Express Fee, Reconveyance Fee & Recording Fee Class Action Lawsuit Settlement

The Talon Group, A Division of First American Title Insurance Company (“Talon Group” or “First American Title Insurance” or “Defendant”) has reportedly agreed to a proposed settlement of a class action lawsuit against The Talon Group in the United States District Court for the Western District of Washington at Seattle (styled as Tavenner v. The Talon Group, Case No. C09-1370RSL) alleging, among other things, that Talon Group | First American Title Insurance overcharged its customers for wire express, reconveyance, and recording fees in connection with escrow services in real estate transactions in the State of Washington, according to the The Talon Group | First American Title Insurance Escrow Wire Express Fee, Reconveyance Fee & Recording Fee class action settlement notice.

According to the court’s preliminary settlement approval order, Talon Group | First American Title Insurance Escrow Wire Express Fee, Reconveyance Fee & Recording Fee  settlement class reportedly includes, unless otherwise excluded:

All persons who: paid a recording fee for recording any document, including deeds of trust to Talon where the recording fee was in excess of the actual cost to Talon in a Washington real estate transaction that closed between August 18, 2003 and December 16, 2013; or paid a wire/express fee to Talon in a Washington real estate transaction that closed between August 18, 2003 December 16, 2013; or paid a reconveyance fee to Talon where the old deed of trust was reconveyed by the former lender within 60 days after completion of the escrow in a Washington real estate transaction that closed  between August 18, 2003 and December 16, 2013.

The Talon Group | First American Title Insurance Escrow Wire Express Fee, Reconveyance Fee & Recording Fee class action settlement provides for the payment of a monetary award to each member of the class for the wire express, reconveyance, and recording fees they paid, up to a total of $1.275 million. Thus, Settlement class members who submit claims (no later than February 28, 2014) may be eligible receive an award of up to $10 for wire express fees paid, $5 for reconveyance fees paid, and $35 for recording fees paid for recording a deed of trust (and $5 for recording fees paid for recording other documents). Moreover, those who paid a reconveyance fee and submit a claim will also receive a $50 coupon from First American Title Insurance Company for escrow services.  Claim forms can be obtained online at www.talonnotice.com.
