Sprint Class Action Settlement of Barkwell v. Sprint Surcharge Lawsuit

If you are a current or former Sprint account holder of an Individual Liable Account with Sprint for wireless services and were charged or subject to certain Sprint Surcharges, your rights may be affected by the Sprint Surcharge Class Action Settlement.

Sprint class actionSprint Spectrum L.P., Sprint Communications Company, L.P., Sprint Nextel Corporation n/k/a Sprint Corporation, Inc. and Sprint Solutions, Inc. (collectively, “Sprint” or “Defendants”) have reportedly agreed to a proposed settlement of a class action lawsuit against Sprint in the United States District Court for the Middle District of Florida (captioned as Eric Barkwell, et al., v. Sprint Communications Company, L.P., et al., Case No. 4:09-cv-56) alleging, among other things, that Sprint improperly disclosed, assessed and collected certain monthly surcharges to defray costs associated with government programs and network connections, according to the Sprint Surcharge class action settlement notice.

Who Is Included In The Sprint Surcharge Class Action Settlement?

The Sprint Surcharge settlement class reportedly includes, unless otherwise excluded, all persons in the US and its territories, who are or were parties to an Individual Liable Account with Sprint for wireless services between January 1, 2007 and October 8, 2013 and who were charged or were subject to Sprint Surcharges on any or all wireless lines of service.  The Sprint Fee Notice Sub-Class includes persons holding Individual Liable Accounts who were subject to Sprint Surcharges and did not receive notice of Sprint Surcharge increases.

What Settlement Benefits Does The Sprint Class Action Settlement Provide?

The Sprint Surcharge class action settlement will reportedly provide certain prospective relief to all settlement class members relating to various disclosures, and certain cash or non-cash benefits to the Sprint Fee Notice Sub-Class. The cash benefits to the subclass under the Sprint Surcharge settlement consists of a $1 payment in the form of an account credit or a check. The noncash benefit consists of a calling card, a 30% discount on certain Sprint purchases or a waiver of the Sprint activation fee.  Sprint Surcharge subclass members must file claim forms to receive these benefits.  Claim forms can be filed online at sprintsurchargesettlement.com/FileClaim.

    I HAVE A COMPLATE I WAS TOLD I CAN NOT TRANSFER MY NUMBER UNLESS MY ACCOUNT WAS PAID OFF SO I DID THEY CLEARED ME TO TRANSFER MY NUMBER OVER TO VERIZION AND THAT WAS DONE OCT 10,2010 THEN SIX ONTHS LATER AFTER MY BILL WAS PAID AND MY NUMBER TRANSFER OVER TO VERIZION THEY CALLED SAYING I OWE THEM $249. 00 i ASKED HOW IS THAT THEY SAID YOU DIDN’T PAY YOUR BILL I EXPLAIN YES I DID BECAUSE IF I COULDN’T I WOULDN’T HAVE BEEN ABLE TO TRANSFER MY NUMBER OVER TO VERIZION TRUE THEY SAID TRUE SO NOW AM IN THE CREDIT BURE FOR NO PAYMENT ON A BILL I PAID IN CASH ON.

    I disconnected my service after 1 week in service w/ Sprint because I’m not satisfied w/ the internet service,so I returned the spare phone & asking to give me back all the fees & activation but I never receive anything instead the sent me a bill from a collection agency that I owe them $387.11,so I went back to ask why I got a bill this,I told them that I disconnected my service already ,I did complained twice to one of Sprint store customer service & they said it did’nt went through.I have all my proof w/ me & account info.And also while I’m w/ this company few years before this happen coz I re-open an account again they refused to unlock my phone since nobody can unlock except them,the customer service was unsatisfied me.

    I WAS WITH SPRINT FOR A NUMEROUS OF YEARS AND DURING THIS TIME. I RECEIVED HORRIBLE SERVICE FROM THEM I HAD A VERY LARGE DROPPAGE OF CALLS AND IT WAS TERRIBLE BECAUSE AT TIMES I WOULD BE ON THE PHONE TAKING CARE OF SOME IMPORTANT BUSINESS AND THE CALL WOULD DROP IN THE MIDST, WHICH WAS VERY STRESSFUL. SO THEY HAD ME TO PURCHASE SEVERAL NEW PHONES THEY SAID THAT THIS WAS THE PROBLEM. BUT IT WAS NOT THE PROBLEM AT ALL.SO, I REMAINED WITH THEM UNTIL MY CONTRACT WAS ENDED AND I WENT TO ANOTHER CARRIER. ALSO THE BILL AT SPRINT WAS CONSTANTLY RISING AND I DID NOT KNOW WHY NOW I KNOW AND THANK YOU FOR THIS CLASS ACTION.

    I’m wondering why there is nowhere on the supposed sprintsurchargesettlement.com website to submit the claim form. After a couple of hours navigating through several upon several links I finally found the claim form and it states that it highly recommends submitting online or by mail. THERE IS NO SUBMIT BUTTON TO CLICK ON NOR IS THERE AN ADDRESS. I have called the phone number they’ve given several times as well and there is no actual person you can talk to it’s only a recording spewing out the same website for information?????????
    Com’on how real is this supposed SETTLEMENT or is just as BOGUS as it seems?

    We used Sprint services since 2002 until 2013 when, after temporary move to New Mexico, we could not use the phone due to excessive drop page of calls while we were overcharged for excessive use of minutes that,
    in fact, did not happen. I cancelled, or so I thought, Sprint by the end of July (after two months of almost no ability to use the cell phone). Yet, when we transferred the number to Verizon, Sprint after several months sent us a bill for “service” despite the fact that they did not even have a functional tower in the NM area. Since then, they sent our account to collection agency that continues to call multiple times/day. This is the last company we would recommend to anyone, as they care not about service, but about money,
    We asked about name of any supervisor or someone from corporate offices, but were denied this. Sprint continues to deny us any adjustment to August service although we paid excessive charges for two previous months while unable to use the phone.
    The only “advice” we get is to call the collection agency. Certainly there are many customers with similar experience and $1 for damages could not cut it.

    I transferred my line (s) from TMobile due to their low ranking and loss of service. In 2010, I found and have been with Sprint since. I traveled overseas last spring (2013) and activated my phone to use while abroad and was denied service overseas and was still charged by Sprint. Since August 2013 I have been having major issues with Sprints data service, and lack of reception (due to my hand set, now due to towers), and loss of calls, messages, emails etc. I was told by Sprint several times my handset was the issue and I could have it repaired at cost or get a new one. I was forced (yes forced) to buy a new handset and stuck with Sprint for an additional amount of time. To this day after repeated calls and complaints I am having the same issues.

    A dollar for my pains, and having to extend my service is not acceptable. Why not fine Sprint several million (money gets the pont across) and allow current customers the option to leave without concern of “credit” troubles, or have “x” amount of service waived?

    I will not reccomend Sprint to anyone what-so-ever!

    I HAVE BEEN A SPRINT CUSTOMER FOR 13 HORRIBLE YEARS, THERE SERVICE AS A COMPLETE JOKE, NUMEROUS DROP CALLS
    TERRIBLE RECEPTION, I HAVE TERMINATED MY SERVICES WITH SPRINT, SO GLAD I DID . ANY PHONE SERVICE IS BETTER THAN
    SPRINT, INCLUDING PICK UP AND GO. FOR 13 YEARS I WAS TOLD
    THEY ARE WORKING ON NEW TOWERS, STILL TODAY THERE ARE
    NO NEW TOWERS, 4G PHONES, WITH ZERO G SERVICE.

    This lawsuit was and is a joke. I don’t believe the settlement. Did Sprint buy there settlement? I don’t believe it. There goes another check on the column of “WHY BOTHER.” Money talks. I had Sprint since they bought off Nextel. Over 15 years. My Settlement is $1. Why waste everybody’s time. I don’t have Sprint any more. Stopped over a year ago. I also had trouble with them. No more sprint for me.

    ON JAN 13, 2014, MONTHS AFTER LEAVING SPRINT AT THE END OF A LONG CONTRACT PERIOD, I RECIEVED A PHONE CALL FROM MICHELLE AT SPRINT TRYING TO COLLECT TWO ADDITIONAL MONTHS PAYMENT. AFTER EXPLAINING TO MICHELLE THE CARFUL AND DOCUMENTED EXCERCISE THAT WAS FOLLOWED LEADING UP TO AND THROUGH THE END OF MY CONTRACT PERIOD, SHE SUGGESTED THAT I SPEAK WITH HER SUPERVISOR.
    MELBA, HER SUPERVISING MANAGER SAID AFTER HEARING MY STORY AND CONFIRMING THE DATES AND TIMES ON HER COMPUTER RECORDS, APPOLIGIZED AND SAID THAT SHE WOULD SUBMITTING AN “ESCLATION FORM” TO TRY AND PUT THIS MATTER TO REST.
    AS SHE EXPLAINED, SPRINT WOULD HAVE NOT RELEASED MY NUMBER TO MY NEW CARRIER UNLESS MY ACCOUNT WAS IN FACT PAID IN FULL. THAT WAS IN OCTOBER OF LAST YEAR, APPROX 13 MONTHS AGO. MATTER SETTLED RIGHT?
    THEN ON AUGUST 2ND OF 2014, I RECIEVED A CLAIM FOR PAYMENT AMOUNT DUE OF $100.24 FROM “DIVERSIFIED ADJUSTMENT SERVICES , INC, A COLLECTIONS AGENCY WHICH STATED THAT I COULD AVOID DAMAGE TO MY CREDIT IF I WOULD PAY THE MONEY THAT I DON’T OWE.
    SO, THIS TIME, I EXPLAINED TO WHOLE MATTER TO “DAWN THOMPSON” AT DIVERSIFIED. SHE SAID THAT SHE WOULD PUT THE MATTER IN DISPUTE AND AS IT TURNES OUT SHE DID EXACTLY THAT. THANK YOU DAWN.
    SPRINT HOWEVER, DECIDED TO PRESS FORWARD AND HAVE THE COLLECTIONS EFFORT RECORDED ON MY CREDIT RECORD TO HELP IN THE EXTORTION PROCESS.
    RECENTLY ON NOV. 7TH, 2014 I RECIEVED A NEW OFFER FROM DIVERSIFIED TO SETTLE FOR PAYING ONLY $60.14 DOLLARS THAT I DONT OWE TO MAKE THE MATTER GO AWAY. NOT ONLY ARE THEY SHOWING HOW NICE THEY ARE BY REDUCING THE AMOUNT BY 40% BUT THEY GO A STEP FURTHER AND MAKE IT EASIER BY GIVING ME THE OPPORTUNITY OF PAYING THE REDUCED EXTORTION AMOUNT THROUGH http://WWW.EASYPAYMENT.COM.
    SO LET’S SAY IM THE CEO OF SRINT, OR SOMEONE IN THE UPPER MANAGEMENT AT A MANAGERS’ MEETING AT A NICE LODGE SOMEWHERE. I COME UP WITH A BRILLIANT IDEA. EVERY MILLION CUSTOMERS THAT LEAVE SPRINT, WILL EVENTUALLY COUGH UP $60 – $100.00 THAT THEY DON’T OWE IF ENOUGH CONSTANT AND CREDIT PRESSURE IS APPLIED. CONSERVATIVELY, THERE ARE APPROXIMATELY ONE MILLION OF THOSE EACH YEAR. THAT EQUALS $60,000,000,00 – $100,000.000.00 EVERY YEAR OF FREE MONEY. THAT AMOUNT IS SHARED WITH A COLLECTIONS AGENCY WORKING ON A PERCENTAGE.
    UNFORTUNATELY, IT’S NEARLY IF NOT COMPLETELY IMPOSSIBLE TO AFFECT ANY CHANGE OR RECOVER ANY RESONABLE COMPENSATION BY MEANS OF A CLASS ACTION AGAINST A CELL PHONE PROVIDER, BUT WHAT ABOUT AGAINST A COLLECTIONS AGENCY THAT HAS HEARD THIS STORY 9 MILLION TIMES, AND DOES NOTHING BUT PARTICIPATE IN THE EXTORTION PROCESS.

    How do I start a class action against SPRINT collections and settlement procedures. I settled a debt with them around 2008 and I still receive threatening calls from attorneys avery year or two. at which point I have to waste my time digging through account records to find the proof of payment and settlement and resend to some new agency. Isn’t this illegal, I want to be compensated for all of my years of wasted and misused time plus any potential repeated damage to my credit which is constantly placed in jeopardy by these slimy practices. They got there money that should be fair and enough!
