Class Action Settlement Announced In Class Action Lawsuit Against Predicto Mobile (Celebrity Squares LLC, TVTXtr LLC and GuessSMS LLC), Cellfish Media, OpenMarket, Too Lazy, Eye Level Holdings f/k/a Cylon, & 3C Interactive Over Alleged Unauthorized and Unwanted Third Party Charges On Cell Phone Bills.

A class action settlement has been reached in a class action lawsuit against mobile content providers, including Eye Level Holdings, LLC, f/k/a Cylon (“Eye Level” or “Cylon”), Cellfish Media (“Cellfish Media” or “Cellfish”), Predicto Mobile (“Predicto Mobile” or “Predicto” or Celebrity Squares LLC” TVTXtr LLC and GuessSMS LLC), Too Lazy (“Too Lazy”), the application provider 3C Interactive (“3C Interactive”), and the aggregator OpenMarket (“OpenMarket”) (collectively “Defendants”) pending in the Circuit Court of Cook County Illinois alleging that Defendants charged and billed cell phone subscribers for third party mobile content (such as ringtones, games, wall paper, graphics, news, and other SMS text alerts that are provided through mobile phones) without their authorization or consent, according to a class action lawsuit settlement news report.

The Predicto Mobile, Cellfish Media, OpenMarket, Too Lazy, Cylon, & 3C Interactive cell phone mobile content unauthorized charges and billing subscription class action settlement reportedly has been preliminarily approved by the court and provides refunds for unauthorized mobile content charges to settlement members (settlement class members are reportedly eligible to receive a one-time cash award of $10.00, or a refund of up to three months of content subscription charges), and attorney’s fees of up to $3.2 million.

If you were billed for and paid unauthorized charges for Mobile Content by OpenMarket Inc., Eye Level Holdings, LLC, Cellfish Media, LLC, Predicto Mobile LLC (Celebrity Squares LLC, TVTXtr LLC and GuessSMS LLC), Too Lazy, LLC, or 3C Interactive, LLC at any time prior to September 13, 2010 that were associated with any of the Defendants you may submit a Claim Form by March 1, 2011 to obtain a Set Cash Award or a Cash Refund.

The Court has reportedly given preliminary approval to the settlement and a final hearing on the settlement is scheduled to be held to determine the fairness of the settlement, as well as Class Counsel’s request for an award of attorneys’ fees and expenses, and the incentive awards to the Class Representative(s) on January 14, 2011 at 11:00 a.m. at the Richard J. Daley Center, 50 West Washington Street, Courtroom 2601, Chicago, Illinois 60602.
