Pomerants v. Skechers Credit Card Purchase & Personal Identification Information Class Action Lawsuit Settlement

If, between April 22, 2009 and November 11, 2011, you used a credit card to make a purchase at a Skechers store (including Skechers retail stores, concept stores, factory outlet stores, and warehouse stores) located in California and your personal identification information, including, but not limited to, postal address, e-mail address, and/or telephone number (landline or mobile), were requested and recorded by Skechers., your rights may be affected by a class action settlement.

A class action settlement has been proposed in a class action lawsuit against Skechers U.S.A., Inc. (“Skechers” or “Defendant”) pending in Los Angeles County Superior Court entitled Ada Pomerants, on Behalf of Herself and All Others Similarly Situated, v. Skechers U.S.A., Inc., and Does 1 through 100, inclusive Case No. BC436360 (the “Pomerants Action”), alleging, among other things, that Skechers violated California Civil Code section 1747.08 by requesting and recording personal identification information, including, but not limited to, postal addresses and e-mail addresses, of Skechers customers who paid for merchandise using a credit card, according to the Pomerants v. Skechers Credit Card Purchase & Personal Identification Information class action lawsuit settlement notice.

Skechers Class Members reportedly include those who between April 22, 2009 and November 11, 2011, used a credit card to make a purchase at a Skechers store (including Skechers retail stores, concept stores, factory outlet stores, and warehouse stores) located in California and whose personal identification information, including, but not limited to, postal address, e-mail address, and/or telephone number (landline or mobile), was requested and recorded by Skechers.

Under the Pomerants v. Skechers Credit Card Purchase & Personal Identification Information class action settlement, Skechers has reportedly agreed to comply with California Civil Code section 1747.08 and to modify the process by which it initially signs customers up for its Customer List (excluding non-purchase transactions, non-credit card transactions, transactions involving loyalty/rewards membership programs, and any other transaction not governed by or exempted from liability under California Civil Code section 1747.08)

Skechers also has reportedly agreed to compensate Class Members who timely register to receive a Merchandise Certificate with a single, transferable Merchandise Certificate. Skechers will offer two different Merchandise Certificates that a Class Member may choose between: (1) 20% off any purchase; or (2) $15 off any purchase.

On February 7, 2012 at 9:00 a.m., a hearing will be held on the fairness of the proposed Pomerants v. Skechers Credit Card Purchase & Personal Identification Information Settlement. At the hearing, the Court will be available to hear any objections and arguments concerning the proposed Settlement’s fairness. The hearing will take place before the Honorable John S. Wiley, Jr. in Department 311 of the Los Angeles County Superior Court, located at the Central Civil West Courthouse, 600 South Commonwealth Ave., Los Angeles, California 90005.
