Krossland Pre-Paid Calling Card Rates & Fees Class Action Lawsuit Settlement

If You Have Purchased Certain Types Of Pre-Paid Calling Cards Distributed By Krossland, You May Be Entitled To A Refund To Be Used For Additional Calling Minutes.

A class action settlement has been reached in a class action lawsuit against Krossland Communications, Inc. (“Krossland” or “Defendant”) pending in the United States District Court Central District of California (styled Galvan v. Krossland Communications, Inc., et al., Class Action Case No. 8:08-cv-00999-JVS (ANx)), alleging, among other things, that Krossland distributed or sold pre-paid calling cards without fully disclosing the applicable rates, fees and charges as required by California law, specifically under Cal. Bus. & Prof. Code § 17538.9, according to the Krossland Pre-Paid Calling Card Rates & Fees class action settlement notice.

The Krossland Pre-Paid Calling Card Rates & Fees Settlement Class reportedly includes all persons who purchased a pre-paid calling card where Krossland was the distributor of the pre-paid calling card (except for cards where the calling card service provider was Locus, AT&T, T-Mobile, Boost, Total Call or IDT), anywhere in the United States, between August 26, 2004 and May 21, 2012 (the “Settlement Class”).

Under the Krossland Pre-Paid Calling Card Rates & Fees settlement, for each Settlement Class Member who does not request to be excluded from (in other words, “opt-out” of) the Settlement Class and submits a Claim, Krossland will reportedly pay each eligible Claim with a Refund PIN that can be used to make telephone calls to any location in North, Central or South America, at the rate of 20 cents a minute to any telephone number within the United States or any landline number in North, Central or South America, and 50 cents a minute to any cellular telephone number outside the United States, provided that the validity of the Claim is verified by Krossland if it elects to do so. The Refund PIN will be good for a period of one year from the date it is activated, and there will be a deadline for use provided to you. A claimant may not submit or receive a refund for more than a total amount of $16, in 50 cent increments, calculated based on 30% of the total face value of the Krossland Calling Cards submitted by a claimant and rounded up to the nearest 50 cent increment. Under the Krossland Pre-Paid Calling Card Rates & Fees settlement, there reportedly shall be a total cap of $250,000 on the dollar amount of Refund PINs, less certain fees and costs.

A Final Fairness Hearing in the Krossland Pre-Paid Calling Card Rates & Fees class action settlement will be held on August 27, 2012, at 9:00 a.m. at the following address: Galvan v.
