Idea Village Kinoki Foot Pad Class Action Lawsuit Settlement

A class action settlement has been reached in a class action lawsuit against Idea Village Products Corp. (“Idea Village Products” or “Idea Village”) and other defendants in the Superior Court of the State of California for the County of Orange (styled Priscilla Hojiwala, Aleen Luckner and Barbara Kochamba v. Idea Village Products Corp. et al, Class Action Case No. 30-2008-00060295) alleging, among other things, that Idea Village and the other Defendants advertised claims for “Kinoki Foot Pads” in a false and/or misleading manner, according to the Idea Village Kinoki Foot Pad class action lawsuit settlement notice.

The Idea Village Kinoki Foot Pad class action lawsuit settlement reportedly provides that:.

“Retail” purchasers who timely return a signed Proof of Claim form, along with proof of purchase of the Idea Village “Kinoki Foot Pad” product, will be sent a full refund for each Idea Village “Kinoki Foot Pad” product purchased in retail. For purchasers who do not have a valid proof of purchase, each such purchaser will be provided a choice of receiving either $10.00 for each Idea Village “Kinoki Foot Pad” product purchased, up to a maximum of three (3), or choose to receive to additional Idea Village Products (with a total retail value of $20.00), up to a maximum of six (6). The other Idea Village Products being offered as an alternative to the $10.00 cash payment are listed and pictured on the Settlement Website at www.footpadsettlement.com. If Class Members submit claims for the product component of the Settlement, totaling more than two million dollars ($2,000,000) the product will be distributed to the Class Members in an amount proportional to the total claims. By way of example, if Class members submit claims for the product component totaling four million dollars ($4,000,000), each Class Member will receive fifty percent (50%) of the claim submitted. The Settlement does not provide any total cap on the cash component, so all Class Members who request the cash benefit will receive the full amount to which they are entitled no matter how many claims are submitted.

Idea Village Kinoki Foot Pad class members reportedly include the following persons, unless otherwise excluded:

All Persons Who Purchased Idea Village’s Kinoki Foot Pad Product Within The United States, Not For Resale Or Assignment, From A Retail Store And Did Not Return It For Credit, But Excluding The Defendants, And Any Entity Related To Or Affiliated With The Defendants And Their Respective Current Or Former Officers, Directors Or Employees, Any Judge Or Judicial Officer Assigned To The Case And His Or Her Immediate Family And Counsel For The Defendants.

A final approval hearing will reportedly take place on July 22, 2011 at 10:30 a.m. in Department CX-105 of the Orange County Superior Court (Courtroom of the Honorable Nancy Wieben Stock).
