Emergen-C Class Action Settlement | Wong v. Alacer Energy, Immunity & Metabolism Lawsuit

(“Alacer” or “Defendant”) has reportedly agreed to a proposed settlement of a class action lawsuit against Alacer in the Superior Court of California for the County of San Fransisco (styled as Crystle Wong v. Alacer Corp., Case No. CGC-12-519221,) alleging, among other things, that Alacer violated various state consumer laws with regard to certain energy, immunity and metabolism related statements made in connection with its marketing, advertising and packaging of various Emergen-C products, according to the EmergenC energy, immunity and metabolism class action settlement notice.

The Emergen-C settlement class reportedly includes, unless otherwise excluded, all persons all persons who purchased the Emergen-C Products in the United States, from June 1, 2006 to February 27, 2012.

Emergen C products reportedly covered by the settlement include the following EmergenC items:

  • The Emergen-C Original Formula;
  • Emergen-C Specialty Formula products: Heart Health, Joint Health, Immune Defense, Lite with MSM, MSM, Vitamin D & Calcium, and ElectroMIX;
  • Emergen-C Multi-Vitamin, Kidz Multi-Vitamin, and EmergenC Kidz;
  • Emergen-C Immune Plus; and
  • Super Gram tablets

The Emergen-C class action settlement will reportedly provide a total settlement fund of $6.45 million to pay eligible claimants, costs of notice and settlement administration expenses, Class Counsel’s attorneys’ fees and expenses and any class representative incentive awards to the plaintiffs.  EmergenC settlement claimants with Proof of Purchase can reportedly seek refunds up to $36, while those without Proof of Purchase can claim up to $18.  The settlement claims deadline is March 27, 2014.
