Discover Bank Discover Payment Protection (AccountGuard), Identity Theft Protection (Profile Protect), Wallet Protection (The Register) & Credit Score Tracker Class Action Lawsuit Settlement

If You Were Enrolled In Or Billed For Discover Payment Protection, AccountGuard, Identity Theft Protection, Profile Protect, Wallet Protection, The Register And/Or Credit Score Tracker Between January 21, 2004 And November 9, 2011, You May Be Entitled To Benefits and Your Rights May Be Affected By A Settlement Of A Lawsuit.

A class action settlement has been reached in several class action lawsuits against Discover Bank, DFS Services LLC and certain other companies affiliated with Discover Bank (collectively, “Discover Bank” or “Discover” or “Defendants”) in the U.S. District Court for the Northern District of Illinois (captioned Walker v. Discover Financial Services, et al., Class Action Case No. 10-cv-06994-JWD) alleging, among other things, that Discover Bank engaged in various wrongdoing in connection with four fee-based products offered by Discover Bank: Discover Payment Protection (formerly known as Discover AccountGuard), Identity Theft Protection (formerly known as “Profile Protect”), Wallet Protection (formerly known as “The Register”) and Credit Score Tracker, according to the Discover Bank Discover Payment Protection (AccountGuard), Identity Theft Protection (Profile Protect), Wallet Protection (The Register) & Credit Score Tracker class action settlement notice.

The cases, which were transferred to a Multi-District Litigation proceeding in the Northern District of Illinois, In re: Discover Payment Protection Plan Marketing and Sales Practices Litigation, MDL Docket No. 2217, are Walker v. Discover Financial Services, et al. (N.D. Ill. Case No. 10-cv-06994-JWD), Callahan v. Discover Financial Services, et al. (N.D. Ill. Case No. 1:10-cv-07181-JWD), Alexander v. Discover Financial Services, et al. (D.S.C. Case No. 7:10-cv-02754-HMH), Sack v. DFS Services LLC, et al. (W.D. Tenn. Case No. 2:10-cv-02906-JPM), Boyce v. DFS Services LLC, et al. (E.D. Pa. Case No. 2:11-cv-00265-LDD), Conroy v. Discover Financial Services, et al. (C.D. Cal. Case No. 2:10-cv-5260-MMM-E), Triplett v. Discover Financial Services, Inc., et al. (S.D. Fla. Case No. 1:11-cv-20519-AJ) and Carter v. Discover Financial Services, Inc., et al. (E.D. Pa. Case No. 2:11-cv-01656-BMS)

The allegations in the cases reportedly included, among other things, that: (a) Plaintiffs were enrolled in Products without their consent; (b) Defendants and their sales agents misrepresented and omitted material facts regarding the cost of the Products; (c) Defendants and their sales agents misled Plaintiffs by hiding the true nature of telemarketing calls and misrepresenting that Plaintiffs would receive promotional materials prior to enrollment; (d) Defendants misrepresented the date of enrollment for Products; (e) Plaintiffs enrolled in DPP improperly were charged an amount equal to .89/100 multiplied by their account balance each month rather than 89 cents for each full $100 of their account balance; (f) certain Plaintiffs were enrolled in DPP despite being ineligible for DPP benefits; (g) the fees for Products are unconscionably high; and (h) Plaintiffs improperly were denied DPP benefits.

The Discover Bank Discover Payment Protection (AccountGuard), Identity Theft Protection (Profile Protect), Wallet Protection (The Register) & Credit Score Tracker class (the “Settlement Class”) is defined as:

All persons in the United States who were enrolled in or billed for Discover Payment Protection, AccountGuard, Identity Theft Protection, Profile Protect, Wallet Protection, The Register and/or Credit Score Tracker between January 21, 2004 and November 9, 2011 (the “Class Period”).

Under the Settlement, Discover has agreed to create a Settlement Fund of ten and one-half million dollars ($10,500,000) to fund the payment of claims as well as the costs of the litigation, the settlement, and incentive and attorney fee awards in amounts to be approved by the Court. You cannot receive a payment unless you submit a claim form. Claim forms may be submitted online www.walkersettlement.com or by filling out and mailing in the claim form.

    I had Wallet protection for several years and paid for it. Fortunately I never had to use it. This past year I bought a better policy which covers that but also covers identity theft. Wallet Protection seemed like a good thing as I felt a little more secure to have the wallet protection but it doesn’t cover enough for the cost of it..

    I THOUGHT CREDIT CARD PROTECTION WAS KIND OF EXPENSIVE AND I DID NOT NEED IT.

    Just one of those things you need to take the time to read the fine frint and understand what your paying for. If you think you might need it then fine, if not, opt out, plain an simple. I myself opted out after the first month seeing how bid a hit it actually took on my bill

    I feel that they should have to refund the full amount paid to them plus interest, maybe around 28% like they charge. What a joke. Fortunately, I did need to use it but all it did for me was freeze my account, never paid anything towards what my balance was.

    I have several of my accounts on Discover protection plan. I called a few times to try and cancel it because I have extra protection through another company, but the representative told me that I shouldn’t cancel until my bill was paid in full. I owe too much money and will take some time with the interest rate and with this extra payment, which I don’t need, I will never get it paid. How do I fill out a form?

    I just got an $11.00 fee added to my Discover account from a catalog company for a club that I never joined, plus they split my order in two packages and charged double the shipping and handling charges. The name of the company was Favorites. I am glad that someone is watching our for the consumers. I cannot find a claim form to print out. Where is that?

    I have these products for years, and they have helped me several times – being unemployed, having wallet stolen, someone hacking another bank card.

    I only hope that filing this does not cause Discover to cancel me. $13 or $14 a month may be expensive, but I do not know of other options that cover all cards.

    I had all of the protection plans that has been mention in this settlement class action, it was costly, it helped me when I was not able to work for over a year. The thing that bothers me is that the people that is victims of these charges get only a few dollars, while the attornies end up with most of the money. what do you think?

    i think a mailing should have gone out. i never received/ nor heard anything on this class action. I just heard about it on the news this week and guess i lose out because the filing date was 3 months ago. how is it that a class action suit can be filed but those affected are not notified in writing??
