Costco Gender Discrimination Class Action Settlement | Ellis v. Costco Wholesale

If you are a female employed at a Costco warehouse store in the U.S. and were subject to Costco’s system for promotion to Assistant General Manager or General Manager positions, your rights may be affected by the proposed  Costco Gender Discrimination class action settlement.

Costco Wholesale Corporation (“Costco” or “Defendant”) has reportedly agreed to a proposed settlement of a class action lawsuit against Costco in the United States District Court for the Northern District of California (captioned as Shirley “Rae” Ellis v. Costco Wholesale Corporation, Case No. C04-3341 EMC) alleging, among other things, that Costco discriminated against female employees by using a uniform, corporate-directed system that failed to promote equally or better qualified women into Assistant General Manager and General Manager positions, purportedly in violation of Title VII of the Civil Rights Act of 1964, 42 U.S.C §§ 2000(e) et seq., according to the Costco Gender Discrimination class action settlement agreement.

The proposed Costco Gender Discrimination settlement class reportedly includes, unless excluded via opt out or otherwise, all women who have been employed at any Costco warehouse store in the United States since January 3, 2002 who were subjected to Costco’s system for promotion to Assistant General Manager or General Manager positions.

The proposed Costco Gender/Sex Discrimination settlement provides for the creation of a claims process to distribute an $8 million settlement fund.  In addition, the proposed Costco settlement provides that Costco will implement job posting for Assistant General Manager vacancies and will permit Assistant General Managers to formally register interest in specific General Manager positions and Costco reportedly will consider changes in its processes for making promotions to Assistant General Managers and General Managers.

Plaintiffs’ Motion for Preliminary Approval of Class Action Settlement and Approval of Class Notice and Notice Plan has been scheduled for hearing on February 6, 2014.
