A class action settlement has been reached in a class action lawsuit against Biotab Nutraceuticals, Inc., Dish Direct, Inc., Tamara Gibson, Robert Winter, Jr., and Robert Winter, Sr. (collectively “Defendants”) in the Superior Court for the State of California for the County of Los Angeles (captioned Williams, et al. v. Biotab Nutraceuticals, Inc., et al., Civil Action Case No. BC414808), alleging, among other things, that Defendants made material misrepresentations and false claims in their advertising, promotion, marketing, and labeling of the “male enhancement” product ExtenZe and that Defendants’ claims that ExtenZe will increase the size of a man’s penis are false and not supported by any credible scientific evidence, according to the Biotab Nutraceuticals ExTenze Male Enhancement Dietary Supplement class action lawsuit settlement notice.
The Biotab Nutraceuticals ExTenze Male Enhancement settlement class reportedly includes the following persons, unless otherwise excluded:
All persons who purchased ExtenZe in the United States between May 29, 2005 and October 25, 2010.
If the ExTenze Male Enhancement class action settlement is approved, a cash settlement fund of $6,000,000 and a product component of ExtenZe Racing merchandise valued at $6,000,000 (“Claim Fund”) will reportedly be set up to pay valid claims submitted by Settlement Class Members in the form of, at the Settlement Class Member’s election, either a cash refund or a retail package of ExtenZe NASCAR Racing merchandise (including an “ExtenZe Men’s Retail Package” with a total retail value of $149.95 or an “ExtenZe His and Hers Retail Package” valued at $176.94).
The Defendants have also reportedly agreed not to make certain statements in product labeling, advertising and promotional materials, including that ExtenZe can increase penis size.
The Court is scheduled to hold a class action settlement Final Approval Hearing at 8:45 a.m. on March 30, 2011 in Department 28 of the Stanley Mosk Courthouse, 111 North Hill Street, Los Angeles, California 90012 to determine whether to grant final approval of the Settlement and to certify the Settlement Class, to consider any timely objections to this Settlement and the Parties’ responses to such objections, to rule on a Fee and Cost Application for attorneys’ fees and expenses, and rule on any applications for incentive awards.
