KITEC® and/or PlumBetter Plumbing Brass Pipe Fitting Class Action Lawsuit and Class Action Settlement

If you are an owner of a residence in Clark County, Nevada that contains, or at any time contained, a KITEC® and/or PlumBetter piping system and/or components (“the Class”), your rights may be affected by a class action lawsuit and class action settlement.

The Court in a class action lawsuit styled In Re Kitec Fitting Litigation Class Action, Case No. A493302 pending in District Court of Clark County, Nevada recently entered an Order establishing a Claims Bar Deadline of July 31, 2010 by which all owners of Clark County homes that contain KITEC® plumbing systems that have NOT already received written notice of the KITEC and/or PlumBetter Plumbing Brass Pipe Fitting class action lawsuit must file a Proof of Claim in order to be included in the class action lawsuit, according to a class action news report.

All of the defendants involved in the class action lawsuit have reportedly settled except for two plumbing companies that reportedly went to trial, lost and are appealing.   The KITEC and/or PlumBetter Plumbing Brass Pipe Fitting class action lawsuit complaints reportedly allege that Kitec or PlumBetter plumbing systems and/or components manufactured or distributed by or on behalf of Defendants Ipex Inc., and Ipex USA, LLC (collectively, “Ipex Defendants”), and installed within homes in Clark County, Nevada are defective because they fail or may fail when exposed to water due to a chemical reaction known as dezincification,  when brass used to make Kitec fittings is exposed to water.

Plaintiffs are homeowners in Clark County with residences that have or had Kitec or PlumBetter plumbing system and/or components specified and/or installed by various Developers, General Contractors and/or Plumbers.  Defendants in the class action lawsuits reportedly include:

    We are presently in the process of putting in an offer on a home located at 9510 Malasana Ct., Las Vegas, NV . The seller’s real estate broker included in the offer a request for us to release the owner of any liability regarding plumbing damagers which may result from a defective product involved in a class action lawsuit against Kitec,n Case No. A493302. They stated the present homeowever is unaware of any such class action and that they were not notified at any time. We did a little research and saw that a home two doors down from this one is involved in the class action lawsuit. The property developer of this gated community, built in the late 1990s is filing bankruptcy.

    Where can we go to get more information on this? We are not willing to signing a release of liability on a property which we now know had defective plumbing material installed and as far as we know, was never corrected. Thank you so much for your help.
