Kellogg Class Action Settlement Of Kellogg Frosted Mini-Wheats Cereal Class Action Lawsuit

If you purchased Kellogg’s Mini-Wheats Cereal between January 28, 2008 and October 1, 2009, you may be entitled to a cash refund from a class action settlement.

A class action settlement has been reached in a class action lawsuit pending against Kellogg Company (“Kellogg Company” or “Defendant”) in the United States District Court for the Southern District of California (styled Harry Dennis  and Jennifer Koz v. Kellogg Company, Class Action Case No. 3:09-CV-01786 IEG WMC) alleging, among other things, that Kellogg falsely advertised that Kellogg Frosted Mini-Wheats cereal improved kids’ attentiveness, memory and other cognitive functions to a degree not supported by competent clinical evidence, according to the Kellogg Frosted Mini-Wheats cereal class action settlement notice.

Kellogg Frosted Mini-Wheats cereal class action lawsuit settlement class members reportedly include the following persons, unless otherwise excluded:

those persons who purchased Kellogg’s Frosted Mini-Wheats cereal in the United States between January 28, 2008 and October 1, 2009. Excluded from the Class are Kellogg’s officers, directors and employees, and those who purchased the Frosted Mini-Wheats for the purpose of resale.

Under the proposed class action settlement, Kellogg has reportedly agreed to create a settlement fund to pay claims of $2.75 million, with any money left over to be donated to one or more charities. Kellogg also has reportedly agreed to distribute to charities that provide food to the indigent a total of $5.5 million worth of certain Kellogg branded food items. Kellogg has also reportedly agreed to make certain changes to the Frosted Mini-Wheats marketing and labeling.

Kellogg Frosted Mini-Wheats cereal settlement Class Members may reportedl seek reimbursement of $5 per box of Frosted Mini-Wheats purchased, with a maximum recovery of $15 for the purchase of up to three boxes. To receive payment, Claim Forms must be completed and either be submitted online or postmarked by June 3, 2011.

The Court has reportedly scheduled a class action Settlement Hearing at 10:30 a.m. on February 14, 2011 in the United States District Court Southern District of California, 940 Front Street, San Diego, California 92101 in the Courtroom of the Honorable Irma E. Gonzalez to consider whether the Kellogg Frosted Mini-Wheats cereal settlement is fair, reasonable, and adequate.
