SunTrust Mortgage & SunTrust Bank Mortgage Modification Class Action Lawsuit

Homeowners File Class Action Lawsuit Complaint Against SunTrust Mortgage & SunTrust Bank For Allegedly Failing To Modify Troubled Mortgages Under HAMP.

A class action lawsuit has been filed against SunTrust Mortgage, Inc. (“SunTrust Mortgage”) and SunTrust Bank, Inc. (“SunTrust Bank”) (collectively “SunTrust” or “Defendants”) in the United States District Court for the Eastern District of Kentucky on behalf of homeowners alleging that SunTrust reneged on a promise to modify troubled mortgages under the United States Treasury’s Home Affordable Modification Program (“HAMP”), according to class action news reports.

The SunTrust mortgage modification class action lawsuit reportedly alleges that SunTrust accepted loan modification payments and then failed to provide permanent mortgage modifications, purportedly in breach of contract and in violation of state and/or federal consumer protection laws.

    I went into modification process with Suntrust in July 2009. The signed documents were competed and my new modification payment started in January 2010. We made payments on time each month and in January 2011 received documents stating we owed $15000.00 and if we did not pay our home would be forclosed on. This comes after we received an updated modification amount and documents in December of 2010, in which our payment lowered by $3.00 due to our escrow account. After contacting Suntrust we were advised that there were calculation errors on their part in our modification paper work and to fill out forms for HAMP which we later find out we did not qualify for. Our home was sold in June 2010. I too wish that SUNTRUST would get what they deserve for forcing people, who are making their payments on time, out of their homes at the fault of SUNTRUST!

    We are selling our home that we have a mortgage with Suntrust. They reported us late on our credit report and I did a 3 way call with the credit bureau and Suntrust to resolve it. They (Suntrust) said I was not late. Then the mortgage company that we are using to build our new home with calls me and says that Suntrust reported us in foreclosure since June of 2011. This company is ridiculous. The hold time to speak with someone is 30 minutes or more and then you get a runaround about who to talk with. Good luck to those who are battling this company. It has been a hard fight for us thus far.

      My neighbor is going through a tough time having to file bankruptcy due to high interest payments he is now locked into by Sun Trust. With current rates that would lower their monthly payments available a little more to the regular middle income homeowner it wold benefit the homeowner, but Sun Trust is holding them into the higher interest rate. I received my payment from Wells Fargo after having to fight them for a low interest loan. I paid mortgage insurance even though I had owned two previous homes, and my loan was only for 1/4 of the value of the home even in this market. Because I squawked I got the new loan and immediate reimbursement for my previous years over payment of mortgage insurance. Everyone needs to find out what they can do if they have been wronged by the banks-but they are still not just handing out what they owe. You have to really be willing to fight them and do repeated calling and complaining and threatening to report them, to finally get to them. You have to complain to the federal banking commission. I got back enough to take a cruise,and stimulate the economy, go off partial medicaid, saving the State some money. I also was able to pay my fuel bill without government assistance. The system does work sometime . We all have to not Expect things freely and give back more rather than take. I could still have gotten those services, but I am a moderate Dem who thinks and tries to do the right thing.

    Finally found out the lender behind Suntrust. Good ole B of A. Could not find this out while we were trying to save our home. Oh no! Suntrust gave us a run around about having to make a “formal” request for the name of the lender. We are still shaking our heads over this. We never had a chance. They wanted the property and they got it. It’s all about the number and the dollars. Not the people. Who are you kidding? Some will do okay with the lawsuits, however, most will not.

    Due to a serious illness and loss of my job, I approached SunTrust Mortgage for a loan modification; I was referred to “Making Homes Affordable” by SunTrust and was instructed not to make payments until they modified my loan. Notified bank of new income from disability, still no response, this was June 2011. ‘Making Homes Affordable’ never did anything, other than have I think they were working on my behalf. December 2011, SunTrust foreclosed on our home, denied loss mitigation stating I was not qualified for the new loan amount that exceeded the original loan made over 5 years ago. In today’s’ market our home isn’t worth half of what we paid. We will be thrown out on 02/15/2012. The Bailout was good for the Goose, the Gander get thrown to the curb, is this the justice we deserve?

      Before you move, take the refrigerator, sell the bathroom plumbing, comode, sink, etc.
      Anything you can think of, remove from the house and sell it.
      Take up the carpet. Get the picture.

      Before your eviction date, the house is yours, to alter any way you wish.
      Make it hard as you can on the scum bank suntrust.
      I have a loan with suntrust, they pay my homeowners incurance, 3 times each month, 3 yearly premiums of 1237.00 each, they pay that 3 times each month. Running my escrow into negative then send nasty letters . I have to take time to go into a suntrust branch and make a deposit of the $ 3711.00 each month to suntrust.
      each time they over pay my insurance , my insurance sends a refund to me. I have to get that back on escrow each month.

        Hi I got reimbursed for the mortgage insurance from Wells Fargo. I started my process of fighting them in May of 2012. I finally got my 1.5% remortgage and took out a little extra to stimulate the economy . But I persisted and filed a complaint with The Federal Banking Commission. It was my third remortgage with them, and they dragged me through the mud to get it, but I persisted. I also had an issue with the insurance with Wells Fargo, and got that back after my complaint. It must be another of their illegal bank schemes that bailed out Wall Street. Good Luck. It is a lot of work but try to be persistent. They need to pay for what they did to the average wage earner.

      You aren’t alone on this one, I was given a loan repayment plan at first that was more than my house payment and we had to make them straight but couldn’t afford them so we declined the payment arrangement–started making the home once a month and being behind once a month just so it wouldn’t go in forecloser. Couldn’t make it after that and then we have been pending loss migitation for loan modification for 2 years now and this is our 4th request……Ours is the oldest file in office. Was advised that they do the older cases first…Geesh, they make money regardless if they are kept or foreclosed on they have insurance on the homes. Its sad! Wished I knew how we could be in on this lawsuit.

        If you got an answer to your question, I would appreciate any information you could pass along to me.
        I was told by SunTrust on a Friday to put Homeowners Insurance on my home which I did. Suntrust foreclosed on the following Tuesday.
        Thats not all, just the last punch they landed. There were many more while going through the “Modification Process”.

    We have the same issues. The joke on us is that if you are behind in your payment, they deny your modification request because your credit score is too low, but if you are current, they deny you because they say you have to be behind in your payments. What’s up? How do we contact the attorneys handling this case?

      I had gone .though this also. My daughter was in the hospital I called Suntrust to let them know i was gonna be late on payment. Do worry they said we will have a modification specialist call you with in 6 weeks we will send you the paper work and send it back. After doing this the 6 weeks was here and gone. So I called they told me my caseworker was fired. The told us we had to start over. We did this for 5 years. And lost our house..

    I have my mortgage through SunTrust. Have tried to get a refinance through the HARP program. After 3 hours on the phone, was told I would get the refi at a reduced intrest rate, but at the end of the call, I was told I didn’t qualify because my credit score was 2 points below what they’re minimum was. Then they sent me a letter stating that I would no longer be considered for a HARP refi because I withdrew my application…liars! I then went to a NACA event which claimed to help with modifications. Spent all day there, met with a scumbag SunTrust rep who said they could help by reducing my payment by $20 a month, big help. Then at the end of that conversation, I was denied because I was current. I was told the only way they would help was if I stopped paying my mortgage…yeah great advice. The rep promised to check with Fannie Mae and get back to me, he never did. Next they called my co-borrower and threatend they would forclose anyway if I went ahead with a modification. How can they get away with this? What a bunch of scumbags.

    We have a home with SunTrust and it has been a nightmare, my husband lost his job with the cotton mill and there has been several attempts to modify our loan. Our home is in pending forecloser and due to be in court in less than an month and sold in less than 2 months. They have yet to modifiy our loan and has refused any payments that we attempt. Had lost most of our paper work and gave my husband knowing he couldn’t afford it to begin with. Did not disclose to us that our home had been burnt down or caught fire. They called us repeated for several months more than once a day harrassing us but than now do not call at all after the court date. Was advised that our case was the oldest file in the office. They claim to stand behind their customers but yet failed to help us keep our home. They have damage my husband credit by repeately pulling his credit and has dropped his score to where we can not obtain anything.

    I couldn’t get a loan modification from SunTrust, and I couldn’t sell my house for enough to cover the 1st and 2nd Mortgage (both with SunTrust) so I finally got permission to Short Sale it. After I had a buyer, and was in the middle of the final papers, SunTrust auctioned my house off for a lot less than the Short Sale offer. Not only did it kill my credit, after 2 years they have now sent the 2nd mortgage to collections.

    We finally sold our house and Suntrust Mortgage is paid!!!!!!! It is sorry that we as consumers cannot control our mortgages being sold off to different lenders. Suntrust has to be the scum of the worst lenders in this country. My wife and I said we are building another house in a year or two but if we can it will be paid in CASH!!!!!!!!     Same story…Gave me runaround on modification..even sent them $11,000 cashiers check which I received the original check back in a blank envelope with no explanation. 8 months later!! Guarantee someone found it in a file and they just sent it back no explanation trying to cover there tracks…Ended up foreclosing for less than half what I bought it for….But would not modify me…Good job etc..Can we get in???

    I am just realizing since my foreclosure in 2006 that something is terribly wrong with the way they handled my refinance: Couldn’t have qualified for the payments (they were as much as I made a month), didn’t come out to look at the property on the ground (flooding area existed), failed to stop or extend foreclosure proceedings after I negoiated with SunTrust Rep. by catching up the payments over $3000, they still foreclosed, unclear whether or not followed legal procedures for sale of property and they have a timeline of 6 months, whether or not ST waived right to file deficiency judgement (allows them to pursue any debt not satisfied at foreclosure (I still owe them $62,000+ on the mortgage and they sold the house for $97,000 and the refinance was for $134,000.00 so they are pursuing me. Something doesn’t sound right with this company; besides that I was told the mortgage was suppose to be on my 17+ acres (It was subdivided 12+ and 4+) and they only used the description for the 4+ acres for collaterial and then a man came to my house to buy the 12 acres and barn, said his girlfriend typed up my documents for my refinance and delibertely left off the 12 acres. Now I am in the process of suing him and his girlfriend’s mother, Dona Shiflette, Taxs & Bookkeeping, Anderson, S. C. for forging my name on a Quick Claim Deed not only including the 12 acres but another piece of property I owned in the city. This is a serious matter, please pray for me that the area of the corruption would be revealed.

    I wasn’t offered any type of program with Suntrust. I wasn’t behind in payments and pain on tme for 3 years, I simply wanted a lower interest rate from 6.25% so that my payments would be more affordable and I’d have some money left at the end of the month for emergencies and home maintenance. Suntrust herks made me jump thru hoops providing them information only to tell me that I “don’t make enough money for the modification”. What’s with that? They didn’t offer any other plan to assist me. In addition, they kept sending me statements telling me that my taxes had gone up and my payment went up, when in-fact, I had notices frm the County Assessor that said my taxes went down. I spent weeks sending the notices to Suntrust to prove that they were hussling me. I’m now a member of the class action lawsuit in California. I hope it settles before I decide to let the house go into foreclosure.

    I would like to join in on the class action lawsuit as well. I have been with Suntrust Mortage for eight years at a rate of 6.25% and am currently trying to refinance with Suntrust at a lower interest rate on a HARP program. Suntrust has been giving me the run around for four months now. I am at a loss with this company having to fight with them constantly on this issue. I get no return calls, now return emails and when I try to call the offce I get an answering machine that says that says to try back later due to a high call volume. The only problem is that the forty trys to get through, all that I get is the same message. This company moved out of Cincinnati so I can’t just go to their office now. I have to do buisiness with an office out of Richmond, VA. If anyone knows what law office that I can contact to jump on the band wagon on this class action lawsuit please let me know. In the meentime I will continue to do some research on this.

    I am currently in my 3rd month of attempting to refi with Sun-no-trust using HARP. I always have to call them for an update and when I do speak to someone it’s the same answer. “the paperwork is in underwriting”. Their customer service is terrible. My loan processor has changed three times and not one of them have been competent. No return calls/emails. This company is horrible and should be put out of business. Does anyone have the contact information of the class action suit lawyers?

      Tim, did you get a hold of any info about a class action suit lawyers? After being refinancing for over a year I finally gave up, hey kept asking me for different paperwork, credit card statements, change my insurance coverage, just to give me the run around. Please let me know if you did.

    Hmmm! Well we too have been working with SunTrust for a mod…Have been dealing with Beatrice (not sure real name since she can’t speak English very well). We got a note to call her and she supposedly lost our phone numbers. Which I find hard to believe since the phone number is on every piece of paper work I handed in. Then to make matter’s stranger I go online today to see my home is being action off on 7/3/12… We never got a notice of foreclosure or a time frame to be out of our home. If it wasn’t for me just looking on the internet I would have never know. No letter’s on the door or anything. It seems like so many people are being treating in this poor matter and this Bank is getting away with it. If this is a true class action please contact my husband and I we want to be a part of this. I will be contacting our Attorney General in Arizona to file a complaint.

      I would love to hear more about your situation. I got a packet stating I was 2 months past due. In fact, just 3 weeks ago I brought to their attention they applied escrow payments to my principal. Thought I got that straightened out. The very next day I got a check from them for $533.09 stating my escrow account had “too much money in it” and by law, they can not hold that money. Then I got the packet stating I needed to call them immediatley to avoid foreclosure. The left hand does not know what the right hand is doing. I demanded a 24 month history of my payments, a letter of apology for their error, verification from them that my credit will not be tarnished and told th em they have 10 days to comply or I am seeking legal action.

        All I can say to you at this point is start saving your money. They will be giving you a letter of foreclosure. I am sorry to say this. We have had lawyers fight for us and this bank is non-agreeable. Good luck and as far as this class action… I think it too is false since no one has bothered to contact us.

    I have been struggling with SunTrust for several months now. I originally placed the house on the market, but it wasn’t selling after 6 months so I took it off and requested a DIL back in January because I knew I would not be able to keep up with the payments any longer after changing jobs and getting a divorce. Now SunTrust is dragging their feet with the process. I have fallen behind on my payments while the DIL is still in review, and SunTrust is telling me if I don’t make payments I could face foreclosure. I have been submitting the paperwork as they request it, and just recently they told me they need something from the realtor which I can only get if the house was still on the market. I asked SunTrust a long time ago if the house needed to stay on the market and they told me no. Liars! If they needed the house to stay on the market, why didn’t they tell me this in the first place!!??

    Suntrust Mortgage sold my late husband and me a predatory loan in 2005. When he passed away, I contacted them regarding his passing and asked if I could reduce the monthly payment, and without actually saying the words ” SCREW YOU”, he found ways to tell me it was my problem. I found back in 2009, I got a modification, I was told about a trail period and one year in the modification. They are now saying my modification wasn’t finalized until July 2012. I have bank statements to prove otherwise. Now I lost my job in 2012 and contacted them again to see if they could reduce my monthly payment, and not the percentage. I understand from a representative that Suntrust could have offered me 45 years, which would reduce my payments on a modification and did not do so. I have be a loyal customer to this company, so much so I cannot pay all my bills which has ruined my credit.

    we allege and state our home purchased in 2008 we invested approx. $25,000 to build home we allege suntrust mortgage sent us a approved signed agreement committment underwriter letter with interest rate of approx. 5.6 % at closing saw aprox. 1 month later saw we being african american rate jumped to approx. 6.5% with no credit changes . hardships of 1 spouse job loss , temp job layoffs , appendix surgery , family relatves deaths, plea for lower int. rate , 40 year loan , all new fees put to back of loan or added in installments , given run around allege now read suntrust to pay 21 million for discrimination from 2005 to 2009 year customers our dream home in jeopardy now told by suntrust employee on 6/21/2012 go ask welfare for help

    I lost my home 2 years ago , ST had the first and seconded loan on my home , they are still reporting me every month as being late on the small loan, even though they foreclosed and sold the home .
    My credit score is at 600 because they continue to report me as late every month , and I can’t make they stop

    How do “WE” become part of this or a new action against Suntrust??? My credit shows foreclosure proceedings when Suntrust assured me that while I was waiting for the Loan Mod. answer…there would be no action. Then they sold my loan to Nationstar and I had to start all over. My credit is ruined!!! Please someone give me an answer as to how to fix this!

    Sorry to say guys but the program is a snake PIT for the America’s. I am not from the US but I see why people are killing each other. This program is mass murder to families and individuals, such loss can send one into a psychological breakdown, especially when their is no one to confront. I advise you all individuals early into the program to withdraw ASAP.

    Just know you will have to pay what ever was subtracted during your trial period. Let’s say your mortgage is $3,000 and you were put on the “trail” to pay $2,000 on time. the $1,000 will be accumulating every month. I call this the “Snake PIT”, because after a year in trail your already $12,000 in the hold $1,000 x $12 = $12,000, get it. $15,000 is the cap since according to the bank no one has $15 Grand laying around. After this you will get a pretty letter colored in cash green colors stating, well your in foreclosure.

    Question has anybody ever made it out of the PIT to testify a solid victory?

    I have searched all over, couldn’t find nobody… search high and LOW… still couldn’t find nobody, but a Snake PIT setup by SUNTRUST.

    Let me say this: SUNTRUST MORTGAGE INC. IS THE MOST EVIL ROTTEN LIARS WHO COMMITT FRAUD, MIS-USE OF FUNDS, MISSREPRESENTATION, EMPLOYEE PEOPLE WITH NO KNOWLEDGE OF LOANS WHATSOEVER. My husband and I are inthe middle of a lwasuit with these SUM of a mortgage co. SunTrust Mort Inc. Back in 2007 they assumed we missed June’s payment sent them proff that they infact withdrew the funds by autodraft. Now, you think that all was good but, NO! I had the privlidge of talking to one of their incomptent customer service reps who told me that they would need a copy of my check for June’s payment. This is no JOKE!!! I spent 30 minutes on the phone while at work telling this IDOT!!! I do not like to call people names but, she was really getting me FIRED UP!!! I told her that I do not have a copy of any check to send her because I DO NOT WRITE CHECKS FOR MY MORTGAGE PAYMENT and her response was ‘THEN HOW DO U PAY YOUR MORTGAGE? I told her that your company each month would withdrawl my payment aount by way of autodraft, hold on to your seats people she said wait for i wait ok her goes she asked WHAT DO YOU MEAN AUTODRAFT? and I said SERIOUSLY? Well, it means that my payment is taken out my computer service funds from my bank are sent to your employer and put in their bank therefore my payment is MADE!!! so that is why I have no copy of a check to send and much to my suprise she said, Sorry but, until I can get that copy of the check June’s payment will be noted as unpaid!!!! So, I tried very hard not to say “WHAT THE —-? but, I remembered I was at work and being a caregiver I have to control my loudness. Anyway, I’ll get to the end of this, We were put into DEFAULT IN ON MARCH 5th OF 2008 FOR BEING 5 MONTHS BEHIND, a supervisor from SUNTRUST MORTGAGE INC, she was in the collection dept told us that they sent back 5 checks for JULY, AUGUST, SEPTEMBER, OCTOBER AND NOVEMBER OF 2007 UNCASHED THEREFORE PUTTING US IN DEFAULT. We were never made aware of any checks being sent back nor of any default until July 23, 2008 when we were on 3 way call with two employees of SunTrust Mortgage Inc. I was in shock when she told me this I told YOU ARE A LIAR AND I CAN PROVE IT!!! she did not like that at all and told me I needed to send proof that she was a LIAR and that SunTrust had infact cashed all five of those checks. So I did and guess what, SHE NEVER RESPONDED!!!! We tried for 2 years to have suntrust take care of the Fraud default the filed in 2008 so that we can get back on track. all I ever did was send in copies after copies no one ever did anything about our problem. We sent in $3000.00 dollars to SunTrust Mortgage so they can pay their attorney to postpone a foreclosure date of July 25, 2008 which their was not one. Later i October we find out they used that money and applied it to November 1, 2007’s payment that had already been paid. Not one of the letters that we would get every now and mentioned being in default, never ever mentioned those 5 checks that they infact cahsed, never answered us as to what happend to the money when the cashed the checks because they did not apply them to the months that we were paying. So we lost our home of 15 years in 2011 we filed a lawsuit aganist SUNTRUST MORTGAGE INC. for FRAUD, MIS USE OF FUNDS, MISSREPRESENTATION ETC. seeing that wwe can not afford a lawyer we have been doing this on our own and so the court has let refile our complaint, hit the lawyers for sunTrust Mortgage with 3 violations and we have a hearing in 2 days in SACRAMENTO SUPERIOR COURT CIVIL!!! They are going to hsve to explain why they put us in DEFAULT when they did in fact cash each check and what did they do with the money… It has been a nightmare, my husband and I have been fighting, his family do not believe that a mortgage co. can be this rotten and we must have done something wrong but, I tell my husband I really do not care what your family thinks because as long as we know that we did nothing wrong then we have nothing to prove to them. I have nothing to fear whatsoever.. SO PEOPLE BELIEVE ME I WILL NOT LET THESE SUM SUCKING, ROTTEN LIARS GET AWAY WITH THIS, WE WILL FIGHT AND I DO BELIEVE VERY STRONGLY THAT WE WILL WIN… IF WE ARE SCARED TO FIGHT THEM JUST BECAUSE WE CAN NOT AFFORD A LAWYER THEN WE WILL LOOSE. I WILL NOT PUT OUR LIVES IN DEBT JUST TO HAVE A LAWYER TELL OUR STORY IN MY WORDS TO A COURT, I CAN DO THAT MYSELF.. SO I HAVE BEEN AT THE LAW LIBRARY EVERYDAY AND THEY HAVE BEEN HELPING ME ON WHAT TO SAY AND HOW TO SAY IT WHEN WE GO TO COURT. THEY TELL ME I CAN TELL MY STORY IN MY OWN WORDS AND THE COURT WILL UNDERSTAND PLAIN ENGLISH.. SO WISH US LUCK AND I WILL POST WHAT HAPPENS AFTER COURT. I AM NERVOUS BUT, AT THE SAME TIME CONFIDENT WE WILL COME OUT OF THIS WINNERS…. THEN MAYBE OTHERS WILL STAND UP TO SUNTRUST AND TAKE THEM DOWN FOR GOOD…… =) GOD IS ON OUR SIDE I CAN FEEL IT!!!!!

    i realize that suntrust did a modification where they just drop 80.00 from mt mortgage payment. i still could not make this payment. So i reapply for another modification, fax all my document. In two week I call them, to hear that they did not get my faxes of document. So I fax them againt. I got the same message. So then I get a call from there attorney about back payment. They strat goum. my check. So I has to filed Chapter 13 to stop the collection. It is sad that I tried everything to get my paymet in my budget. Did not work.

    Suntrust, refused to give us a loan modification after 2 years of run around. I would submit paperwork, they would lose it I would submit again, via fax, via mail and I would call every week to get an update. I never spoke with the specialist or underwriter of the same person twice. They finally called me at work one day and said you have 60mins to submit your paperwork. I explained that I already done so and I was told, I don’t have it so you better send it again and now you only have 53 mins. I left work ran home and refaxed the paperwork only to be denied a loan mod, they were unable to give me a reason. Worst lender in the world, what goes around comes around!

    There must be a way we can all get together and report SunTrust to their CEO. It’s 2012 but I am in a similar situation as all of you above.
    I co-signed on my sons loan on his condo in DC. He lost his job in 2011 and he applied to SunTrust for a home loan modification. It’s been 14 months. We would submit paperwork, they would lose it, we would submit again, via fax, via mail and email and I would call every week to get an update. Nothing! When a document (because they misplaced it) is missing you start the process again from the beginning.i.e., it again takes 40 days to hear back from them. It has been a total, total nightmare. Finally, I borrowed the money and paid off what my son owed and he withdrew his application. The main reason was there was yet another document they needed and the process would re-start from the beginning. I could no longer take it. My credit cards were being cancelled and my credit score from the 800’s is now in the 600’s. So I borrowed the money and paid them $13,107.53 on 7/27/12. They cashed the check on the 31st July. I faxed them the copy of the cashed check and the payment coupon to their call center. YET the collection calls still keep coming and today I found out they can’t find the check and are trying to locate it.!! They are the most incompetent, inefficient group of people working for SunTrust. Somehow MANAGEMENT SHOULD BE ALERTED. This is the WORST BANK I HAVE EVER HAD TO DEAL WITH.

    Run away from any SunTrust Mortgages / modifications.
We had a construction – permanent loan with a FIRST POSITION LOAN and NO LIENS with a loan to appraisal value of 50%. A SunTrust Privacy Agreement was included with the closing documents. Our bank officer torpedoed our original loan conversion that had been signed off by underwriting, signed by us, returned to SunTrust in GA. The bank officer was a friend of the builder and conversion information was shared with the builder. We were forced to pay the builder’s overbillings before loan conversion was resent 2 months later. WORST BANK EVER

    My wife and I are currently in a short sale apointed by suntrust. This mortgage company is guilty of alot of things, but our situation simply just don’t make since. Read My story…. in 2006 we were awarded a 10 year interest only loan on a Modular home approx. 4000 sq ft. We paid over $107,000 in our first three years of this interest only loan. That was fine for awhile until we found our home was Built with alot of structural issues. In 2007 we hired a law firm to build a case against our builder for faulty building practice. During that time we hired two completely different firms to assess damages incured during the initial build. Both firms reported simular results. How does this happen? You are probably wondering how we got the keys to the kingdom… at this point so were we! From 2006 to 2009 we found out that we had somehow had no case against the builder because they went bankrupt. We did our part during this lawsuit, we never told the bank about the issues with the house and kept on paying our mortgage. Just a reminder, even on a brand new home, you may need to hire a non-bias inspection company to have the home checked for safety before you accept the keys. 2009 – we were stuck with a home that has an estimate damage of over $250,000. Both the Berkeley County and the state of South Carolina were contacted to comment and step in for thier involvement in the legal part of all the mess, both resulted in washing thier hands from our situation. Permits from the County were not even signed off on. “Can’t fight city hall” The balance in full for the home and land added up to $359,000. No money paid to suntrust from 2006-2010 was ever applied to the principle amount. In dec of 2010 we defaulted on our loan due to poor service. Let me sum this up! from 2006-2010 we paid over $107,000 to suntrust for a home that has $250,000 damage and we are now being forced to deed in lude foreclosure. In short we are loosing our home. We smell a scam! My mortgage states that I paid for 5 inspections that were to be performed on the home before occupancy letter is to be issued. we bought a lemon and were forced to pay all that money out with our best interest and thrown out the window. No accountablity has being taken by suntrust at all. suntrust also gave this home a high appraisal amount, around $450,000. How can this happen? easy, no one inspected the home after the build. I should mention that the loan money never hit our bank for us to dispurse the builder, the bank hadled everything. My wife I feel that we are victims of scam and have been criminally abused. Obama where is my bail out? We don’t have money to fight and accuse suntrust bank at this time and lucky us, we are still living in our home. Did you catch the irony? I have already paid for this mortgage free and clear, the house isn’t worth anything too anyone but me. Iam currently out $107,000 and about $30,000 in upgrades to the finished upstairs area and a two story deck that I owe on creditcard that I cant pay for at home depot. suntrusts involvement in this deal stated that they loaned me money, we owe them the balance of the loan. They can have thier damaged home, just allow me to return it and give me my money back. In closing, I learned my lesson to never trust anyone every again when purchasing a home, suntrust is deeply missing the point, first off they are going after the wrong guy, second they care more about thier bottom line than thier customers and third, they are holding my interest in this home ransome, it should be illeagal to be able to do this in the USA. Come get your broken home suntrust after all you have more interest in it then me. May God’s wrath be upon you and everyone else that was involved. peace!

    suntrust finished the loan modification to my girlfriend,incredible suntrust gave to her more than 5.5% interest rate for the modification this is abusive,usury,inmoral and saw to my girlfriend TAKE IT OR FORECLOSURE,this interest rate is over the market rate,none have this abusive interest rate when give a loan modification.In the other hand only gave less than 96 hours to take a decision,what do you think about it?Is this legal?What she could to do to lower that rate?

    My husband injured himself, and I had to come off of my job to care for him. He received worker’s compensation for nearly a year. We definitely took a hit without my income but we made it. We started in on our savings which quickly disappeared. When we came to the end of our savings I started contacting Suntrust for help. As mentioned in the other postings, I was asked for the same documents over 7 times. I even called my home perservationist to verify that all the documents that were required had been received, just to wait nearly a month or two to hear that the file was denied because documents were missing, that I personally verified with my loan modification representative, verified they received himself? I went through this document game with Suntrust, so long that I took it upon myself to get emails and send these documents that they kept saying they had not received so that I had proof that I sent them. I later received a letter stating that they had received everything to complete my loan modification package, which was finally a relief to me, after 7 other times of sending the same documents in.

    I waited and waited and didn’t hear anything so I contacted my loan modification representative again, and he immediately start reading off more request for documents again that they needed in order to move forward with the modification, on documents that I had sent over 7 other times. It seems to me that they are attempting to get you frustrated so that you will give up and just walk away(foreclose), or continue paying a payment that is keeping you from feeding your family, or being able to keep your lights and other things going in the home.

    One of the representatives, told me that after 30 days your file is discarded and you will have to start the process over, even if it’s not your fault that your file have set on someone’s desk for 30 days. The trouble part about this is that they don’t tell you that, and you are waiting thinking that they are processing your paperwork. I asked the representative how can anything get done, if they are using this approach with the people that need help? She couldn’t give me a response.

    The only thing she said was she was going to try to escalate my file. I’ve heard that several times before, just to find myself in the same situation nearly a year later.

    Suntrust has to be investigated and disciplined for their actions. My belief is that they are allowing that money that was given for the bail out to draw interest and denying the people the loan modifications that they have been qualified for.

    If I was the President I would do an investigation, and have all the interest returned that was earned on any money that they haven’t used for the people. They should not be able to benefit from their dishonesty.

    Suntrust did the same thing to me.Told here is you modified payments. But they never did there papers. The loan went to another lender they tried to foreclose. I finally got it modified but I am still paying for there thieving. They screwed up my credit. I am still fighting. We need to sue the daylights out of them. They need to be stopped.

RE: Take a look at the recent settlement where the people will get $840 for their trouble and maybe, maybe not, a refinance of their mortgage. I bet they just get more delays on the refi and more action will have to be taken against them.

They had me believe all was well during the so called modificatin, even intructing me to put insurance on the home on Friday (gave me less than 3 hours to get a binder on it) then, promptly foreclosed thej following Tuesday.

    I have been trying to work with ScumTrust for the past year, first as a short-sale that took 5 months and in which my buyer walked, and then secondly to modify my second mortgage which was at 9%. Needless to say it has been an absolute nightmare. This company adamantly refuses to do anything for me, or work with me in any way. I submitted all my paperwork for modification of my second loan after not paying it during the short-sale process. It took them 2 and a half months to tell me (10 days after it was denied, and with ME calling THEM) that because I have 2 loans with them, the primary loan must be modified first. Okay, then, thank you for wasting my time…. Anyway, the first mortgage being current, I wasn’t too hopeful of it being modified, but not really worried about it too much, it was the second mortgage I couldn’t afford. So, 2 months later, (again, ME calling THEM) was denied on the first mortgage. (6.8% interest rate btw) So I relaunched the second loan, with fingers crossed!!!! and lo and behold!!! 2 and a half months later…..I call THEM… and they inform me that a week prior I had been denied on the second mortgage because the second mortgage had to “mirror” the first loan….WTF does that even mean? So I ask, and am told again that a supervisor will be in contact the following day… More BS. Never spoke with a supervisor. Come to find out, the “mirror” meant that they wouldn’t do it because my first mortgage was current, where my second is not. To add insult to injury, I received another bill in the mail, which listed my options and the number to call for a repayment plan. I call that number, and wouldn’t you know it…. 3 days ago (WITH NO LETTER/PHONECALL/NADA) ScumTrust charged-off my second mortgage and I will now be going through a collection agency!!! I NEED HELP!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

    saw the story on CNN … we have our mortage oringinally with sun trust who refused to work with us on a loan mod, they have had two service companys who keep making errors, or saying they havent recieved our paperwork, blah,blah, blah. would .ove to join the lawsuit if we qualify. washington state.

    I have lost my home to Suntrust. I tried to go through the loan modification process. I was told I need to proof hardship in order to qualify for the modification and would not be accepted if I were current on my mortagae. I was told that as long as I did not fall 3 months behind I would not be put into forclosure. So in August of 2009 I filled out and sent in all paper work for my loan modification. I missed Sept and Oct. mortgage payments and then paid Novembers. My last payment was credited back to my account. When I called Suntrust to ask why they told me I was in forclosure. I expained to them that I was working with loss mitagation to modify my loan and that I was told in order to prove hardship I must be delinquint on my account. They told me that I misunderstood. That they would never tell me not to pay my mortgage. I was then told the only way to get out of forclosure was to pay the forclosure attorney and then i would be back in good standing with my mortgage. I paid that attorney every penny he asked for and was never taken out of forclosue… I have all paper work to prove this!!! I would love to be appart of a lawsuit against this company. They have taken the home from my children and destroyed my marriage. If anyone knows who i can contact please let me know. Thanks Rebecca

    We have fought Suntrust since 2009,always losing our paperwork,Never getting to talk to a live person. So after 3 Bk and several attemps to remodify our loan they forclosed on our home on Dec 4,2012. We were on a trial payment plan for 3 months,that went on for over a 1 1/2 years,the monies sent in without fail were never put toward our mortgage,instead they said they used the monies for fees. Talk about being scared my husband and I are both in our late 60’s with 2 older adults living at home with us , due to job loses and a 10 year old grandson.     Wow, some of these stories match our situation exactly. They have ruined my credit by reporting late payments and by constantly checking my credit score! I have applied for the HARP and HAMP and been denied twice with many months of being run around. I wrote down a number every time I had to fax the same paper, I was up to 7 times on my flood insurance form. This place is horrible, I cannot believe how badly they treat their customers.
    I would like info about a class action, do we need to start another??

    I too need help with a class action law suit against Suntrust. I was part of the independent foreclosure review and received $500 dollars. This has been absolutely ridiculous. When I had lost my business in 2009, I called Suntrust. They told me I had to be behind 4 months before I could file for a loan modification. After 4 months, they told me they could not help me. They then said I could short sell my house. I had my home ready to be sold 5 times, including having cash buyers, but they never responded to the buyers or they said they were handling it from an outside company, so the files would be continual lost and re-submitted. Finally, they never reported the foreclosure as a foreclosure until it sold in 2010. Since then they have still been reporting on my credit that I owe the money that was paid to them when the house was sold (to the government) and that I was 120 days late. Through the Federal Banking Consumer Protection agency, I was able to have them stop reporting the 120 days late… which they have been doing from 2010 until February of this year, but they went back to reporting me having a balance.

    On at least two occasions, SUNTRUST sent representatives (that I was later charged for) to inspect the property. Two cars and a golf cart in the driveway and their agent claimed the property with a perfectly manicured lawn was abandonded.

    Often true of the government…but in the case of Suntrust – I’m afraid this boils down to conspiracy.
    In 2008 my office went through a reorganizations – I was asked to take a $20,000 pay cut.
    From here my story is very similar. In 2008/2009, I took late pays on other bills to make sure my Suntrust mortgage was not late.

    (1) I called and wrote asking for a loan modification or permission to do a shortsale, since the house was underwater…and was told that I didn’t qualify unless I was 90 days late. I asked, “if I’m 90 days late, will you foreclose?”, I was advised that foreclosure was possible. . I continued my payments.
    (2) When HAMP came out – I tried again – I was assigned an account manager/mortgage rep….we exchanged a several volumes of paperwork. . She said that I could submit for modification or shortsale – but not both. I submitted for modification…Then she disappeared.
    (3) When I contacted(wrote him a letter- no direct communications) the VPof Suntrust Mortgage. I was advised to resubmit my paperwork..from scratch. ..by this time I had found another job 3hours from my GA house… was maintaining two households- commuting on weekends and then I was advised that I made too much money. -and did not qualify.

    Fortunately, I was able to find another job out of State..,and we leased out GA(Suntrust) house saving us from foreclosure and bankruptcy but I’m still losing hundreds per month between rent and mortgate payment. We were finally about to refinance under HARP and save a few dollars..

    The ultimate slap in the face – a letter a few weeks ago about a Suntrust settlement for biased mortgage rates to blacks and hispanics..charging that whites with similar financials were giving favorable rates and charged smaller fees.

    One thing is certain, Suntrust did me wrong for the last time today, June 5th, and I am contacting legal representation to sue their butt.
    I have received a settlement check for $1,000, better than most people who only received $300 I heard, but I am going for more. No more mercy for these bastards.

They dont do loan modifications for va members… screwed us for months.. Then gov VA put a block on loan… Sun still put us in forcloser… my wife was very sick at the time… she is gone now..big time screwed

    I purchased a home with Suntrust. Tried to get the modification i was told i could not be current on my payments. So i missed a month was told not to make payments until my modification was approved. Everytimer month I had to send the documents again because they said they never received them. The sixth month they received the documents but my home was already being foreclosed on and my modification was denied. I was denied a modification because i was too late with my documents. Everitime I would call I would be sent to another department that was unfamiliar with my case. I was on active duty and they still didnt care. Before my deployment I was kicked out of my home.

    I was going through a divorce and had a lot loan with SunTrust Mortgage, Inc.. The loan came due in full so they would not accept my mortgage payments. At that time the Special Loans department had a loan for me to refinance into, but my ex-wife would not sign the documents to be able to refinance into a different loan. I stayed in contact with STM the whole time I told them my intention was to keep the lot. I was an employee of STM for 8 years and left because customer service levels were declining so bad. Long story short they continued to send me letters of delinquency, fees for inspecting the property, appraisal fees, market analysis fees, ect. It is a sand lot. Once I finally was able the get the property settlement agreement signed by my ex-wife giving up her portion of ownership in the lot, I sent all the required documents to STM the same day. I then receive a letter denying me a modification of any kind giving me two options: to sign deed in lieu of foreclosure back to STM or do a Short Sale, neither of which I wanted to do. Now I cannot qualify for a loan from any other bank or financial institution due to the back interest that is owed on the loan showing up on my credit as delinquent mortgage payments. STM said the reason for the denied modification was I was too late getting them the documentation I was waiting on from my ex-wife. STM will not even answer my calls nor respond to my emails any longer. I would love to speak to someone further or provide the documentation I have to help in this class action lawsuit against SunTrust Mortgage, Inc.

    I was under the impression that SUNTRUST was going to help me out of the kindness of their heart only to realize I am not the only one who finds out they have no heart.

    I can’t believe I am reading all of the same replies that were said to me. We Lost our home in 1/09. It was our home we built ourselves. We were not interested in getting bailed out, just needed some time to re-organize our finances. I started calling in Fall of 2007, asking for a re-organization of our loan, if partial payments would be accepted, etc. I was told we needed to be 3 months behind on payments to qualify to re-organize, scary thought, never missing a payment or paying late in our past. Said they would send the paperwork for us to complete and after missing 3 payments, would be considered. After missing 2 payments, returning the completed information SunTrust requested, they had no information as to the status of our information getting processed. Getting anxious, not a custom to skipping Mortgage payments, just before the 3rd payment is owing, calling again only to find out we don’t qualify for the re-organization and no explanation. We then catch our payments back up as we are terrified as to what is going on, our payments at the time $2300.00/mo, not an easy task. My husband and I feeling out of control of what is happening with our home, no explanations or advise, but not wanting to spend our savings on house payments, because our income had dropped directly due to the economy. They would not accept partial payments, as to see we are making an effort under the difficult circumstances. Completely unacceptable actions made by SunTrust Mortgage, made our family, have to pick up and move 2 times during the next year, the emotional and mental stress and pressure, in what was already the most difficult time of our lives. Then to hear Obama making Mortgage companies answer months later, and helping people stay in their homes, we would have loved the support too, totally unfair. Please let me know, in any way, that I can help to make this company pay for their misrepresentation and faulty service to the public.

      A very similar thing happened to me. They told me to stop making payments and they would send me an application for modification. Never got the app, called every day, got it and returned it, “they never got it back”, filled out another after calling every day, then denied because I didn’t make enough money! Um, no kidding, that’s why I applied for modification. Our home was foreclosed on the spring on 2008. It appears that we are not eligible to participate in the HAMP Settlement because it happened to us too soon? Have you looked into it at all?

    My home wasn’t but 2 months late and my home was foreclosed on. I called every month trying to set up some arrangements until I got caught up. There was a pad lock put on my home before I could get all of my belonging out. I wasn’t to go know where near it. It hurt so bad because I loved my home. It was in that bad of debt to be taken away from me.
    I was a college student working two jobs with kids.
    I just have a question? How do I get this off my credit report the foreclosure
    Would it be complicated to get another home.
    I had to file bankruptcy when I lost my home because the back payment was going to be deducted from my salary.
    I just need to know, If it will be hard to get another home. My son name was listed on the loan also, we were doing good with the payments but then he went off to college. I need to get his name off the credit report also. Thanks
    If someone could help me with this questions, I would appreciate it.

    Modification program Applied 2009 never ever been late on payment to date, supposed to take 3 months, 16 months later 16 lates sent to credit bureau, One letter of foreclosure Onne letter pay up back interest 5,000. called oh !!!! just a formality . Still am paying this this mortgage still have never been late . but have suffered mentally and physically due to horrific stress open heart triple by pass , cortisol causes plaque to build in the arteries , which in turn causes heart attacts , of course I can’t prove it but it remains, . the last loan we took for home improvement to sell in 2006 house appraised at 397.000 fell to 154.000 with the market crash. at the last closing they came to the house sat at my table and said I didn’t need flood insurance . I live six canals off the Gulf Of Mexico! We have been under water for nine years, held hostage by this fraudulent institution!
