SunTrust Mortgage & SunTrust Bank Mortgage Modification Class Action Lawsuit

Homeowners File Class Action Lawsuit Complaint Against SunTrust Mortgage & SunTrust Bank For Allegedly Failing To Modify Troubled Mortgages Under HAMP.

A class action lawsuit has been filed against SunTrust Mortgage, Inc. (“SunTrust Mortgage”) and SunTrust Bank, Inc. (“SunTrust Bank”) (collectively “SunTrust” or “Defendants”) in the United States District Court for the Eastern District of Kentucky on behalf of homeowners alleging that SunTrust reneged on a promise to modify troubled mortgages under the United States Treasury’s Home Affordable Modification Program (“HAMP”), according to class action news reports.

The SunTrust mortgage modification class action lawsuit reportedly alleges that SunTrust accepted loan modification payments and then failed to provide permanent mortgage modifications, purportedly in breach of contract and in violation of state and/or federal consumer protection laws.

    My sister has been trying to get a loan modification approval for months and now she is getting the threatening letters regarding foreclosure. She is simply paying what Suntrust asked her to pay on a monthly basis. She is never late with her payment. They continue to tell her to disregard all notices. She can’t speak to her case manager as they won’t provide her his number. Even when you call Suntrust, they can’t tell you who the Sr offices of the company are and where the HQ is located. I would like to help her move this along, but not sure who to deal with this company. Can you please advise.

    Suntrust made two deals with me, one verbal and one in writing. They violated BOTH. Obviously verbal is difficult to prove, other than the preponderance of similar stories Im finding online. The written one however, not only did they break it unilaterally, they even AGREED on the phone that they did and that they were mistaken (they had accused me of breaking it and I had documentary proof that I did not) but couldn’t fix their own mistake.

    They bullied me into bankruptcy, and then failed to credit all the money I had paid during the foreclosure nightmare, leaving me having to challenge their claim for arrears in court.

    They hang up on you if you have more than just very basic questions, or they transfer you into limbo. Its amazing really, my home is deeply underwater, they would take a bath on it, and Im an excellent candidate for a work out. But they seem to want to corner the second hand home market.

    Maybe they are wanting to be slum lords.

    They created an agreement for a modfication in my case and failed to send the agreement to me to sign. Every time they ask me to submit paperwork, I do and then it takes them so long to do anything, that I have to continually resubmit paperwork. It’s been over a year later now and they’re still not done. They are basically now saying they won’t do anything at all.

    Is there a way to become a part of this lawsuit if I’m from a different state (Washington)?

    I too have been battling with Suntrust. Last Monday I talked to a really nice guy there, and he told me he had all my paperwork from NACA and that he really thought they would end up giving me a modification. He said he didn’t see anything regarding being foreclosed on. The very next day I get a letter from Nationstar and they inform me they will be servicing the loan starting Dec 1, 2010. Then the next day I get an auction date posted to my front door. I want to be part of this lawsuit please. They blatantly lie to you, give you the run around and then renig on everything they had told you. Why is our government allowing this crap to continue?

    I have also been in the loan modification process with Suntrust mortgage for 2 years, after making trial payments for almost a year they told me I was actually denied for hamp and offered me a different amp. I returned the notarized modification agreement and have made the payments, I kept calling because I had not received final documents and was told to keep waiting, in the meantime I continued to make the payments and have now received a letter saying that Nationstar is my new servicer. I have made every payment as they have told me and Suntrust is reporting me as late, I do now know what will happen next???

    I too have been in a trial period 5 months beyond the end date only to have Suntrust transfer the loan to another lender. I live in Arizona and in the news today, Terry Goddard our State Attorney General has just filed a law suit against BofA for loan fraud for not handling Hamp program correctly. I am planning on starting a class action law suit myself in this state and proceedin with legal action against Suntrust for their misrepresentation and bonifide lies the whole time I was in their process. The Banks should not have been bailed out as they have not passed on to the consumer what was intended. They should have been let to fail and perhaps we would be on the way to recovery sooner as a nation.

      I was in a trial period with suntrust that should of lasted 4 months but instead went 11months. They sold my mortgage to nation star and all paperwork was lost that i was in a remodification. It looked like i was 60 days behind and was only making partial payments.im now in the forclosure and am losing my home. I live in Arizona as well.

        I live in Manassas, Va and I also had a loan modification done with Suntrust (with all the paper work notarized/filed and returned to me) and then they turned around and sold my loan to Nationstar. Two weeks after getting a letter from Suntrust that my loan was being sold to Nationstar, I recieved a letter from Nationstar saying that I was behind in payments in the amount of $17,000.00 (now it is around $25,000.00). Nationstar claims it is because Suntrust did not file my paperwork properly. After going round and round with Nationstar for over a year, I just learned from a realtor friend that NationStar just filed foreclosure paperwork on our home. After looking at all the complaints aganist Suntrust and Nationstar looks like there is a scam going on with these two companies. Someone has got to stop them for taking peoples homes and dreams. Now I have to beg a lawyer to help me out with very little money. I am hoping that someone see what is going on here and they agree to take my case, stop my foreclosure and then sue Suntrust and Nationstar for fraud!!!

      Hi Ken,
      I have been going through this for a year & a half now as well. I did everything thing as told when I was approved for my modification back in Sept, 2009. Now my house is to be auctioned off at a Trustee Sale tomorrow at 11am with Shapiro Law firm. When I finally got a live human at Suntrust on 1-7-11, he told me to go onto the website & fill out modification paperwork for the 3rd time, to basically start over. I told him my house was to be foreclosed on Tues Jan. 11, 2011 due to their mistake & conflicting paperwork. He preceded to yell as he told me “just go to the website like I told you to & print out the modification papers!” I have so much documentation of their fraudulent modification & actions, as well as many paperwork discrepancies.       This family in in Florida. I have tried to assist a family in Florida with their loan modification paperwork with Suntrust since they speak very little English and I am bilingual and I could not believe that after providing all requested documents in a timely manner, their modification was declined for reason of not providing doc’s requested. (very untrue). Next thing I found out, someone showed up at their property to deliver a flyer to contact the office immediately when the owners just received the letter declining the loan modification. It wasn’t even a week when someone (assumed it was from Suntrust Mortgage) at their property. What is going on….This family can’t sleep and are getting very ill (depressed) just thinking they are going to lose their home. All they wanted was a modification so that they can get current. These owners are retired and only live with Social Security and this bank is a nightmare. I have help many homeowners with modifications with different lenders and I must admit this modification process has been a nightmare. Please help this family since they just got news their daughter is very ill and has been hospitalized 10 times recently. Please help.

        Not to be rude….We had lawyer’s helping us for two years and the same thing happen to us. Please tell them to start saving what money they can. This bank will be sending them a letter soon to foreclose on their home. I really believe there is no such thing as a loan modification at this bank. Sorry!!

    Same exact story for my wife and I in VA. We were told to take advantage of the Loan modification program with Suntrust in which we would go for a trial period. That trial period lasted over 8 months in which suntrust was charging us late fees and interest without us knowing. When we noticed it on the monthly statements, they told us not to worry as it will balance out at the end of the trial period. We would try to call them and no one knew anything because Suntrust outsourced the loan modification to another company. My wife and I had a 30 year fixed rate and put 40k down on the house. We had the home for 3 years and never was late or missed a payment. By the end of the 8 months “trial period” that was suppose to last 2 months, we then owed 20k more than we purchased the house for!! Suntrust would not talk to us about the matter because you cannot reach them, they wont give you a number. We started getting foreclosure letters shortly after. We then decided to short sell the house in which we got a fair market offer for it and its appraisal. the offer stayed with suntrust for 7 months and now I just found out they sold our mortgage to another company and the short sale fell through. We now must foreclose. THESE JERKS CANNOT GET AWAY WITH THIS CRAP.

      I am sorry that happened to you; and I have been with Suntrust Mortgage as well and had my loan modified with no problem. However, I am a little taken back by all these comments that are being said about them. I noticed that in everyone comments they blame them for dropping the ball, but why haven’t anyone taken some responsibility for your part? This is the worse recession ever and every bank that is doing the HAMP has over 60,000 + loan modifications applications. You should be thankful that you are with reputable known bank rather than one of these fly by night financing companies that no one has ever heard of. Believe me all of my friends had them and they are going through the same thing that you are; however these finance companies you can’t get a hold of. I understand your pain and frustration. Believe me I had the same treatment. But I was persistent in getting this accomplished. Hamilton I don’t mean to pick on you but you say you were being charged interest and late fees without knowing. Your payment should be the same every month. Why did it take you close to 8 months to realize this? Why are you not contacting your assigned loan modification rep and ask him/her? Every case is assigned to a loan modification rep. Why didn’t you email him and contact him personally? When you say they will not give you their direct line phone numbes that is poppycock. I had no problem getting my Loan Mod. agent’s direct line. Also Hamilton living in Virginia – Suntrust corporate office is in Richmond, VA. Why haven’t you picked up your phone and call their corporate office and make an appointment with the CEO of Suntrust regarding your situation? I live in Atlanta and I did exactly that. Was going to drive there too. I was determined and persistent to think outside the box. Do I need to say more? In any event, I have gone through the not answered calls, losing my file, etc and have been in my home for over 10 years. But if you are not satisfied with the treatment you are receiving, why don’t you be persistent and investigate what are my next steps. I bypassed the loan modification dept b/c I was not getting anywhere. Went straight to their corporate office in Richmond, VA. And I got results. You know what was shocking when I spoke to the executive department, they said they wished more customers would contact them b/c I was the first customer that ever called their dept and complained. Doesn’t sound true, but know it is being a corporate professional myself. Before you reach it to the top, the vice presidents, managers, etc. makes sure they handle the problem at the bottom before it gets to the big guys. You can stop this foreclosure; if you don’t have the money; the only choice you have is bankruptcy in order to save your house. Either way your credit will be affected. But that would be the least of my concerns right now. Again, not picking on you — just giving you my suggestion on what worked for me.

        DSC, do you work for SunTrust Mortgage? Throwing the responsibility back on these customers is wrong. That’s great your modification is in place at this moment, but you don’t know what the future holds. I agree with every other comment regarding SunTrust. I started the modification process nearly 2 YEARS ago. I was diligent, documented every call, sent in everything they requested repeatedly. I spoke with supervisors, managers and everyone under the sun. I don’t care if they have 60K or 6 million modification applicants, they should have used some of the money they received to hire more employees to help process applications. After 18 months I was offered the option to skip 3 months. The president had just signed a bill mandating unemployed homeowners that were 3 months or more behind receive assistance. What they did was try to catch me up the 3 months we were behind so that we wouldn’t qualify for a modification. These banks are tricky and greedy. It doesn’t matter if they’re “reputable” or unheard of. They all share the same unlawful, unscrupulous, sordid practices. I did something better than contacting the corporate office, I filed a FEDERAL lawsuit for FRAUD. They can change mortgage companies 20 times. I don’t care, each time I am going to march down to the Federal Court building and amend the lawsuit to add the new company. Furthermore, I am working to regain a rental property we lost to foreclosure with SunTrust. If someone has already bought it I’ll sue for damages. What most of us don’t understand is modification is tacking unpaid balances, late charges and fees on the end of the mortgage. They’re going to get it one way or another. Here is something else financial institutes don’t want you to know: they make a considerable profit when you foreclose. If you’re thinking to yourself it seems like they are trying to force me into foreclosure, here’s an epiphany-YOU’RE RIGHT! That’s a whole different topic. I am hopeful that this lawsuit will serve justice in my case. We have to fight them. Our families deserve it and so do we. I wish you all the best of luck.

          Hi Carmen, I hope everything has worked out for you since your posting. I have been in a loan modification with Suntrust Mortgage since Dec.2011 nearly a year later, I have constantly sent the same documents that they have requested over 8 different times. It’s almost like they are playing with you in hopes that you will give up and leave your home. I was made aware of the help that was offered by the letters that was sent by Suntrust, and when you contact them for help the representatives have been taught to keep asking for the same documents over and over. I was told by the representative that my file would be discarded if no one has gotten to the file within 30 days, and that’s when you receive the letter in the mail stating that your modification has been denied because of missing documents, the same documents that they have thrown in the trash because they have expired according to them because my file set on someone’s desk too long, before processing. My personal thoughts were that Suntrust wasn’t expecting Obama to get elected again, and they have delayed the help,because they didn’t want to help the people in need with these loans.
          The way that they have treated my husband and I during our time of need, when help was available has been very disappointing to me. I had to leave my job when my husband was hurt to where he couldn’t work. I had to come home to care for him, and we didn’t contact Suntrust until we had depleted all of our savings. They should be responsible for neglecting to help the people, when our president has clearly alotted the help for those in need.

        How nice for you. However your ignorance is a shame. The “customers” that you are talking about have probably been on the phone for hours and hours every week since they started this process (Way to long ago).
        I happen to be one of those cutomers. Suntrust made a mess out of my loan and failed to apply my payments correctly to my loan. after the capitalization of my loan continued to put my payments in suspense accounts and didn’t send me a statement for 1 year even though I requested one damn near weekly. When they finally sent me my first statement after being a “finished mod” it was dated for sept printed in november It said I was behind on payments that I had already paid.
        a day later I recieved a letter that my mortgage was being sent to nationstar. I called suntrust and they said they would fix it but they didn’t they only said that to pacify me until I was no longer there client.
        A couple days later on Dec. 1 nation star took over my loan that suntrust never fixed I have sent every documentation I can because Nationstar said they didn’t recieve any. i have also sent bank statements proving money was taken from my account from suntrust.
        Nation star isn’t fixing anything. My account is under research but it is also in foreclosure. Hopefully the fix it before it is to late. I think that people like you need to understand that you are a exception to a very huge mess that people and families all over the u.s are dealing with. We are having to uproot our lives because of it. You standing up for banks that practice unfair policies and other practices and sloppy paper work makes you sound and look ignorant. The only reason this worked out for you is because you are one of the few that doesn’t have a clerical error on your document. That is it. It could have just as easily been you in our shoes. And if i was in your shoes I would be feeling really lucky but not ignorant.

        This is in response to DSC. While I am happy for your loan modification process having been approved, mine was not. Instead, it was sold to Nation Star. I jumped through all the hoops they required. I should have been contacted before the end of my 3rd Trial Payment. I was not. Apparently you did not read ALL of the information countless people have written. I did have a modification rep. I called several times. Left several messages. My rep’s name was Barbara. Would you like her telephone number? I called it several times to politely ask for an update as to the status of my modification. One time I was told to continue to make payments until I heard from them. Persisent? You don’t know the word. When your house goes to foreclosure, you don’t piss around like a damn sheep waiting for the next one. It’s my home. Honey. I live in VA. I know the corporate office and its location, exactly!!!!!! I can drive to the location within an hour. Oh and here’s the kicker. Once my loan was sold to Nation Star, we had to call Suntrust AGAIN because Sun Trust provided no information. They wouldn’t even communicate with Nation Start. WE had to call Sun Trust and spent 2 hours begging before we finally got someone who could at least promise that they would send our interest statement and history of payments. Nation Star had none of this. That was over a week ago and still nothing from Sun Trust. I honestly don’t know what planet DSC lives on, but it isn’t planet Earth.

    Sun Trust did the SAME thing to me. They would never answer or return emails or messages and you are left in the dark for months until you finally enter into a trial mod program, which determines nothing ultimately. I made all my trial payments, so I qualified for modifications but then didn’t qualify. After 9 months, I signed papers for an Alt Mod and sent them back. When I called to confirm, they said the wrong papers were sent to me and that another set was coming. I filled those out and sent them back. When I spoke to several different reps, they all kept saying “congratulations” because I was approved. After a week or so a rep called me to say that my new mortgage payments would be the original amount I was paying, not the modification amount that was clearly stated in the paperwork. How could this be a modification??? The rep said that I was earning enough now, according to what I was showing as income in the paperwork. I was livid. He didn’t READ because I clearly stated what I was making, with a copy of my checks–dated–along with my bank statements showing deposits of each check, as well as my employer contract that specified my income. Basically he doubled what I was making because he stupidly assumed the checks were weekly income rather than every two weeks. When he saw his error, he said, “Oh, then you don’t qualify for anything after all.” WHAT?? It took a year to decide if I qualified for a alt mod but it took him suddenly 2 minutes to determine I didn’t—the one who couldn’t even read–the dumb one–HE decides I don’t qualify in two minutes–even though all my numbers had been the same all along, the same income that allowed me to enter into a trial mod, the same income that allowed me to qualify for an ALT MOD, for which I was congratulated for. I lost my house. They didn’t even attempt to help me stay in my home even though that it what they advertise with each letter they send out regarding foreclosure. Sun Trust ? There is no trusting a sun that cold.

    someone shoud do something about these banks saying taking tax payer money and saying they are going to modify loans, and them playing all these games with people. They have no intention of helping us. Pleasse call you congressman and ask them to get off their butts and do something for the thousands of families that this bank is putting out in the streets. Maybe we should all just take our money out of this bank and join a nice credit union.

    I too was in modification with no answer for 10 months with Sun Trust, they than sold my loan to Nationstar (even worse). In the transition Sun Trust decided to add up all my modified payments and apply them to the start of my trial and temp modification. So no before they sold my loan to Nationstar it showed me not paying since June whn in fact I had never missed a payment ever, before this modification mess or during. On top of which the SunTrust computers sent an automated late statement to the credit bureaus saying I haven’t paid since JUNE and owe $11,ooo dollars. My car is dead and my credut score went from 777 to 600, now I am out a car can’t get approved for even a beater. I have written letters to Nationstar, SunTrust, My congressmen and woman, My Senators, The President and called as many. Surprise zero response! Now what do I do, how long before a class action suit actually goes to court, and when it does what will happen to SunTrust, they don’t own our loans anymore. They’ll get a fine and we will still be screwed.

    Suntrust is playing me the same way. Our HAMP mortgage should have been completed July 2010 after the 3 month trial. They sent me the final paperwork to sign in December 2010 and now in January we need “corrected” paperwork for an additional credit of $2.00 a month. I told them Gas costs more per gallon and I’ll pay the two bucks but they replied “it has to be exact” How can I get in on this law suit?

      I am just about to pay my 3 month trial payment. This entire situation with suntrust (virginia) is out of control. Everyone who has a complaint is correct. I have called to find out what the next step is 3x and get no response. I am an expert at phone calls but I feel awful for the people who don’t know how to do any of this stuff. Is there a class action lawsuit for Virginia? Also, they told me we could refi for a 40 year once my husband went on SSI to support more income?

    We hired a law firm to help us with a loan modification with Sun Trust Mortgage after I lost my job and was unable to find another one. Suntrust put us on a three month trial. We make all payments in full on time for EIGHT months. When I was finally able to talk to someone, in October, I was advised that my request had been escalated due to the length of time we had been in a trial period. It was escalated alright……..In November we were notified that our loan had been sold! Now we are trying to work with the new mortgage company to see if we even qualify for a trial period. Now what?

      I also hired a law firm after being in the process with Suntrust Mortgage since April of ’09. Got the run around for a WHOLE year and made trial payments until they finally tell me they can’t do a permenent modification because “I didn’t qualify”. I hired a law firm in April 2010. They said that I fit within the guidlines and after 3 months of sending in paperwork and negotiating in July 2010 Suntrust sent me a FedEx package of a new loan mod agreement. I was told this time that after the 3 month trial period of making payments, which I did, I would be permenently modified. I didn’t happen. I guess they were just buying enough time to have my loan transferred to Nationstar in December. I made my Dec and Jan trial payment to Nationstar as instructed in writing by Suntrust Mortgage because Nationstar would pick up where Suntrust Mortgage left off and finish the permenent modification. WRONG! When I talked to a rep at Nationstar they told me my payment was my original mortgage payment and that they had no record of a modification process. The rep said that Suntrust probably hadn’t reported it to the treasury and that I’d have to start the process all over now with them. He also said that they were dealing with alot of new people transferred from Suntrust with the same problems. All the time, mind you, Suntrust hasn’t sent me any proof of all the payments I made stating that they’ve been credited to my account or are in escrow somewhere. I’m feeling as if they just took the thousands I paid in trial money and ran without holding up there end of the deal. They shouldn’t get away with how they screwed people. Is there any class action suits against them? I need to know. I live in GA.

    Ditto!!!! Resubmitting paperwork multiple times, NO call backs, just the run around, being put on hold all the time….once for 70 minutes!!!! when a recorded voice then said they were too busy to take my call that day! Many transfers to other operators who are no help, lots of excuses. Referred to other companies who might help but were useless except to keep me busy. I called weekly to check on progress and always told they were very busy and would get to me asap….never happened. Twice I received repeat bills from 2 months prior…that had been paid but showed up as past due. Months of waiting…almost foreclosed that I avoided by the skin of my teeth by borrowing from everyone I knew. The when I was up to date they dropped my case completely and said I had to start over! I never got any documents from them. I get many harassing calls, several times a day if I am just 5 days late. They refuse to accept a partial payment. In Oct I was not quite 2 months past due when I got a $15 bill for a property inspection – supposedly to see if my home was occupied and in good repair. This was allegedly done on Oct 21 (before I was past due). I live at the end of a long driveway with no other houses in sight and my home is not visible from the main road; I have 2 dogs that bark like crazy at anyone who comes up the drive. I happen to know that I was at home all day on Oct 21 and not a soul came up here! Now $15 may not be much money to some but it is a clear sign to me that “sun-untrust” will use every dirty trick they can to harass and steal. Please, let’s show them they cannot lie and steal our homes!!!! Pass the word because some don’t realize how they are being screwed.

    My goodness…reading all or your comments brings me to tears! Everything that I’ve read, I’m have been dealing with for the past two years now. For the first four years that I have owned my home, I was NEVER LATE on my mortgage payments. I have invested 150k in my home. I have never touched any of the equity. In 2008 I called Suntrust inquiring about a lower interest rate. Due to the certain amount of equity I had in the house, the fact that my payments was always made on time and my credit score was in good standing. I felt that it would not have been an issue for them. They said that the could not help me with an lower interest at that time due to collapse economy and I should try again in a couple of months. I called three months later and they once again told me no. In 2009 a rep told me that they have a program( loan modification) that may help me to get a lower interest rate. I called the modification program and the told me that they would be able to help and that I should not make anymore payments on the original mortgage, for they are going to modify it and send me some type of three month trial payment plan. I fell two month behind on my original mortgage payment. I called the modification department asking if I should be making payments and they told me no…because they are handing it on their end. The first time I send in the modification application, the denied me because they had entered the wrong info…note: I am now three months behind on my mortgage payment. I also got legal documents about foreclosure on my house. I had to resubmit another application, which I was approved. I did the three month trail payment plan. I was sending in the payments that they had suggested and then they sent me all of my money back. I called them asking, what happen? They told me that they never received all of the paper work back…that some of the documents are missing and that they were trying to call me, but I never returned any of their calls. BS….They then went on to tell me that I was approved for another modification and that they will be sending out another application for me to fill out. I sent everything back to them and called them every two days to check on the process…they told me I was all set. In January 2011 I received legal foreclosure documents again….I called them to ask them what was going on and the rep told me to IGNORE the documents. I knew that if I had taken that advise…I would be stupid. So I called the law firm and left a message stating that they should be working with the loan modification department..because this should have never even went that far. I called Suntrust today and they told me that they are still processing my documents…..two years…I was approved for my mortgage in less than a day and two years I’m still waiting on this damn modification.

    We have experience some of the same things with sun trust. In 2008 I lost my job and applied for home modification to keep us from defaulting on our mortgage. We were not delinquent on our loan and understood to qualified we didnt have to be late and because of our current income we qualified. Around june of 2008 after applying thru sun trust they lower our payment from 1,238.00 to 1,068.00 and if we paid on time for 6 months our payment would be reduce to that amount. The bank has numerous finance forms Sign and fax the same forms more than 5 times. when we ask why are we filling out same information
    we were told that the information had been lost or never received. Recently when we filed bankrupcy and learn to our surprise that we were delinquent in our payment. We were never told that the reduce payment would make us delinquent. However when we received the reduce payment was a trial period and we would keep that payment and our loan would be our new payment. We were never late and always current had we known that this would make us delinquent we would have continue making our original payments. we have always had money to make our payment which came out of my husband 401k retirement and they were aware of that. If we have to pay the delinquent
    and interest we would have excepted the lower payment amount. We deceive and lied too. Nowhere in any of our documents does it say by taking the reduce amount we would become delinquent. We have since called them and was told our modification would be close after the our bankrupcy. We also ask why is our home showing delinquent in our credit report and was told dont worry that is bank policy for loan modification and we would not loose our home. I again ask if that was the bank policy why we were never told this information. He then told us to call back after bankrupcy. After reading these statments from other people I’m afraid they may try and foreclose on us and would love to
    know if we can be included on this class action lawsuit?

    In May of 09 Suntrust said I qualify for the loan modification. They put us on the trail period. But it turns out they never completed the paper work. Then in October of 10 Suntrust sold my loan. Now the new bank wants to forclose. I was not late on payments but now I am 8 months in the rears. We had no problems with the modification payments. But here we are they are trying to steal our house.

    I want to be in on this class action law suit. I tried to modify my loan for over 8 months and they have been nothing but abusive, and mean to me before telling me i don’t qualify when I read all the guide lines and I do Qualify.

    My husband and I are currently consulting with an attorney in Orlando. It seems we all have a very similar story with the same ending of selling the mortgage to NationStar. We will gladly join in this lawsuit, there is stregnth in numbers!!!

    I too am in the same boat. I was denied the mod due to low income. I then got another job and second job and made more money. Not an overbearing amount. At this time I am in forbearance. After four months of timely payments they reviewed my case again and said I made too much money for the mod. But little do they know that my attorney is in contact with there attorneys office. I sent another full payment in january after I payed decembers before they dropped my forebearance. They sent me a check fro 48 dollars and some change. They used my money to pay full payments and the difference was sent back to me due to not having enough to make another payment. Well the forbearance contract that my attorney and I read states that they can’t just drop my forbearance unless it is at end of term or untimely payment made. None of that has happened. Now I received the full payment back in the mail and the letter stated they were proceeding with the foreclosure. I am going to hire a lawyer and file suit against them. That will stop the forebearance and I have alot of proof over breach of contract. Therefore they will have to abide by the forbearance. But since it ends soon they will still be able to foreclose on me. I am pursuing other options. But for now I believe I have a case agianst suntrust and fannie mae. I am eligable for the mod and they denied me anyway. I was approve by St Ambrose housing councilers and was denied by suntrust. So here I go. I would like to know about this class action suit.

    Same scenerio, complete runaround. On modification plan for 10 months then suddenly get foreclosure letters and returned modification checks. Banks are bailed out and investing. Im on the streets panhandling..

    I contact SunTrust Mortgage to advise of my hardship ans was told to STOP making payments on my 1st and 2nd trust in order to qualify for a short sale. I had several buyers however Sun Trust took too long with the approval that the fisrst 2 buyers didn’t want to waith. The last buyer had monies in escrow and I was given 24 hour notice that home was to be auctioned. Sun Trust destroyed my credit and is now suing me for 103K on the second trust. I want to participate in a class-action suit. This happened in So. CA. I had to relocate to east coast to gain help from family. Please tell me who to contact for help.

    someone please start a class action lawsuit against suntrust and the “scam” loan mod program they were a part of….i am now with “nationstar” who was given my mortgage and many others that were in the hamp program…they were taken away from suntrust because suntrust made a disaster of these loans, i may end up losing my home due to what they did even though i am perfectly able to pay the mod payment…PLEASE HELP!

      I too am looking in earnst to find an attorney who will go after Sun Trust Bank for their fradulent behavior. I did contact the Federal Trade Commision to report my concerns. They do not investigate individual issues however IF they have enough complaints they themselves will investigate Sun Trust as they did Countrywide.     This too happened to me.. however, sunTrust ended up foreclosing on my home and not notifiying me. Strauss and Troy lawyers have filed a class action suit against SunTrust. You can get the information from their website. http://www.strausstroy.com. I am contacting them first thing in the morning. If you have not been foreclosed on yet, PLEASE stay on top of them, call everyday if you have to. They will continue to do this.

    SunTrust Bank used to be one of the best small banks for south Floridians, but their bad management and greed has made them reach to the top worst banks according to my recent experiences with them. The loan modification program starts by accepting application but never reviewing them, customer service is automatic telephone messages, payment records…good luck, escrow accounts ha-ha-ha. What happened to this financial institution is beyond me!

    I began modification process in July 2009 after unfortunate circumstances, as I am sure you can all relate. I called SunTrust weekly.I have names, dates, and conversations well documented. It took almost 1 year of this, before I got trial payments started in May of 2010, I paid 5 trial payments and in October of 2010 my loan was “modified” I signed and noterized documents and sent in October payment with modification papers. I paid my November 2010, shortly after received a letter from SunTrust saying we were being sold to Nationstar. I called SunTrust to verify and was told to continue to pay my modified payment to Nationstar as of December 1st. So I sent in December payment to Nationstar and recieved a call from Nationstar stating, that according to their records from SunTrust, I am behind my OCT and NOV payment…..HMMMMMM???? I explained the situation and was promised by Nationstar this matter would be “promptly” handled. I have continued to pay Nationstar my payment that was modified and continue to be harassed by them for what they call a delinquent account. I have called SunTrust only to be told “WE NO LONGER SERVICE YOUR LOAN CONTACT NATIONSTAR!” Nationstar claims SunTrust never finalized modification on their end (how convenient), so a letter of default has been recorded, even though I continue to pay my payment. I am BEYOND FRUSTRATED! I just want this to be over. It has been the most stressful year and a half of my life. I am working with an attorney here locally and would love to be a part of this class action lawsuit against SunTrust mortgage.

    It looks like we are all in the same [sinking?] boat.
    We tried to get a loan modification from Suntrust. We were told we had to be behind to even be considered. So we stopped making payments as unofficially recommended by Suntrust, and after three missed payments, Suntrust accepted to review our case. For 8 months, they asked us to keep sending the same paperwork over and over (bank statements, credit card statements, proof of income, tax forms, etc.), but I know now they were just keeping us busy thinking they were actually going to do something.
    During that time, we kept receiving collection letters, but we were told by Suntrust to ignore them as these letters were generated automatically, and since our case was being reviewed, we did not need to worry about them. WRONG!
    In June 2010, we received a final notice to let us know our house had been transferred to some attorney’s office to start the foreclosing process.

    We feel like we have been played by these people. I would be the first one to sign up for a class-action lawsuit against these bastards. Pardon my French.

    same situation with us..our loan modification was recently sold by suntrust mortgage company to NorthStar and now we are being charged for a higher mortgage payment. Maybe we should all unite for a class action or lawsuit!!!!!

    I know what everyone is going through. I don’t even know where to start. I feel sick, loss, frustrated etc… Everything that i am going through i can not even explain how bad I feel. Sun Trust and Nationstart mortgage are the my nightmare. Sun trust says one thing and Nationstart says something totally different. Whom should I believe. Only the people that are going through this situation can really understand. Single parent loss all my savings I have nothing to help my daughter to go to college. And now about to loose my house. i already lost one. Can someone really help us is there a hope for us?

    Whoa! This is an eye opener… I have just spent the last hour reading all these posts and can not believe what I am hearing. You are all correct in the habits and dealing with Suntrust (except DSC, but he had to go to the top og to get his mod done).       We have also fallen victim to the “Home Affordable Modification Program” (HAMP) and are seeking Legal advise as we speek. We are hoping for Class Action suit! Jansen, Strauss & Troy 800.669.9341 or by e-mail jsgatlin@strausstroy.com or wkflynn@strausstroy.com… I vote Law Suit!!!!! 24 mos.+ later after endless calls, updating paperwork, having to request info several times before we finally get paperwork in the mail, no returned calls back and still on the road to no where racking up late fee’s and interest charges on first/second mortgage that we can’t make payments on. We are thankful they haven’t changed the locks at this point, but they did try nov 2009 but my husband ran them off and we called SunTrust as it was happening. They did apologize for that and allowed us to stay. This is a huge problem and SunTrust should be held responsible for new (HAMP) they have found some loop holes that puts them on the fine line of being legally crooked!

    I just got off of the phone with SunTrust. I’ve been calling for 18 mos. now and have been sending in all of the required documentation. I’m told things should be finalized soon. I’ve been told that for a year now. Are there any other Marylanders out there with the same loan mod. problems with SunTrust? Any suits filed in Maryland? I’m at a loss with what to do next.

      I too am a Suntrust client in Maryland. I have been in the foreclosure process for 3 years now, applied for loan mod. 5 times, applied for HAMP, gone through N.A.C.A., and even went through the HOPE organization.
      The HAMP – home affordable program, tried to connect me with lawyers in California that wanted to charge me thousands of dollars to ‘help’ me- basically to do the same thing that NACA does, appeal to Suntrust and threaten them.
      I have been denied by Suntrust because I make too much money, make too little money ( and they can’t tell me how much more I would have needed to earn to qualify- because they said” then I would just rearrange my numbers to qualify”) or was too far behind for them to help.
      Even if Suntrust would just lower my interest rate from our current 5.625% to a competitive lower rate ( the market is currently about 3%-4%), that would lower my monthly payment to an affordable amount. Then they could put our delinquent amount ($95,000) on the back end of the loan. But I can’t even get them to do That!! Our monthly mortgage is currently 37% of our total monthly income, which is above the recommended 31%. Problem is, once you are delinquent, the mortgage company does not accept any partial payments, or full payments if you do not pay the arrears. Then, once your credit is shot, it is impossible to refinance.
      I would love to get involved in a classaction lawsuit. I want resolution to this situation so I can move on, but I don’t want to lose my home ( even though it is $150,000 underwater ).

      Hi Jim, I’ve been passed on to many different managers, directors, supervisors,etc… and they all told me that they were sorry about all the trouble that I had been through and that it shouldn’t take much longer since she was working with me, and I had submitted everything. All of the representatives said the exact same thing, just to find myself talking to someone else because the previous representative, stopped taking my phone calls when I would try to follow up on the status when I didn’t get any feedback.

      That’s why I say they have been taught to use this tactic in handling the customers needing help with their mortgages.

    I have gotten another call from SunTrust on March 03, 2011 – They want me to send in all my paperwork again do to it being outdated. I did this 49 days ago and got a letter from them on 01/22/2011 stating that someone will be contacting me within 30 days. The Rep on the phone told me that because the time had lapsed that I would have to resubmit… This is my fourth submission and they do this every time and now after reading what you folks have gone through… It would not do me any good to get the HAMP Mod done anyway. I too have had it I’ll be hiring a Lawyer within the next week. These types of business practices are unacceptable and offensive. Are there any web developers on this posting that will help me put together a web site for “SunTrust Complaint” forum. The more information on violations the more ammo we have to go to court.     Hi Chris and Ken. I also live in Arizona and last Saturday I was mailed that beautiful foreclosure letter. I talked to Suntrust and they were pointing fingers at Nationstar. I think they are both horrible companies. What they are doing to us just is not right!!!!! Has anyone received any solutions?

    I have the same issue with Suntrust selling my loan to Nationstar. I had COMPLETELY finished and signed off on all the loan Mod. documents with Suntrust and was already 2 months into the modified payments when i got notice that Natiionstar now had my loan and NOTHING from the Loan Mod with Suntrust was recognized ,I was now showing as Extremely delinquent when 2 months prior I was current with all delinquencys and penalties gone. I’m waiting to see how nationstar will handle this. I had to provide all new paperwork after 18 months of back and forth with Suntrust prior. Nationstar has been very accessible and on top of their process,We’ll see!! We all need to ban together against this!!!! How do we do that?? Someone please let me know. cfoley66@comcast.net

      UPDATE!!! I recieved all my loan mod papers and got it all approved through Nationstar. They have actually been very communicative. All the penalties etc. that should have been waived “according to Suntrust” were all added back in though since Nationstar could only go by the $ amt. that Suntrust transferred.So… I have a mod. but my loan jumped 37,000! Is this really help???? Sure my monthly payments are less but now I’m even farther “up side down” than when I started. Any justice out there?? Please contact me with any suits filed in FL. Thanks

    Hard Working American – You are an idiot! Some people are having hard times and all they are asking for is a little help. My Dad had a house for 30 years and the payments were the same $120 per month, they never changed, even when the insurance and taxes increased, because the banks figured it all in. My house payment (30 Fixed) over a 4-year time period increased $318 per month do to insurance and taxes. At this rate my house would have an increase of $2385.00 on top of my normal payment…

    NO! “Hard Working American”, you cannot sit on your high horse and judge us because a company is stealing from us or screwing us over by promising one thing (HAMP) and then pushing it off to someone (NationStar) else.     My wife and I just got screwed by Suntrust. We made trial payments for 11 months and got denied a permanent modification. They’ve given us 30 days to pay the difference between our regular and trial payments plus INTREST! I tried calling them and asking to refinance, reconider, make payments, or move it to the end of the loan. They refused.

    They were selective about my income. My hours at my regular job has been quartered. They refuse to count 1099 work and unemployment as income.

    I took my regular and 1099 pay(NOT including unemployment insurance) divided by 12 and we’re perfect for the debt to income ratio. They told me to go to hell.

    I tried to call the HOPE hotline. It was a waste of time. They agreed with the bank. I’m taxed on 1099 income, have records to prove it, but it doesn’t count as income

    I wrote the 2 worthless shitthead senators from Illinois and got a generic reply back . They were as useful as titts on a bull.

    I was 2 weeks behind 11 months ago, but now I’m 7 months. I was in better shape before I got help from the bank. The HAMP program was a taxpayer financed scam. We’re all suckers for falling for it.

    This has been an absolute act of fraud and deceit. I too have experienced the same acts of Suntrust and now Nationstar. All of our situations mirror one another. If there is anything already in the works to be done to fight against Suntrust and now Nationstar please forward me the info. I am located in GA.

    In 2007 we purchased our home and made all payments on time. In November of 2009 Suntrust propositioned us with a trial modification that was set to carry on for a 3 mth period. We agreed and begun to pay the trail amount under the idea from Suntrust that if we went into this modication without being in the rears that is how it would remain until the modification was completed. After the 1st trail period was reaching it’s end, Suntrust sent us another modificaiton package to complete with a different payment amount. The difference in our original payment was less than $100, which now I see as a blessing. This secong modificaiton was supposed to be completed within 3 mths, but carried on until Novemeber 2010. I proceeded to call Suntrust and each time I was told to continue paying the modificaiton amount until the process is completed. I pulled my credit in July 2010 to reveiw my reporting as I do periodically only to find Suntrust had been reporting me delinquent. I contacted Suntrust and after they reveiwed the matter they provided me with a letter stating that the credit bureaus have been updated and they reported my loan as delinquent due to a clerical error. In November I received another letter from Suntrust advising me my loan had been sold to Nationstar.

    Prior to making my first payment to Nationstar I called them to make sure things carried over properly from Suntrust. They stated that there was no modification, but the loan did have 21k sitting in an escrow that they would apply to the loan which would put me 2mths behind. I explained to them the matters involving Suntrust and they told me they had no info in regards to my claim. I faxed them all the paperwork from Suntrust reflecting everything I told them and their replay was for me to submit another modificaiton request and to start paying the original loan amount. I have been paying my original loan payment since Nationstar assumed my loan. I submitted paperwork for modification to them in January and have not heard anything back yet. They call me every other day about what they see as a pass due amount, but when I ask to speak to someone regarding the modification I am denied. At this point I dnt even want a modification, I just want them to straighten out this mess!!!     Well, I just had to put my 2 cents in. Below is a letter I type up on the 10th of October 2009…

    Hello, My name is Ysidro Martinez and I have a Mortgage Company Issue.
    I was laid off from my job my job back on June 30th 2008.
    My savings (IRA) was already used up because for the 6 months
    prior, my employer was not paying me. I immediately started the
    unemployment insurance benefit. I contacted my mortgage company
    and explained to them that I lost my job and was looking for options
    if their were any. They mailed me a document to sign and mail back
    which put me on a 4 month forbearance. This gave me a little
    breathing room to focus on finding a job and paying other bills. The last
    month of the forbearance was November 2008. I found full time employment
    on October 27th 2008 for a company called Alphacom. On December 2nd,
    I contacted My mortgage company to confirm that this was going to be
    my first payment after the forbearance. They informed me that it was to
    late and that my property was already in foreclosure. They also informed
    me that I was suppose to make the payment in November and that if I
    made the payment, it would have been rejected. The last month listed
    on the form they had me sign for the forbearance was November.
    While discussing this, they informed me that now they were going to
    start the process of a loan modification. So when I could not convince
    them to come up with the forbearance document I signed, I agreed to
    the loan mod. The rep. took a little expense info from me and stated
    that someone will be contacting me about the loan mod. December passed
    and I was not contacted. January came so I contacted them. After finally
    contacting the loan mod rep. I expressed my concern over the time lapse.
    The rep informed me that they were waiting to see the results of their staff
    Meetings since Obama just took office and that there was going to be some
    New operating procedures take place for loan mods. Another month passed,
    So I called in again, to remind them that my property taxes were due at
    The end of December and if not paid at the end of the following month,
    The amount goes up. The rep informed me that he was going to roll
    The property taxes in to the loan mod. He assured me of this. March came
    And no one has contacted me about the loan mod. I called in again. The
    Rep informed me that the new options and new operating procedures are
    Still under review. He assured me that my property will not be foreclosed on.
    April came and I called in only to find it very difficult to contact my loan mod
    Rep that was assigned to my account. Another rep reassured me that they
    ( the company ) would take the months that passed into consideration when
    Figuring out the total amount owed. I contacted them again a few weeks later
    To check the status and they informed me that they were waiting on me to
    Fax in my monthly expenses. They never contacted me to inform me that
    That’s what I need to do.

    I was laid off from Alphacom on May 1st and started the unemployment
    Process again.

    I kept receiving foreclosure documents in the mail. I called in to again
    Express my concern and the informed me that even though they are
    Working on a loan mod, they foreclosure process still moves forward.

    A rep from loss mitigation called me and informed me that they went
    Ahead and approved me for a 120 day non-paying forbearance. While
    Discussing this with her I mentioned that this was my second one,
    She said that If I had one last year then I did not qualify for a second.
    Some how she did not know about last years forbearance.
    This concerns me deeply as to how my account is being handled.

    I found employment contracting in June. I worked two weeks and faxed
    In two invoices and a letter from the company I was contracting for
    Stating my employment and hourly wage. I was averaging $2800.00 a
    Week at the rate of $50.00 an hour.

    With this information, they informed me I did not qualify for any of there
    Options for a loan mod. They said my expenses were more than my income.
    They wanted to send me a short sale package to sell my property.
    Or they could foreclose on it. Neither of these options worked for me,
    Cause the months that passed while they were deciding what to do
    From December to April totally falls on them and they should not be
    Charging me for something they caused. A few days later I called
    In again and asked what income amount they were using for my
    Monthly income and they said $2800.00 a month. This is clearly
    Another mistake on their part. I informed them that the amount was
    Wrong. The $2800.00 amount was weekly not monthly.

    So they disqualified me for a loan mod based on an incorrect
    Income amount.

    I informed them that the county was going to foreclose so I faxed
    in the property tax bill and they took care of this immediately with
    no mistakes. Thus rolling in an escrow account into my loan.

    At this point I am on a 120 day non-paying forbearance. Which
    I did not sign for nor did I qualify for. But when it’s over, they
    Are going to want the whole amount due and not taking into
    Consideration the time that they spent waiting for the outcome
    Of meetings and all of their costly mistakes. Costly to me…

    I am not trying to get out of paying for anything. I just want
    Them to be fair and pay for their own mistakes.

    How do I deal with this…? END OF LETTER…

    Here we are, 33 months later, in and out of forclosure. Currently in forclosre but no sale date, I received a forebearance aggreement offer to pay 3 months of payments. Now that I have managed to save some money since Sept. 2009. I hired an attorney. As soon as I did this, I saw on the news that Fannie Mae is in Austin, Texas helping struggling home owners. I contemplating paying them a visit…

    I would love to join a class action against Suntrust…

    Suntrust….”trust” yeah right! I share a similar story to several of the posting here. Me and my wife’s first home purchase turned nightmare. We had bought a home and were forced to go with Suntrust if we wanted the incentives from the home builder. They were pretty attractive buy downs and rebates. We were told the only program that we would qualify for was a 10 yr IO and 1st and a 2nd. The rate was decent enough and I was told it would be easy to refinance…shame on me. I work at a company and have a variable salary my wife and I also had excellent credit scores with a nice bit of savings. About a year into the home I experienced a change of wage at work and my wife was also expecting another child. I was told that Fannie Mae owned my loan and heard about the HAMP program. We were never late nor were we having trouble making the actual mortgage payment. When I called SunTrust they told me that I might be able to lock in a lower interest rate on a 30yr fixed and all I had to do is modify. We jumped through all the hoops and they put us on a trial payment. They never even explained the terms of the loan just we would have a lower payment. Me and wife made all the payments we were told this would take up to 90 days to complete….what a joke. ….We had made trial payments for almost two years. I called and faxed and emailed every other day practically getting the run around…also I started recieving letters from my creditors about my accounts and fica score dropping. Now I was real frusterated…..Then one day went to the mail box and found out my loan was sold to Nationstarr, like many of you contacted Suntrust who claimed they new the terms of my modification and that the process would pick up where I left off. I contacted Nation Starr immeadatley and was informed they had no idea that my loan was in modification the rep assurred me that they were a different kind of company and that they would help with in 60 days….well that is where I am at now….except I am now calling a different company and getting a different run around. Also to add insult to injury NStarr keeps sending me ceritified mail stating that I owe a back mortgage form the failed Suntrust and if I dont resolve they will foreclose on my home. I need to know if I have rights or a case…..my wife and I have never been late on our regular mortgage or trial payments….we have followed up and jumped through every stinking hoop. All we were trying to do is get a 30yr fixed in opposed to the 10yr Interest only program we were sold by suntrust. Now our credit is faulted and we are in jeopardy of losing our first home. I feel like not making anymore payments and either short selling or walking way as it has now became three years worth of a major problem instead of the American dream or happy home…..any advice good lawyers or help feel free to email me tbrillante@verizon.net I am very willing to file a class action lawsuit against these criminals.

    Hi everyone. I am going through the same thing that so many others have been talking about. I keep thinking…. if this weren’t happening to me, I wouldn’t believe it.
    We applied for a HAMP mod in March 2009. We played the waiting game and continued to pay the full monthly payment while we were “under review”. Finally, in Feb 2010 we rec’d our trial modification paperwork. Sent it back the next day. They promised us a perm mod after the 3 trial months. I called weekly and there was never any change to our account. They told me not to worry to “keep making that modified payment”….they were overloaded with tons of people requesting a modification and to have patience. No one ever told us that that whole time we were falling father and farther behind. Fast forward to November 2010 we receive notice that they are selling our loan to Nationstar. I thought I had problems with SunTrust, Nationstar is worse. They said that they aquired troubled loans…that SunTrust “messed up” and they had to “clean up the mess”. We are still “under review” but we are now in foreclosure and just hired an attorney to buy us time. Nationstar tells us not to worry, but I am scared. If I knew this is where we would end up I would have never started the modification process. What these people are doing is criminal. If anyone has any info on a class action we are in.

    I happen to be in CT and I am in a similar situation as the people who are part of the current lawsuit. While I am not in foreclosure, I have been denied eligibility for the HAMP at least 4 times in the past 8 months. I also work with someone who has a SunTrust mortgage, was denied the HAMP and is now in forclosure. I have pages of documentation showing that I qualify, yet I keep getting denied. In addition, when I first asked about loan modification the company gave me all the wrong information. No-one ever informed that I was eliglible for HAMP, they kept referring me to other programs for traditional mortgages.

    Finally, it came to my attention last week that SunTrust has been sending my denial letters and other information to an address in North Carolina, specifically a family farm, nothing like my property. Neither the homeowner in NC, nor I can figure out how this happened, except for the fact that this family was a SunTrust customer, but refinanced through another company due to a HAMP denial by SunTrust. I am in need of legal assistance, not only for the home loan modification, but for the destruction of my credit by SunTrust and the breach of privacy issues.

    It’s absolutely shocking to read all these accounts and realize that my story fits all of them to a T. After two years, I just received a certified letter of default. Suntrust has clearly acted on a protocol to deceive and grossly mislead it’s customers. This is no coincidence that all of us have had or are on our way to having the same experience. I am in the process of contacting all of my state representatives (Washington State). Everyone one of us needs to spread the word and come together to make these people pay for the hell that have put us through, the stress they have put on our family’s, and destroying our credit.         I’m having a terrible time with even getting SunTrust to call me regarding a HAMP or loan modification. How does one join the class action lawsuit against them? They are forcing me into foreclosure by not responding to my numerous requests.

      This absolutely crazy! Legalized criminals!!!! We had started this modification process back in 2009, and after 2 years of payments and trial periods an lawyers fee’s. We were put in foreclosure in the middle of a modifcation (which is against the law). We finally got a “final” modification on a court order signed in april 2010. 13 payments later, they still never updated us in their so called ‘system” , we just got a letter stateing they are not accepting this modification either. our lawyers are getting involoved again. When will this crap end!

      Strauss & Troy law firm in Cincinnati is handling a class action lawsuit filed in eastern District Court in Kentucky. Not sure if they handle other states. Might be worth googling their phone number and calling them. I want in on this lawsuit as well.

        I wish all you good luck with your situation. I told fella at Suntrust I’d get channel 7 ABC news out here and do a Public Information story about my ongoing dilemma. He said I was “threatening’ them and that wouldn’t help me accomplish my my goal with them. I said “it’s not a threat, it’s a reaction to your company’s inaction and fraudulent business practices”. “I don’t want to be another victim of foreclosure for simply asking you to re-write my loan or work with HAMP program”. We’ll see what happens.

          I am going through the EXACT same thing right now. I have been going through this since September of 2009. I was told by their Loss Mitigation Department that they could not modify my loan unless I was 3 months behind. I sent my 4th month payment in and they sent it back to me. I have since then filed bankruptcy to stop a sale. Then they started the process again, only to lie and tell me I did not have any additional sale dates. In the meantime still working on the modification. As of last Friday, my house went up for auction, after being told I didn’t have a sale date. I found out by having the new owner of my home knock at my door and introduce himself. He has given me 15 days to move out. I now have an attorney. I am going to file a wrongful foreclosure suit and contact channel 7 news. I have been looking for a class action suit against this company.

            I applied for loan modification in August 2009 after I lost half of my income and my wife was diagnosed with utirean cancer. I was told in 2010 April/May that I am in the last stages of being approved. Strangely in Aril 2011, my application was denied. I made partial payments in May and June. I was then asked to resubmit a new application and the one officer asked me to not pay for 2 months and they would start a new trial period. Am I to trust them or what is your advise. I live in California.

    I am in ths same boat. I live in Nebraska and they first sent me a letter that I owed them $2,000.00 in back taxes. I made may mortgage payments on time and didn’t know how that happened. I was going through a divorce and then fell behind on my mortgage payments. I called the HOPE NOW and they called Suntrust, while I was on the line, and we spoke with them and I requested that they postpone the sale of my home. That was in Aug. 2010 and while I was going through the home modification process, they sold my house in Oct. 2010. I never did get a reply from them, if I qualified or not. I called them about this but Dona in the litigation dept said that I never requested a postponement of the sale, WHICH I DID. She said that there is nothing I can do. I am now talking to a real estate attorney on what I can do. Please contact me regarding the class action suit. Suntrust should not be allowed to play with someone’s life like this. I am sure they would not like to get the runaround.

      Call the FDIC and ask them who to contact re SunTrust and what you can do. FDIC oversees all banking and lending institutions. Ask SunTrust what bank is holding your Deed and all of the paperwork that landed the Deed in that bank’s hands. If they don’t/can’t provide you the papers, I’m told you don’t have to pay monthly mortgage until you get those papers. Do your research on-line first. Attorneys are expensive and are making a killing off the gutter-rats like SunTrust

    I am intersted to find out if people living in California have had problems dealing with Sun Trust regarding loan modifications. We want to continue to make our payments, but need a modification.
    At the time we took out our loan through a broker, we had no idea we were signing up for an INTEREST ONLY loan. At the time we signed our documents, the title company just put docs in front of us and did not explain a thing either.
    Seeking help in California for load modification suggestions.

      Cindy – Yep! I’m in California and my loan was sold to SunTrust before I even signed the papers. Shame on Altura Credit Unon who set up the loan!!! I’m having a helluva time with SunTrust. They claim they elevated my account to a negotiator but she NEVER calls me. When I don’t make my mortgage payment by the 10th, someone will be calling me but they’re going to get an earfull. You have to fax your correspondence to them so that you have documentation that you attempted to reach someone. You’ll get a flunky first who tells you to fax stuff to a negotiator but that negotiator never calls you back. They’re even trying to up my County Taxes, and Hazard Insurance. Called County and my HO insurance and nothing has gone up. In-fact, due to property values going down, the bogus taxes should be less than they are claiming. Time to start filing complaints with FDIC, HUD and congressman. I think I’m going to get ABC local news team out to my house and have them do an expose on these jackasses.

    I filed a lawsuit against SunTrust this past year when SunTrust failed and refused to modify my loan. It is incredibly frustrating not to be able to talk to the same person twice, to receive letter after letter that is unsigned in a form manner threatening immediate foreclosure. Twice, I have tendered payment based on the loan modification agreement, and in one instance the check was sent back, and in the other instance the check was never processed. I am meeting with legal counsel later this week, and incredibly, they tell me they are not authorized to settle this case.

    We are in the same situation. SunTrust never filed our Loan Modification papers and has since sold the loan to Nationstar. Nationstar now wants to foreclose.

    here is an idea if sun-trust doesn’t own the property and nation star doesn’t own the property, give it to the person that has invested the most per capita in the property. you all deserve it. check your bank notes with a copy you requested from your mortgage company If names and signatures match up they are on the up and up. if not they need to reconsider their actions.     I have been dealing with SunTrust as well and they do not know what is going on with my mortgage. I get switched around from department to department and no one can help me! Frustrating!!!! I would like to know of any class action suits as well. Is there anyone on the Eastern Shore of Maryland that will be able to assist me and not be a scam!

    I had a modification done and the payments worked. They just increased my payment from 2100. to 3433.27! I told them I can’t do that. ( it was due to escrow) They refused any payments.. Now they say I can pay to escrow but that won’t keep me from getting foreclosed on! They told me to make up the 6 months behind (while working with modification again) I can add the 21K onto my payment over 6 months.. REALLY!! That’s a payment of 6933.27!! My mortgage balance is 412k with a 60k equity all at SunTrust.. My home value now is 300K! Yeah!! I want in on the class action law suit!

    I notified SunTrust of my impending layoff and ask for help with modification in Nov ’09. April ’10 finally got some information and May a modified payment. March ’11 was told we did not qualify for the modification they gave us and sent back our April ’11 payment. Called and was told to make our original mortgage payment and to pay the back amount we owe of over $5000. When I asked how was I suppose to pay it…. Get a loan. If I had the availablilty to get a loan I would have the money to pay the mortgage. Where was I to “Get a loan”…. a familly member or friend. Was told that once a auction date was set that they would be able to stop proceedings to see if we qualified for other programs. When will this STOP

As of Jan they stopped sending me statements. Was told because I was invloved in a modification that it was up to that department to send out statements. I told them I felt that they wanted me to be late so they could forclouse . No one had an answer for me was told send more paper work did so.
    Today I received a statement that I have not paid my taxes or my insurance and have to pay them know. What a bunch of bull. I am still bearly making my payments, still calling every other week with no luck. Next week they will what 2011 taxes. Then it will be something else. Has anyone ever gotten a loan modificated ?
    Is there a class action suit in Northern California I can join?

    I share in your misery. Suntrust Mortgage has put us through the ringer. We finally, after months, got a loan modification agreement. We filled it out, sent it back certified with the payment requested for March. Now they’re saying we owe for March and April. I called on April 1st and paid $550 over the phone. They took that money to pay “fees” even though I specifically requested to make the HOUSE PAYMENT. I will not rest until I get justice here.

    Suntrust has screwed me just like everyone else posting on this page. I was less than 30 days behind on my mortgage and they offered up a modification program. I informed them that I was unemployed and thats was why I was a little behind. They told me to submit the paperwork and they would modify the mortgage. Just make the trial payments in a timely manner. 7 months later…….pay us all the money that was waived for the past 6 months or we will foreclose in 30 days. I was denied from modification because I am unemployed and insufficient funds. This is bulls**t. They knew I was unemployed when they started this mess. If anyone can help. Please let me know. Is there a class action law suit I can get in on in Georgia ???

    Add our family into the mix too!
    We bought a new construction condex and they forced us to pay property taxes on 2 homes for 2 years . It killed our finances and they would not take the other property off despite hundreds of hours of my time.

    They told us that in order to be a priority for a modification we would need to get behind 3 months in mortgage payments. We got behind 2, but I got nervous and called to pay it, but they already put the house in foreclosure! They violated our 90 day right to cure. Plus the paperwork they filed with courts was a mess- totally wrong! Thank goodness I save everything!

    When I paid the past due amounts in full they miscalculated a payment by $12 and used the remainder for more ‘fees’. Yup, a payment disappeared into thin air. They said we need to have a $1000 buffer in our escrow in order to close it! They acknowledge the mistake but refuse to put it back and are adding more fees to our account and have recently sent us another certified default letter?!?!?

    I am going to make it my mission in 2011 to seek justice for the last 7 years of torture!

    I hired a group of lawyers do to the same situations you people are having. Being denied HAMP and having to give them paper work over and over again. The run-arounds and the excuses that we never got the paper work. Our Lawyers are laughing at this now because they are experiencing the same stuff, the same run-arounds and this really does not look very good for Sun (don’t) trust Mortgage. Best advice I got was to hire a lawyer that deals with these situations. Do it, you wont regret it!

        We had trouble with Suntrust as well. We tried to short sale our home twice, gave them two good offers in good faith, and they sat on the offers for so long that the deals fell through and finally they just decided to sell our house at foreclosure. So even when you try to do the right thing, they screw you around.

          We are dealing with the same thing as all of you in Florida. Sun Trust never finished our modification, then sold our mortgage to NationStar who has been no help in trying to finish the modification. Sun Trust has reported me delinquent to the credit bureaus even when I wasn’t now I have to try and get that straight as well. If you live in Florida and are willing to start a class action if the suit above is not representing Florida let me know. We all need to stick together and bring them to justice.

            I am very much interested in starting a class action suit in Florida. SunTrust Mortgage excepted our “modified” payments for over a year but never completed it. Now they told us that it was a trial the whole time and even though we were never past due on our mortgage we are now in foreclosure. Someone has to stop these crooks.

    I can even begin to tell you what a nightmare this has all been! I started my own process with Suntrust in Sept 2009 telling them in January 2010 we would be short on money to pay the full mtg! We have cashed in everything we have, I have done the ring around the tree with them for 8 months calling every 2 weeks! I hired an attorney in May 2010 so it has been a year and still doing the same motion of paperwork, Living Expenses, Bank Statements this has caused an enormous amount of absolute family heartache and aggravation! Not to mention Health Issues I have had…I am beyond over it…But I refuse to give up because that is what I heard they want you to do so they can take your home!! I Refuse to Lose since I have put so much time and effort I will see this till the end!! I begin to think that they must think we won the lottery and hiding it in out bank statement…OUR INCOME IS NOT GOING TO CHANGE…Hello the cost of living just keeps going up why so much paperwork and waste of time we could have come to some agreement before all this…”GREED” is what it is! When we fell short in Jan 2010 they said don’t mail it if its not the full amount we will refuse it…And it goes on and on with tons of conversations I have had on the phone until I am blue in the face!

    Yes, same thing here. I was on the trial program starting Jan 2010. They have been playing me all along. No updates, no follow up. the famous answer is “we are behind, just keep paying the trial amount and check back later”. now all of a sudden sold the loan to NationStar who honors nothing from the modification contract and is foreclosing houses. I dont even thing Suntrust applied for HAMP on my loan as they where supposed to per contact. now my credit is a mess and I’m very mad.

    We started our loan modification process in March 2009. After getting the run around for a year we finally got HAMP mod papers in February 2010. We had been on the trial period payments until November 2010 when we received notice that Suntrust was selling our loan to Nationstar. I feel lied, cheated and deceived. If I thought Suntrust was trouble I had no idea how bad Nationstar is. They immediately started foreclosure on us because they said that Suntrust never booked the modification and we were showing months deliquent. Nationstar said it’s not their fault and are unwilling to work with us. Now… here we are thousands in arrears, lawyer fees, ect. They offered us an “apollo” mod which lowers our payment by around $20 and they tacked on over $11,000 to the end of it. Um, no thanks. There is something really fishy about this company. Has anyone looked at their foreclosure paperwork (if it’s been filed)? Make sure you check your assignments. Nationstar is participating in foreclosure fraud and I have proof. We are fighting them in court and they have a lot of explaining to do.
    Everyone, don’t give up and complain to everyone and anyone you can. There is power in numbers. We need to get Nationstar shut down for taking away homes that aren’t even theirs.

    Ok I think this is crazy, how can a company do such a thing. Every story I’ve read has been just like mine, so I’m on the research path. NACA is a non for profit and they offer tons of services, Ive already signed up and going to a work shop in June to see what they can do for me I advise any one who has been duke to attend.     Unbelievable… The fact that we have all been decieved in the same ways by the same company seems to equal….”lawsuit” I was told to stop making payments on mortgage to show we were behind. Then we were told to keep making trial payments even though we received NO statements from Suntrust for over 6 months. Now they added $12000.00 to the back end of our total mortgage because of various fees, but still tell us we are behind in payments. When I got my monthly payment back in the mail today I went off the wall. Called them and they basically said they didn’t want it because we owed more than that amount. Every time we call we get a contradiction to last call and even paperwork we recieve, contradicts themselves. We are at our wits end as seniors, we need to save our home! When we asked to speak to managers we were told “there is no one to speak to”. Asked if there was an office here in NJ they gave us a name, but when we contacted them, they said they were unable to help us. Is it all smoke and mirrors? Please, if there is a class action suit, put us on the list. This is our 4th home and NEVER,NEVER had to be abused by such irrespondsible lowlife. THey sure put a hole in the American Dream!

    My Suntrust story is similar to the rest. I am in the construction business and have seriously been impacted by the death of the construction industry. I lost my business that employed 40 people. I lost my 3 commercial business properties. Because I had always signed personal guarantees for my accounts, I was forced into personal bankruptcy. If anyone deserved a mortgage modification I thought it would be me. I got a job that pays me less than half of what I was use to making, and I was using 90% of my salary to pay my mortgage. Suntrust told me I did not “qualify ” because I did not make enough money. My mortgage is $5000 per month. Suntrust told me that my income would need to be close to $10,000 per month to qualify. I THOUGHT IF I MADE $10,000 PER MONTH I WOULD NOT NEED A MODIFICATION. I got my income up to about $9,500 per month and now they do not believe my income. I moved my father into my house and he pays $2500 per month and I rented out my barn for $1100 per month and my wife got a part time job (she also cares for 4 children). Suntrust asked for proof of my fathers income. I sent them his tax returns and W-2 forms from his two retirements. They say they need original award letters and nothing else will do for proof of income. His retirements are Military and Civil Service both W-2’s clearly state his yearly award. Why would they need anything else? They also do not believe my income. I have sent them every bank statement and paycheck, but for some reason they say my package is incomplete. I do not know where to go next. I have a friend who has hired an attorney who was able to get an injuction agaist the foreclusure sale. The attorney says judges are starting to side with the homeowners. I think next months payment is going to pay for a lawyer.

    There is something fishy going on with Suntrust. I am agreeing with almost every comment here. I had a modification last year may 2010, not through HAMP but by request. They lowered my payment @about 200.00 and tacked on the past due to the end of the loan (which I did to get the mod). they told me I would still need to pay $1000 to get it done. after 8 months of payments on time, we fell short again as husbands income changed. At this point we filed BK7 with plans on keeping house but lowering our overall debt to keep the house. We received a letter from Suntrust (without our prompting) that we were eligible to modify again. I sent in all the paper work, and let a few months go by without making my payment, thinking we could modify, but knowing we couldnt if we werent behind (which I do take responsibiltiy for). We were then sent a letter saying the investor won’t do another modification as we didnt make 12 months of consistant payments on the new mod. Ok. still understood, but not happy. I researched my options of help with arrearages and here in california we have 4 good plans to give the banks money, under KEEP YOUR HOME CALIFORNIA, which we qualify for several of those programs. Only one of those is a loan/principal reduction program, but the others pay up to 6 months arrearages, or help with unemployed persons. etc. Suntrust will not even look at taking any money or agreeing to be a service provider. I don’t understand why they would not join as a provider and take $15,000 from this fund set up to help people like me. I am not unemployed. I make a good income (85k) and can support payments, just not the arrearages. We fell behind originally as my husband lost his 90,000 a year job and we did have debt that we had to restructure under a BK. But our situation has improved. My health insurance costs went down $500 a month. Debt went down. I received a raise. I have shown them proof of this, but it begs the question that knowing all of this, they refuse to take part in in Hamp, KYHC or any program that offers assistance. WHY??? I had to ask.. I sent all the CEO’s letters and copies of letters from congress urging the large banks to participate and asking them to take a second look and also become a provider with KYHC or hamp. Many large banks have signed on, such as Bof A, wells fargo, citi etc. and I watch this list grow everyday…but SUNTRUST will not do it. see:

    Suntrust refuses. I have sent letters to my local congressman and they contacted the California corporation on my behalf. Yet Suntrust says they never received correspondence. I called Hope now, the link posted on Suntrusts sight to “help”, but Suntrust never read any of the info from them (or says they never saw anything). I just get we don;t participate in these programs. Its all a front as I see it and they don’t want to help the homeowner, even the ones that can support it. Does this make any sense why the bank would not take government $$$? A large fund that was set up here in cali? This is the money we as taxpayers pay for, and should get help when we need it??? This is our TARP.!!! This is a fund that does help us directly, unlike the other bailouts, yet now Suntrust refuses to use it. It makes one wonder why they would want to foreclose, when only $13,000 is due, the house is worth 100,000 less then whats on the mortgage, so if they foreclose what are they really gaining?? What is the thing I cannot see or understand??? But they won;t take assitance? That is something I cannot figure out and could very well lose my home in the fustrating process. Yet not a word of hope from them. Can someone explain this to me???

    I am just another Californian in the same boat with Suntrust! They approved me for a Loan Modification trial period that started January 2010….I called every month as i was instructed and offered to send in any paperwork they needed! I updated my pay stubs whenever they asked…I would fax and overnight any and all paperwork. Every month i got the run around with some new customer service agent and was told my “file was under review!” In January 2011 I got a letter that stated I was denied a loan modification cause they were missing paperwork. I called and asked what paperwork I could be missing as they must have a 10 inch stack by now. I was then instructed that I had to do another Loan Modification because my first one went over the 3 month trial period…now they wont modify me. I just sent in my paperwork to NACA to start working with them.. Does anyone in California (Northern California) have any advice or any good attorneys that they have had success with? Has anyone delt with NACA? I want to keep my home and kept my end of the deal with Suntrust and feel hopeless at this point! Any help or advice would be greatly appreciated. Thank You!

    Does anybody know of any class action lawsuits in Illinois. I can’t believe that all of these people on here are going through the same hell as I am. There has got to be something we can do. In 2009 my husband walked out of me leaving me with 3 kids and a pile of bills. I contacted Suntrust to see if they could help. Here we are 2 1/2 years later and my house just got sold at auction. During the time that Suntrust was supposedly trying to get me a loan md. they would not take any payments from me. They screwed up twice on my loan app’s and I had to start all over again twice! Now they are saying “well, you’re 24 months behind” I screamed at them and told them thats because you wouldn’t take any of my payments!! They were still charging interest and fees over this 2 year period so that incresed the amount that I owed making it impossible to get a loan mod. The balance on my house when I started this was $204,00 and its $260,000! House isn’t even orth more than $180,000 right now. I have to find a place to rent for my 3 kids and my pets. Suntrust ruined my credit so bad that its going to hard to find someone to rent to me . They knew what they were doing. They knew that I was a single mom with 3 kids. They are heartless bastards! I was thinking about getting an attorney to sue these bastards but I would also like to join in on any class actions law suits if there are any in Illinois. Do people all have to live in the same state to be included in a class action lawsuit? We have got to do something! They are not going to get away with this!

    In April of 2009 we applied for a Loan Modification from Suntrust it took them months to do anything.Lost paper work and mistakes on there part caused endless problems.We were told in January 1-2010 that it was a done deal and told us our new Interest rate and new payment which help us keep our home so we thought.In Decenber of 2010 they sold our mortgage to Nationstar and our problems began.We were told by Nationstar that our Loan Modification was no good and we owed thousands that we were behind in that we never sent in complete payments for a year our more.We had sent in our new payment that Suntrust told us to.Seams they sold the mortgage without telling the new Mortgage Company where we were in the Loan Modification.Most of you are now saying WoW But that’s not the end we are about to lose our home because of there blunder.Also there is nothing good to say about any of them.Nationstar has hounded us from day one with 4 to 6 calls a day and in the off hours they use computer generated calls .In all the time Suntrust had the loan they just took the check and went on like everything was well.Watch out people or you may next to be screwed by these mortgage companys

    I lost my home because each time I sent in the paperwork for a modification, they lost it or dropped the ball. When you call you can never get a “human” on the phone and if you are lucky enough to get one finally, they put you on hold and then the call gets disconencted. If you call back, you have to start all over with a new person trying to explain the situation to them. How frustrating! No customer service at all…..

    Wow! This is painful to read!!! I’ve been going through exactly the same thing that most of you have gone through. I began my loan modification process in December of 2010. Suntrust would ask me for more and more documents, which I promptly provided. They would give me date approximations of when this modification would go though, yet nothing got done. Finally, they opened up an escrow account for me and said that my loan was in process of modification. The next month, I received a statement on which they had added my taxes to my monthly payment, which had not bee modified yet. I called suntrust and asked them why they had added the property taxes to my monthly payment, since (1) I had already paid the taxes up to July of 2011 and (2) they had not modified my loan yet. They explained that this was standard procedure in order to finalize my loan modification and that I should not worry about this new payment amount and should continue paying my regular mortgage payment. They confirmed that all was going well, and that all would make sense once the loan modification had been finalized. Then, in May, I received a letter stating, “A review of your loan modification request has been completed. Unfortunately we are unable to offer you a Home Affordable Modification.” Wow, my heart fell to the ground! Anyway, since then, I’ve been requesting that Suntrust delete the escrow account from my loan, so that I can move on to Plan B. They have not! I call everyday and everyday I receive a different answer from their representatives. I’ve continue to pay my original monthly mortgage payment (the one without the taxes, since I’ve already paid them)! Meanwhile, their collections department keeps calling me, up to 7 times a day. Interest and penalties are being accrued daily for an amount, which I don’t owe, and they don’t seem to care to get this escrow account deleted. Why are they not deleting the escrow account, I’ve been asking myself for months?! All they need to do is delete the escrow account, so that I can know the real figures of what I owe (for the two months that I fell behind) and pay them, so that I can keep my home. I guess, you’ve answered my question! They want to drag me along, until interest and penalties (on an amount that I don’t owe) keep accumulating to the point where I am unable to pay them; resulting in one more foreclosed home! This is THEFT and our government is doing nothing about this!!! I must continue to call Suntrust everyday, every hour until someone deletes this escrow account once and for all!

    I was on military deployment and missed 4 payments. when I got back,I attempted to make up these payments and get caughrt up. ASs soon as suntrust new I was home they filed foreclosure on me. I fought with them for over a year, the whole time sending my payments to them. They would not accept my payments and sent them back to me.Now after more than a year I was over a year behind, not by my fault, but by them not accepting my payments. Remember I was only 4 month behind when I returned.They would not modify the loan. they said I did not qualify. They started my loan over at 30 years at 20,000 more than I paid for the house and I HAD ALREADY MADE FOUR YEARS WORTH OF PAYMENTS ON TIME.My payments are now about 500 more than they were before.

    my father has been a victim of thier “promises”. he had a heart attack and required immediate surgery. after promising to modify and lower and attach his escrow balance to the back of his loan, i found out later that escrow balances can NEVER be modified. my father and i were lied to numerous times about this. our payments that we sent during the modification process, we were told in a “special holding accout”, which now they say have no record of. 6 MONTHS OF PAYMENTS! GONE! they recently sent us an escrow statment stating the the mortgage payment would be 3 TIMES the original payment. THATS WHAT YOU CALL A MODIFICATION! my father being a heart patient now for 2 years had additional heart complications beacuase of him dealings with Suntrust. now he doesnt qualify for a modification because his income is considerably low due to his health. Suntrust mortgage will not allow me to put my name on the deed of his house, buy his home from him, beacuse they have a “NO FAMILY BAILOUT” policy……. what are we suppose to do with such reckless disregard!

    OK – Folks!
    I just had Suntrust Audited by a firm (Forensic Audit) and found that they have violated many State and Federal Procedures/Laws plus practiced in Predatory Lending. We just got the loan rescinded, wiped out, and they have to send back every payment we sent to them over the last 2 ½ years. They have 10 days from the 08/12/2011 to appeal – We have them on the run – Life is good!

      Please let me know what firm you have used! I have been dealing with these retards (..unTrust) since 2008 and the only thing I have achieved is modification by adding up late payments and fees on the back of my mortgage. My house lost 30% of it’s value and ST is just asking for payments.
      Here the sad part – my mortgage is securitized and “the investor” does not allow modifications at all. My interest rate is …. 7.5% (WTH)…
      I refuse to pay $4400 per month for a small house that my kids know as their “home”.

      I am very ready to do anything – law suit, audit, BK… whatever it takes…

    I have been battling with SunTrust for nearly 2 years. I have tried dealing with the CEO down, incompetence at its best. No return phone calls lost paperwork, the list goes on. I find it strange that the Attorney Generals Office is not proactive considering the higher than average foreclosures there are in California. I think a little pressure from them on SunTrust would bring them to book. I have found that the people from NACA are on your side and more than helpful. Most people from that organization are ex victims of the big Bank boys. If anyone knows of a class action I could join in California please let me know.

    I have been battling SunTrust for 18 months now. i lost my job. I was laid off a year and took a job paying alot less than I was making. I would call SunTrust and never could talk to anyone other than a call center. They owouldn’t let me talk to the person in charge of my loan. They started foreclosure proceeding. I wanted to save my credit so I decided to do a short sale. I had a buyer and we waited 4 months. We faxed documents to SubTrust 5 time in the 4 months because they kept saying they didn’t recieve the documents that we faxed 5 different times. The buyer got tired of waiting and walked away. now I am in foreclosure again and my loan is on hold. Whatever tha means.

    The goverment needs to step in and straighten these banks out. This is BS they way they treat TAX PAYING AMERICANS!!!!
    IS anyone interested in starting another CLASS ACTION SUIT against SunTrust? I am.

    I’ve been trying to get a modification for 3 years, Suntrust originally sold my loan to Litton Loan Servicing and they inturn resold it back to Suntrust a few months ago. I have done everything I could to attain a modification but both banks do nothing but continue to ask for the same documentation over and over. This whole process is frustrating. Would apreciate any help at this point.

    I have already lost my house to foreclosure with Suntrust a construction to perm mortagage loan. Some of the same issues I have read here I have dealt with. I was so ripped off by SunTrust in this construction to perm loan it is unbelieveable. Is there anything I can do after the foreclosure has happened if I was unfairly treated. I tried to hire an attourney to sue SunTrust but after a few thousand in fees his advice was I wouldn’t have the money to fight Suntrust so I should just cut my losses and startover in life. I lost my house, my savings, my 401K. Is there anything I can do? Class actions suit? Just tell me where and how.

      We are in NC and had problems with out SunTrust Construction-Permanet Loan conversion 2/2011. We are currently in Superior Civil Court for Breach of Contract (representing ourselves). The loan did convert months later once we met their unrea$onable terms. SunTrust has since stopped their Construction-Permanent Loan program.

    My husband and I also tried to get a loan modification with SunTrust after my pay was cut. They took our application and almost immediately started us on trial payments. After about 4 months of my constantly inquiring as to when we would receive a modification, the rep. at SunTrust told us that we never qualified and had to become current or risk having it put on our credit as be delinquent. To our surprise it was already on our credit as our being two months behind even though we paid them exactly what they asked for each and every month on time. Later we were forced to file chapter 7 at which time our loan was discharged. Maybe two weeks after receiving the discharge we received a letter from NationStar saying that they were now our servicer. Since then they have repeatly tried to get us to sign the deed over to them. What these people have put us through, I would be more than happy to join this class action lawsuit.

    I live in Ca. Suntrust was my mtg. I now rent “my house”.
    I purchased in 2007. I qualified for the 1st time HO. prgm but declined it because my realtor (crook) told me I would be unable to re-fi later, as I had that in mind for college $ for my daughter. He told meI needed a loan broker who could get me a great deal. (found out later her license was suspended). I put dowm $85,000. I was on Soc Sec, finishing up treatment for cancer. The payment were to increase $1000 after 4 years, with another increase after 2 more years. In fact they had increased by $500 in just the 1st 4 years.
    I applied for the hamp in 2009. I was again receiving cancer treatment, receiving the same income of Soc Sec.
    The day after my home forclosed I received a letter from Suntrsust stating I did not have enough income to qualify. I had never missed a payment sin since 2007 & I had paid all the trial period payments. I had also sent in 2 pkgs of the application process because they had “not received” my pkg . I had the fed-x receipts and I talked to them on the phone & they DID have my info. I called & called & also got the runaround. When I demanded to talk to someone qualified I was told that they were going to submit my application to a different program but I had to be in default to do so.
    So (trustingly) I withheld my payments & was so assured the paperwork we would be in the mail I decided to put in hardwood floors, etc. I called & called. I talked to HOPE and many other who were supposed to be helping me.
    Then, out of the blue I got notice that in 6 days my house would be auctioned off unless I came up with all the back payments & about $12,000 in late fees. Once again I was on the phone & was told the sale
    would be pulled. That didn’t happen
