Arkansans Charged Medical Record Sales Tax Fees File Class Action Lawsuit Complaint Against HealthPort.

A class action lawsuit has been filed against HealthPort (“HealthPort” or “Defendant”) in Pope County Circuit Court in Arkansas alleging, among other things, that HealthPort, a Georgia company that maintains records for health care providers, charged Arkansans an alleged illegal fee identified as a “sales tax” when they request copies of their medical records, according to a class action lawsuit news report.

The HealthPort medical record sales tax charge and fee class action lawsuit reportedly seeks reimbursement for all Arkansans who have paid such a medical record sales tax charge.

    Can a medical records storage company based in Wisconsin charge Wisconsin taxes on patient records from Pennsylvania? Wisconsin levies taxes for medical records requested in their state, but according to the most recent medical records fee update for PA, no PA tax charges are required. Any thoughts?

      If you are referring to the class action lawsuit in Allen v. Healthport Technologies, LLC, Case No. 12-013154, pending in the Circuit Court of The Thirteenth Judicial Circuit in and for Hillsborough County, Florida, General Civil Division, visit the website maintained by the Class Action Administrator in that case at http://www.healthportclassaction.com. According to that website:

      “You can exclude yourself from the class by sending, by mail, a written “Request to Opt Out” to Allen v. Healthport, Class Action Administrator, EXCLUSIONS, c/o A.B. Data, Ltd., PO Box 170500, Milwaukee, WI 53217, postmarked no later than April 16, 2014. Your request must include: (a) your name, address, telephone number, and statement that you want to opt out of the lawsuit; (b) the case name and number: Allen v. Healthport Technologies, LLC, Case No. 12-013154; (c) a statement that you requested copies of medical records from Defendant since March 9, 2009, and that you believe you paid charges in excess of 25¢ per page after the first 25 pages; and (d) your signature.”

    Yes i live in fla and have paid several of dollars on medical record trying to get my ss plus if i wanted a copy for myself i was charge double . So if i can be added to this lawsuit go for it… I would love to have all the hundreds of dollars given for medical records.

    The reason for charging for a first set of any medical records is against the law. But for them to charge for copies for any type of allegation, should be also. I have had Martin Memorial Hospital in Stuart, Florida and Florida Hospital @ Celebration, Florida to want to charge a $ 1.oo a page, and this is for a first copy. These are your records, they have already been paid for so make the copies needed, with NO CHARGE.

    Received a postcard concerning a lawsuit addressed to Judy A. Stein, 4604 Cedarbrook Way, Lakeland, FL. No such person lives at this address or has ever lived at this address. You have the wrong address for this person. There are two Judy A. Steins listed in FL, one in Safety Harbor and one in Sebastian, FL.

    Why are you people putting your names and addresses on this website, very risky. Medical records are confidential and releaseing them is not as easy as going to Kinkos. What is the state regulated fees for releasing medical records in FL? Do you know? If you don’t know what is allowed to be charged according to your state legislature, I would check that out before signing up for this class action law suit. If you are upset with the state legislated fees, contact your congress person. Why is your state regulated to charge for copies? Who contacted the state legislature to make this a law? Attorney? I wonder. be safe my friends.

    You people are charged for your medical records because it cost money for the paper and ink it takes to print them! Hello?!?!?! Big freaking deal!, most of you are making such a fuss over a few bucks…get a life!

    My mother was in a nursing home for a fall and she has Alzheimer’s. During her stay she had a wheel chair pushed into her leg and got Mersa. No one a the Nursing home told me and I continued to question why she was not being released when they told me she was fine. The Assisted Facility where she lived prior checked her out and excepted by back and shortly we found out that she had Mersa which is highly contagious, an open sore flesh raw and very painful and a wrong to bring her back into an other facility. Mersa got so bad she could no longer walk and was bed ridden. She had painful doctor visits where the scraped the wound. They claim she did not have it a the Nursing Home.
    I requested her records for the nursing home and they charged be $45.00 for the records and would not allow me to see the records they only allow what they wanted to release. They covered up her infection they tried to treat it but used the wrong medicine. Her doctor said She could of died or never walk again. Her doctor pulled her through it but everyone was being exposed.

    Final analyze is that they got paid for not caring for my Mother, gave me a hard time and charged me for my mother’s records which is her records and lied to another an Facility who wants to protect their people. You need those records to pass them on to her Doctor so he can understand what has gone on during her stay, they never passing any info over to her primary care doctor.
    Everyone needs to become more aware and keep your own set of records.
