Homeowners File Class Action Lawsuit Against Bank Of America For Allegedly Failing To Modify Troubled Mortgages

A class action lawsuit was filed against Bank of America in U.S. District Court, Western District of Washington (Seattle), No. 10-00488, on behalf of homeowners alleging that Bank of America reneged on a promise to modify troubled mortgages as a condition to accepting twenty five billion dollars of federal bailout money, according to a class action news report at news.yahoo.com/s/nm/20100323/us_nm/us_bankofamerica_mortgage_lawsuit.

The Bank of America class action lawsuit reportedly alleges that Bank of America agreed to take part in the U.S. Treasury Department’s $75 billion Home Affordable Modification Program (HAMP) since it accepted bailout funds from the Troubled Asset Relief Program (TARP), but allegedly had an incentive not to modify loans because doing so might cause it to repurchase more loans, collect lower servicing fees, or assess lower default charges because fewer payments would be deemed late.

    I ask for a modification back in October,2013 when I received the modification notice I declined the modification and I was suppose to pay my mortgage of $827.68 and It was increase over and over again just when it was suppose to be back they charged me $971.02 and now it’s $2,429.39 a month I was injured on the job and I make $ 1,000.00 instead of $3,000. Why would I approve an increase when I could not afford the first one, I was suppose to be canceled out and I was suppose to go back to where It was $827.68 a month and their was not suppose to be escrow. What can I do to get this back I am 63 years old my husband is ;84. Please can you help.

      My experience with BOA is as many many , others. Almost letter by letter. We can’t allow this to continue destroying peoples lives. There has to be a way to end the BOA liars, with restitution for all the hell they create for homeowners.
      I plan to continue for as long as it takes to bring resolve and for all homeowners, restitution. There should be an end to the Devils On Earth, BOA!!
      I may be old and tired of the hell I’ve been through, but not a quitter.
      I realize some info in this article is “oldlawsuit”.. But if that’s the case, there needs to be a ” New” suit started since BOA is continuing their deceit, lying , Stealing, and every illegal practice they can possibly scam homeowners with. We as customers wouldn’t survive one single item of such actions they have pulled, we would be behind bars.

        We had the EXACT same problem with BofA. I sent complete docs in with a promise for a modification in 2012. I called and called and they said they were impressed by my complete package and there were no conditions left, they were only waiting for a decision. The first red flag was that BofA WOULD NOT ACCEPT ANY PAYMENTS during the modification process. They said if I sent a payment that they would send it right back. My husband and I were so uneasy with this stip. I called every week for 3 months and heard the same story from BofA. I hung up the phone in tears during the last month. Then, Seterus called ME and said they were our new service company and that BofA let them have our mortgage!!! They said they had not yet received our full file and until they did there was nothing they could do to help us understand what was going on. Another 4 weeks go by and Seterus explained that they had all our info and they would be happy to modify our mtg. MEANWHILE, they had us at 4 months PAST DUE!!!!!!!!! We had to accept a trial modification with no terms if we wanted to avoid foreclosure.

      PLEASE READ THIS.

      I don’t mean to sound terse since most people simply don’t know, but this forum and the article discussing an old class action law suit in Washington state isn’t remotely what you think.

      Here’s the key …

      YOU MUST LEARN how this all works, or the banks and courts will easily, happily gobble you up like the hundreds-of-thousands of homes they’ve already confiscated.

      Here’s a few things you’re going to have to get under your belt in order to understand what’s going on …

      1 ) A class action lawsuit is NOT a magic fix. You cannot simply sign up and expect some wonderful resolution with the big-bad-bank that is trying to hurt you. The fact is that the LAST thing you want to do is resort to a class action lawsuit. A class action suit will:

      A ) Strips your individual case of the details that judges and juries take into account when deciding if you — as an individual case — have been wronged. All class action lawsuits “corral” filers into a narrow set of criteria and homogenizes or lumps you together under a very narrow view of what the bank did wrong.

      B ) All class action lawsuits are SPECIFIC in their complaints AND, unless filed in Federal court, SPECIFIC to residents of a particular state. If you are not in Washington state, you can’t file with this lawsuit or any other class action that’s not in your state.

      2 ) This is an OLD lawsuit and long since concluded. For some reason, the mere existence of a lawsuit, even if sometime in the past, and people have some silly hope that they can get retribution or compensation from it.

      Wrong.

      THERE IS LITTLE HOPE for your home and your assets if you simply get in some line, join some group, or depend on someone else to save you.

      3 ) Please pardon the caps, but this needs emphasis …

      THERE ARE NO HEROES.

      You CANNOT depend on some hero to step in and save you or your home. You MUST be your own hero, educate yourself AND fight this thing YOURSELF. Even with an attorney, YOU must be the lead in the fight.

      There are NO heroic law firms that are jumping in and saving homeowners from the big-bad-banks … maybe a few that try … maybe one or two here and there that feel they have an edge … but NEARLY ALL are running from confronting banks like a herd of deer from lions.

      4 ) A class action lawsuit should be the LAST thing you try to get compensation for damage done to you … AND … a class action RARELY stops a bank or offender from continuing to offend. IF you win … a BIG if … they simply write a check (usually pennies compared to the money they made) and continue to be offensive.

      5 ) This is critical …

      You should not even go to court AT ALL.

      Banks have thousands of lawyers at their disposal. They know every nook and cranny of the law. A courtroom is THEIR battlefield, and they know every trick and strategy there is. STAY OUT OF COURT and fight them by making every single thing they do both public through the media AND through state and federal politicians and agencies. BE RELENTLESS in calling attention to their behavior.

      THEY HATE PUBLIC ATTENTION.

      Use that.

      6 ) Not only that, but courts and judges — this is a sad fact of the matter — FAVOR the banks, openly, blatantly, and walk into their courtrooms already believing that homeowners are simply trying to rob banks. Many judges (and their staffs) have stock portfolios that INCLUDE REVENUES AND INCOME from the very banks that are being accused in their courtrooms, yet no one stops these courts and judges from prosecuting and persecuting you.

      7 ) If you DO find yourself in court — and you should fight like a badger not to, dragging agencies and politicians and the media into the fight — when you go into court, IMMEDIATELY point at the banker’s lawyers and say, “These people are trying to illegally confiscate my home!!”

      Why?

      Because those same lawyers will be walking into the courtroom pointing a finger at YOU calling YOU a criminal that’s merely trying to rob the poor defenseless bank … and all to often the judges BELIEVE THEM.

      Get this right folks.

      LEARN what you’re up against.

      LEARN how courts work … how they REALLY work.

      TRUST NO ONE and educate yourself.

      FIGHT like a badger, shed ANY shame or guilt you may have and POINT YOUR FINGER PUBLICLY at the banks for this criminal activity by involving every media outlet that will listen, every politician and state or federal agency you can muster to look at your case … BE RELENTLESS.

      Lastly … and again, pardon the caps …

      THERE ARE NO HEROES that will save you.

      You have to save yourself.

      For your own sake, please scroll up on this page and read my 25 point list of things that might help you save your home. These aren’t “my” things, but come from discussions here and elsewhere. They are things that people have used that WORK to fight these criminals.

      I had a 2 mortgage loan with Country Wide mortgage and Bank of MAerica took over before 2011. in 2005 I paid back in total $27,000 back for one of the mortgages and had a interest only loan with good income. They denied me a new principle and interest loan and foreclosed on me in june 2011 . What can I do?

    These people have been screwing with us since they took over countrywide home loans they promised us to lower or modify our loan and after over a year they kept saying we need more papers even though we went to one of there home loan branches and their own people faxed the papers still they cant find them for the fifth time. They even told us to stop paying until they could get it straight and returning the payments we sent now they have transferred it to 3 different company’s who want the same paper work over again Greentree,
    now Northwest something and another company they file repos then when we get Keller Williams to help us the day of the court case BOA cancels the repo now both scum bag firms NW and Greentree both want $$$$$ and we are due for another repo court time in Dec. I am live with my wife and 2 kids and collect Social Security and cant even pay for all my bills the value of the house and property is now down to $65k when we still owe $ 125 k the mobile cant even get reified or any thing so were screwed. I was told we could not join the suit as it was settled along time ago I have lots of these comment saved on my computer SOME ONE PLEASE HELP these IDOTS should cancel the loan because the property is not worth it and it is totally now worth fixing unless I move this piece of crap out and build something else here. The BOA IDOTS have caused me so much stress I am taking heart meds three some times four times a week from the stress I have no Idea of what to do. HAVE A HEART BOA

      they also have said we signed with them after Countrywide which is a BOLD FACE LIE .
      Since we got this place in 02 we signed with Discovery Mortgage it was sold to Ocwen, then we went to Countrywide and have been getting screwed every since even with them and a old employee Robert that promised a lot of crap but screwed us we have hade no recourse against any of them Countrywide told us way back since Robert does not work for them they cant help us

      I agree. My home was paid off and they still took it. They were working with deutsche bank. I even worked with the attorney generals office. They contacted them. I also paid for my day in court,but the judge refused me my day because I didnt have a lawyer. Now BAC admitted drawing up fake mortgage loans and selling them. got a raw deal through the courts.

    i was also one who got behind on my mortgage note and contacted boa for and home modication. they ask me to send all the infor they requested,and i did.but every time i contacted them they said they did’nt received this infor. they foreclose and they sent the sheriff serve eviction notice on me.i went 2 years trying to get my home to get this modication loan. i want some one to contacted concerning and class action lawyer.

    In August 2012, I had a major stroke, requested assistants, was assigned a case worker and this process has been going on and on since then. I was advised after spending my 14000, in savings to make my house payment, that they could not help me because I had not missed any payments, I was also advised that I did not qualify for assistants and that they would not accept a partial payment. Wake up America! Bank of America and all officials involved in FAVOR of the banks, including judges and their staff members that have stock portfolios that INCLUDE REVENUES AND INCOME from these very banks that are robbing the innocent and practicing housing, and disability discrimination in their banks and courtrooms. I challenge the courts, governments and banks to put their money where their mouth is.
    The government no longer works for the people fire them, you would fire a roofer if he did not do the job right, well fire them all. Bad reputations and publicity about these people, banks, judges etc. will travel like the recent forest fires. Stand up and execute them with bad BUSINESS PRACTICES. Let the whole world, every media cite be made aware of these practices.
    Back to the point, I have already been assigned more then15 case managers; of course nothing gets done on my case, because they keep changing case managers. The most recent letter from them is telling me about starting procedures on foreclosure, isn’t that sweet. Gag me with a spoon, these practices smell like rotten eggs.
    Here is the issue, suffered a major stroke in August, followed by open heart surgery. I have been on disability, a mere 1244.00 dollars a month, and a house payment of 1385.00 a month.
    For starters, instead of our government giving money to banks and businesses, how about giving those on social security and disability a decent source of income, and bailing us out. Therefore we can make our house payments and pay our bills, and act as responsible adults who have integrity.
    For those of you, who think I should get a job, try these shoes on, DO NOT TELL ME TO GET A JOB? I am 58 years old, have a new disability and a master’s in Public Health. I am not uneducated, lazy, or any other thoughts you may have, I actually graduated from my masters, 15 months after my major stroke and surgery. There is proof that I am not a quitter, I have tenacity, spunk, and persistence. However besides our government and businesses practicing housing, disability and age discrimination, we need everyone to open their eyes and help us make changes. I am willing to stand up and fight how about the rest of you? We have nothing to lose, why not.
    Remember if my Father God is with me, who can be against me. No one, God is the designer of this world and grater then all. How many businesses, banks and courts are willing to take me on my challenge or are all of them chicken lilied yellow backed cowards.

    Scriptures say you will reap what you sow. Wait until the coming of God almighty, what goes around will come back around on you.

    I bought a home in 2006 and had a Countrywide mortgage. After the economic crisis, the HARP program was introduced and I tried to use it. Bank of America had bought Country wide and every time I tried to get help from BofA they claimed my loan did not qualify. I got all my documents together and my case fit well into the economic bracket for receiving assistance. Every time I tried to get help from BofA they claimed I did not qualify, and I kept calling them about it. I feel the bank behaved in ways that hampered my access to assistance. The Banks got bailed out and I got no help. Susan

      There is a BoA Civil suit regarding all their auto-mated Robo Calls. After all the Class action suits BoA settled.. there requires many more, cause there is No_Change from BoA at all..!

      I was told we have a Suit against BoA in Penn. for this ongoing Fraud against US. BoA has lied by Charged me a $41 late Fee since Oct. 2014 just to Destroy My Good Credit.. I was NEVER late once..! I’ve contacted My Senators & spread the word. We need a Young upstart Lawyer to show US Honor.

    Anthony Tucker, October 15, 2014 I went through the long process to modify my mortgage with Bank of America for two years and was denied. They turn my mortgage over to Select Portfolio Servicing, inc. They are even worst then BofA i file for bankruptcy to hold to my home. My last hope the Lord Jesus Christ to save my home. Those dirty bank chiefs cause
    the financial melt down went to federal reserve got their billions and we taxpayers aided those
    greedy fools and they put military families in the streets and none of those greedy fools went to jail. It is very true the rich will always mess over the poor and working class until Jesus Christ return and all the injustice will be corrected to justice read for yourselves in the Bible.

    I bought my first home. Also purchased Mortgage protection plan.P wanted to pay off my home fast so I paid double payment many times. I was laid off after a year. Called BOA and was told that they would not honor the MPP. It was three months before I got another job. I wanted to make the house payment but they said not unless I could make all 4 at this time. I didn’t have $3500. I begged them to let me get caught up and they would not.

    They forced me out of my home. Then when they sold it they got $40 less than what I owed. I just got my tax info. They charged me three times the amount that was owed on my house to the government. Now the IRS is coming after me for the tax money.

    Please help me. I can’t pay those kinds of taxes. I don’t even own the home. They stole everything I built up over 30 years. It is just gone. Now I am displaced single woman, aging with no where to go.

    BOA put me a home mod loan , never did anything on time , fedex or getting faxes even though I have conformation after conformation, the denied the first one due to un excuses able reasons, the started another, the sold loan and Im doing it again, they held and still have $820.00 of one of my mortgage payments they had me pay and did not apply to my loan. They have lied to me over and over .

    I have been working with B Of A to modify my mortgage payment for 4 years. I have stacks and stacks and stacks of paperwork that have been submitted from me, attorney’s and Mortgage help programs asking Bank of America to lower my Monthly Mortgage pymt. I was in a short sale for 28 months when the buyer pulled out due to the process taking so long. Short Sales should typically only last about 6-8 months. I order to qualify for a Short Sale your have to be behind in your payments and not make mortgage pymts while going through the process. I am now 33 months behind in mortgage payments because the short sale took so long. Not one person through these last 4 years at Bank Of America cared about my financial situation and my ongoing diligence to keep my home. I am forced to file Bankruptcy. I have talked to 25 different Customer Service Reps. Nobody ever knew what was going on with my file. I have called all the Mortgage Help Programs that are out there, I have hired 2 different attorneys (who claimed they could lower my mortgage-but did nothing), and have made over 800 phone calls and talked to 25 different Customer reps in 4 years. Bank Of America is the worst financial institution I have ever had to deal with. It is a shame they are allowed to continue to be in business while they ruin the lives of responsible homeowners who only want to have a home to call their own. Shame on you Bank Of America…you should be ashamed of yourselves. I always tell people my horror story that I have had to deal with for the last 4 years with BOA in hopes they will not be victims of your greed.

    I have one of those adjustable rate mortgages that is not Freddie or fannie backed and have been unable to refinance my mortgage. The mortgage started with Countrywide and was sold to BOA which has offered a loan modification but since we were struggling with $850.31 mortgage payment the offered a modification which increased the payments to almost $1600.00 a month. If we could not afford the original payment how does a person afford the double payment. Since the lawsuit I think BOA should do something. We tried to refinance in 2007, 2011, 2012, 2013 and 2014 and were told NO you have too much DTI. I have recently received 2 drive by appraisals in the last month about 2 weeks apart and the difference on the appraisal is $10,000.00. BOA also gave me some unethical advise that I filed a complaint with the CPFB and still did not get results. BOA is refusing to help me and I fear they will foreclose on my home. Since they refuse to help me I ask that they forgive a portion of my loan due to the unethical advise given and to refinance the remaining portion of the loan. I have also aske that the entire loan be written off due the practices they do. I will be homeless if they foreclose on my home and I have tried to work with them and they refuse to give me help. We have lost $650.00 a month take home pay due to the cuts that Gov Scott Walker in WI has made state employees take. He is making in mandatory that state employess put 18% of their pay to retirement and has increased the health insurance from about $80.00 to over $260.00. I need legal assistance to make them do something more favorable. I cannot afford to hire an attorney to sue BOA as that is over $1500.00 a month as well. BOA needs to write off my mortgage or write off half of it and refinance the remaining portion. Need assistance

    I been in your shies since 2009 when they forclised my house and I was making payments and they told me to stop payments till modify goes thru that was all a lie I even made the trial pymts I really wish we could do something about thus they are getting away wit do much and bow they switch me to green tree pkease help if you can thanks any help is better than none I’m in vurginia

    I was promised a modifcation back in 2009, and again several times in 2010,2011,and finally in 2012 put the ousse oup for a shortsale. A week vefore closing, Bank of America renerged. Put it through a deed in lieu porcess 4 times in 2014. Still not settled in 2015. Woprked with more than 45 Bank of America “customer repreentatives” ove this period. Lost over $100,000 and my home thanks to Bank of Ameiorca’s failoed promises and numerous delays.

      I fully agree with all of these comments as I have a BOA loan that was originated through Countrywide and I live in WISCONSIN. I was told things by Countrywide and BOA and the latest has been BOA and all lies. Have adjustable rate mortgage and payments were $830.51 and when loan modification was approved payments went to $1500.00+. was struggling with $830.51 and received some paperwork stating payment would be around $600.00 yet final docs stated the $1500.00+ which we declined and they still are sending statements for $1500.00+ and was told payments would go back down to $830.51. Not happened yet and have had so many case managers cannot tell you and nobody is doing a thing. Asked for CEO’s e-mail or fax and was denied that info. CEO is in NC yet get calls from CA as part of his team to field calls. One rep was going to e-mail my concerns to CEO and others, I asked to be cc’s on the e-mail and was told “it is not in your best interest to be cc’d on the e-mail” I said that is so you can tell him something different than the actual truth. I said I would sending something to him but I wanted to make sure response came from him and was told someone on the team would address. well if it is addressed to CEO personally someone else opening and reading the mail I said is mail fraud, BOA rep laughted at me. BOA needs to be stopped and all the people that they are foreclosing on they should get their homes free and clear due to lies they tell and the no assistance with these unfavorable mortgages. They got sued by the government and lost and were told to help customers and they refuse to help customers. I need someone to help me with my matter as if we loose our home to foreclosure we will be homeless living in the street. We have told BOA that a short sale or deed in lieu were not options we want to keep our home. if there is someone that can help me please reach out.

    I owned a property that was paid for it was my retirement fund . My Husband signed a note with BOA for a loan against this property in order to help an elderly aunt that was selling her home to move here. My husband agreed to an extremely high interest rate only because it should have been a short time loan as soon as my aunt sold hers. However, it did not sell and we were stuck with an interest rate of 13.75% Which we have paid for over 15 years( on time. ) My Husband a Veteran recently passed from his service to our country and I am in Probate. The Court appointed me to settle all of his accounts (which by the way requires an attorney that charges handsomely for their services) BY THE HOUR and so I went to BOA and with a credit score in the 700’s applied for a refinance to put the house SOLEY in my name and lower the interest rate. It will be a YEAR next week, they have thrown me under the bus. BOA promised me a new loan at 4% The papers were made and signed. THAT WAS NEVER DONE Then they put me in NEW LOAN THAT WAS NEVER DONE then they sent me to ASSUMPTION THAT Too WAS NEVER DONE in the mean time the house was empty THE REPRESENTATIVE SAID NOT TO RENT IT BECAUSE I WOULD MORE THAN LIKELY HAVE TO SELL. and I was paying the payment as well as loss of my income ( remember this house was my job) Utilities, Insurance , Taxes , Maintenance . After loosing over 16,000 and of course since I have lost my income I COULD NOT PAY MY PERSONAL BILLS ON TIME My credit took a plunge causing my credit to become low and unsuitable for another financial institution to take the loan. One of BOA employees told me at this point to stop making the payment so they would give me some help. WRONG Then they put me in MODIFICATION This too was NEVER COMPLETED and they sold me to Bayshore in CA but Bayshore did not know of this transaction and so then I am transferred back to BOA and after 3 months sent back to Bayshore that once again had no idea where my Loan was. As of Last week I was told I could continue to pay that unreasonable interest rate or sell at a loss or let the BOA take my house. NO OTHER OPTIONS. So now the court direction for me to settle my husbands affairs where completely ignored by BOA and now when I called to notify them that I would sell and pay them off and I needed to know how much time I would have to complete this and was told that they would NOT tell me that .Of course I am learning that they can force a short sell.
    I have lost my house and income. So a year of faxing and carrying paper work that( no departments share with one another,) to each of these obviously this is a company policy to delay and stress and confuse and abuse its customers is simply a stall tactic so that they can take homes from Countrywide home owners So, I have not been able to settle my Veteran Husbands affairs to please the court. I have ruined my credit and have had a stroke. Isn’t there anyone big enough to punish these folks for their criminal behavior? AND How in the world do the employees of this Monster sleep at night?

      BOA sets all their customers up for failure. they MUST be stopped. I have been trying for a loan modification for over 1 year and they set me up to fail and have at least 8 different case managers. WISCONSIN is also one of those states that needs a lawsuit started.

    First BOA refused to take cash for house payment and threatened to call the police. Then my only son was killed at 17 years old and funeral cost put me behind so not only did BOA refuse to work with me Community America Credit Union actually moved numbers around. lied to the state AG and finally stole my Harley and car. Went to my bankruptcy creditors meeting in Jeff City last Tuesday. Thinking wow I lost everything no tax breaks no refi but we paid to build one hell of a brand new courthouse. Prob 10 to 15 million for me and one other couple. BOA will pay the settlement and the government will keep it. They already sued over the countrywide bs and I’m still waiting on that money. Welcome to the USSA.

    My nightmare started in 2011 fell behind tried loan modification. Hired a lawyer he suggested bankruptcy he messed that up house went into foreclosure hired a firm called fresh start and another lawyer he said first lawyers fault it was a mess in bankruptcy Fresh start done nothing second lawyer suggested a different chapter if bankruptcy. Hired another firm called credence law firm. What a joke there. Back to working with bank. Did this for a year. Until the day after Christmas i woke to a house fire. My insurance sent check to me and it had to be signed and sent on to bank. They recieved check and letter of intent on February 5 cashed February 11 i have talked to 15 different people was told i had to send in a contractors bid copy of license and his w-9 before they would send my money back. Then i called and was informed my house has a forclosure sale date in April. I called bank lawyer they knew nothing of fire or check. I haven’t heard back from them or the bank. I need a lawyer they now owe me 40+ from my insurance money plus they keep adding fees. I need a lawyer now.

      I went through 4 years of nightmares with them. I called the home office in Charlotte NC. They actually seemed to care, and I went through Fannie Mae vs. Bank of America for Modification. I had contacted the controller of currency, all the things that were suggested by the person who started this website. I had 4 offers for Modification by the time I was finished with them. But I knew not to trust them, so I took Fannie Maes offer. Check to see if they have yours or Call the Charlotte office. Best of Luck.

    I live in WI and got the shaft from BOA. They now have me owing them over $10,000.00 due to them not removing the modification payments when we declined it due to our payments went from $830.50 to almost $1500.00 and we never made a single payment and from Oct 2014 thru Apr 2015 they billed me for that payment and then sold the loan. they broke the law and the terms of their letter and now the new servicer has added this amount on to my loan and making me make the payments again. BOA need to be stopped and I hope that a lawsuit happens for WI customers.

    How crooked can a bank be.For us we got home in 2007,, went into modification with only 2 payments behind.we found out we have no contract with boa(the snake) after paying on our house for 8 years,, we owe 6 thousand more than what we brought the house for.as if we paid no payment.They lost the law suit, but want to pass the punishment to the home owners. BOA, you will be your own downfall.

    I had to replace the roof on my property in 2007 because the roof failed and water was running down the walls. I paid for it with a check from my personal account and then reimbersed myself out of my home equity line because the farm insurance refused to cover the loss……….then the bank refused to honor the reimbersement and stated that ” a new roof does not increase the value of the home” Like really? I have been fighting with CW and BofA for years…..they haven’t produced an authentic copy of the deed of trust.
    I was one of the first loans Jerry Brown used in his successful siut against CW for preditory lending. The new California Atty General is investigating B of A for robo signing and producing a false deed of trust……most recently my loan was bundled and sold to another bank who apparently has no clue about what’s going on.
    My home is worth about 1/4 of what I paid for it and how the inspector passed it; I am pretty sure that he was paid off to pass it……….there are so many things wrong with it.
    I am in as many lass actions as I can find.
    They also charge me an outrageous amount for insurance when I always carried it and sent them notices to that responsibility by email, fax, and snail mail………they all are truly lying criminals

    I too have had the same problem with BOA fo r 8 years. I kept getting modifications to restart. When I would send in all paperwork for oen and start payment it would get canceled. Then I would get another modification by Fed Ex to restart program. This wen ton once or twice every year. It is still not corrected and the are sayign the same thing, no paperwork when I know the paprwork is gettng to them. Where can we fidn help.

    We applied for a loan modification back in 2013 and was told NO and we had one of those unfavorable mortgages that they were suppose to either refinance or modify. Then we tried twice in 2014 denied once and then finally in Sept 2014 they offered a modification but it literally doubled our payments which we denied, and they continually charged that as a monthly payment from Oct thru April when they sold our loan and nothing has been corrected, even filed a complaint with the BBB and CFPB and nothing has been fixed. I even have the letter that from BOA that states if we do not make one payment on time our loan can no longer be modified and original terms remain in place but that has not happened. Now trying to fight with BOA and new loan servicer on what needs to be done. BOA has screwed by loan up to the tone of $11,000.00 and refuses to fix the problems. They failed to tell me that my payments included an escrow account and when the modification offer was denied they continued to charge me for an escrow account. BOA has broken so many laws that they should be required to give all current and previuos customers their h0mes free and clear of any mortgages. They took that bailout money and did not help consumers, they also got sued by the attorney general and still has done nothing. I cannot afford an attorney to file a separate lawsuit so if their is a suit going on I want to be a part of it. I deserve my loan either written off or at least $50,000.00 compensation for their errors.

    They did the same things to me as above with everyone else. We bought the home on June 15, 2007 through Country Wide Home Loans and BOA took over and everything went to hell in a handbasket. Started the modification process with Save the Dream America through NACA event on September 23, 2011. We went through sending paperwork and everything. It wasn’t until May 2012 that we were approved for a trial modification we made all payments and until September 2012 when I was laid off. We keep constant communication with them and in the same month they decided to withdraw the modification stating that previously did not submit proper paperwork. I asked well if I did not submit it then why on earth would you approve me. In the meantime they won’t except any payments at all. They said you have to start all over again and I did went through this from 2012-2014 and they finally said no and my only course of action is to short sale. So we did that took forever and finally sold it December 30, 2014. So while everyone was enjoying the Christmas Holiday and New Years my family and I were packing up to move because the buyer insisted that we close before the end of the year for tax purposes as this was an investor. BOA is the worst financial institution ever and they have no heart at all. I have had issues with them since day one. I can’t believe they treat people this way after all they did get bailout money to help the homeowner so where is/was the help? BOA will eventually have to pay for their wrong doings!!!!

    For four years and three failed modifications on there part we finally got one right….. So we thought! They are doing the same thing they did before by sending me foreclosure notices and satin I haven’t paid when I’ve made my payments at a local branch and there’s always excuses as to how I didn’t do something right and there never to blame and when we went through the mod the first time they added $8000 on the end of our loan like we haven’t paid at all when in fact we had been! I’m so sick of this piece of crap, slime ball people who don’t give two shits about anything but screwing this hard working family!!! Burn in hell Bank of America…

    i was in motor cycle wreck 4-4-2006 bank of America took my name OFF home loan in jan. 2007. I was kicked out and off home and land 1-3-2009. boa took every thing I had for twenty plus years. I get 1095.00 dollars a month from ssi, I also now get 407.00 month from military comp disability so I have been living on the street. I want all my property back. my home is no longer livable, it is junk. if any body knows how I can get help from a lawyer or law firm let me know by phone, 3202372266.     In 2008 my husband and I had to bankrupt, (did the chapter 13) Our lawyer told us that we could get a modification on our mortgage. Great, but then she says, “You need to miss three payments.”. I didn’t trust her so I kept making the payments. In the mean time I called Bank Of America to talk about the modification. Yes they said. You need to miss three payments. Okay I said but kept sending in payments. They held our checks, didn’t cash them because, “You need to miss three payments to qualify.” The process started. By 2014, we had sent our paper work in over 21 times. I even took it to the office and put it in their hands twice. Well, we got another lawyer to help us. After 15000.00 he kept telling us that things were good and blah, blah, blah. Only for me to see on the news that he was under arrest and disbarred for taking clients money and doing nothing. Well, 2015 we got another lawyer. She stopped the foreclosure but after 6 years we could not come up with the 300,000.00 they wanted and would not modify. We lived in that house for 32 years, never missed a house note been through the loss of a child, me, two cancers and my husband a brain tumor, never missing a payment. And then this b.s. modification crude came up and now we have moved. The bank couldn’t get the money at the sale so they have it. I would like to be in on the class action, to go after these big banks who trample on us. If we could hit them in their pockets enough then and only then would the other banks pay attention and hopefully the laws would catch up with them.

    After my experience and reading all the others, what will it take to get a class action lawsuit going against them. I’m in. I am tired of boa aka: rushmore lying and taking our homes. My house of 32 years sits empty, the grass is tall, the lawn has limbs in it and I’m sure the pool (with the new liner) looks awful. I have moved on but the loss is staying with me.

    i tried to do the modification and everytime they said the paperwork was filled out wrong and by the time i sent it in the second or third time they had taken my home . this was in 2014 and whole reason i did it was i was a single dad with 3 kids and they took my home

    I did everything but stand on my head to get a mod.! BOA kept saying I was ineligible when that was not the case. I even lost my job and they said I had no emergency situations. I went back and forth forever. finally got 1 and they added 10 more years to my mortgage! I just pd off the 10 years and now I still have a 30 yr mortgage. I get less money then I pay out on my mortgage every month. The difference is $700 that I have to scrape up every month! They really didn’t do me any faVORS!

    Bank of America bought my contract from anot her company then when I had my heart surgery and could not work BOA decided no to accept our paper work or they said they never recived them even we took them to one of their branches and manager faxed them they took our home of 13 yrs so now we have to live in a travel trailer they took our home in 2015

    they took our home in 2015, saying they never got the paper work. I documented and got proof from the fax and post office that we sent our paperwork in 11 times. We called 3 times a day, documented everything we did. For 30 years we never missed a payment They held my checks probably 10 of them saying we don’t need to pay due to the modification process. I said BS, and sent the checks anyway. Wonder how those people on the other end of the phone call could sleep at night knowing they were just feeding us a line of BS.

    I dealt with nothing but liars at Bank of America when I tried to get a loan modification in 2007. At first they told me that I was making too much money and hat too much money in the bank to get a loan modification and in 2011 & 2017 they told me I did not make enough money to qualify for a loan modification. I have all of the documented paperwork including the many lies told by different BofA mortgage representatives. Just before each settlement, the representative said that BofA would make, they assigned a new representative and I had to start the entire process all over again. They even told me that they did not have digital back up with the information that I provided only to admit that they lied about this. It got so bad until I had to give my home to my son.

    Bank of America would not even talk to me about a modification. They put me off and changed all the original paperwork and foreclosed on my home. They wouldn’t even accept any short sales offers.
    As a senior citizen, I lost everything and am facing being homeless every day while B of A got bailed out and then stole our homes and resole them for more money in their coffers.

    We had one of those unfavorable mortgages with the adjustable interest rate and the attorney general of the united states told Bank of America to refinance all those mortgages back in 210 or later and we were denied a modification. The mortgage then was sold to Bayview Loan Servicing who after almost 1 year helped us get a modification and after about 2 years Bank of America saw the loan was back on track and demanded it back from Bayview Loan Servicing and since it went back to them we had nothing but problems. They have no direct contacts and when you ask for something you are continually bounced around to different numbers and NEVER EVER get calls back. This company is one of the worst. BANK OF AMERICA keeps screwing me over on my payments by taking money out of my escrow account sending me a check and then raises my monthly payments because my escrow account does not have enough money in it. I told them i did not request this and to leave it in my escrow account so they have to continually raise my mortgage payments. I send the check back to them, they don’t have record of it that it was sent back and it takes 6 months or longer to get it put back into the escrow account. The OCC needs to review them and talk to customers that have mortgages with them and see how they fee. this company is the worst. I wish I could refinance my home with another company and get away from Bank of America. I don’t understand how they did not have to follow the direction of the Attorney General and refinance those loans. You cannot even send them emails because when they respond they encrypt the emails and you have to set up logins and then they don’t work it is horrible. I wish they were forced out of business or overtaken by another bank. I hope they get sued and they are forced to pay milliions to their customers. I wish they would be forced to pay off all customer loans that tried to get modification and were refused by them. I have all my paperwork from trying to get a modification and who I finally got it with Bayview Loan Servicing. They were great to work with and I had a direct contact so if something was not correct I sent an email or called and the problem was addresses. Thumbs up to Bayview Loan Servicing and Thumbs down to Bank of America.

    Bank of america contacted me about a modifacation. My home was paid off. They testified how they made fake documents and sold them. Tried to fight it in court but was refused a hearing. Do to these actions I was thrown out of my home. This was in 2016 and Im still homeless and lost everything. It shows how the court system does you wrong if your well off. Still trying to fight aint giving up. I lost everything I had.

    I was clearing out some very old emails today and saw this. Bank of America screwed us over on our Home Mortgage back in 2007 as they were told by the attorney general to refinance everyone that held an adjustable rate mortgage and we were refused and they kept raising out payments. I tried to work with them for several months to get a loan modification and then they sold our mortgage to another company and I had to work with them for several months and provide proof of payments and finally we got a loan modification from this other companyand once our payments were back on track for about 2 years BOA demanded our mortgage back from the other company and we had to file bankruptcy also. BOA has been nothing but a large stress company for us. We cannot get answers from them and they refuse to do anything. They are non-stop sending me emails every month reminding me that my payment is due and I have paper statements coming to me. I wish BOA would be either bought out or forced out of business with mortgages. I wish I could get some compensation of a large portion of the outstanding balance written off or a huge settlement that would payoff my mortgage in full. I over over $100,000.00 and I will need to do something in the upcoming years with the outstanding balance. I pay extra to my escrow and every year they send me the extra funds and also increase my mortgage payment so there is enought in escrow to pay the taxes and insurance for the current year. I send that money back and tell them to keep it in my escrow account and DO NOT raise my mortgage payments but that does no good. i hope they are forced to stop or forced out of business.
