Amazon.com Class Action Lawsuit Complaint Filed Over Alleged Circumvention Of Internet Explorer Web Browser Privacy Settings & Alleged Collection Of Personal Information

Amazon.com Privacy Class Action Lawsuit Complaint

A class action lawsuit has reportedly been filed against Amazon.com (“Amazon.com” or “Amazon” or “Defendant”) in the United States District Court in Seattle Washington, alleging, among other things, that Amazon circumvents internet web browser privacy settings to collect personal information without permission by allegedly tricking or spoofing Microsoft Internet Explorer by using an invalid Compact Policy code “AMZN” and that Amazon.com allegedly uses Flash cookies to transmit data via Adobe Flash Player to circumvent Internet Explorer web browser privacy settings, according to an Amazon.com web browser privacy class action lawsuit news report.

I was a seller on Amazon with 100 percent feedback and delivery
My building where I store my books was affected by a building that blew up and shock the town and was felt miles away. I was not able to get into my building since all my inventory fell on the ground and we couldnt open the doors. I have 24 outstanding orders for Coasters and they were all destroyed. I refunded everyone and linked the news clips of this explosion and everyone was understanding.
Amazon kicked me off after fighting to the finish. I was kicked off December 2009 . I called them March 17 , 2011 and they told me I was kicked off forever.
I said that I didnt think it was fair that my mom, dad, brother, or friends were allowed to sell my inventory and they just assumed that I was the actual seller.
I cannot even sell my business locally becuase Amazon tracks all my emails from one person to another.
I did a test and had a friend list items on her Amazon account with a zip code a few miles away and she did the shipping from a different location and she was closed down.
I had my mom put up a few listings and she was shut down becuase we have the same last name.
They have the ability to trace my emails to others and stop them from me selling on Amazon.
I sell 200 Books a week on Ebay and own the largest Auction CAtalog Company in the World. Amazon is totally wrong and it is not my fault that my property was destroyed. I have proof of claims and new reports. Just type L and L paving explosion Tinton Falls New Jersey
My building is behind L and L paving
    What can I do
    Thank you

I see thing about sellers, but what about innocent people who personal information that Amazon gave away with the tricked victim permission. Like me for a chance, Amazon gave my personal information away without my permission WHAT YOU SAY ABOUT THAT

While I was preparing to prepare a class action suit against Amazon.com, I came across your Blog. For no apparent reason, my Seller account has been suspended without given a chance to defend myself. I sell over $700,000.00 per year on Amazon, and out of nowhere was suspended last week. I fully plan to go through with a class action suit and need names and stories from other sellers that have gone through this problem. It’s time that they stopped acting like god and get what’s coming to them. If we can get together 50 former sellers, we can sue them for 100 million dollars. We can’t sit back and let them treat hard working people like trash. I can only imagine who is “reviewing” my account. I’ve been in retail for 40 years and now have to deal with this kind of crap.
JOIN me, and we’ll beat them. My family is full of lawyers and they’l be happy to join us as well.

Jamie Geiger I was recently robbed by Amazon.com and their BS A-Z program that lost me $400.00 dollars to a scammer down in Miami,FL.

I tried to reason with the buyer and they refused to send my Blackberry back to me and then two months later Amazon refunded them back the money to them.

So not only did they get the money back they also have my brand new blackberry that they got away with.

Amazon does not care about the sellers and told me tough luck and that it’s part of the risk of selling on their website.

I am so frustrated with them WHEN IT WAS MY MONEY!

They never listen or care and I am done with selling on a crooked website that caters to scammers.

The funny thing they did tell me is that “sir they can only do that (5) times a year until they are banned from Amazon.”

That is just disgusting. IT SHOULD NEVER HAPPEN AT ALL.

Amazon.com should have a system just like the seller has to put in a tracking number to get the money it should be the same for the buyer on returns before they get their money. Then when the seller receives the item back then a refund can go back to the buyer.

I want to join your law suit and fight back against that back stabbing corporation that does some pretty messed up things to people from around the world. There are thousands of people just like me who have gone through with their bs crooked system.

My cell number is 801-376-7573 and my personal email is CaliAmg55@att.blackberry.net. Let me know.

They are making sellers neurotic and psychologically upset and harassed by the account freezing and assinine rules that say a
seller of used goods, even if sold as “for part only” is responsible for the refund if the item (a camera, for example, which is sold for parts only) doesnt work like new and include every original accessory originally supplied. Talk about insane!

Amazon will continure robbing sellers until they are stopped by the government. And the government is not willing to carry out the will of the people.

Count me in on any lawsuit.

    • Buzzy June 27, 2011, 1:38 am

If your family is full of lawyers, I guess you know that lawyers want money also for their time and energy.

I like the way you express yourself. I believe you sound honest. It sounds like you might be right guy to get the Scoundrels at Amazon, and Ebay, and Paypal. It’s disgusting how honest sellers are treated in this psychopathic manner, with no regard to their need to make a living without being harassed by insane rules. Sellers need rights. Sellers should force Congress to regulate internet websites which seriously affect the well being of millions of small sellers.

….Amazon thinks they are god, but they aren’t. The people have the right to shut down or take over the entire operations, if it is deemed in the public interest.

I’m ready to join any movement to control these crooks with federal regulatory rules.

Have you pursued a class action suit against Amazon yet?
I would like to join forces with you.

I was suspended from Amazon in July 2012 for no apparent reason and they are still holding $950 of my money. I know this isn’t a lot but I am a widow on a fixed budget and I was supplementing my income by selling products on Amazon.

What is so frustrating is that they won’t tell me why my account was suspended nor will they return my phone calls.

Please let me know more about your lawsuit.

      Sincerely,

      Joyce in Minnesota

I would like to know if there has been a class action lawsuit against amazon. I would like to be a part of it. Amazon has destroyed my company. I started selling on Amazon about four months ago and since then I have been scammed numerous times. The buyers have frauded me using the A-Z Claim and the horrible cancellations towards items they purchase. Amazon recently suspended my account for reasons beyond my fault without even giving me a chance to explain the situation. In the past week, even though my account is suspended, I am still getting people who have ordered perfectly good working computers from me just to take parts off the computer for their own purpose. When they ask to return the item I decline due to amount of time they have had the item and conditional differences in the item. They file AZ claim and get their full refund back after stripping the computers of the parts they actually need or want. I have tried over and over to fight with Amazon about the unfair process of their company but its only costing me more and more money. Please help me to join this class action lawsuit against Amazon. They need to pay for their scamming of sellers.

Terrell Marshall Daudt & Willie PLLC, along with The Monts Firm and Crowley Norman, LLP, have filed a class action complaint on behalf of third-party sellers against Amazon.com holding the sellers’ monies longer than allowed by its own contract and Washington state law.

Amazon’s third-party-seller business enables merchants to sell their products on its website. The amounts of money Amazon holds in excess of the time allowed by law range from a few dollars to thousands of dollars. All the while, Amazon keeps the interest and other gains generated by the funds owed to Plaintiffs and the Class and utilizes the available cash in its business. The scale of Amazon’s practice makes it lucrative. Amazon.com, Inc. reportedly generated over $20 billion in third-party sales on its website in the fourth quarter of 2012 alone. By holding on to this daily cash flow for only a few days or weeks, Amazon is able to invest this money in money market funds, marketable securities and other investments, and utilize the cash as working capital in the operation of its business.

      I did $250,000.00 in 2012 on Amazon.
The same thing just happened to me.
      Seller account closed.
      Money on hold.
I had to pay for removal of FBA inventory.
      Forcing me into Bankruptcy.
Will no longer respond and will offer no specific reason for suspension

I would loved to see Amazon Sue for their A-Z Claims. Amazon is absolute thief! If you order anything from Amazon and the seller doesn’t purchase to have you sign for it, all you have to do is contact Amazon and tell the customer service you never received it. EVEN THOUGH the tracking shows you received it you will get a refund and keep the item that you received. All the buyer has to do is lie and say they didn’t receive it not only does the buy get to keep the item they get a FULL refund. I spent hours searching for the package. I found it at the buyers post office and they told me that they did deliver it like the tracking stated. the A-Z claim steals from the sellers. I have lost over $50 + from this bS A-z rules. I want Amazon Sued So very bad! contact me I am disabled so I can help do research or anything to get Amazon hit.
      Suzanne.

Yes we all need to complain to the Federal Trade Commission and chose have an attorney call you back. This happens all the time on Amazon and they act like once you list a product on their site it becomes their property. Amazon is stealing. Plain and simple.

I had only been selling on Amazon a couple of months although I was up to over $6k a week in sales. I just invested over $4000 in new inventory and without notice Amazon suspended my account. I had 98% positive feedback (only one complaint out 57 feedback and hundreds of sales).

Amazon is not willing to give me any information nor will they discuss it over the phone. I’m very frusterated and would be happy to join a class action suite.

Please email me at ty@ibattery.net. lets not let this super giant walk all over us!

When I first opened my account on amazon there was a 14 day hold on any money that I received from selling. That was fine, and I continued to sell anticipating that the hold would be lifted. A few days after my 14 day hold was lifted my account was immediately placed under a review for 30 days which required them to hold any funds in my amazon account. Once again, I continued to sell assuming that after this 30 day review I would be able to sell without being constantly hasseled by amazon. They also told me at this time that the 30 day review was standard, and that I had not done anything wrong whatsoever. A couple of days before my review period was up my account became suspended. When calling amazon they could not give me any explanation as to why my account was suspended. They said that it is within their “user agreement” that they can cancel an account anytime for any reason. Amazon canceling my account is fine, because after this experience I have no desire to ever do business with amazon again. However what I do have a MAJOR issue with it the fact that amazon is currently holding approximately $2500 in my account and will not disburse it for another 90 DAYS! So in the very short time that I have been an Amazon member they have somehow managed to HOLD my money for a total of 134 days, and that is assuming that they disburse my money at the end of their 90 day waiting period. I have never been screwed around by a company so much in my entire life. I could go on and on about all of my horrible amazon experiences, but I am sure all of you are well aware of all of their unethically business practices. I would gladly join ANY class action lawsuit against Amazon! It is high time that amazon faces some reprecussions for all of their actions. Please email me directly at adramsey_27@yahoo.com regarding the class action suit!

We were robbed of annual revenue of $100K from Amazon due to their ridiculous A-Z guarantees. We knew their policies were a bunch of Ish but we were happy to loose the money to keep the customers happy at all times because of the revenue Amazon brought us. We kept a 100% positive rating and kept up with their customer metrics.. still we got banned. Never had a reason of why and they are currently still holding $55K even though they banned us 4 months ago.

If there is a class action lawsuit, please contact me. We will be more then glad to help provide any information against them. They may be the biggest online store but without everyone of us helping them build their site, they would have never gotten there. We should not be use as dispensable slaves.

I was also robbed by amazon. I had a 100% perfect rating, when out of nowhere amazon suspended my account for what I thought was just a safety check of my inventory. They then proceeded to close my account entirely, give me the run around, and have kept over $7,000 dollars of my money. If you’re going through with this lawsuit I want in, please contact me via email, thank you.

Well, I am on the ban wagon now with the rest of you. I wish I had only knew all of this before getting hung out to dry by Amazon. I received a e.mail last night that my account had been suspended and I would NEVER be able to sell on Amazon again. They will not give me a answer to any reasons why. Sounds like I am lucky though because they only have $450.00 of my money. I am just a honest person trying to make a living and these guys at Amazon are doing some fishy stuff. I hope they are brought to the surface some day. I would like to become part of the Lawsuit if there is one. e.mail me and let me know.

I have unpublished all content from my bookshelf at Amazon’s KDP, which publishes ebooks to the Amazon catalog, and reported both Amazon and a content thief who blocked one of my short stories to the FBI’s Internet Crime division. A flurry of emails and phone calls failed to make Amazon move to rectify the situation. Apparently, no one knew it but Amazon has been hacked several times by knowing content thiefs seeking to profit from authors’ works. I have been informed that my accounts have been closed, and I filed a DMCA notice stating that my rights were infringed. If you plan to file a class action I would like to be part of it, because Amazon holds itself immune from prosecution and supports the claims of pirates. Clearly, Amazon only does what is good for Amazon, and it needs to be reminded of business law, because the terms of service clearly denies authors the rights to their own works in writing, without any consideration or acknowledgement to the authors. In the presence of any two party agreement entered into, the contract is considered void automatically in any court of law. But it has also not reported sales timely to most of the independent authors who post content to its site, and that clearly constitutes collusion with the pirates to deny authors their just royalties. Essentially, I don’t trust Amazon as far as I can throw it, so no sales = no content. I will never do business with Amazon or its subsidiaries again.

Count me in ….I’m a retired individual who decided to sell books on Amazon .com . While I have only sold about 60 books in total and only received five 5 star ratings , Amazon has froze my accounts and I have heard nothing for about a month now…Being retired , the $340 bucks that they are sitting on sure would come in handy…This really is unfair , I’ve followed all their rules, have 100 % satisfied customers and no complaints !

  • Morgan Johnson February 20, 2013, 4:51 pm

I am in full agreement with all of your post. Something must be done about this.
They are sitting on opportunity and holding it hostage.
They are discriminating as to who has access to it’s use and who does not.
This should be heard in the United States Supreme Courts of Law.
Big corporations should not have this power and discriminate as to who can use their services. It should be as it is advertised as a free and open Sales Platform open to the public for public use.
Without restrictions on ones ability to buy and sell.

No man has the right to limit another man’s income or the opportunity thereof.
These platforms like Amazon and eBay can be used to deeply impact the poverty level here in America and around the world if they would allow it as such.
People could, would, and should be able to make trades globally as a business, company, corporation, or as an individual and no one or no corporation should be allowed to stand in the way of that.
This goes against your God given rights to be able to provide for your self at your own choosing. In other words the right to make your own income.

To have this Platform and not make it readily available for all to access opportunity without discrimination is Un-God like and Un-American!

This must be brought to the light and something must be done about this on the largest scale possible.
I’m talking major protest and major law suit!

first of all amazon and ebay are acting as retailers and as are those selling products on amazon and ebay so where are the federal taxes? Number one I am a retailer and my product pictures are being used by sellers on ebay and amazon to sell products that they are not licensed to sell……ie….any such person selling products from a manufacturer or owning a business that sells products are legally obligated to carry a retail tax number with in their state……and are also obligated to file taxes with the IRS each year……….There are also other tricks that ebay and amazon use to pull business away from a ligitamate business such as Dropdowndeals.com, browse and save and I am sure that there are many others that they use against the normal everyday licensed business owner…………I will start a class action law suite for the retailers of America that are getting ripped off everyday by people claiming to be retailers….and ebay and amazon have no rules or criteria that have to be followed when signing up these people that could and do rip you off and leave you questioning the e-market place on the internet……..I say to you as a consumer go to the stores with in the internet and buy from refutable businesses that value the warranty that go along with the retailer products, only that refutable companies will value a warranty……Because they are backed by the manufacturer of the products which provides a warranty to the retailer and the customer alike………..Please use your better judgement amazon and ebay are raping the american retailers and dealers and manufacturers and driving the market to a place that it can not survive in…….each state and region has its own prices normally, so you can get something cheap on the internet….fine……but are you getting what is suggested…..? are you getting the warranty? are you getting the ability to return the product free of charge from you back to the manufacturer ? and are you going to be able to get your money back? are you going to get an exchange for the right product with out question or concern that they are going to value you as a customer enough to do all these things for you so that you will return as a customer???????????

The refutable business will ebay and amazon doesn’t care a bit about you all they do is collect a fee for the transaction…..also….after the 2 or three percent that ebay and amazon take out any refutable business would be stupid to sell through them, because that is usually about the mark up on the products…..you want satisfaction on a refutable business…….Try Stensmowerparts.com…………We will value you as a customer by providing a service to the public and valuing the warranty of the manufacturer because that is good business ebay and amazon are not the answer……..

  • Jarrod July 27, 2013, 11:43 am

amazon offer a generous return policy, then if someone takes advantage of it they close their account. They advertise items on your site that do not match what you get. They send damaged or misrepresented items in hopes that buyers will shrug it off & keep the items so you can keep the profits. My viewpoint, at this time is that they’re liquidating items that aren’t what you claim them to be, in hopes that i’m going to keep them. Then they insult my intelligence & accuse me of being the problem, blaming the victim of your own fraud is a pretty bold move for a publicly traded company that holds it’s reputation on being the most customer centric company in America.

So my final tid bit of information for you amazon, be ready for things to get real ugly because when this comes out, the media, lawyers, class action suits, stocks drop. Your headed down a real risky path.

Hi, I was a small-time retailer on Amazon. Finally got tired of the hassles of dealing (or trying to deal with; their customer service is nonexistent to atrocious), and closed my account in 2013. Last week I got an invoice from them saying I still owed them some money (small amount) past due. This was not correct, and I wrote them and complained. They agreed I was correct and dropped their claim. But here’s what bothers me: I have little doubt they KNEW I owed them nothing. If they do this to a large number of their retailers, think of how many would just pay the bill and not question it. I think this is part of an intentional scam, and I do not trust the integrity of this organization at all. I would love to see a lawsuit that requires disclosure of their billing practices to see if this happens to others as an orchestrated deception. If so, somebody should go to jail. I suggest starting with Bezos.

Don’t know if this happen to others. It happen twice to me. I per-ordered a product for a much lower price and still wait for 4 month on the shipment. Amazon’s Email confirmed that the product will be shipped as soon it will be in stock. Well, It’s in stock for 3 months now, but the price increased dramatically. I email customer service twice and got just a brush off.
Like – I can cancel if i don’t want it anymore. Amazon is protecting all his business partners to maximize profit. I don’t want to pay much more then i agreed on the original purchase.

On Amazon.com we had 100% feedback and “Buy Box” on 600 product pages, virtually all our products. Then a competing seller, we kept underbidding us, and we always matched never went under, made 15 fake orders on the same products using different name and addresses. They all resulted in first fake negative reviews. They virtually all removed and we reported seller to Amazon’s “Investigation Team”. Accused seller soon after disappeared, assuming they suspended him. Then 15 fake A-Z Claims were made. All but one was dismissed. However due to Amazon’s quite obvious broken “A-Z Claim” system, even claims made in sellers favored, yes unbelievable even totally dismissed cases, count NEGATIVELY towards “Order Defect Rate” metrics. As we only started selling about 5 months ago, these fake dismissed claims have pushed our rate just over 2%, causing us to loose “Buy Box” on ALL, and consequently our sales have plummeted to near flat-line

This injustice against sellers has to be stopped. We want to go at them with a Class-Action lawsuit.

Just last Friday I found out that Amazon had given my personal information without my consent to someone who ordered $ 879.00 phone to someone name Lod D. Jones , when I called the fraud number they gave me some foreign guy got online and ask me to download an app that call any app so that they can hack into my computer and gain total control. I know that I’m not the only one person who have been done like this. My family is already struggling we don’t need this mess.
