Audi A4 & Volkswagen VW Passat Class Action Settlement Of Class Action Lawsuit Over 1.8 Liter Turbo Engine Oil Sludge

Audi and Volkswagen Class Action Settlement Reached In Class Action Lawsuit Over Alleged Oil Sludge In Model Year 1997-2004 Audi A4 Vehicles and Model Year 2004 Volkswagen Passat Vehicles Equipped With 1.8 Liter Engines.

A class action settlement has been reached in a class action lawsuit pending against Volkswagen Group of America, Inc. f/k/a Volkswagen of America, Inc., Volkwagen AG and Audi AG (collectively “Defendants”) in the United States District Court for the District of Massachusetts (Boston) (styled In Re Volkswagen and Audi Warranty Extension Litigation, Civil Action Case No. 1:07-md-01790-JLT), alleging, among other things, that the 1.8 liter turbo engines installed in model year 1997-2004 Audi A4 vehicles and model year 1998-2004 Volkwagen Passat vehicles are prone to the formation of oil sludge and coking deposits even when maintained according to the recommended maintenance intervals and oil quality specifications and that the August 2004 Extended Oil Sludge Warranty (8 years/unlimited mileage) violated applicable consumer protection laws, according to the class action settlement agreement and settlement notice.

The Audi A4 & Volkswagen VW Passat 1.8 liter engine oil sludge settlement class reportedly consists of the following persons, unless otherwise excluded:

All current and former owners and lessess of model year 1997-2004 Audi A4 vehicles or model year 1998-2004 Volkwagen Passat vehicles equipped with the 1.8 liter turbo engine (collectively, “Settlement Class Vehicles”) imported or distributed for sale or lease in the United States by Volkswagen Group of America, Inc.

The Audi A4 & Volkswagen VW Passat 1.8 liter engine oil sludge class action settlement reportedly provides that Audi and Volkswagen will cover 100 percent of the maintenance costs for owners/lessees with proper documentation of required oil changes, and 50 percent for those without proper documentation.  The Audi A4 & Volkswagen VW Passat class action settlement also reportedly provides Audi and Volkswagen owners and lessees eligibility for a 10-year/120,000 mile enhanced oil sludge warranty.

What about people like me who after the motor went, traded the piece of junk in for a downpayment(less than book value because of the blown engine) for another car!!!!!!!

    • Kirk Witzberger January 7, 2011, 10:04 am

If you find a way to get reimbursed for trading it in for a loss, I’d like to know — I did the same thing.

I would love to know how I can get reimbursed for selling mine for a loss after the motor went. Talked with someone at the the settlement administrator and he said the settlement does not cover those that sold and incurred the Loss of Economic Value. Ughhhhhh….. Would Never recommend anyone buying A Volkswagon.

  • Steve December 30, 2010, 12:36 pm

I had to sell mine for scrap as I couldn’t justify putting another $8000 into the junk to replace the blown engine. Was told that since I didn’t completely stop for the oil light that the blown engine was my fault. They new better and I’m more screwed than before. Bought it used and no real records. Before I thought bad luck, now I realize Audi actively screwed me.

If you find a way to get reimbursed for unloadin it for a loss, I’d like to know. I traded in mine for a loss because I also couldn’t justify $8000 out of my pocket.

Who are the lawyers for the plaintiffs?

I have a story long enough to write a book with VW. I had a 1998 Passat and a 2004 Passat. The only decent trade in I could get was with VW or I would not have done what I did. I finally gave up fighting with them. I now have another Passat with a different engine. I hope it does not do the same thing. I have always maintained my cars with synthetic oils. I tried to sue them two times but got now where. I am glad that it’s finally been recognized. The VW dealerships do have the records but I’ll bet we wont be able to lay our hands on them to prove our case. Those records have all been put on computers and VW knows the real story but they are not going to admit it willingly.

There is a bigger problem lurking with older Audi A4s, and probably most Audi models, of missing pixels on the instrument information screen. I have owned my 2000 A4 since new, and I love it with the exception that there is a degenerating information screen that loses more and more pixels every few months. Warning lights are not understandable, the gear display is illegible, and other information is missed because of this problem. Go to any of the several Audi forum websites and a cursory look will reveal threads on the topic – with the upshot that it seems almost ALL Audi vehicles of certain vintages suffer from this.

This engine may cost Audi/VW less than the advertising to get a new customer. Why not have an engine replacement option @ $500-800 for those of us who have life left in our cars so we can have some confidence in to produce??? Confused

    • Tom January 6, 2011, 6:18 pm

      type error…..in the product???

  • Kirk Witzberger January 7, 2011, 10:02 am

As with Anthony and Steve, I unloaded my Passat at a loss rather than replace the engine at my cost. How can I get reimbursed for my loss?

  • Andre January 11, 2011, 1:47 am

My 2000 A4 1.8t blew up today, after an oil change at the local dealership…at 130,039 miles. I have extensive records and had replaced extensive parts on the care 8,000 miles ago..
Do I qualify for this sludge issue or broken timing belt settlement?

I now have a hole in the side of the block!

    • Chris March 1, 2011, 7:22 pm

No, the timing belt upgrade is completely separate. Bending valves because you were too cheap or lazy to upgrade the pump and belt are your fault.

I have a VW jetta 2003 wagon with only 70K miles, it sarted to have the oil sludge problems at 40K miles. Spent over $4000 in repairs but now it feels like going to blow up on me any day, eats more and more oil and sometimes won’t start. Can someone help me, I can’t afford to buy another car, though I need one everyday to commute to work and school. Please help!

  • Robert May 4, 2011, 1:06 am

When do I get my money? I’m still making credit card payments on this sludge work among the normal wear and tear maintenance. I mean geez-louise, the Audi-VW guys are a bunch rip-offs who claim their product is competitive with other car makers. well, they didn’t fare well in the consumer reports. What is it with Audi and VW products when they have so many maintenance issues that make your hair stand up? While they unleash these brand new models nobody can afford anymore, I’m still in the ditch waiting for my reimbursement! And i’m still driving my 1997 A4. I was hoping to get into a newer car. It should’ve never come to this point as Audi should stand behind their high priced pieces of crap. The financial stress continues with falling jobs and wages. The newer Audi models are only for the priviledged who can dish out the bucks during hard economic times.

I sympathize with everyone because I have experienced the same exact problems! Trust me I WILL NEVER PURCHASE ANOTHER VOLKSWAGEN as long as there’s breath in my body! These people don’t care & they only want the car payment. I own a 2003 vw passat which is a beautiful car bought it brand new. After having my vehicle for two years or so there were recalls everytime I turned around. Finally the engine failed due to the oil sludge & I maintained proper maintenance, oil changes, etc. They new me so well at the dealership that they recognized me anywhere in the city where I live. Well, when the oil sludge problem happened no one could help me so my husband had to pay $6000.00 plus for engine repairs. We have submitted all documentations & was told 100% reimbursement would be refundable & we are still waiting!!!! This actually put my family in a terrible financial situation. I WILL NEVER RECOMMEND ANYONE TO EVER PURCHASE A VOLKSWAGEN EVER! Last but not least I also went to the dealership where my car was purchased to get all the info that I could pertainting to my vehicle for records to send in & they couldn’t retrieve not one! All records they said were plugged pertaing to my oil changes!(which I said was fishy & some crooks these people are) but I found oil change receipts that we had filed in our filing cabinet after we paid off the vehicle thank God they weren’t thrown away. The problem now is getting my reimbursement check that they’ve been promising long before December 2011. Everyday they keep saying they’re waiting for vw/audi to make the deposit at any moment so they may send out the claims. I AM SICK OF THEM THEY ARE ALL A BUNCH OF LIARS!!!!!!! This is ridiculous & nobody can tell us anything other than to keep calling back & that they can’t tell us anything as far as when we should recieve our money. This is bad business totally unprofessional make me believe they are all a bunch of CROOKS!!!!!!!!!!!!!!!!!!! My advice to anyone is to never ever purchase a VOLKSWAGEN ever. I wouldn’t want onea brand new one even if it was given to me belive me this is just how disgusted I am with vw and the people with this volkswagen law suit/settlement !!!!!!

I bought a 2001 Audi A4. Is there a way to find out if my A4 had the Class Action upgrade and when it was done? What is paculiar is that when I took it to the local Audi dealer in Fort Wayne Indiana and paid for the pre-buy inspection, they never said a word about the sludge problem and verbalized the great buy it was for the money. Hmmm… I have to wonder if they omitted it in fear of liability. Now that I have read about the CAS I’d like to thorne them a little for doing that. Is there any recorse for their lack of information that I paid to get?

  • Marco R. October 6, 2012, 9:58 am

I just spent over $2500 for a complete Head Job and Timing Belt, drove not even for 10 KMS and the same problem happened again, turns out the oil sludge is not letting enough oil into the Timing Chain Tensioner and valves hitting the Pistons! I called Audi this morning and They asked for the VIN, saw there was no extended oil sludge warranty its only in the US! I really need help in this pls, I have a 2000 Audi A4 and dont want to spend anymore money on this car!

    thanks
