Sprint Class Action Lawsuit Complaint Filed Over Sprint’s HTC Evo 4G Cell Phone & Samsung Epic 4G Cell Phone & Sprint’s 4G Network

Sprint HTC Evo 4G and Samsung Epic 4G Owners and Lessees File Class Action Lawsuit Complaint Against Sprint & Best Buy Over Sprint’s 4G Network.

A class action lawsuit has been filed against Sprint Solutions, Inc., Sprint spectrum L.P., Sprint Corporation (collectively “Sprint”) and Best Buy Company (“Best Buy”) (all collectively “Defendants”) in the United States District Court for the Southern District of California (styled David Salvatierra v. Sprint Solutions, Inc., Sprint spectrum L.P., Sprint Corporation and Best Buy Company, Civil Action Case No. 10 CV2044 BEN ) alleging, among other things, that Sprint marketed and sold Sprint’s HTC Evo 4G cell phones (“Evo 4G”) and Sprint’s Samsung Epic 4G (“Epic 4G”) cell phones as being able to access Sprint’s 4G network even though Sprint is allegedly only able to provide 4G service through Clearwire Corporation (“Clearwire”) whose 4G coverage is limited to only 53 markets in 22 states, according to the Sprint HTC Evo 4G and Samsung Epic 4G class action lawsuit complaint.

The Sprint HTC Evo 4G and Samsung Epic 4G class action lawsuit complaint reportedly alleges that Sprint 4G customers were billed for and required to purchase Sprint’s “Everything Data” plan and billed and charged an additional $10 fee specific to the Sprint 4G device for 4G access, but that Sprint allegedly failed to provide 4G access to most areas, purportedly in violation of state law, including breach of contract, and purportedly in violation of the federal truth in billing requirements.

The Sprint HTC Evo 4G and Samsung Epic 4G class action lawsuit complaint is reportedly brought on behalf of a putative class of all individual persons or entities, unless otherwise excluded, in California and any other state as the Court may determined to be appropriate who purchased, leased or otherwise acquired 4G cellular telephones from Sprint and were billed Premium Data Charges or other charges specific to 4G phones that were not properly imposed on their accounts at least starting in May 2010.

    Sprint is the most dishonest company I have ever had the displeasure of being in contract with. From the lack of promised 4g to billing discrepancies on a monthly basis that they think people are too stupid to catch, to basic lack of intelligence and honesty and people skills in their customer “service”- I have seen it all with Sprint (all except for them actually providing 4g service in my area). I am in Minnesota and do not get 4g coverage in my town of 60,000+. Sprint at one point was telling me that I would have 4g “sometime within the next 2 months” and after hearing it three it four times and THEN hearing them blame it on the tsunami hitting Japan I was irate. What a horrible tragedy for them to try and hide their lies behind. I definitely want in on this class action. Sprint makes me sick.

    My EVO is not the issue- the phone itself is solid an when I am in a real life 4g area (not the imaginary one I get charged for) my phone works beautifully…too bad that area is 70 miles from where I live. Sprint blames the basic coverage/dial up speed/dropped calls with poor quality on my EVO when I call them. UNBELIEVABLE AND SO WRONG.

    I’ve had issues with my 4G in the Alabama area and I’ve been told we have 4G. I looked on the Sprint Coverage map and it says “No Coverage”. I’m even having problems with 3G. It’s ridiculous!

    i want in on the lawsuit, i have an evo, and now i just learned that the WiMAX 4g will NOT be coming to my hometown, and i continue to be charged for it, when i call sprint about it, i get no headway, as a matter of fact they’re quite rude….funny seeing as the company is losing money and costomers by the droves and wouldn’t want to TRY and keep me by not charging me for a service i’m not getting and will not EVER recieve seeing as they’ve chosen to go with LTE vs. their current WiMAX

    Wow. If we could only start a Class action lawsuit for their mobile cards. In March of 2010 I signed a 2 year unlimited data plan contract on my air card. I just got a bill for overages of more than $300 due to a change in their data plan, which had evidently been brought to the Sprint customers attention on their bills???? Who gives them to right to do this without first notifying its customers? Unbelievable. Imagine the thousands of people this has just happened to…..

      I’m with you! I’d love to know how they can legally charge for “overages” that cannot be verified. I work 7 days a week, live by myself, only use the internet for Facebook, have not viewed a movie/listened to music/or downloaded an app and yet my bill for each of the past 3 months has had @ $500 in overages!!!!!

    I want in too- I’ve been without my Evo for a week now because somehow I’m suddenly not able to access any mobile network or wireless or any crap at all, and I’ve been back and forth to their store for ‘repairs’ for the entire week- oh and I pay for imaginary 4G also. Their data plan being unlimited was the ONLY reason I was staying with them, but I’m out. I’m done. Sprint is just garbage now.

    Sprint is garbage. I had a corporate account for 2 years, I had to call in over 100 times in that 2 year period for problems with service,billing,and multiple other issues. I finally got a rep.that seemed to actually knee what she was doing. After assisting me with several issues,this rep and her superviseor, advised me to drop my corporate account and open a family plan. Because my corporate plan was illegally set up by a company in Calif. This was with the promise that all 5 of our activation fees would be waived. Yeah right we changed our plan called Sprint, of coarse the rep won’t respond back at all,I’ve talked to 4 other reps since includeing the retention dept. No one will call me back. Last night I spent 2 hrs on the phone,end result was a superviser telling me to guite spinning my wheels there is nothing in the notes so its not going to happen and a 850 dollar bill for 2 months, should be less than 500.

    I have the Sprint 4G Evo, the charging port is defective and they will not replace my phone unless I pay $100.00 repair fee. The phone does not charge, and I am paying for service I cannot use.

      I am going through problems with Sprint’s EVO. First, the charging port went out in 3 phones. The service center in Lake Charles La where I live, exchanged my phone each time but what I did not know, they were exchanging the phones with a refurbished model. No problem. As long as the phone works, I’m satisfied. I received my 5th phone only to have the LED (?) screen changed the same day I received the phone. Well, now i am angry. I was told by an account specialist they would send me a NEW phone. She instructed me to call Tech Support. I called them and they have no clue on a new phone.

    I have never been so decieved so badly by a company till now!
    I am talking about Best Buy & Sprint! First by Best Buy and ALL the 4G high speed banners all over, and their sales rep touting the higher speed. (of course the demo phone is on the stores WiFi which they don’t tell you.)
    After agreeing to 2 overpriced phone lines I could handle it for the price of mind of unlimited everything.
    But after trying to get 4G I find our city only has 1 tower on the other side of town! Also them the $10.00 per month premium data charge. Sprint conviently does NOT send you a bill until LONG AFTER your30-day trial is over. There were also so many other usage fees and such my bill is 50% higher than the twit at Best Buy signed me up for. But again the bill was so late I could not cancle.
    My 2 gripes, 1.I should NOT have to pay a premium data fee.
    And 2. I should NOT have to pay for 4G when my home location does not have 4G!!!

    I also would like information on the lawsuit because I am suppose to be in one of the best markets in New Jersey but still experience off and on 4G service and they all ways blame the phone so I can buy a new one or pay for another replacement through the insurance which is another 100 dollars ever time its done.

    I would like to be included in this class action suit. It appears that my experiance is common with sprint. I live in the high desert of southern california and continue to pay their ever riseing fees and still have no 4g service for my Htc Evo’s (2) or the Samsung epic’s 4g (2). Additionally Our service continues to get worse. The “system is busy” text messages are received late or not at all, poor quality calls ” breaking up”. Help mr. wizard ! 03/19/12.

    I purchased my phone from ACN…..I was told that Sprint had 4 g service and the phones would be 129.00 for 2 EVO,s…got my first bill and was over 200.00..purchased a hotspot to and was told it had 4 g and unlimited internet..after I got the bill on the hot spot it was 150.00 for a month..was told that their was.only 3 g service and it was limited..got ripped off by ACN and Sprint..

    Purchase Dec 2010 from Sprint Radio Shack in Palm Beach area. Did not have 4G service for over 5 months in which I paid the 10 fee. I am disabled and have been hospitalized over the past couple months. In Feb 2012 my phone was literally going through a battery an hour. It is really hot to the touch. I dont have insurance on my phone and am told I must pay 150 to repair. I cant afford it. I also dont have the luxury of running all over the county to find a repair. This is my only phone. I got so ripped off. I am sick and tired of big companies ripping off the middle and lower classes. Of Course Sprint will probably sue HTC for millions with their thousands of lawyers on hand. Please get this going I am sick of being bullied when I have Cancer.

    Any progress or determinations on the class action suit? I’m in the boat been paying for 4G without any provided in my areas. Was bullied on the phone a few moments ago by five different individuals offering ZERO support. On your plan details it states in your basic services that you receive “4G Services”. (The lady actually told me she would contact the IT Dept. to check on this “typo”, when I was SOLD this premium 4g service from the salesperson in the store) For the fact that I have not received the 4g services I want to remove that from my list of services with an appropriate monthly credit. I didnt even ask for the “$10.00 Credit”, I just want services removed from my account, which in America usually means crediting those services removed. NOPE! They stated that every phone is required to have the “premium services” after January 1st 2011. They didnt even respond when I told them I signed up in 2010, BEFORE this “requirement.” It is BS because it is just a line item in the billing, and yet they all say that the phone won’t work without the fee. A fraudulent fee at that. After a gentleman told me that when I bought the 4G it was the first phone to have the requirement, and I responded, “I don’t care if you sold me a spaceship I still want a credit because you don’t offer 4g services in my area.” Unless I am grossly misunderstanding how this all works, this is a sham and I want to participate in the suit. They wouldn’t even releive me of the ETF if I chose to cancel. “None of those options are available to you, sir,” they stated.

      Jason, James, and Melissa, All Account service managers incapable of addressing customers’ problems and in some cases incompetent when it comes to understanding the basic principles of services procured and services actually rendered. They all know and enjoy frequently interjecting with the words, “requirement for your phone,” like it means something amidst a fraudulent white collar hustle that continues to unwaveringly and incorrectly bill me.

    I am with all of you. I’ve been wondering, since I first acquired my 4G Evo how it can be legal for Sprint to charge me an extra $10 a month for the 4G service that it never is able to use. It’s ridiculous and outrageous. It seems as if Sprint is charging that extra $10 a month for almost any phone these days. I am on a family plan and my fiance is getting charge an extra $10 a month for his Blackberry. Blackberry doesn’t get 4G so I called Sprint to ask why they decided to add the extra charge and they claim it’s because it’s a smart phone or whatever. WTF? A year ago when my brother had a Blackberry he wasn’t charge the extra $10, so why now? Sprint’s CEO is already grotesquely rich, why the extra charges? Does he feel like he needs a raise?
    We need to form a NATIONWIDE class action lawsuit to stop these charges!

    I would like to get in with the lawsuit also, because I have two EVO’s and I have been told every since I got my EVO’s I was told that the 4g was coming 6 months to a year and I still don’t have 4g service. My bill is so high now I can’t even pay it or try to set up another payment agreement, they said that my bill has to be paid before my services will be cut back on. and it’s the past due amount, so my phone is off and i went to another carrier.

    I’m in North Carolina and would love to join a lawsuit. We have 2 Epics and not only are we charged the $10 on each phone but we can’t get any coverage inside our own home. I have spent hours and hours talking to Tom, Dick and Harry and numerous other rude “customer service” reps. They won’t let me out of my contract even tho they are not providing the service promised.

    Gary, I was At&t a couple of years ago and kept getting dropped calls, unable to use the phone in my home. They asked me if I wanted out without a penalty. I had no idea that if your equipment didn’t work as promised or service, they let you out. I bet if you looked into your contract and on-line, you may find a way out. Good luck!

    Yes, my wife and have been loyal customers for over 12 years. We are both very upset over the false advertising, trickery to purchase unless 4g capable telephones and being charged for a service that is not and now not ever going to be available in the State of Arizona. We have paid for a service for over two years, and kept being told that it would soon be coming to AZ over and over by Sprint. We are going to challenge our last year of our contact. If we are not released from it we will surely file a lawsuit with the Attorney Generals office.

    We also want in.

    I want to file some kind of suit. I pay $200 a month for poor and unprofessional customer service, as well as for a phone hat never works. Had to get it replaced 4 times (HTC EVO) for them to replace it with a different model phone (Epic) and then that phone in less than 24 hours started acting up. and the options they gave me was to either down grade, pay for an upgrade, or buy a phone straight out! Really!. I want them OUT OF BUSINESS ASAP!!!!

    I like the HTC EVO phone too but feel like I’m on my own as well.

    I kept, and keep, getting excuses about 4G capabilities from the local Sprint customers. This should not be allowed. If they want to compete fairly, they should not mis inform or lie about their service capabilities.

    Also, my usb port broke and even though I had insurance they would not accept responsibility of the poor workmanship of their product. Again, I conformed to their poor excuses and have been charging my phone externally; swapping batteries multiple times a day.

    Any guidance is appreciated. My next step is the BBB.

    I’m sho ked, thinking that it was only my house that had some sort of strange building product that doesn’t allow signals through! I have the EVO 4g LTE and upgraded from the previous EVO. I have to admit that the guys at the Sprint store were very helpful most of the time, even when the first LTE crapped out on me. But, they replaced it with a brand new phone and I upgraded the software immediately that night to get the best possible fun out of the phone. So….like so many of you, no 4g services and only problems trying to connect even to the lower grade 3g. And, promises after promises that the tower near my house is “being upgraded at this very moment!” Not good enough! I said. They knocked of 25$ a month til Marchon my unlimited data plan, but what about the previous 3 months of little to no 3g and absolutely NO 4g whatsoever?? I’m really on the fence right now and getting frustrated because it seems par for the course for Sprint, when they promise again and again that the 4g is coming!BBullshit! Funny it works fine in other areas but I’m home 80% of my day after work. Not sure what to do yet, but getting pissed!

    Hello…I have had Sprint now for 2 years and still waiting on the 4 g service that it was going to be in our area soon…well soon has come and gone..the 4 g phone is now out dated..and their still selling 4 g service..My hot spot I was told unlimited internet connection on it..every month I go over it..and my average bill is almost 300.00 a month..what a ripe off..Sprints customer service ..where I live is worthless. You go in with a problem you go out with the problem..the customer service is like not our problem..sorry about you luck..I had 3 cell phones and canceled 1
    9 months ago and talked to Sprint wondering why my bill was so high and they never canceled the line..plus overages on the hot spot..I get 1400 minutes a month and only use 200 they should use the unused minutes to go towards overages….I had US Cellular..customer service was excellent..had it for 15 years ..got talked into switching,,what a regret…

    I live in North Carolina, and I have the EVO 4G , there is no 4G coverage, and there is no 3G coverage in the Goldsboro NC area, no data, internet, anything, Sprint says their towers are down and under maintence. What do they do about all the customers they have in the area, their agents are rude and they are lying or maybe they just don’t know when service will be up and running, The agent I spoke to this morning hung up on me after he told me I would be compensated for the dates I was out of service, I told him that has been since Nov. 2012. I can make calles and get 3G service where I live and know where else, not even 3 miles away which is supposed to be great coverage according to the coverage maps.

    I bought my Samsung Galaxy S3 in Nov 2012 serivce is awful first the rep tells me maybe its my phone may I remind you I’ve had it 3months. Then she tells me to turn the 4g off and connect the 3g only well that sucks as well. Dropped calls and I have to use WiFi to get a good connection to the internet. A $110 dollar bill and I can’t even access the internet with out connection to Wifi. I agree Sprint should not be charging for services not provided. Total rip off then if you decide to cancel you get hit with the $350 fee so they are winning regardless and on top of the month in advance charge..

    I am definitely interested in this class action lawsuit! As near as I can tell, I have been overpaying by $10/mo for well over two years. I had no idea that Sprint was charging me $10/mo (I know, I know) despite me already purchasing an “Everything Plan” for my Samsung Galaxy phone. Obviously, the fact that “everything” is included in the title, plus the fact that the people who sold it to me said that’s all I’d need, are basically incontrovertible evidence of bait and switch.

    As a side note, I should add that I was sold a 4G phone despite living in a city that only offers 3G and some months, I don’t receive my bill (and yes, I check my Spam folder, too) then Sprint charges a late fee.

    I would love in on this law suit as well. I have an iphone 4s and it works when it wants. The phone says 3G, I check the internet and the phone locks up. I try to do my updates and my phone locks up. I went into Apple and the representative told me that it was the service provider not the phone causing problems. I have had dropped calls and the phone breaks up when I am on it.

    I am paying the $10 a month, I was told it was because every smart phone has to pay this fee thru Sprint. I receive late fees, and reconnect fees more then once a month.

    I owed a blackberry and returned it 4 times and Sprint kept sending me a new blackberry. Sprint told me that I had to return it 6 times in 6 months in order to receive a different smart phone but the phone I would receive had to be comparable to a blackberry(I couldnt get a iphone, galaxy,etc). I shut my blackberry off when the renew date came up.

    Please assist.

    When we upgraded to our Samsung 4g we were given a an exact price as to what our monthly charges will be. Other than the second month being a bit highr than the next following months because of partial months etc…. our price quote included ALL DATA and NO PREMIUM DATA CHARGES WERE EVEN MENTIONED! But… Once our bill came, and then the NEXT months bill after that one we notice our charges were WAY TOO HIGH and NEW CHARGES including PREMIUM DATA CHARGES were NEWLY ADDED and we were being charged without ever having to COMMITG to or AGREE to this NEW CHARGE added to our account! The Quote AS WRITTEN – AGREED – UPON – AND IN BLACK AND WHITE was for 196- plus what ever TAXES were to be added. This price would be No Where NEAR what they are billing us for!!! Our Total cost INCLUDING Insurance at 11- PER LINE is a TOTAL OF $ 208- per month. BUT….. Each Month we are billed AT LEAST $349- EVERY MONTH! They are including SEVENTEEN Separate TAX Statements as well as an ADDITIONAL FEE for PREMIUM DATA CHARGES! This is being SNEAKED onto Our and MANY peoples Phone Bills and Not ONE OF US ever Agreed to or commited to or even KNEW ABOUT THIS CHARGE when we Agreed to the Two Year Coract! I would be willing to and available to join in ANY suit you may have going RE: Premium Data Add On Charges

    I purchased a phone from Target Stores that was on the Sprint Service. Although they want me to be bound legally to the contract that I signed at the store they do not want to provide the discount I was promised. I am sure there are multiple issues Sprint could get a class action law suit brought against them for. The service is not what was promised either.

    I live in an area promised by sales to get 4G. Never happened. I am at the end of my contract today. I have 2 Epic 4G phones purchased at Best Buy that the only time they ever got 4G data is when we went out of town. I paid $480.00 over the life of the contract for a feature I could not use in an area promised it could be used in the very near future. Not only that but 3G sucks in this area with this phone. Probably goodbye to Sprint anyway after today. Where do I sign up. I live in western NY.

    My wife and I both purchased the Epic the day it came out at Best Buy and were required to take the 4G add on and keep it on the two lines while not having any provided 4G service for $10 per month per line. The phone I upgraded to was the iPhone 4s since 3G was no different than the service provided. I later upgrade both lines to the 5s for promised LTE service. If this is still ongoing, would love more information on this suit.

    I have had my phone (Samsung Galaxy Epic 4G touch) with promises of 4G service since July 2012 however, I’m now told that they are discontinuing the 4G Wimaxx and now 4GLTE service still no use seeing that I rarely get 3G service. I don’t appreciate paying $300.00 a month for 3G service they always have tower, network, repair issues. Never any call backs or follow ups…ect. Feel like I’m getting jerked around from computer prompted script reading customer service reps…. I hope I can join this lawsuit because seriously how much can you take.

    We have been fighting with Sprint since updating our phones in December 2012. Dropped Calls, intermittent service and no internet connections. Recently my wife was diagnosed with Lung Cancer and we had to install a landline to insure connections to Doctors and Hospital services for treatment. I would like to join this lawsuit.

    I have the HTC Evo 4g/LTE, it’s ageat phone with service that is terrible by Sprint. I would love to file a complaint and be apart of a class action lawsuit!

    As far as the 4G I’m not sure they even had it wrkin. where I live they said there towers were rt behind my house yet I NEVER had 4G n dome times didn’t even have service most the time. I called many time and they just said that they werr wrkin on the towers that it will b back u n going n a couple days. Never happened. After having sprint for 12 yrs and always gettin the run around and my bills always had charges on them that should have never been there I finally changed providers. Sprint was not gettin the service they wanted so they had to do something to get customers so they said they had 4G when they never really did.
