Nissan Maxima, Altima & Quest Automatic Transmission Class Action Lawsuit Complaint

Individuals Who Purchased or Leased Any 2004 through 2006 Maxima, 2005 through 2006 Altima, or 2004 through 2007 Quest Vehicles Equipped with an Automatic Transmission File Class Action Lawsuit Against Nissan.

A class action lawsuit has reportedly been filed against Nissan North America, Inc. and Nissan Motor Company, Ltd. (“Nissan” or “Defendants”) in the United States District Court for the Central District of California (styled Howard Teba v. Nissan North America, Inc. and Nissan Motor Company, Ltd., Class Action Case No. CV 12-00332) alleging, among other things, that Nissan manufactured, distributed and sold 2004 through 2006 Nissan Maxima, 2005 through 2006 Nissan Altima and 2004 through 2007 Nissan Quest vehicles equipped with automatic transmission that allegedly contained a defect that causes breakdown, transmission slips, delayed shifts, acceleration surging and/or mechanical failure, according to the Nissan Maxima, Altima & Quest Automatic Transmission class action lawsuit complaint.

The Nissan Maxima, Altima & Quest Automatic Transmission class action lawsuit is reportedly brought on behalf of the following proposed class pursuant to Federal Rules of Civil Procedure 23(a), (b)(3) and/or (b)(2):

All individuals in the United States who purchased or leased any 2004 through 2006 Maxima, 2005 through 2006 Altima, or 2004 through 2007 Quest vehicles equipped with an automatic transmission. (the “Class”)

All Class Members who are “consumers” within the meaning of California Civil Code s 1761(d) (the “CLRA Sub-Class”)

The Nissan Maxima, Altima & Quest Automatic Transmission class action lawsuit complaint reportedly asserts claims for alleged violation of California’s Consumer Legal Remedies Act, California Business and Professions Code s 17200, breach of implied warranty pursuant to the Song-Beverly Consumer Warranty Act, breach of express warranty and fraud by omission.

    I want to be added in the lawsuit. I have 2005 Maxima, defective transmission according to my mechanic, almost killed when would not shift into higher gear entering hwy. Please advise.

    I would like to be added to the lawsuit. I have a 2007 Altima and the transmission is making a very loud noise and slipping. Sometimes when shifting it doesn’t go to a gear

    I brought My Nissan Maxima(05 from thr dealieship in Vero B each FL. After drivingit for a while I had the transmission issues other owners experiences. I talk to the service; who ill asdvise me that the car had a CVT transmission and it does shift. After complaining to him for several times he asked me to bring the car. They evalutied and he gave me a paper with work request to replace tranny for over S3000.00 with only a one year warranty. I refuse to sign the work request and think these cars 04-07 maximas should be recalled Nissan should pay the customers for the hardship and embarassment the encounter on a day to day basis.

      Oliver, I am in the same boat. Brought my 04 Maxima a few months before the extended warranty was up. One of the main things I asked them to address was what I thought was a beginning of failure of the tranny. Like many others – hard shift 1st to 2nd and then 3rd to 2nd. I was told nothing was wrong. Of course, after the extended warranty had run out the tranny failed completely. Another dealership suggested I call Nissan North America to see if I could receive an “out of warranty” consideration for the cost, but told me I had to bring it to a Nissan dealership for them to consider it. This newest dealership assured me that the transmissions they were using for replacements had the “problems” resolved. The guy at Nissan North America was so cooperative, I felt as if he was making out the check as we spoke… I ultimately spent nearly 6K despite a warning from my cousin who is an “auto” guy. My argument was that, I really liked the car – it was tricked out, and now with the new work I had a car with a new tranny, brakes, tires etc. and I knew I could not buy a car in that condition for the 6k. I could kick myself in the ass now.

      So I called Nissan North America back, but now I have to speak to another department and this new guy was so damn rude and arrogant. Bottom line is that I received nothing. I was stuck now.

      Brought it back 11th month of the year warranty. Explained I was having the same issues I had with the original tranny but auto mechanic insisted there was nothing wrong. So guess what, after only 2 months and 4K miles later I have a car I cannot drive because the tranny does not work. AT ALL – or at least if you want to go more than 5 MPH.

      Did you join the class action suit? I did 2 years ago but have heard nothing. My experience with class action suits had not been favorable sadly. Once the attorney takes his fee and expenses, nothing is left for the clients. I guess we will see.

    NISSAN HAS KNOWN ABOUT THEIR TRANSMISSIONS SINCE 2004. TOOK MY 2006 MAXIMA BY THE DEALER EXPLAINED WHAT THE TRANSMISSION WAS DOING AND THEY ACTED AS IF THEY KNEW NOTHING ABOUT IT AND WE ALL KNOW THATS B.S ! NISSAN IS THE ONLY ONE THAT WILL NOT ADMIT THEY HAVE DEFECTIVE TRANSMISSIONS. DON’T CARE! TOYOTA-CHEVROLET-FORD-GM-KIA-HONDA THEY TAKE CARE OF THEIR CONSUMERS BECAUSE THEY CARE. NISSAN COULD CARELESS. I WILL NEVER OWN ANOTHER NISSAN PRODUCT EVEN IF IT WERE FREE. THEY ARE THE WORST CAR I HAVE EVER OWNED. I WANT IN ON THE LAWSUIT

    I HAVE A 2004 NISSAN MAXIMA. WHEN I DLOW DOWN TO TURN A CORNER, THEN ACCELERATE TO 20 MPH IT JUMPS REALLY HARD. I HAD THE TRANSMISSION REBUILT ($4,000). NOT LONG AFTER THAT THE SAME PROBLEM! TOOK IT BACK OVER 5 TIMES SAME PROBLEM, BUT THEY SEEM TO CANT FIND ANYTHING WRONG!!’ TONIGHT I LEFT A PART GOT RIGHT AT HOMECAND IT STARTED DRAGING and LEAKING TRANSMISSION FLUID! NISSAN NEEDS TO OWN UP TO THE DEFECT. I WILL NEVER PURCHASE ANOTHER NISSAN!

    They should have included the 2007 maxima.my transmission went out @ 56.000 miles wasnt covered under warranty coverage.

        I got my 2007 Maxima brand new and now at 81,000 miles the transmission is bad. The first place I carried it to was a nearby shop as it was a Saturday. They said that Nissan is known for bad valve body and thought that might be the problem. Turned out they found metal shavings in the pan. Found a site that says Nissan is making this right with an extended warranty. It is 10 years 120 miles. So I call Nissan and carry it in. They say there are no shavings in the pan. They think it is the valve body and it isn’t covered under the extended warranty. This is BS! They are lying about this so they don’t have to pay for replacement of my transmission. I want in on the lawsuit! Please tell me what I have to do to get on it. Thanks!

    how do I get involved with the class action suit. I have a 2006 Maxima SE that had the transmission give out the time was at around 72000 and just seasonally went out again and its started making noise an it just gave out the gear will not shift any more. Pretty much it has the same symptoms that outer have written.

      i cant understand why nissian is so reluctent to fix a problem that is all their fault dragging this problem on for so many years has only made things worse if nissian cares about there reputation as a class car company do what you know is right ps i had to replace my transmission in my 2004 at a cost of 3800 dollars and the new one is acting up now after only about 5000 miles.

        I have a 2005 Nissan Maxima and had to have the transmission changed and still have the problem of hesitating, and jerking. I was told that it was the motor support and had that changed twice and it is still doing it. The money I have spent fixing this car I could have just purchased a new different brand. How do I get into the lawsuit.

        IAM on my second Nissan?I just bought a 2005Murano. It’s been a week. I have had so many close call accidents with my five Grandsons in the back. Every site I have researched are almost identical. And Nissan ignores it? I desperately want to be in on this class Action Lawsuit. I don’t know who Nissan thinks they are. Every company I have ever dealt with has immediately taken care of it. Especially with so so much factual websites all saying the exact same things. This is totally unacceptable. And don’t telle Nissan doesn’t know this!! There is way way to much data on these model Nissan!! Are they really going to risk their company all because they don’t want to take the blame. I would like to know how many of the employees, vice president. President and thousands of othersown one of these positions Nissans. I bet the warrantysand recalls fixed theirs for free. I want in. PLEASE!!!I have never been so disgusted or in disbelief over Nissans business practice. And, whos standing upaking the accountable. I’m not stopping. Period. Nissan should have all the same rules as everyone else. I will surely get the word out about Nissan. As a cosmetologist, I see and talk to several people in one day. I will NOT stop! Nissan you should be ashamed and embarrassed by your actions. I remember when Nissan was my favorite. And they stood behind their product and words. What happened to Nissan?     First vehicle I ever bought brand new. Have treated it with kid gloves. Don’t drive it very much. The vehicle is in excellent shape. Never been in an accident. I noticed when the car was reaching 100,000 miles that after the car warmed up and I shift from Reverse to Drive, there was a pause, then, the transmission would engaged with a very hard hit. It took me a while to realize my transmission was failing, since otherwise, it drove fine. I took it to Nissan and they said it needed a new transmission and that would cost $4,666.92. I have their quote.

    Hi,I currently own a 2004 nissan maxima and I am hearing a rattling noise upon starting the car. My mechanic says it timing chain and tensioners. I brought this car to the dealership on many occasions and they ignored me saying oh we can’t find the problem knowing they knew what it was because they knew the sold these cars with the knowledge that it would begin to cause problems. My warranty has run out of course and I probably have to come out of pocket thousands of dollars to fix. Shame on them.

    i have always owned a maxima. have 02 & 04 no problem with the 02 but the 04 had transmission replaces at 41000 miles . at a cost of $3900 plus, guest what now at 51200.miles same problem. i am bless to be alive . after passing a car the tran went out a 18 wheel almost jack knife to keep from hitting me. there was no way i could get back over.

    I have a 2006 Maxima brought it brand new to replace a 1999 Maxima that was still in good condition as a matter of fact I had/have a year full of Nissans, 280zx, Pathfinder and a Titan. Took my 2006 Maxima to a Transmission Specialist and was told the problem was a 3 dollar bushing located in the valve body and if you replace the valve body with another one from Nissan you will have the same problem sooner or later. This is my last Nissan. Have to go with somebody who will stand behind their product. Vehicles are too expensive for me to spend money on a new lemon. Where can I join a class action?

    Lawsuit needs to include the 2009 Altima. I have a 2009 Altima with less than 100,000 miles and is about to have its 3rd transmission. The dealer is replacing it under warranty and warranty has been extended to 120,000 miles but after that if I keep the car it will cost me $5,000 or $6,000 every 10,000 to 20,000 miles to replace the transmission.

    I loved my car, but it has become a nightmare. I had to fix my car and Nissan would not help are care about my problem. Transmission had to be replaced at 62,000 miles. A one owners car bought new and did ever thing I needed to do to take care of my care. It looks like a new care. I plan to retire soon and want this car to be the last car I would ever have pay for again. I had to pay $3200 plus to fix it and now I need to look in to retire later to get a car I feel will last through my older age. I think this Nissan even with the fix will last.

    I BOUGHT A 2006 QUEST 2 YEARS LATER TRANSMISSION WENT OUT TOOK IT THE DEALERSHIP AND THEY GAVE A CRAZY CUOTE FOR THE REPAIR HAD TO TAKE IN TO A TRANNY SHOP PAID $2700

    I have a 2010 Altima with 120,000 highway miles and I am 405 over the extended warranty of the transmission and corporate is not going to fix it. As of 11/12/2014 I am still in negotiating with them, I refuse to fix it, I was not notified of any transmission problem and the fact that they extended the warranty on them from 100K to 120K allows me to believe they knew they had a problem but did not want to do a recall

      I was wondering if you have had any luck getting them to pay for a new transmission? I bought a used 2007 altima and was not informed about the extended warranty. My car started making noise last summer when it still would have been covered under this warranty but I was not aware that they had extended it. Now the miles have passed the warranty. I emailed the Nissan company and they say I may qualify for after warranty assistance but I have to get it officially diagnosed. Reading all these comments I am losing all hope that they will help with the issue.

    I have a 2006 nissan maxima that seriously almost just killed me!!! I have been having the transmission slip here and there and jerking into gears for a couple weeks now. My dad checked the fluids and other things and didn’t seem to think anything to worry about. Well I was just driving with my 1 yr old in the back on the highway when it totally stopped accelerating and the rpm just revved real high and I was down to 20 mph in the high speed lane and couldn’t get it to stop jerking and revving and couldn’t get over to the side of the road for almost 10 min and was having a hard time keeping control of the car!!! I am currently on the side of the road waiting for a as in 2 degrees weather and am NOT at all happy right now and now that I Googled and found all this well known info of this defect and nissan refusing to help, I’m seriously going to lose it!! Thank god we r safe but how many r out there that have been hurt by their neglect? !?! However, I keep finding mention of a class action suit yet can’t find, even here, how the heck I participate in it etc!! Can someone pls direct me to where I can actually get involved in this please? ???

    I have had to replace my transmission 3 times and missed school, and to this day my car is in the shop for … You guessed it! The transmission. I’ve paid $8000 for repairs and had no rental car, lost my grant for school because I was unable to attend class, and really am sick of visiting my car at the shop!

    Own a Nissan Maxima SE 2006 – After it hit 63,200 it started experiencing the jerk motion when starting the car, along with the de-acceleration on the expressway. It’s very scary to drive this car now, and I share the same experience with the rest of the 2004-2006 Nissan Maxima owners. This is not fair, as we paid a good amount for this car only to get ripped off by Nissan if they don’t replace the transmission.

    I have had the same transmission problems with my 2005 Nissan Maxima. Went to the dealership and they told me that there was nothing they could do about it. I put a new 3000 transmission in it and had to walk to work while it was in the shop for several weeks (first one didnt work) and now not even a year later it os doing the same thing again. As a single mother i cant afford to go purchase a new car and i am scared to death to go any where with my kids in the car. Not fair that they can do this to people!

    transmission problem. had to replace it at a cost of 3800 dollars. 2004 maxima after it reached 100.000 miles. had to take car back twice to fix leaks and it still doesnt seem to be right. i really dont trust driving it especially out of town.

    I bought my Maxima brand new in 2005 . I’ve been having alot of trouble with the car jerking when shifting. I understand I’m not the only one having these problems. My car looks brand new but I’m afraid I’m going to have to replace the transmission.

    I bought my car in 2009 with 45,000 miles its popped in and out with gear change has always ran aweful sensor light always on never wanted to start worse car ever and now my transmisson blew today. I had an 1999 nissan altima never a problem even at 200,000 miles when I traded it in. Thus 2006 nissan altima is crap they should recall every single one I still owe $9000 I got ripped off special edition id say because a mechanic said its called that bc only so many were made bc they were garbage and they new it

    I have had the same transmission problems with my 2004 Nissan Quest, the transmission slips, delayed shifts, I spent a fortune to repair it and after 15 months it is doing the same thing again.

    2005 Nissan needed Transmission after 150000…also had to replace my computers for the car shut my whole car down

    I understand the lawsuit was withdrawn in 201 but may be wrong. It is valve head issue with IW transmission and that same transmission is used by volvo. Replacing the valve head with an upgraded model usually cures the problem

    i like so many unfortunate consumers had to replace my transmission in my 2004 maxima at the cost of 3800 dollars nissian needs to admit its mistake and do whats right to rectify the problems and satisfy the many consumers who have sufferd.

    I own a 2005 Nissan Altima 3.5 and though the car looks new and, has been well maintained am now seeing it’s apparently known by Nissan typical transmission problems. It is banging when putting it into forward or reverse and starting to slip at 127K. This company does not own up to it’s defective products and, will never have to worry about me, my family or any of my friends buying one again.
