Mercedes-Benz Class Action Lawsuit Complaint Filed Over Allegedly Defective Balance Shift Gears In Mercedes M272 Engines & Idle Gears in Mercedes M273 Engines

Mercedes-Benz Owners and Lessees File Class Action Lawsuit Complaint Against Mercedes-Benz Over Allegedly Defective Balance Shift Gears In Mercedes Benz M272 Engines & Idle Gears In Mercedes Benz M273 Engines.

A class action lawsuit has been filed against Mercedes-Benz USA, LLC (“Mercedes-Benz” or “Defendant”) in the United States District Court for the District of New Jersey (styled Greg Suddreth and Paul Dunton v. Mercedes-Benz USA, LLC) alleging, among other things, that Mercedes-Benz M272 engines are equipped with defective gears in their balance shafts and Mercedes-Benz M273 engines are equipped with defective idle gears which wear out prematurely, excessively and without warning, purportedly causing the vehicles to malfunction, the check engine light to illuminate and the vehicle to misfire and/or stop driving, according to the Mercedes Benz M272 and M273 balance shaft gear and idle gear class action lawsuit complaint.

The Mercedes Benz M272 and M273 balance shaft gear and idle gear class action lawsuit complaint is reportedly brought on behalf of a putative class of all owners and lessees within the United States of Mercedes vehicles equipped with M272 engines (bearing serial numbers up to 2729..30 468993) or M273 engines (bearing serial numbers up to 2739..30 088611), unless otherwise excluded.  The Mercedes Benz class action lawsuit also is reportedly brought on behalf of Illinois and Massachusetts subclasses.

RECALL & REPAIR all of the vehicles that need to be fixed…

I need a lawyer. Can someone email info on lawsuit

  • Tim S. May 6, 2015, 10:09 pm

Add another to the list. P0016, P0017. 2006 C230 Mercedes Benz M272 engine. My first and last Mercedes Benz. Of course, you would think by 2010, all the dealers would have known of this issue, but Bill Holt in Canton, GA didn’t mention it to me when I purchased it used for $16,500 that year. Something blew the heck out of the plastic parts on the intake manifold; I’m thinking it was the gear teeth flying off this inferior balance shaft sprocket. That was $1,000 repair. Now this $5,000 repair awaits. You can’t trust them, you can’t trust dealers. Don’t buy new cars, don’t buy Mercedes Benz. They have proven themselves, by their own actions and deeds, untrustworthy.

  • Sandy May 8, 2015, 3:57 pm

Recently I got a code pop up and after reading the code, went online and did some research. The code I received was P0016 on my 2007 Mercedes S550. From all the readings it seems like this will be a very expensive job. I need some information on this lawsuit and what is being done to fix it or can I take my car in as a recalled part. I live in California.

I own a 2006 C230 and I paid 5,000 for defected parts, I was so frustrated about the situation, I contacted MB for a warranty repairs but, they denied my request. I was informed that MB knew about those defected parts and why they are refusing to take their responsibilities. They deserve it.

  • Kimberly Seegars May 18, 2015, 3:30 pm

My 2006 CLK 350’s check engine line comes on and goes back off. I definitely want to know how I can be a part of this class action lawsuit. I did receive a notification about the lawsuit.

  • Angela Williams May 18, 2015, 3:50 pm

I brought a brand new Clk 350 for 65,000, I the year of 2005, only owner, move to Florida , and was told I have a engine problem that would cost me almost 3500, to have repairs, with only 60,000 mile on car, I got if repair, but the car still wasn’t”t running right, I didn’t want to be stranded on these dark road, so I tried to trade car for something else, before something else break down, bad business on Mercedes, that is why they stop making CLK 350.

  • Ckr May 19, 2015, 2:42 am

Yes you are right it happened to me, but it is just this engine, because I have had a 380sec Mercedes that lasted me for over thirty years with no major engine problems. As I understand it, it has been fixed on the 2011 and newer.

However we all need to be in this law siut and spread the word to have a recall and warn others about buying this perticular engine. It also seems to hit around the 60,00 mark, and they need to fix or compensate some how on these models. But I still love Mercedes.

  • Jacqueline Torres May 19, 2015, 9:28 am

I just bought a 2006 Mercedes R350 AND ALL I KEEP DOING is keep putting money into it…

  • Trina Alston May 20, 2015, 6:29 am

I have a 2006 CLK 350 and this problem happened to my car last year and I had to dish out over $5,000 for repairs and the check engine light still will not go off and the car stills misfires. I think that this part was put in more than just the cars they have listed in the lawsuit and needs to be addressed.

  • Shareen Lang May 21, 2015, 1:04 pm

Balance shaft issues and front end issues. My car doesnt shift into gear and when it does the cr jerks forward, When i am driving the car slows down even when gas pedal is pressed all the way down. Car has to shut off and restarted, and sometimes after restart car stays at 20mph and does not shift. Defective balance shaft part which is costly to repair.

I own a 2007 Mercedes Benz S350 which I rarely use. The car has only clocked 41,000km.
Just recently, the car refused to start and simply refused to do anything with the electronic gear selector inoperable. I have always used MB’s since 1975 from MB 450SE, to 1986MB280SE, 1997 MB S320, 2002 MB S320.
This is a very unusual “poor quality” for the revered MB Brand.
The Philippine MB authorized and only dealer seems to be helpless in getting the car repaired. The car has been in the MB shop ( CATS Motors for three weeks now, with no solution in sight. I am willing to join the class suit against Mercedes Benz

  • Theodoros kappas September 22, 2021, 4:12 pm

I had it done on my 2006 Mercedes e350! How can i get in it to for the lawsuit

  • Tim Shubert September 22, 2021, 5:41 pm

Lawsuit is over, settled years ago. Depending on your mileage at the time, you wouldn’t get much to cover the $4,500+ repair cost. Lawyers made out okay, customers got the shaft. Don’t waste your time. MB could care less.

Having the same issues. Is this class action still open or is it closed?

    • Glenda Stemple February 5, 2022, 6:46 pm

I just discovered that there was a class action lawsuit against MB regarding the
balance shaft failure or guide idler gear wear and camshaft solenoid adjusters. But repairs must have been done before May 13, 2015.

just bought a 2006 ML350 with codes P0016 P0017. car has 90K and needed brake lines replaced due to rotting out. This is my first and likely last MB. I have and have always had BMW cars but am sick of buying plastic crap under the hood. This car is even worse. Removed engine to find bad balance shaft gear. Luckily is just started to fail and the engine has no additional damage. Was suprised to see 6 bolt mains on the crankshaft.and was suprised at overall quality of fasteners. Cant remove chain guides without removing heads. Cant remove bad designed gear without removing engine from car. Poor engineering! MB should have to warranty their bad design and stand behind their engines like Hyundai has been forced to do. FU mercedes

Just bought a 2006 ML350 after 10 miles check engine light came on P0016and P0017. Previous owner ripped me off. Had to remove engine and replace balance shaft. Mercedes is now making profits selling kits through third parties like FCP euro. The kit does not contain whats needed to do the job, and filled up with parts that are not needed which cost a premium. Mercedes warranty is 3 years 36 thousand miles. Why would you buy one? I never will again. This car only has 90,000 miles and had a new intake put in by Mercedes that cost almost $3000. Cant wait for the transmission issue. Why does Hyundai have to replace engines on their cars with no time deadline? Mercedes should have to replace all the M272 and M273 engines they sold here in the US. SCREW MERCEDES!
