A class action lawsuit has been filed against Mercedes-Benz USA, LLC (“Mercedes-Benz” or “Defendant”) in the United States District Court for the District of New Jersey (styled Greg Suddreth and Paul Dunton v. Mercedes-Benz USA, LLC) alleging, among other things, that Mercedes-Benz M272 engines are equipped with defective gears in their balance shafts and Mercedes-Benz M273 engines are equipped with defective idle gears which wear out prematurely, excessively and without warning, purportedly causing the vehicles to malfunction, the check engine light to illuminate and the vehicle to misfire and/or stop driving, according to the Mercedes Benz M272 and M273 balance shaft gear and idle gear class action lawsuit complaint.

The Mercedes Benz M272 and M273 balance shaft gear and idle gear class action lawsuit complaint is reportedly brought on behalf of a putative class of all owners and lessees within the United States of Mercedes vehicles equipped with M272 engines (bearing serial numbers up to 2729..30 468993) or M273 engines (bearing serial numbers up to 2739..30 088611), unless otherwise excluded.  The Mercedes Benz class action lawsuit also is reportedly brought on behalf of Illinois and Massachusetts subclasses.

The Mercedes M272 engine is reportedly installed on the following Mercedes Benz vehicles:

    I have a 2006 ML 350 and recently had the CEL light go on, dealer said that the BALANCE SHAFT was defective and could go at anytime, thank God I brought it in as they say it could fail at anytime. have had this car brand new and this one problem was estimated at almost $10k to fix which is ridiculous, and as much as I love this car and want to keep it, the cost to fix it is unrealistic especially for a MB that should have came with quality parts especially in the engine, this sort of thing should have been a recall. The electrical issues I dealt with and can understand since its not as bad as a BMW but to have a defect in the engine is unacceptable for a Mercedez. Please put my name on the Class Action Suite.

    I have 2006 E350 the only 51000 mil with balancing shaft issue and Mercedes quoted me $5,500.00 to fix the issue. Unbelieveable!!!
    Right now car have 60000 mil and I have problem with transmission!!!!!!
    So ,MB not reliable car right now and have came with not quality parts especially in the engine, transmission.This sort of thing should have been a recall 100%.No any cars in the market have had problem with the BALANCE SHAFT and transmission for less then 60 000 miles.
    No recalls from MB,amazing.Why any another cars like Honda,Toyota and etc very reliable and honestly if something happens,and not afraid to recalls.
    MB will losing thousands customers…
    Please add me to the lawsuit ASAP!!This is 110% winner case…

    I’ve owned 2 MBs over the last 10yrs. A 2003 c230 purchased at the MB dealer almost new (6K) miles as a certified pre-owned car. That car visited the shop almost as much as the pump station. Luckily it was covered by warranty for all kinds of problems. Valve advancer mechanism, radiator cluster failure, brake assist module, etc… I learned that the C and E series during those years were a black spot for MB. I now own a 2009CLK 350 purchased with 12K miles. Long story short, 18 months of ownership and 20K miles later I’m over $3K in maintenance… Ask me if I’ll buy another MB ever…. I hope somebody at MBUSA reads this. My definition of quality is very different from that of the brand… Prestige is built on quality and reliability. No wonder they push younto trade in your car before it hits 50K miles… Because they fall apart.

Recently got the light checked by MB and found it to be a balance shaft issue. They are asking $4200.00 for repairs. Is this lawsuit still going on and if so what can I do about this?

    Where can I pin the lawsuit, lost several thousands on my ML 350. Never, ever drive a Mercedes again even though it was my 4th one!!! Mercedes should stay behind their expensive products once a major part breaks that is not part or regular wear or maintenance. I am very disappointed

    My 2006 350ML stopped running on the freeway. Van Housen MB of Roseville, Ca. says piston #4 broke and destroyed engine. They offered 20% off $14,000. They won’t return our call as to whether new engine or rebuilt-MB warranty or no? They advertise quality. My car self destructed at 73,000 miles.

    I have a 2007 ml350. My Check engine light was on and had to have it checked to pass smog. I was told I needed a new balancing shaft. That will only be 7,000. Then i got my car back and trans cuts out when going around corners . It also revs up under full exceleration.

    2007 C280 with 65k on it. 4 different mechanics, 2 being MB dealerships. The last dealership had my car for a month, replacing all sorts of things. 3 grand later, I dont even make it a 1/4 mile down the road and the car cranks but doesnt start. I had to trade car in at a huge loss and spend money on parts and labour that didnt even fix my problem. Pls add me to lawsuit.

    I have an R350 2006 with the same problem with a fault code of 1208 & 1210 that popped up 3 weeks ago. My mechanic informed me that these fault codes relate to a technical bulletin which involve the CAM sprocket and will have to open the engine up to replace. This is right after rebuilding the transmission and replacing the solenoids. I only have 97,000 miles on it.

    I consulted with my local dealer about a ticking and whining sound back in 2011 when the vehicle was under warrantee. This complaint along with my air suspension issue. At that time, they were unable to determine what was causing it on both. There were no fault codes at that time. Therefore, they cannot warrantee it.

    After the warrantee lapsed in July 2012, the air suspension finally was determined (which is another story). The ticking sound kept on all this time until the fault code showed up a few weeks ago.

    Can you tell me how I can throw my hat in this lawsuit?

    2007 C280 died on me this morning on my way to work (04/24/2014)
    car has been serviced for the past several months for engine light car started running bad. On 04/19/2014. Mechanic informed me to trade the car its a piece of crap. the balance shaft is bad and it would cost me $6000 to repair. Mercedes has been well aware of this problem but refuses to rectify it. placing all the cost on the consumer.

    I have the same problem with my 2006 ML 350! Why would anyone that produces this Mercedes vehicle sell it; knowing how long it has before it breaks down. I think that a car company should want it cars to last forever! Definetly should not hold the lifeline of a car before it sells! They should have to disclose all info. like this! Everyone that has a vehicle that was made from to soft of metal! It is definitly a manufactures defect! THERE SHOULD BE NO QUESTIONS ASKED!Mercedes you made it own it! It’s a problem that if not fixed can cause other parts to fail also! why should we have to waste time on a lawsuit! its known it’s a manufactures defect what is the hold up! this lawsuit started in 2010!!!!!!

    My 2009 CLK 350 has a ticking sound too,but it is not always there. MB could not/did not fix it.
    Also, I have an issue with the rear head rest popping up randomly. Took it back 2 times (before the warranty ran out) and two times this year already. My car has only 31000 miles. I wonder about Mercedes quality!
    Should I get rid of it?

    My 2007 mercedes C class has just been diagnosed with a faulty balanced shaft sprocket with fault codes 1200 and 1208 on June 1, 2014 after completing Service “A” and asking the service writer to please identify my Engine warning light. I was told it would cost upwards of $8000 to repair & I have a printed estimate for 7,006.99 from Mercedes Benz of Pembroke Pines, Florida. I took the vehicle home and then researched this issue and found the class action lawsuit – called the dealership back and was told by the service writer that he did not know anything about the lawsuit of which I would like to be a part of. his argument is the car has 68000 miles on it (and is in excellent condition) – I countered with the fact that Mercedes sent an internal memo out on this – I purchased it new from same dealership in 2007. As a customer where was my notification if this issue? This is a big safety issue and now i will not drive it. Would like to know haow to join this suit – my engine is a M272.

    I’m having the same issues, my check engine light came on a few weeks after I took my 2006 Mercedes C230 to the dealership for repairs and maintenance. Now my RPM’s go up and down on their own when my car is on and when accelerating the RPM’s go up higher than normal. The car has become harder to stop and when in park for a the RPM’s go up. When my light first came on a few weeks ago my car was shaking non stop and was acting like it was going to turn off, now it’s not shifting right and it still shakes once in a while, the check engine light is still on. My extended warranty just ran out in April when I took my car in for service!

    Just purchased a 2006 MB E350 used 30,000 Miles. Thought I was getting a great car with low mileage until I was driving and the car would either stick in a low gear and not shift or would “clunk” down into a lower gear while driving….very dangerous!! The only way it could be corrected was to pull over, cut auto off and then restart. I understand repairs are very expensive ranging from $3000 to $6000.     I’m having the same issue on my 2007 clk350. The car will not go pass 25 mph, very loud noise from the engine, you can feel the transmission pulling, and a burnt plastic smell. When it first happened , I pulled over on the side of the road, turned the car off and turned it back on and it solved the problem. Took it to the dealer and a private shop and they found nothing wrong. The same issue continued off and on for about 2 months, now it’s gotten even worse! The “check engine” light has come on, when I switch to drive or reverse there’s a loud clunk nose and the car jerks.

    I have the same problem with my 2006 Mercedes R350, cylinders 4 and 6 are running at 80-84psi on compresson while the remaining cylinders are at 145psi. We are faced with the repairs but its not worth making them since they will cost more than the cars current valuve

    Out of warranty was certified ran ou of time 72k miles

    On August 14, 2014, our C230 Mercedes
    2007 model was taken to Crown Motor
    Company with a “Check Engine Light”
    on. The service department said the
    balance shaft gear was worn and the
    mileage was 90,000. Repair estimate
    was $7800.00. A local Mercedes specialist
    in Birmingham,AL said Mercedes previously
    charged $4500.00 to do this job. He also
    that the Mercedes vendor of these gears
    used metal too soft for O.E. specifications.

    Took my 2007 GL 450 for engine check light on August 14. was told needed balanced gear replaced and would cost 6,500.00, has only 59000 miles on it. really loved the car but am very disappointed. don’t know if i will buy anothet mercedes againg. too expensive to repair especially for manufecturer faults. this is not the normal wear and tear. did not know about this lawsuit until today. pl. send me the info on how to become part of it.

      The class action lawsuit was dismissed. I am not understanding how if MB used a metal too soft for O.E. specs they are not resp0nsible.

    E 320 check engine light on / knocking and msfiring signs but i dont believe its the spark plugs since only have less than 50k miles, i fixed it with Sea Foam in oil and gas but eventually light is showing other issue. mabe this same problem others have. another atty or judge should take all our complaints and make additional class action due to multiple cars having same issue. I am waiting to fix this to hear about htis possible case…let me know asasp i want to use the car!!! ROCK center refuse to fix anything I am not convinced that its the spark plugs/ maybe wires but after reading all this it maybe same.

    Mercedes wants me to change the engine!! Neglect of diagnosis of my car, we have rapport with the companies who service our cars and trust they are letting us know to fix something while giving inspections etc…. they didnnt tell me anything except maybe the gas cap was off!!!!

    Its important for another atty or law expert to file another law suit since too many people have this engine problem. If its “fly by” smoke or fuel injection pre ignite its very costly and not our doing. My car has 49K miles is 2005 e 320

    I drive a 2006 E Class with the 272 engine and I too have noticed a very loud noise in front of the engine, I was told by a MB authorized repair shop that I needed trimming chain redone but through the great vine I also heard of this problem and Mercedes Benz has not send me a recall for the problem. What can do to have my car repaired the mechanic is asking 6K dollars to have this work done and I can’t afford this cost. Can some one help here. I am not looking for money in the pocket just my car repaired. I have paid for this car as a very well made vehicle only to find out they are having major problems and MB has not wanted to tell the owners of these car of such. Someone told me they went to have their car fixed with this problem at the dealer and paid 7K dollars for the repair. This is not right!

    I am being quoted $4000 for repairs, which the mechanic not knowing why the gear is chewed up. Then I look online at all of the people with the same problem and that there is a class-action lawsuit. How do we get the information on this? And what should be done, next? pay the $4,000? Buy a new car?

    Same problem with my 2006 clk 350, it event from intake problems , got it repaired check engine light still on now cam shaft sensor. Please email me info. On this class action lawsuit against Mercedes Corp. And why is the cars still being sold and the dealers is not informing the buyers of these problems. Send info on how I can be included in this class action law suit.

    I have the same problem with my 2006 C280 code P0016 and P0017 camshaft sensor pick up out of range signal due to bad camshaft design trigger trouble code 16 & 17, estimate cost around $5000 for the repair.
    Please tell me how to join the class action suit.

    I just paid $4,400 to MB to get the shaft gear repaired after the ‘check engine’ light came on. Please tell me how to join this lawsuit.
