A class action lawsuit has been filed against Mercedes-Benz USA, LLC (“Mercedes-Benz” or “Defendant”) in the United States District Court for the District of New Jersey (styled Greg Suddreth and Paul Dunton v. Mercedes-Benz USA, LLC) alleging, among other things, that Mercedes-Benz M272 engines are equipped with defective gears in their balance shafts and Mercedes-Benz M273 engines are equipped with defective idle gears which wear out prematurely, excessively and without warning, purportedly causing the vehicles to malfunction, the check engine light to illuminate and the vehicle to misfire and/or stop driving, according to the Mercedes Benz M272 and M273 balance shaft gear and idle gear class action lawsuit complaint.

The Mercedes Benz M272 and M273 balance shaft gear and idle gear class action lawsuit complaint is reportedly brought on behalf of a putative class of all owners and lessees within the United States of Mercedes vehicles equipped with M272 engines (bearing serial numbers up to 2729..30 468993) or M273 engines (bearing serial numbers up to 2739..30 088611), unless otherwise excluded.  The Mercedes Benz class action lawsuit also is reportedly brought on behalf of Illinois and Massachusetts subclasses.

The Mercedes M272 engine is reportedly installed on the following Mercedes Benz vehicles:

    I have an ’06 R350 with only 63K miles on it. I took it to the dealership to have a ‘flapping’ noise looked at. It didn’t sound right. When they drove the car up after the service was complete I still heard the ‘flapping’. I was told they changed a pulley. (I’m a girl, but I know pulleys squeak not flap!) They showed me the pulley and brought the service tech out to discuss with me. All fine and if a pulley needed to be replaced, but why is it still flapping? I was told ALL cars sound like that… REALLY?!! Mine didn’t, and now it does , something must be wrong…. I was told not to worry about it. Fast forward to today…. my SR says that my car needs a $15,000 engine because cylinders 1 and 4 are gone, 63,000 miles. Now they want to “give” me $2K, as a ‘goodwill’ gesture toward it. Leaving me $13K to pay out of pocket. I guess I will have to make it my mission to keep MB from sticking it to good hard working people. I work for my money, so that I can afford nice things, not to spend it on junk or let someone take what I have earned. It has been a huge disappointment that Mercedes Benz will not stand behind their product. I am at a loss. What to do next? How do I get in on this suit.

    MB E 350, 2006 with 75 K miles, same “engine light” and shaft problem. VIN WDBUF87J56X208757 , a YUGO would have done better than this MB !
    Wagner MERZ BENZ dealer in Worcester charged 6204,94 to fix it!

    MY ENGINE CHECK LIGHT CAME ON AND I WAS TOLD IT WAS BALANCE SHAFT GEAR AS WELL. I WANT TO GET INFO ON THE CLASS ACTION SUIT. IT’S A DEFECTIVE PART THAT THEY KNOW AND THEY WOULD’NT ISSUE A RECALL. WHEN ALOT PEOPLE HAS COMPAINT.

    2007 E350 ha a P0011 error code in conjunction with a CEL. It was diagnosed as a worn balance shaft.
    Plus I just finished having the steering wheel position sensor replaced because of an ESP/BAS error

    I have a 2007 C230 Mercedes-Benz with an estimate of 125,000miles. My check engine light illuminated. I took the car to an authorized Mercedes-Benz dealership for service and was told the problem is the balance shaft gears need to be replaced with the cost of $5000. I have always maintained my car’s service through authorized Mercedes-Benz dealerships. How do I join the class action lawsuit?

    I have 2007 ML 350 and was surprised when the MB service advisor told me yesterday that the balance shaft had to be changed and would cost $6700 .. this SUV has 42,000 miles on it … looks like these cars are not reliable any more …

    I have a 2008 Mercedes E350. I bought it used from Baker Motor Company in Mount Pleasant, SC in June 2012. The check engine light has come 4 times since this date. We have taken it to the dealership and they have told us nothing has come up in the history with the diagnostic check. I took it today to an Import Repair shop and they did a diagnostic test today and got the code signifying the balance shaft was unstable and thus causing the check engine light to come on. I am now going to call the Mercedes dealership and try to get this taken care of. Please add me to the class action lawsuit.

    I have an ’06 R350. We just had it in the shop to diagnose the check engine light and looks like it’s the shaft. $5-9K to fix! What a joke! I thought I was making a good decision when we bought this car….looks as though I was wrong.

    Too my 2006 C280 in for service B. Told them my CEL was on. They came back with $6300. I have owned many mercedes over the years. Never have i had to rebuild an engine after 90K miles. My dodge mini van has 227K miles and still going strong. Go figure!!

    I took my 2007 Mercedes C230 into the Waukesha, WI Mercedes dealership because the check engine light came on. The dealer said the balance shaft is bad and it would cost $7,200 to fix the car. The dealership stated that they would pay for the parts $600 but not the labor $6,200 so I contacted MB USA and they review my request for a goodwill credit but stated they would not offer any goodwill credit. I will never buy another piece of shit from MB ever again. Please add me to the class action lawsuit…thanks.

    I have a 2006 R350 Mercedes. This car is a pile of junk as another fellow commentor put it above. In the last 12 months, I have replaced hatchback motor ($850.00), the back light senseors($635.00),
    the car droping on it its side ($2200.00), The power stearing going out ($1699.00), all the lights burnging out and replaced, new breaks ($1400.00), and now the engine light came on again and I am told after charging me$450.00 for diagnotics, the 4th cylinder has no compression becuse a peice of the in take broke off and got sucked in the engine. They are telling me on the minum it will cost $4100 and on the maximum $8500. I am not fixing it and the payment were going to be done in 6 months!! The delaer wants to give me $5000.00 for it which is what is owed on the car. I spent over $40,000.00 on this car over the last 4.5 years and have nothing to show for it.

    2006 ML 350 98,000 miles-check engine light went off in January. We took the car to the MB- defective gears on the balance shaft- total repair cost $7,000!!!! UNBELIEVABLE!!! During the course of 7 years of driving this car, every 6 months brake lamps and headlamps had to be replaced! We had no idea that there are so many complaints similar to ours re: MB. PLEASE add us to the class action lawsuit.

      Also have a problem with the 2006 e350, was causing the transmission to get stuck in first gear, thought once i got a new trans even though there was only 44,000 miles on the car the noise and problem would be resolved. After spending $5,000 to fix it, i still have this problem with load engine noise that sounds like a loud whine. Mercedes also said that they would escalate the issue, but offered me a $1,000 towards purchase of a new one. IS this class action suit still ongoing? I would also like to be added to the list. This is the most ridiculous experience i have ever had with a mercedes. I have owned 8 of them and will not ever buy another.
      I also own a 2009 clk550 amg, i would like to be part of this if it is still possible.

    I have a 2007 c-230 and just found out from Mercedes’s Benz of Plano that it will cost me $6600 to fix the balance shaft. Does anyone know if the lawsuit is still going on or if not of there is any other way to make Benz liable for this cont. and frequent problem the cars have?

      I have a 2007 C230 and just had the check engine light come on as well. I took it to my independent MB mechanic and he informed me that it is the dreaded P0017 and P0016 Balance Shaft. I am fearfully of what may happen if I ask for a good will repair as it seems that MB has come back to say it is normal wear and tear. BS!!

      The lawsuit is still going on . If you print the lawsuit the attorneys name and number is on it. You can call him to get added to the suit. Also take the suit into MB Plano along with this article and speak with the service manager or director of service. Did that with draughts and repair is half of what has been seen on here.

    2007 C230 sport here, had the conductor plate issue (which MB won’t even sell the part to anyone, so you can’t use your independent shop) at 80k miles, and now at 94k the balance shaft. $6,600. No help from the dealer or MBUSA. I think they won this class action suit in NJ though. It was thrown out. Someone needs to prove the part is defective before anything will get done. Maybe a hardness test of the old sprocket and a new one to show the difference?

    We bought our C350 new from El Dorado Mecedes. We religiously had it serviced with them on or before any service was needed and approved all receommended services. We have 42,000 miles on the car and the error code came on stating the balance shaft needs to be replaced, at a cost of $5,300.00 +++. They will pay all but $2,000.00. MB new about this for years and never did anything…and the dealer new as well and never said anything. This should have been a recall and fixed for free. HOW DO I GET MY MONEY BACK? Please add me to your lawsuit.

    We have a 2006 R350 with 78,000 miles and it has the balance shaft issues mentioned. Took it to the dealer and they said it would cost about $8,700 plus tax. called MB USA and they were not willing to make any concessions towards the repairs. Please add me to the lawsuit

      Reginald Glover 23Nov2013. Wow I was unaware of the problems that Mercedes Benz has on the Balance Shaft.This car is causing me so much problems that I don’t have a clue of what to do. They wont to much to fix the problem. Once you get the job done, then they will have a recall on the problem. This way they wont loose money, cause the customer will then have paid for it. I WILL NOT buy a Mercedes Benz ever. Sign me up for the lawsuit.

    I am having the same issue now. Independent shop is telling me this is a
    “common issue” with MB. I have a C230 Sport. Indie shop is saying they will only replace the tranny with a “remanufactured OEM” part. Not sure if I trust that. MB charging me $8,000 for a C CLASS!!!!!!!

    I want in on this class action suit. CALIFORNIA RESIDENT.

    I can’t believe this is happening!!!
    I have a MB R350 2007, 99,000 miles.
    I just came from MB dealer today for “check engine” light……well, guess what : worn balance shaft gear, fault codes 1200 1208.
    $7795.00 to fix it!!!
    I logged on just to try to understand what I am faced with, glad to find this blog .
    Would like to join the class action lawsuit. I will also report it to NHTSA to add to the possibility of these parts be recalled.

    2007 c350 with 55k miles – check engine light came on in May 2013 MB dealer diagnosed with error codes 1200, and 1208 for balance shaft issues, would cost about $7700 to repair. This appears to be an engine defect and why consumer would needs to pick up this bill. This is outrageous if MB doesn’t take case of these issues ASAP. (Boston, MA)

    2007 ML 350. Check engine light came on and we received the call that the Balance Shaft needs to be replaced to the tune of $5500. How can this be added to the class action law suit. MB obviously knows they have a problem and apparently has done nothing about it

    Let there be no doubt, this problem with the engine’s is 100% Mercedes fault. Not only that, but Mercedes retaliates against anyone that is a real threat to their B.S. I don’t know how they’ve avoided massive recalls by NHTSA, but I could take a good guess.
    These failures are caused by poor design. Crap EPA oils don’t help, but they’re not the reason for oil starvation on a engine with 72000 miles & dealer service (for whatever that was worth) every 8000 miles with Mobil One 5w/40. Mercedes-Benz is not the company it was. This is the last of my business.

    I have a 2006 CLK350 convertible with only 37,000 miles and I just got the codes P0016 and P0017, therefore I would like to be part of this class action lawsuit. Not only it is ridiculous that a car with that mileage has problems, but it is even worse that the company knows about the situation and has done nothing to correct it. It is amazing that nothing has happened to MB USA for selling cars with known problems. Who is covering for them?

    I took my mercedes R350 to the dealer in Walnut Creek California (where I purchased the car from in October 2006). Check engine light came on and DTC codes are 1200 and 1208. I was charged $170.88 for the diagnostics and told that they recommend and engine tear down for possible worn balance shaft gear. The estimated costs is $7,500. I am 5K miles over the 75K warranty but I believe I purchased up to 100K and will verify with Easy Care. I am stuck right now. As a hard working single mom, this is the only car I own. I cannot afford a car payment! Please add me to any class action going on regarding this. I am shopping for an independent mechanic who would no charge $170/hour for labour. Parts to fix this issue is only $900.00. The rest of the outrageous bill is for labor. Isn’t that a joke considering it is a known fault with the product?

    We, too, have a 2007 E350 with only 66,834 miles! The engine light came on just before the car was due for inspection. We brought it in for service and were told about the issue and the class action suit. The repair shop reset the computer for us and, luckily, the light stayed off until I was able to get it inspected. Please add me to the suit or let me know what I need to do to be included. Thanks. My sister has always dreamed of owning a Mercedes one day. I guess its a good thing in this case that dreams do not always come true.

    Transmission conductuer plate manifold issue and cam magnets
    For 5000.00 I have spend so much money on the car power steering
    Pump brakes and horrible electrical system so please add me to

    I have a 2007 e350 4matic, 63k miles. I bought it used a couple of months ago and I am getting the 1200 and 1208 codes, swapped the sensors from left to right and still get the same code, engine needs to be pulled. So much for Mercedes being a quality auto manufacturer. They made these gears out of inferior materials, charge an arm and a leg and now they won’t stand up to their own mistake. Please add me to your class action law suit.

    I have just had the balancing shaft and gear replaced on my 2007 C280. the gear was warn and the timing could not correct itself when engine was hot. the check engine light came on and the fault code was the cam balancing shaft gear issue. I did not run the car and had the work done where I have my regular service done( not a MB dealer). I would like to know how to join the class action suit. This is a major repair that required the front end to be removed along with the engine and drive train. this cost me $3000 plus being with out the car for two weeks.

    My 2006 E350 with only 70,000 miles on it, just had valve body go bad. $2500… I filed claim with Mercedes USA. Still pending a call back though I suspect they will deny like everyone else. I’ve been told by multiple mechanics that this is such a common problem and should have been recalled. I am one upset Mercedes owner. My old Honda with 300,000 plus miles on it ran better than this! And a fraction of the price. How can I be added to this?

    Started seeing symptoms around 90K of balance shaft problem. Changed shaft sensors and no help. Stealership wants $10K to fix.

    Love the car and MB, but this is a real blemish to their record!

    2007 C230 Sport Sedan — dealer advised check engine light relates to defective balance shaft gears. $5k to fix. He said, “Mercedes is aware of the issue and will contribute 50% to the fix.” They won’t own up to the issue they installed a faulty component in the car. Add me to the lawsuit, PLEASE!

    I have a 2008 c300 4matic with 63000 miles on it. I took it to the MB service due to the engine light coming on and off while driving and they just told me the balance shaft needs to be replaced!!!…Don’t buy a MB it’s not worth the money! Why would you spend more than 2,ooo on an engine less than 100,000 on it? If I had known this issue, I would have never bought a MB a few months ago!

    2006 ML350. Engine replaced at 15k , transmission problems at 90k and now balance shaft problem. Dealer maintained and they want 6300$ to fix Am lucky 117000 miles on car. This is a car with a latent defect is a time bomb. We need to sue MB and get them to fix this. I am trading car in to get away from problem and from the $1000 cost every time I go into the dealer. The Japanese are producing better automobiles. Add me to suit. Never again will buy a MB product.

    I’m having the same problems at 114,000 miles with my 2007 CLS 550, which also has the engine 273. It seems that Mercedes must have known that my transmission would also fail after the warranty period, but chose not to do a recall on the problem. This clearly seems to be a legal issue.

    I own a broken 2006 E-350 sport model. It has been parked for three years pending a lawsuit against MB USA. The car transfers engine oil into the coolant after 2,000 miles driving or less. It has been repaired at MB Pleasanton, Ca. 5 times for this problem. The last time it leaked out the coolant/oil mixture after 8 miles driving home from the dealer. It has 69,000 miles and the dealer says its terminal. MB offered us 3,500.00 to go away and bury the car. We have a court date on September 9th with a jury trial. MB USA should have replaced the engine the first time it had this problem at two months old and 1700 miles. Its been to the dealer 19 times for warranty work since new. It is a piece of junk, I regret buying this car. “Its the best or nothing” as MB says. I got the nothing part for 55K. Any ideas out there?

    I bought a 2007 GL 450 and have 69,900 miles on it. Check engine light came on and the dealer told me that the idler gear is worn out. it damaged other parts as well, like the intake manifold and camshaft magnets. Total quoted repair cost was $7,500. I took it in to the MB dealer and was advised the conductor plate is faulty, which needs to be replaced along with several other parts. Outrageous!!!!

    I bought a R350 with 90k miles and from there came problems: steering pump problem, leak resevior seal, valve lifter problem, continuous check engine lights (done go away), seat belt light on, transmission jerking foward on level ground.
    I have changed cams sensors so many times and the cam sensor lights are still on.
    Please add me to the class action suit.

    I have a 2006 ML350 and I am in Canada. The vehicle just got a CEL but looks like the issue is different from the balance shaft problem, so waiting patiently for the mechanic to fix it. Meanwhile I am bracing up for a fight with MB Canada if it turns out later that this is still a balance shaft issue. I found this government website for vehicle safety complaints in Canada, I did not use it yet, but thought it may be useful for other MB owners having issues:

    2005 SLK350..7sp auto trans. w/77k miles. I’ve had several episodes with my chk engine light on. I believe this defective gears is whats triggering my CEL on. I’ve managed to replace, repair, and clean all necessary parts and still having problems. I was told that its my ignition coil/spark plugs misfiring, had it fix and replace twice with OEM parts and still having problems. Please add me to this class action lawsuit.     I have a e350 2007 and my engine light came on at 82,000 miles. I took it in for service and was told that the crank shafts and the engine were bad and it would cost $5,000.00 dollars to repair. I am very disappointed in this car and more disappointed because I contacted Mercedez and they stated there was no recall. I am reading that the engines are bad on this model.     I have an “06” E350, the balance shaft is defective. I replaced all 4 cam shaft magnets, after diagnosis. Check engine light came back on the next day, definatly the balance shaft. Add me to the suit.

    Yepp same thing, I’ve been following the Majeed Seifi vs Mercedes case since August…they took out the M273 enginges, but the M272 engines are still in the lawsuit. This is ridiculous. My 2006 C280 4Matic with just barely above 90k miles has gotten the CEL…and the engine is already louder than my porsche…where as before it was so quiet I didn’t even realize it was on…screw Mercedes.

    Problem with the Crankshaft Position – Camshaft Position Correlation
    P0016 & P0017 – check engine light off & on over past two years or so
    Permanently on now, can’t be inspected without proof of work over $200 but Mercedes can’t even give an idea of what it is or cost may be.
    Leased car for 27 months and now almost finally paid for purchased thru Mercedes. They’ve made plenty of money off this one. NO MORE!
    Sign me up for the law suit.

    I am in 10, 000 big ones on a 2006 E 350, and 2006 R 350 both transmissions . The R @ 60,000 M. Was estimated at 7300 but negated with the dealer to 6300. That tranee is junk. I have a 97 Diesel with 206,000 and no problems and some one drives it daily.
