L.A. Fitness Class Action Lawsuit Complaint Filed On Behalf Of L.A. Fitness Health Club Members Over Health Club Membership Cancellations & Monthly Dues

LA Fitness Health Club Members File Class Action Lawsuit Complaint Against L.A. Fitness Over Alleged Billing For Charges For Monthly Dues After Members Allegedly Cancelled Memberships.

A class action lawsuit complaint has been filed against L.A. Fitness International, LLC (“L.A. Fitness International” or “L.A. Fitness” or “Defendant”) in the United States District Court for the Middle District of Florida (styled Joshua Vaughn v. L.A. Fitness International, LLC, Class Action Case No. 8:11-CV-00457-SCB-AEP), alleging, among other things, that L.A. Fitness respresents that it offers monthly membership contracts to its fitness and health clubs that can be cancelled at any time by following the cancellation provisions in the L.A. Fitness monthly dues membership contract, but allegedly charges members for dues after they attempt to cancel and no longer wish to use the gyms, according to the L.A. Fitness health club membership cancellation & monthly dues class action lawsuit complaint.

The L.A. Fitness health club membership cancellation & monthly dues class action lawsuit complaint reportedly is brought on behalf of the following putative class of persons, unless otherwise excluded:

All former members of LA Fitness who have incurred at least one additional monthly billing charge after they timely cancelled their Monthly Dues Membership Agreements with defendant LA Fitness, despite the fact that they were up to date with dues payments at the time they mailed their notice of cancellations; or (ii) are current members of LA Fitness who entered into Monthly Dues Memberships Agreements which contain the cancellation provisions set forth in the Complaint and who will allegedly have to pay dues for one or more months after they attempt to cancel their memberships.

    I have been unknowingly paying dues on a credit card that is no longer actively used, 15 months after canceling my two memberships. I am pissed!!

    I thought L.A. Fitness was a private company. Are they a corporation which can be sued?

      Lynn, anybody can sue anybody else — no matter whether it is a private company, a corporation, a partnership, a limited partnership or a person.

      If something is not right in the world and I or you or any individual or corporation feels strongly enough that there is ‘bad stuff happening’ on the part of another person or party (the ‘bad guys’), we have the responsibility first try to fix the problem ourselves, and if we cannot, we have the responsibility to stand up and say “I feel this isn’t right, I’ve tried to fix the problem to my satisfaction, and I have been denied satisfaction — I need help.”

      We then enlist the assistance of a court to help us. We may need to hire a lawyer to get the appropriate amount of help, but if we can find a lawyer who believes our case has merit, many times they will take the case and not charge us for their services as long as we agree that the lawyer can take their fees out of any money we receive should we win our case.

      This type of agreement (a contingency agreement) ends up with less “winnings” going to the person who stands up for what is right, but many times the “win” in court is enough for that person — because what’s right is right and the feeling of victory can be worth a lot more than money, especially if the ‘bad guys’ are forced to stop doing the ‘bad guy stuff’ and are forced to pay back money they took from us, or are forced to change their ways.

    I have been trying to cancel my membership but am having a difficult time doing so. I sent the letter that I printed off their website to cancel and mailed it certified but still have not heard anything. I do know that the letter has arrived in Irvine, California just about two days ago. I have found from my research that other people have been experiencing the same problem.

    I was a member of Bally’s since 1985, when they bought Bally’s I was offered to join Lafitness but since i was planning to move to an area where they had no clubs, I passed. Last night I found a debit for$150 dollars from LA fitness corporate on my account. They had my account number and used it to steal from me. Let me know anything I can do to bring these crooks to justice.

    Yeah I’m hearing that 24 Hour is just as bad as LA Fitness. Haven’t heard many bad things about Equinox though, so maybe that’s the place to go.

    I’m stuck paying for two months as I just signed up with LA Fitness last week. After being almost financially screwed by their personal training contract (I got out of it via their three day cancellation policy, though it was costly to pay for that next day air mail), I’ve decided to leave their gym. I didn’t tell them my reasons, because I didn’t want to have a salesman on me about how unhealthy I am. So I went in and had that cancellation form printed off. There is no place to sign, so that’s concerning. They literally hand you a piece of paper and tell you to pay your own money to stamp it and drop it in the mail, as if they couldn’t fax it in themselves. Such a great money making idea right?

    Anyways, I’ve decided to go about this by making multiple copies of the same form, and mailing one in, day after day after day, until they cancel my membership. This should hopefully, at the very least, annoy them. I know that it sounds like a Professor Chaos scheme at revenge but hopefully it will speed up the process.

    I am a member of LA Fitness in the central Indiana area. I have had great success with the facility, what LA Fitness has to offer, its staff, and especially the trainers. They have always had an open ear for any questions that I have. The manager has (twice) allowed me to change my membership dues payment date and my training dues payment date. All of the costs were explained to me in great detail before signing on. For those who need to cancel because of unforseen circumstances, you should follow the steps givin in the agreement. If that does not work, simply contact the entity in which you pay LA Fitness and have the payments stopped. If you follow all provisions on your end, they can no longer collect or hold grievance.

    Day 1 – signed a 12 month trainer contract
    Day 2 – diagnosed with cancer, started chemotherapy
    Day 3 – suspended my regular and trainer account for 8 months.
    Jan…August – paid 10/month to keep the accounts active while undergoing chemo
    August 12 – the suspension ended, a charge appeared on my CC.
    Sept 12 – cancelled both regular and Trainer account
    Sept 13 – another charge for the Regular and Trainer account appeared on the CC. Of course, I cannot use any of the 24 sessions these two months would have paid for. But no amount of pleading will get the LA Fitness to drop these charges. I’m sure all their contracts are the same. Before signing up, just remember that death by cancer is no excuse for not paying.       I had a similar experience, although not as difficult or serious as yours. I began to develop cysts that would burst and leak fluid and I asked them to cancel my 1-year pre-pay. When I sighed up the associate told me that they can cancel it and then pro-rate what I had paied and send me the refund. This was an outright lie and honestly I take blame for not reading the contract or understanding it. I told LA that it was painful to work out and that I was trying to spare bursting cycts from getting wiped all over their equipment. It didn’t matter. They said the same thing about suspending the account and ask if I had any idea when the cysts would go away. Part of me wanted to go tea-bag the admin desk there but I’m staying away because others shouldn’t have to sit in my bloody cyst juice.

      Have fun with that. And be sure to wipe the seats down before and after you use them. Trust me.

    I was a Bally member and would be sent a bill by mail to renew which I would do by paying in person. Last year when LA Fitness bought Bally, the company (without my authorization) charged my credit card for one year renewal. When I called to complain, the gym rep said that I signed a contract. I have not signed a contract with LA Fitness; I had a three year contract with Bally which expired. Yet, I feel “stuck” with this situation and I want out! I do not agree with the terms or practices of this gym.

    I feel like my wife and I get into spider’s net – polite staff cannot stop your membership referring to Head Office and LA Fitness continue to sucking your money despite your demand to quit. There only step that helped me after three months negotiating – cancelations my Credit Card.

    Same thing here, paid in full for two months with check. They got in checking account and took out more payments. We challenged with bank. Now we get calls everyday wanting credit card. We have a letter from them saying we do not owe anything. But they are telling us if we do not give them a credit card they will continue to harress us. Be very careful with this company.

    they are scam artists. after i signed up for the club membership, they decided to sign me up, 2 weeks later, for personal training without my consent. they even sent me an email confirmation for the personal training 2 weeks after the membership enrollment email confirmation. the personal training contract they sent didn’t have my signature or initials, but someone else’s. they had my card info from my membership draft and drafted $399 out for personal training for 12 sessions and then wanted to draft $300 every month there after for 12 months totaling 3,9999.00. i never agreed to anything like that. i went in the next day and they said they couldn’t cancel the “contract”… no apologies or anything, a little strange since this is a illegitimate contract that I NEVER SIGNED OR AUTHORIZED. they tried to offer me all types of things to get me to go along with their scam, extra sessions and freezes etc. i thought about it for all of 30 mins before i completely got disgusted and decided that i no longer want anything else to do with those dishonest ppl.

    I spoke with someone over a year ago from the corporate site about cancelling my membership and am still being billed! It’s total BS and at this point had given up that my account was going to be debited 43 dollars a month until I cancel it. If you’re going to get our money back.. do let me know!

    I have had the WORST experience with La fitness and have been trying to cancel for almost a year. They make you sign a year contract for personal training, but they won’t hold up their end of the deal- like scheduling sessions. Most recently one of their employees told me I can cancel my contract this week, so I thought it was taken care of but they still tried to charge me. I am so frustrated, and finally I cancelled my credit card info and now they call me 15 times a day harrassing me. I don’t know what to do. Someone should sue the hell out of them so they can’t take advantage of people anymore.

      I’m currently going through the same problem with them now. I cancelled my membership in Feb. but I’m still getting charged for personal training which they never contacted me on, so I didn’t have a trainer or a time set up for it. The person who signed me up for membership told me that he would call with my trainers name and time but never did. Now they say it was my fault for not checking on it. They say I can either cancel it now and pay over $200 or keep getting charged until it expires in August. Either way I lose a butt load of money. I’m really pissed.

    Got screwed too. Sent a cancellation letter 3/15/13 via regular mail. followed up with a phone call to the local facility to see if there was a record of cancellation notice. Was told not yet. 3/28/13 a charge appeared for 39.99 on CC. Spoke with Ops Manager in person, gave her a copy of letter, and was told she’d make some calls. Later that day got an email stating mbrshp was cancelled as of 4/3/13 and that my 3/28/13 charge would not credited. Will be talking to my Illinois LegalShield law office tomorrow morning!!!! Will advise of my outcome.

    We paid the first and last month of a short term membership, January through April, and then were billed for that last month again. When calling it to the manager’s attention, she refused to refund that duplicate billing, stating that we needed to have given thirty days notice. We gave notice of our withdrawal date, which was 6 weeks before the end of our contract, but they pretty much said tough tootsies, your membership has been extended until the end of the next month, May, when we will be 1500 miles away. It was a date that they had hand written on the agreement, and we were supposed to have remembered to check that a full 8 weeks before the end of the contract and given them another notice. They acknowledge that we have paid for that last month twice, but refuse to refund it. Not anybody we want to do business with ever again—–

    I’m having issues with LA Fitness not cancelling my account, and not allowing me to use the facilities I have paid to use. I’ve read many complaints online. I’ve also noticed many recent lawsuits pertaining to this very issue.

    I filed suit against LA Fitness today in small claims court. If they don’t address the matter to my satisfaction prior to the trial I will have the case removed to federal court and seek class action. At the very least I will remove the case to district court. I had the wherewithal to opt out of the arbitration provision within the membership agreement.

    Small claims court is an option if you have been wronged by LA Fitness and have not opted out of the arbitration provision. Small claims means LA Fitness does not have to pony up for a lawyer, and the ability to appeal to a higher court is absent. It’s much easier to write a complaint for small claims, than it is for higher levels of court.

    LA Fitness knows they can get away with ripping most members off when they attempt to cancel. They know the few people who sue them will be a drop in the bucket compared to all the money they make from ripping people off. Don’t be a sucker, use any legal recourse available to you.

    I had a hard time cancelling a membership because it was under my ex-spouse’s name even though they were charging MY credit card. I called several times and they said I could not cancel someone else’s membership regardless of who was being charged. Finally, I wisened up and said “fine, I do not wish to cancel the membership, BUT, I am notifying you now, that you are not authorized to charge my credit card and if you do I will take legal action and report your charges as illegal and unauthorized charges to my bank.” They immediately stopped charging me for the membership fees.

    I’m looking for Californian lawer to sue LA FITNESS for unlawfull charging of my card after contract cancelation, cyberstalking and cyberharassment (since I cancelled my credit card they call me every day from different states’ clubs and bulling me to keep paying 10$ every month despite contract cancelation).

If they want 29.99 per month for a single and they just multiply that by three, then what are we saving for a family??

    Went to the website 2 weeks ago to cancel my membership. This was not an option online. I had to print and mail in a cancellation form for my and my daughter’s membership. This was mailed out approx. 10 days ago. I am still being charged and according to them they have received no cancellation. I’ve talked to someone at the local gym and someone in a California location. They have told me 2 different things. One said since a cancellation was sent in I “probably” don’t owe anything. The second told me to “just go ahead and pay the balance”. So I called my club again and the person agreed to cancel my membership over the phone right now which I thought was a good thing except I got the cancellation email and they want me to pay $29.99 for each of my and my daughter’s cancelled membership. I also mentioned that I thought when you signed up y0u paid 1st and last months fees so this would not be an issue? They said that the last month would actually be next month and it would be “free”. Needless to say I am very angry and guess I will have to pay the balance they say I owe to keep it from going to a collection agency and hurting my credit.

    Cancelled membership for three members in our family twice. Sent in the form once and still got charged. Cancelled the credit card, and started getting 5 – 10 calls per day. Sent in another cancellation form. From everything I was reading, cancelling at the club would be useless… they still keep charging anyway! Now, I just spoke to one of their “Operations Managers” who after listening to all of this said he would refund me for all three members for one month, but needed to update my billing information first!! I told him to mail me a check for the refund, and that he doesn’t need updated credit card information unless they’re going to try to bill further! He said OK, then I can’t help you, have a nice day! They are the worst company I have ever dealt with and would not recommend them to ANYONE.

    I paid for a three year membership for my 17 year old – ONLY BECAUSE – the sales person said that at ANY TIME I chose to cancel they would reimburse me the remaining months on the membership. Needless to say after contacting the corporate office which was no help and the local LA Fitness at 1861 Main Street, Keller, TX 75248 in which CJ, the Operations Manager WAS NOT NICE, WAS OF NO ASSISTANCE. LA Fitness is a company that does not offer any AFTER THE SALE SUPPORT at all!!! I will definitely make sure I check into any future gyms. LA Fitness offered me NO options. I asked to change it to my other son – nope can’t do that either. The reason we were cancelling is because my sons’ schedule changed, which put him going to the gym when all the machines were being used. Could not get a good steady workout without standing in line to use the machines. LA FITNESS – you are a horrible company – taking peoples money but not being there to accommodate their fitness needs.

    I have had had huge issues with LA Fitness in Huntington Beach on Goldenwest. I moved out of the area on 7 June 2019 and one or two days prior went into the gym, asked the front desk who to talk to, was directed to who they said was the appropriate manager, told them I was moving and giving my cancellation notice. We took care of the paperwork and now here in March/April of 2021 they claim I didn’t process the cancellation properly and won’t refund anything (even though I followed their cancellation policy). This has happened to many others andm, in fact, one of the fraud claims specialists had exactly the same issue with LA Fitness (and she did get reimbursed through chargeback … I’m not sure if that is going to work). It isn’t a lot of money, but it is the principle of the think. This is basically stealing from me. LA Fitness makes it hard to cancel and then even if you do it according to their terms, they still keep billing you. We need more class action lawsuits and changes in how gyms are regulated to stop this!!!
